That's right. >> Can you tell me what happened? >> We just went and got a pizza and I said, "Joe, you're going to miss my road right here." And he said, "Ooh." He was going and he was going a little too fast. So, he said, "Well, I'm going to have to pass it up and make a turn around." >> So, he was going too fast to stop and make a turn. So, he said, "I'm going to go on down and turn around." I looked down to reach for my cigarette and I'm in the ditch, man. I didn't I said, "Joe, what happened?" >> I got out to try and see if everybody else, you know, the car was okay and that's when I had met with the little girl. >> Two women I helped out. >> What about the driver to the truck at that point? Where was he at? >> I have no idea. Is this question going to be real long? Too long? I'm just asking for one more handcuff. >> I have a shoulder issue. >> I understand. We will do that here in just a second. How much alcohol comes from you, buddy? Been drinking a little bit tonight? >> I >> I'm not worried about you. I don't care if you've been drinking. >> I've been drinking a little bit. >> Did you observe him drinking alcohol? >> Uh I might have seen him take drink >> Okay. >> but not like a shot. >> A shot? >> Okay. >> or two. 12:30, maybe. >> So, you're saying roughly 5 to 6 hours ago? >> I'm saying that's what time he got up there and that's what time I observed it. You're awesome. >> Put a safety second test on him if you want to. >> What about smoking a cigarette? >> We're not doing that. >> I was the first one here. I'm the one he threatened with a knife and punched in the face. >> So, which guy threatened you? >> The one that y'all just took out here. >> He punched you? >> Yeah. He was in the driver's door trying to cut a big one. I said, "Buddy, let me help you." Excuse me. Excuse me. If you touch me I said, "Buddy, I'm a first responder." >> I'm a first responder. >> No, you don't understand. I am actually >> He's just a drunk. >> Yeah. >> So, they both went to jail tonight. >> Who did he punch, yeah? >> Him. I'm the one that wrestled him with a coffee mug in my hand cuz I had on a >> So, what about the driver? Where was he at during all of this? >> He first run over there and throwed his hands up in the air and started praying and cussing in the same sentence. And I said, "Buddy, you need to calm down and walk away." The other guy climbed in the SUV trying to get to the safety kit. >> Did he make any statement when he hit you? >> Get the [ __ ] out of my way. I'm a first responder. Do you see this knife? I'll stab you. >> So, he threatened to stab you. All right. So, we So, on top of AI, charge him with fourth-degree assault and charge him with terroristic threat, third. >> How many people passed away? >> [music] >> I am requesting you submit to a test for blood, breath, blood, or urine, or any combination of these tests. If you refuse to submit to any test that I have requested, your refusal will result in the suspension of your driver's license by the court of the time >> I'm refusing. >> Your refusal will result in your license being suspended by the >> Okay. I'm refusing. >> You refuse to submit to the breath or urine test. This refusal will be used against you and you will be subject to the mandatory minimum jail sentence, which is twice as long as the mandatory minimum jail sentence supposed to be submitted to these tests. You are afforded an opportunity to at least 10 and no more than 15 minutes to contact an attorney. Do you wish to contact an attorney at this time? >> Yeah. >> Do you have a number I can call for you? >> Nick Pearl. >> Nick Pearl. >> Nick, it's Joe Hammock. I'm in a bind, Bubba. Sir, can you tell him what's going on? >> This is Trooper Bender with the State Police. Your client, I guess, was in a two-vehicle injury collision where at least one child has died, to the best of my knowledge. One has died at this time. And your client refused all field sobriety, and I believe he is going to refuse a blood test. But, a search warrant has already been signed by the judge to get his blood. >> Okay. Can I talk to him? >> Go ahead, sir. >> I don't even know what county I'm in. I got hit head-on, Bubba. >> What county are you in? He is in sir. >> Can you tell me somebody it's a contact over there? >> Do you have somebody to contact that he can that he can contact? >> I don't know anybody I don't know anybody to contact. >> Okay, sir. Would you like me to call anybody else for you? >> Listen, my arms are numb. >> Okay. Would you like to make a call to another attorney? >> Can you call my dad? >> I'm not calling your dad now. >> Why? >> Because that's not what this is for. You have 10 minutes to contact an attorney, nobody else. >> How am I supposed to contact an when I don't know none? >> You want a public defender, that'll have to be at your arraignment. If you can't give me a number, I can't just give you one to call, you know what I mean? If you can't give me one, then we're going to move on, okay? >> Okay. >> You need to submit to a blood draw. >> No. >> Okay. Well, I have a search warrant for your blood, regardless. >> For what? Getting hit head-on? >> So, we're going to go get your blood. >> Oh, man, come on. How am I being charged with vehicular homicide when I got hit? >> Well, that's what the evidence is going to tell us. If >> [music] >> it wasn't you, then that's what the evidence will say. >> Sir, somebody swerves into your lane to hit you head-on, man. >> What's the vehicular homicide carry in here? >> It's a class B felony. >> Okay. How many years? >> Depends on what the court says. I'm not a judge, and I can't answer that question for you, sir. >> Sir. >> Sir. >> How about me getting a flying the whole time? >> I'm not supposed to argue with you. You can't feel sorry for me. >> Sir, I didn't do wrong, man. >> And that's what the evidence will tell us, man. There's people a lot smarter than me over there taking care of what actually happened. >> How old was the kid that died? >> 7 years old. >> How old? >> 7. >> You know what it's like, [ __ ] >> What