So, we're responding to a report of a possible DUI. Um RP's calling in saying the lady driving the truck has been drinking all day, has children in the car, and is driving um in the area right now. So, we're going to we're going to get up here and attempt to locate the vehicle um just to make sure they're not driving under the influence. 23. Stand by. 23. I believe there's going to be a vehicle. Copy. Traffic. We'll be pulling into Circle K. 23. I copy traffic circle. record and traffic coming. [snorts] >> Hello. >> Hi. >> How you doing? >> Good. How are you? >> Good. Good. So, we actually got a call that you were driving under the influence. >> Me? >> Yeah. Yeah. So, do you have you been >> um where I just left a What? >> Yeah. So, I'm like I said, I'm not I'm not even sure who called in. Um but would you mind just stepping out talking to me real quick? 23. Who is RP on this? >> Oh, we may not have that. >> What's that? >> May not have that. >> They're >> They're here no matter what. >> Yeah, they're here for me. They're documenting me, not you. Um, we'll just come right over here. Have you had anything to drink today? >> Uh, earlier today. Yeah. >> Yeah, cuz I'm smell I was smelling a little bit of alcohol. >> Yeah, earlier. >> All right. How much? Probably a truly >> a truly >> like Yeah. >> Okay. You You haven't been drinking all day long? >> No, no, no, no. >> Okay. >> All right. And that's all we want to make sure like like I said, we like if I don't believe you're under the influence and stuff like that, then that's one thing. But we just want to make sure people aren't driving causing >> Oh, no. >> others to be in harm's way, you know, things like that. Well, I have some people that have been causing a lot of >> Are you Are you the people down off of teller? >> We are. >> Okay. >> We've moved since then. >> You moved since then? >> Mhm. >> Were you just over there? >> Yeah. Across at the neighbors for her birthday. For a 9-year-old's birthday. >> Okay. >> We were at our neighbor's house for a 9-year-old's birthday. And we were just heading home. I got the neighbor kids with me. >> Okay. So, >> so listen, we're not we're not trying to hold you up or get you in trouble or say anything like that, but would you be willing to do some field sobriety tests to just to show >> Yeah, whatever I got to do. >> Okay. Um, >> hi. Good. Good. How are you? >> That's my partner, Deputy Cunningham. Um, he he specializes in this stuff. If you're not drunk, >> Yeah. >> he he's going to know. Okay. So, >> all right. You going to do field sobrieties for me? >> I'm sure. I've never done one before in my life. >> It's not hard. >> We'll uh we'll kick off these lights. >> Okay. Yeah. >> 23. We'll be out uh on SFST. >> All right. So, what I'm going to have you do is put your feet together, arms at your side. You're going to follow the tip of my finger with your eyes and your eyes only. Don't turn your head. And just keep following till I tell you to stop. Okay. All right. You can see that. All right. Follow eyes. Eyes open. >> Sorry, I went back to So, what I'm going to have you do is left foot forward. We're going to use that line. That way, you have a nice reference point. Left foot forward, right foot heel to toe. And then just keep your arms. So, just mimic what I'm doing. Perfect. Just keep your arms relaxed at your side. Hold that position until I tell you otherwise. Okay? So, you're just going to watch what I do. I want you to take nine heel to toe steps. Watch your feet. Arms at your side. Count the steps out loud. One, two. Right. 3 4 6 7 Let me move my head. I don't even like being talking in front of class. play. One 2 3 4 5 6 7 8 I don't know. >> All right. So, next we're going to do the one leg stand. >> Okay. >> It's going to be a foot either one of your choice. You're going to hold it approximately 6 in off the ground. Arms and legs straight. It's going to look like this. You're going to point at your toes. Arms and legs straight. Count out loud in a manner of thousand 1,002. Sorry, I think my foot is going up. Okay. >> Okay. You can >> uh I have a preliminary breath test. You willing to do that? Okay. >> I don't know. I mean, am I supposed to? >> So, under Nevada law, you are required to submit to one when requested by a police officer. You can lose your license, but at the end of the day, I'm not going to revoke your license over it. But it does give me an idea where you're at. >> All right. So, all you got to do is wrap your lips around the tube, blow into it like you're blowing up the balloon for about 3 or 4 seconds, and then you're done. >> All right. Now, I'm allowed to do this legally or what' you say? >> It's your