You was the one told me that I swung at him. He pushed me in the chest and swing on him last night. He reached for a knife. When he knew I'm a bust and I took the knife off him, did I not? And I did not arrest you. Did I lie about hating having it? No. Okay. Cuz I told What's your first name again? My name is Carl. Why you need my name? He I'm going to write a report. I understand that. Carl. C E R L or C A R L. Sorry. C A R L. Last name. S M I T H. Smith. Okay. That's what I thought. I remember your date of birth, Mr. Smith. You got a good phone number. You get home from work today. What time did you get home? I just told you 10 minutes ago. It's real easy. Simple to figure it out. 10 minutes ago. So what? 3:30. Somewhere around the time I walked from 3:00 walked from the what day here. Where you working at SC right there with man. He called said he hit holes in the wall from what she told me. And I said, "Why did you do that?" And when I said that, he jumped off the bed to swing at me. And I was like, "What the hell?" Cuz I just fixed the walls. What's her name? Tina. He just The boy is mentally sick. I I know. He's got He's bipolar, schizophrenic. He come in there. I said, "What you hit the walls for?" Cuz I just put him in the window. He broke seven of them. I just put $800 to pay money on the windows that he didn't pay a penny on. And it when he gets mad, he go break some money to pay for. So you want to get in trouble for this man right there? And he and I, you know, I I know the law just as he you want to get in trouble for him. For what? Him grabbing on my mama. Shot arm. When we ask when we ask you to step outside and she's her house, doesn't matter. It's her house. You called us here for a reason. I called y'all. Do you want us here or not? No. Not no more. Perfect. Now I got to go get my arm cuz he done bit my barn arm. He bit you, man. My got She got a metal rod. She got They had to put her arm back together, bro. I didn't say bit. She bent. I said bent. So you want to talk to me or no? I want to talk to you. I ain't him. I ain't talking to two head people. I want to talk to both of y'all. Well, then talk to me. I want to talk to him, too. Okay, then start talking. He can hear you. Can you come out? He can hear you. He's not. I'm the one called you. So why aren't you responding to me? I don't, bro. We're all here, which is why I'm here talking to you. It's called collective knowledge. Sir, you don't need to talk to one specific person. So, I know last time I came out, some of the windows were already broken. Did you fix them since the last time? No. All of them been fixed now. He was f to break some knife. I didn't go behind him. Mr. Jones, can you stand back over there with Officer Decker, please? Thank you. Mr. Jones, can you continue walking over there, please? Cuz your mother or Yes. Your mother wants to stand wherever she wants. So, I need you to stand over there. I can stand wherever I want in this world. Now, I'm going ask you again. Please get out of my yard. Fine. Until we're done, ma'am. I don't care. You can do business out there that gate 5:00. If you want to stand out there with me, that's fine. I'm not going out. I'm not going nowhere near you. All right. You stay right here for no reason. When I'm going in the bathroom to pee. I didn't want you go in the bathroom. I don't give a damn what you want. It's my right. It's inside. I'm going to pee. Man, mama, don't talk to that man no more, bro. Don't talk to him no more. Tell But tell Listen, bro. Listen. I'm You're going to listen to what I'm telling my mama not to talk to him for a reason. Cuz that making me mad. She not diffusing the situation. We're going to walk all the way to the back so we can talk. What is you doing? You understand? Don't Don't move, bro. Don't move, bro. You want to talk to this gentleman about what? I don't know. Someone was requesting EMS. We're trying to figure out dumb ass. Excuse me. That did. Where's it at? That tall linky ugly joker right over there with the we thing twist up on his head. Handcuffs are going to stand for now just cuz I'm by myself over here with you. I'm going to take them off of you eventually. Hey, no problem cuz I just get pissed off and doing stupid junk every day. I got you. Things were tense. You were kind of trying to walk. Just call him. I said I'm going to walk outside the gate cuz cuz I was cuz I feel like I would knock the hell out of you. I got you. Okay. It don't make no damn sense. Tina told you Tina told you all that that he broke the cell. I didn't know he broke the the whole wall to I got the door. She said he got to go. I said, "What the hell you doing now?" She said, "Why is he pursuing her?" Okay, because she is continuing to yell while we're trying to figure out what's going on. Well, she's not in any trouble. She's not swinging at him or nothing. We need her to chill out. It's called disorderly calm. Why he got the grudge in her face is to get her to calm down. They ain't going to calm down by walking to his face. If you tell him to walk away, she walking away. Why? Why you following? We trying to set the tone. She's going to the road. Now if you come behind now he's a stupid tell him that to say so I don't give a sergeant whatever you I got you that's dumb I hear what you're saying somebody walking through the thing don't come behind him like that one my niece nephew all Larry Brown used to work with but I ain't never seen a bunch of do not come nowhere near me as long as you walking out there ma'am I'm going with you that's where