what's like? >> Somebody run in your [ __ ] and die, and now you're in You know what I mean? >> I can't say I do. I can't say I do. >> Yeah, I know you don't. I see where you're at. >> After the incident, both occupants of the F-150 were brought to jail. Sources indicate passenger Walter Nichols the III was charged with one count of third-degree assault of a first responder for allegedly punching a first responder who was trying to help the trapped child, one count of fourth-degree assault resulting in minor injury, one count of third-degree terroristic threatening, one count of second-degree disorderly conduct, and one count of public intoxication, first offense. News sources indicate Walter agreed to testify against the driver, Joel Hammock, in order to avoid a 10-year sentence. Kentucky's correctional website indicates Walter was convicted on one count of third-degree assault of a first responder, and one count of third-degree assault of a police officer. His parole eligibility was deferred until May of 2027, making that his earliest release. His maximum confinement would have him released in December of 2029, nearly 5 years after the incident. The driver, Joel Hammock, was charged with one count of vehicular homicide while under the influence of alcohol, one count of operating a motor vehicle under a combination of substances for the fourth or more time with aggravating circumstances, one count of first-degree assault, and three counts of second-degree assault. According to reports, Joel later told officers he didn't know if he was drinking. He explained the Bud Lights found in his vehicle were not his, but his passenger's, and that he only drinks Bahama Mamas. Search of the vehicle found an open Bahama Mama container and baggies of marijuana. Investigators also obtained surveillance footage of Joel purchasing Bud Lights at Casey's gas station just prior to the crash. Joel continued to tell officers he was unaware how he collided with the Kia and emphasized that the sun was blinding him, despite him sharing that he was wearing sunglasses. Reconstruction of the crash did indicate that the angle of the sun was a factor, along with Joel's impairment and speed. Forensics indicates Joel was traveling 73 mph in a 55 mph zone before colliding into the back of the Kia, which was traveling 17 mph an hour westbound around a curve as it approached an intersection with substantial glare from the setting sun. The 7-year-old girl who passed, Rose Morgan, was in the third-row backseat, the most impacted area of damage. After rear-ending the Kia, the truck continued to push the vehicle over the length of a football field before they hit a rock wall on the side of the highway, causing them to flip over. At no point has the Kia ever collide with the truck head-on as Joel claimed. Forensics indicates Joel did not apply his brakes prior to the impact. He reportedly had a blood alcohol content of .151, nearly double the legal limit. For a man that is 6'3" and well over 200 lb, it would take drinking approximately seven beers within an hour. His charge also indicates he was mixing drugs. A Kentucky State Police news release indicates a jury found Joel guilty on one count of murder, two counts of first-degree assault, two counts of fourth-degree assault, and one count of possession of marijuana. According to the Kentucky Correctional website, Joel was given two life sentences. His earliest eligibility for parole is in December of 2044, 20 years after the incident. Kentucky's legal process makes parole discretionary, meaning for a life sentence, Joel could spend the rest of his life behind bars. Few can understand the grief of losing a child to drunk driving, but know you are not alone. To help viewers understand navigating the emotional impact, Trish Waling, who lost her 18-year-old daughter in a separate drunk driving incident, joined Midwest Safety to speak about her experience. >> Today I want to share with you how I lost my beautiful daughter Jordan to a drunk driver on December 28th, just 3 days after Christmas. I'm hoping that this will help you or maybe a friend at a time when you're going through grief over something as simple as disappointment or something as unimaginable as the loss of a loved one. When the highway patrol came to my house, it became the worst day of my life. They sat with me while I called all of my family. My oldest brother John, who was always the big brother guy, for the first time he couldn't just give me a hug and brush me off and tell me that it was going to be okay and just to get back at it. Um I'm very fortunate. I have a large family and they helped me with the funeral arrangements, which are uh indescribable. I can't even planning your final goodbye to your baby girl to put her in the frozen ground, never see her again. And with the help of my uh family and my friends, um in Jordan's honor, we put together a run uh called Run for Jordan. >> [snorts] >> We joined MADD and we have been raising money to stop this senseless loss since then. It's not just living on like like you would if this hadn't happened. You do have to build it. You have to rebuild it. You have to rethink what it means to move forward without her. Create all of your events without her there. Uh weddings and births and like that that she would have been a big part of. By turning to my family and turning to Mad, I've been able to turn my grief into something positive for her. To make my loss mean something. I really hope that for those of you out there listening, you can take one thing away from this message and that is to in that moment of grief, turn to those people that you can count on. If you don't have those people, there's an organization out there that you can turn to. But I hope that if you do experience a small loss or a great loss like losing a loved one, >> [snorts] >> that it makes you a better person. It makes you a more compassionate person to those around you that may have gone through something like this. And I hope that you can make something good out of something tragic.