choice at the end of the day, but I have to go on my >> I say no. What happens? >> I have to go on my observations of the field surprises. This gives me an almost exact number of where you're at. >> I don't know because I just don't like these people. I don't I don't know. I just want to not do this. >> Okay, that's fine. >> I'm sorry. I just I I I just I've never done this before. I'm nervous. >> Without the preliminary breath test, he's got to go off of the test. All right. That gives us a number. >> Yeah. >> You know what I'm saying? So, >> so she allowed us to do the field sobriety test. Um she failed every indicator on the eyes. She failed a few on the walk and turn and a couple on the one leg stand test. Um, as I'm standing down wind, I can smell the alcohol on her breath. Um, she changed the manner in which she was counting. Uh, she did one of the tests twice when I only asked her to do it once. So, she's definitely showing that divided attention. Um, I don't know if he saw a driving pattern or anything, but as of right now, she's failed the field sobriety test. And a lot of the times when people don't want to do the PBT, it's because they're afraid of that result. Um, I've had a lot of people just be like, "Yeah, I'm not drunk and I'll prove it to you." Nine times out of 10, it comes in about half the legal limit. We get them a ride home. Um, but she's exhibiting signs of intoxication. >> She bailed me. >> Yeah, >> she has all six indicators in her eyes. Uh, failed to walk and turn. Found it for some reason that she needed to do it a second time. She put her foot down, used her arms to balance. >> I saw Yeah, I saw that. >> As I was standing down wind, I can smell the alcohol. >> Yeah. When she got up, I smelled the tea. >> All right, Michelle. So, here's the deal. All right. So, you felt the SFSTs. Okay. >> I did. >> Yes. Yeah. So, almost every almost every test. So, the eyes the eyes is a big one. They don't lie. So if when we start seeing nice stagmas, that means you're most likely over the legal limit. >> Okay. >> Okay. So So before I before I do anything, I want to read you your rights. Okay. That way you're aware of everything. Okay. >> Are you kidding me? >> Just don't freak out yet. Okay. So you have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to attorney and have one present before and during any questioning. If you cannot afford an attorney, one will be hired to represent you free of charge. You can decide at any time not to answer questions or make statements. All right. You understand your rights? >> Mhm. >> Okay. So, with that being said, I'm going to read you this. Okay. All right. I just want you to listen. Okay. You are under arrest for driving under the influence. All right. You are being requested to submit to evidentary testing of your blood or breath to determine alcohol content or controlled substance. If you consent to a breath test, you must give two or more consecutive samples. If this is other than a first offense or it's to believe that you're under the influence of a controlled and or prohibited substance or reasonable grounds exist to believe that you have caused death or substantial bodily harm to another person, you are requested to submit to a blood test. You have the right to refuse chemical testing. If you do refuse to submit chemical testing, I'll apply for a search warrant to use reasonable force to obtain up to three blood samples from you. A refusal to submit to chemical test or any portion thereof will result in immediate suspension and subsequent uh revocation of your license and operating priv for one year whether you're found guilty of the charge what you're arrested. All right. You are further advised that any warning related to having an attorney present before answering any questions does not bear on the issue of submitting to evidentary testing. You do not have the right to speak to an attorney before testing. So that being said, just to break it down, you if you if you refuse and you we put in and your license will be revoked for one year. >> Okay. So are you willing to do evidentary testing? >> Like a breathalyzer? >> Uh-huh. Breathalyzer. [laughter] >> This is so stupid. >> Have you been arrested for DUI before? >> No, I've never had anything. >> So it's most likely just going to be a breath test. Yeah. So, it's most likely going to be what? >> A breath test. If you if you have never been arrested, >> I've never been arrested. I've never been in trouble until these people. >> I got you. Are you willing to do a breath test at the jail? >> I have to go to jail. >> Yes. Unfortunately, yes. It's there's two mandatory arrests that I have to arrest on. That's