I'm coming to get away from me until it's a result I'm going to be near you me and you and him Go over there. Who got assaulted? Come on. Me. You know who? I'm going over here with him. I don't know who that. I have no idea. Don't you come nowhere near me. I'm with an officer. That's fine. He's going to be near you, though. The man already don't put his hands on you. Don't move. Stand right. Dave, for real, bro. So, daddy put hands on you. Held you down. Yeah. How'd he put hands on you? Like, how? I need you to tell me cuz otherwise you're not doing nothing. Like hit me in my neck. You see right here? I see it's bleeding pretty. Yeah. And I got surgery on my nose. That's why I want to talk to the sergeant and you to let y'all know. It had nothing to do with my mama. My mama is sick. Okay. I told I I'm the one told her to move back. It was not her fault and the police came there. My mama got shot. They had to put her arm back together. That's why I told you let me. I would have moved her out the house. I didn't even want you touching them for y'all. I got plenty of folks that work for y'all and that's a higher rank than you. And if they show up, they going to show out behind her. They going to have an issue with you and your department. They going to have a big issue. And you probably know some of my folks if I was to name them right now. Again, name dropping doesn't copyright here, by the way. Okay, I'm telling you. But that's that cause a problem. Do you know who this lady is? Everything y'all don't know. Doesn't matter to me right now. She got a lot of power in y'all department, bro. And y'all just heard her. What matters to me is what's happened right now. I'm telling y'all, it's between me and him. It don't have nothing to do with her at all. Talk to me about it cuz we we we Okay, my girl My girlfriend was on the phone. All right. I'm having having trouble with my surgery stuff. They It was a mixed communication with my refill. I'm just fresh out the hospital. Had stitches removed and they had to close my tumors up and stuff. I have cancer. Okay. Okay. I'm wearing a pullup underneath here. That's why I'm not trying to unnew. I'm not trying to get in nothing. My daddy grabbed me. When I got up, I said, "Can you please get out my room?" I was in my room. That's my room right right here. They room right here. I'm in my room. He come in my room yelling at me. I'm like, "Man, can you please get out?" I got my my wife on the phone, my baby mama. We is engaged. We about to get married. I'm about to have a kid on the way. Okay. I'm like, "Man, can you please just leave, man? I'm already in a bad mood." about you. I ain't got to get out you. This not your room. And she like, can you can she tell him, can you please get out of this room? I'm trying to calm him down. That's who I just hung up on the phone with when I just pressed the button. So he grabbed me, pushed me. I'm like, man, let me go. Let me go. Like you hurting my neck. Let me go. Push. Push down. No, go over there. He He pushed down on my neck and started. I said, "Man, damn, man. It feel like it's bleeding, bro. Let me go." So he hit me. trapping. Okay. So, I'm I'm like this on the bed on my backside. Okay. I'm like, "Bro, I'm about to swing back. Leave me alone now." And I said, "I'm about to call the police." Okay. We just had it's it's an issue. If y'all I don't know if none of y'all was up there. The hub up there right across the street from McGomery M. We just fought up there. Like I got the paperwork. Yeah. We We just We just fought up there and they they asked me did I want to press charges. I said no. Police asked me. He said, "I see your daddy coming at you on camera. He swung out four times before you swung back." I'm like, "No, that's my daddy." I walked in to look at the wall. He jump out the bed trying to throw out you, man. I You threaten to somebody going to blow somebody brains. I know he ment Yeah, me and him. He grabb a tussle. I grab him just hold him. He punching me outside talking about I punch him and then Nate cuz he comes out. I did not punch him. When he punched me, I punched him. That's when he got punched. He jumped out of bed. Did you say anything to him when you noticed the whole I just jumped out? I looked at the wall and he jumped up bumped in me and pushed me back. I said, "What wrong with you?" I could not tell that cuz said when I come in, I didn't know he did it to I matter my room and leaned on the bed by her and took the hat off and I was like, she was like, "He got to go." Like, what dare you? She said, "He got to go somewhere." She like, "What the hell?" And she said, "Well, he look at the wall hole." So right next you tell me the wall I'm going to look I goes in there he goes like you come to my room I said I'm looking to hold the wall I didn't say nothing to me I wasn't looking he jump push me did that and he throwing that one hand hit me that's no thing cuz like I say I didn't hit you I didn't grab you and touch it I looked at the ball I'm fresh point it out for me oh that that's today yeah I'm I'm fresh out of surgery I just had my stitches taken out I'm saying that injury is from today or from your surgery That's from my surgeon. He hit me right there. Oh, he hit you right there. Yeah, Mr. Jones, your mother was making complaints that you were breaking windows in the house, man. Look around. You know, you know that's her normal. You done been before. You know that's her normal. So, she's always calling you breaking windows. Yeah. So, you didn't break any windows today? Look around. You don't break any windows today? Okay. When was the last time this Did you break? 