domestic batteries and and uh DUI. Any other time I have a little bit of discretion. Okay. And >> what do I do with my car full of kids? >> Okay. Do you have your phone in the vehicle? >> Yes. >> Is there someone that can come pick up the the truck, >> dude? >> Okay. So, here I'll walk over over with you. We can grab your phone. Okay. >> Love you, Harley. Love you, girls. Don't worry. That'll get me. That'll get me. That'll get me. >> Love you. >> Love you. >> All right. We're going to come. I'll go on the back side so they don't have to see any of this. Okay. What's that? >> No, thank you. [snorts] >> You're You're literally going to I'm going to hold it. All right. You're going to wrap your whips around the end. All right. Get a good good grip on it and then it's like blowing up like one of those little small thin balloons. You got to just do it do a solid constant blow. Okay. You'll hear the tone. If you hear the tone, it means it's good. Okay. >> Okay. >> All right. So, deep breath. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Oh. >> So, you got to just keep keep that up. You You started good. Ready? Blow. Blow. Blow. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Keep going. Keep keep. I did. >> Holy crap. >> Okay. So, deep breath. Nice and hard. Nice and hard. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Good. Perfect. >> Like I said, I'll get you the numbers. >> 1039 >> 78 Hill Robinson. I believe it's going to be on a red and color Honda Civic Honda Accord. Correction 1028 is going to be 11 alpha delta whiskey alpha 6 >> I'm officer trucker with the Oxford Police Department. You mind cutting down your music? You know why I'm stopping you tonight? >> You are all over the roadway. >> Yeah, I know. I I just live I My girl was right behind me, man. My >> Yeah, >> damn. My my uncle's got Anyways, it's been a rough day. >> Have you been drinking? >> No, no, no sir. >> Smoking? >> No, no, no, sir. Well, I mean, cigarettes, but >> Yeah, that's fine. Um, do you have driver's license, proof of insurance? >> Yes. He said no to drinking, no to smoking tonight. >> No, sir. >> Uh yeah, they're with him. It's a couple of females. They were following behind him. Where where y'all going >> to my house? Like like I said, man, look, my my uncle got diagnosed with uh damn at Alzheimer's or [snorts] something. >> Yeah, >> man. We We've been in the hospital all day. So, >> I got you. Um you got proof of insurance? Man, I do not have my card, but I got it on my phone. Can I >> Yeah, pull that up. Yeah, that's perfectly okay, man. >> Like I said, man, it's it's Today's been a rough day for us, man. >> I got you, man. I understand how it can be sometimes. I'm not here to hassle you or >> No, no, no. >> Yell at you or anything like that. I just want to make sure that you're safe to operate a motor vehicle, have a conversation with you, and make sure you're safe around other people. That way you >> you're not endangering others. >> Can I Can I throw this up? >> Yeah, go ahead. >> No. Well, I was trying to look back at her because she's supposed to be following me to Oh, good. No warrants, nothing like that. No, >> no, not that I'm aware of. >> Okay, that's what I'm just asking. >> Yeah. Yeah. Yes, sir. No, no, no, sir. To make it easier, you can instead of scrolling up and down, you can probably click on those three yellow dots and it's going to pull up your pictures that have been sent between you and your mother's trats >> right here. >> Yeah, that's how it works on iPhone. I don't know. >> I got an Android. Oh, >> okay. You got an Android? Okay. >> Yes, sir. >> You're fine. Can >> Can I just call my mom real quick and see what >> 762? Yeah, go ahead. Give her a call and you'll be good. Uh, I'll be back with you in a minute. >> Brandon, armed of oxford. >> He he was all over the roadway. Uh, he's got >> what throws me in for a whirl, a group of females that were following him. So, it's kind of throwing me in a whirl here because if you haven't been drinking, you haven't been smoking, why do you have somebody following you? He says they're following him to his house. But they he lives out on HJ. I'm going to run his tag. See what what got going on with that. I see that you have insurance. Do you mind stepping out of your vehicle, talking to me? >> Yes, sir. >> No problem. >> I just talked to her, too. She said, >> "Yeah, you're fine, man." >> She said she's going to send it, but >> All right. I Can you step forward a little bit so I can shut your door? Appreciate it. All right. So, >> do you want to see this one though? >> I've already uh checked your insurance. You're good to go on that. You can close that up. Um I have >> Why >> do what? I I I >> Why? >> Because you were taking a little bit of time, so I went >> Yeah, but why does it say temporary? >> Temporary. That's the temporary one. They send you until they can get you the permanent copy. So, >> um, just standing out here talking to you, I can smell the odor of alcohol coming off of your breath. Okay. >> You had some indicators of your driving that you were possibly under the influence of alcohol. So, what I would like to do is to ensure that you are safe to operate a motor vehicle. So, would you be willing to have officer Matt here conduct standardized field sobriety test? >> What? Whatever I need to do, man. I don't care. Like I said, it's just been a it's just been a long damn day, man. >> Yeah, I got you. We'll uh step over here on this. >> It's a little flatter over >> a little flatter over here. Up on the lock. Okay. I'm not telling you to walk in yet. I'm just telling you to put the left foot on the line. All right. >> All right. >> One. >> I didn't tell you to start yet. >> I I I can't do it. I can't do it. >> I'm telling you. But >> come here and talk to me. >> Uh, no. It's It's fine. You guys can come here and talk to me. Uh, >> all right. So, are you wanting Do you want to arrest him >> or Yeah. Yes, sir. >> I don't know. That's up to you. >> It's It's up to you. I'll let you go through the test if you want to arrest him for DUI. He's DUI. >> Okay. So, that's what you want to do? Yes. >> Okay. Let's hook him up. >> Okay. >> Uh, Mr. >> All right. Let's go ahead. Put your hand back for me. All right. At this point, you're going to be placed under arrest. >> Yeah, that's fine. >> All right. All right. What what about my car and can can they drive? >> If one of them have a valid driver's license and are old enough that that is perfectly okay. >> Is there a specific one in the car you want it to or >> Well, my my girl. >> No. >> Yeah. >> Cuz if not, it can't stay here. It'll have to be >> towed because the kids only have a permit. >> Permits 15. They're two 15 year olds in there. Uh, >> do you have anybody else phone call that could be here within a reasonable amount of time? >> Uh, yes. I I I can't. My mom my mother probably could. >> Okay. Where' she say? >> Well, she's in Aniston right now, but it's I mean, she could probably be here in 12 minutes. >> Why are you going to jail? >> Cuz I've been drinking. Was worried about Dave and everything. I don't know. I just been I've been panicking. Mom, I I I don't know. >> So, you're getting charged with a DUI? >> Yeah. >> Yes, sir. >> Yeah. Yeah. >> Uh do you know about how long it'll take you to be here? >> Uh I I'll got to wake my husband up. >> Okay. >> So, just a few minutes. >> Yes, ma'am. >> I mean, I can't drive two vehicles. >> Yes, ma'am. That's fine. Uh so, it'll be within about 20 minutes. >> Uh yeah. Yes, sir. >> Okay. You mind putting your hands up on the dash for me? All right. Appreciate it. You're good. All right. So, the reason I stopped you tonight is um you got a front right headlight out and your tag lights are red. >> Yeah, they're red >> here. So, you want to get him out and >> Yeah. >> talk to him. Maybe they feel pride or whatever. >> All right, Mr. Slo. I'm going to have you go ahead turn off the truck. Go ahead, unbuckle and just step out here and talk to us for a minute. Hey, don't walk up on Just stay right here. Hey, >> there's the open beer can. >> Oh crap, man. That thing's been in there for like 3 days. >> All right, my fault. You're fine. Get back in the truck. >> There anything in the vehicle that you know about? >> I mean, stay here. Don't Don't walk off from us, but you can relax. Okay. All right. >> We're just trying to have a conversation with you. Hey, >> why are you Why do you keep walking up to the truck, man? >> Dude, like I seriously only drank one beer the [snorts] whole time I was there. >> I got you. >> All right, we're over. We're over here. >> I'm sorry. My fault. >> Follow with your eyes and your eyes only. without moving your head. >> You're going to take your right foot, put it in front of your left foot, and you're going to step down by your side while staring down at your feet. All right. >> Yeah. But what gave you the impression that I was intoxicated? Cuz you pulled me over for a headlight and >> the the open container that was in the back seat. All right. And then you told me while we were out here, you had a beer to drink, right? >> I drank one beer with my supper. >> All right. So, do you consent to continue with this test or not? >> No. Like this. >> All right. So, at this point, I'm going to go ahead and place you under arrest. >> Hey, I'll do the test. >> I'm going to go ahead and place you under arrest. You're under arrest at this time. You're under arrest. You're under arrest. >> Dude, you're going to get the test. >> You're under arrest. I'll do the >> Stop resisting. Stop. Stop resisting. >> You're under arrest. Okay. >> 1048 resistance. I'll do >> You're under You're about to get teddy. >> I will do the test. >> You're under arrest. >> I'll do the resistance. >> Stop. >> I'll finish the test. >> You're under arrest. >> I will finish the test. >> Put them on the ground. >> Get on the ground. >> Put your hands behind your back. >> Put your hands behind your back. >> Finish the We'll pass THAT POINT. PUT YOUR HANDS BEHIND YOUR BACK. PUT YOUR HAND BEHIND YOUR BACK. >> You're about to get tased. >> You're about to get tased. >> This is a taser. >> I see that. >> Do you want to get tased? >> No. Why don't you >> roll over and put your hands behind your back right now? >> 104. How did y'all go to full? >> You're going to get tased. >> All right. So, we're headed to help out an officer who uh is calling for backup on a traffic stop. Hold on a minute. He's be out on a traffic stop a good little ways from us. We're going to try to get out there as quick as we can. Roll over and put your hands behind your back or you're about to get tased. We're not going to sit here and keep doing this. >> Roll over. >> Roll over. Roll over. >> Roll over. Roll. Hey. Hey. Let go. Just relax. >> Roll over. Don't really know what's going on at this point, but we're going to mosy our way on down there. >> 247. >> Roll over. You're about to get tased. >> Let go. I'll roll over. >> Roll over. Roll over. Hey, >> so hot. >> Roll over. There ain't no relaxing with this. Roll over. >> Put your hands behind your back. >> And roll over. I >> put your hand behind your back. >> I can't. >> Put your other hand behind your back. >> That's not possible with you pushing me down. >> Quit. >> Quit pushing on me. And I can't >> stop resisting, man. I'm not >> 744. >> I can't [clears throat] freaking get it out. >> Pass that. >> 7:44. >> Dude, stay on the ground. >> Oh my god. >> 744. >> Dude, stop. >> We got the subs in custody. Cut for. Go ahead and have a 1084 routine. Well, now that I heard him and uh it doesn't sound like they're actively fighting, uh feel a little better as far as at ease. Uh we're still going to try to get out there as quickly as we can, but at the same time, it's more your buddies are calling for help. You're trying to get there, and everything's going through your mind as to what, you know, what are they dealing with? what's going on. But like I said, he did key up a second ago. It sounded a little better than it did the first time. So, I'm a little bit more at ease about it, but I still want to try to get there as quickly as we can and help them and assist them in any way that they need. Of course, they're way at the the other end of our police jurisdiction, and we were pretty much downtown in the middle of it. So, takes us a couple minutes to get out here. All right, we're uh probably about 30 seconds away from them. I'd at least say at least under >> under a minute. Uh we'll be out there, but sounds like uh they may have the situation under control at this time. So, like I said, it's a lot better feeling knowing that everything's seems to be okay right now than when it first started. And all you could hear was yelling in the background. Be that by the suspect or the officers, it was kind of hard to tell. All right, this is the intersection. But they're at We're just going to like kind of look and see. >> 756 1023. >> Hey buddy, y'all all right? >> Okay. Yeah, we uh he was doing field sariety and he done the HGN and then he was going to get him to do the walk and turn and he explained it and uh the guy said he didn't want to do it. So he said, "Look, are you going to do the test or not?" I was like, "No, I'm not going to do it." He said, "Okay, you're under arrest." And probably not. >> Yeah. >> You good? >> Yeah. I'm going just search the vehicle. He had a open container in here. Okay. >> After that, I'll inventory it. >> All right. >> Y'all ain't hurt or nothing? >> No, we're good. >> Okay. >> They just they didn't want to go with us. >> They never do, my friend. They never do. >> I guess they were running field sobriety on the subject uh for drinking and driving. And uh sounds like subject didn't want to finish doing field sobriety and was being placed under arrest and decided at that time that he was going to fight uh with officers. Officers were able to get him uh detained and he is now in the back of the patrol car and he'll be taking a ride to the Oxford City Jail tonight. >> [music]