3 months ago. Okay. So, your mother Did your mother tell you to get out the house? No. Did anyone tell you to get out the house? No. All three of you live here. I I I stay I was put back in her custody by judge car for being sick. I'm supposed to be here. Mhm. She's supposed to take care of me now. So, who lives here? I live here. She live here. He just pay me. He don't even live here. He's not on He does live here. Not really. He's here and during the night and during the day he's somewhere else. He really don't stay. Okay. But I want to ask him and see what he says about that. on that. Are you staying here? In and out. Yeah. Okay. You have another resident somewhere. Why? You said you're in and out. So, I'm trying to confirm your res. My sister house was in the aunt house around the corner there. Well, okay. But you have your own key to the door and everything. You have your own key to the door. Really? I think she got one key that's left to the door. He probably lost his key. So, did he invite you into his bedroom? Did he invite him? Yes. His door wide open. Did he invite you to say go look at the hose? I don't know if it's his bedroom or not, but she said, "Go look at the hold up." Cuz I don't want to pay the last time. And so I went to look. I You said you knew it was his bathroom. Bedroom. You You just said you knew it was his bedroom. I said it's his bedroom cuz his mama gave it to I don't know really. I wouldn't look at the hole. She told me look at it. Okay. But it's his bedroom. No, I wouldn't look at the hole. Well, you know it's his bedroom. So he's over 18. He has privacy to his room. So you have to have you have to have permission to enter. He has privacy to his room. His bedroom. You got to be kidding me. He's 18 though. You sergeant. You got to do better than that. Yeah, I know. But I'm not the one handcuff. He's not 18. He's 25. I said he's older than 18. Oh, it don't matter cuz like I say, well, it means you went into his room and he got into a scuffle about it. But look at it this way. I just paid out $500. Keep going to prison. Next time I won't do it. He'll go. Guaranteed. I thought he paid you a favor when he didn't get you arrested last time. Get me arrested. I don't care about arrest cuz he got to go. I'm taking care of him. He take me. He doing himself a favor cuz he ain't getting That's right. You're right. If you're taking care of stay in jail when I get out, he better be gone. Put it that way. Ain't enough pulling surround say if I go to jail for stupid junk like that by him acting up like that. Ain't enough of y'all been surround my niece with you and I stilling got What would you do? What I do? Yeah. What would I do? You said what would you do if he's not gone if he's gone? You said he better be gone if he don't tell him. He might be putting up for murder. I ain't threatening, but that's what you might do. That sound like you just did, but that's all I need to know. At any point, did you invite him into your bedroom? No. Okay. He just came in there and confronted you about never told him to come in. He said he was confronting me about the hole that was in the wall or something. I'm sorry. That's what he said. Did you punch holes in your wall? That hole been there. I fixed everything. That's why the window. How long ago was that hole there? That hole was there for like a month now. A month? Yeah. I punched it in a month right before I got admitted into Cana. Then can I asked Cana, can they transfer me to Memorial? Because I've been born at Memorial. And then that's when I had my my surgery. They kept me in there. I've been in there for like 3 4 weeks. They kept me in there. I couldn't have surgery cuz my my heart issues and then they kept me in there till my heart got good and then they did my surgery and I just came home. He confronted me about it because I still own money for the hole. Still own that but I did everything else. I don't think he has residency either. I think he come and goes cuz that's his girl. But I think he lives somewhere else. He's got I didn't ask if he has belongings and stuff. He might have some stuff here, but I don't think he lives here. Well, besides the point. He doesn't have a key either. Yeah. Bit strange, especially if they've been together this long. Uh two. Yeah, cuz he matches up what he said. He's like he stays here, he stays somewhere else. And that's what he said. He comes and goes. Uh two, does he have a right to go in his kid's bedroom? No, he still has right. He's not the door was wide wide open. But I guess whether it's open or closed doesn't matter. He has the right to privacy. So not only did he go in this kid's bedroom whether maybe make contact with this kid, but he didn't go in contact this kid talk to this kid. He confront him and then physicalation cur in this kid's bedroom. It don't matter if I go mad about either way. You just turn around for me, bro. I just want to check your your custard fit. Make sure they're not too tight. Either way. So at this point, you are going to be under arrest for battery DVA. Battery? Yes, sir. For what? He reopened the wound on his neck. Marks on his neck. I understand what you're saying. He's saying something else. You can tell all this to a judge. And I'd be glad. I tell I did not touch his neck. Do me a favor. Spread your feet. I'm going to take everything out of your pocket. I reopened the room. How do y'all know that room was no before? I ain't cleaning. That's what I'm trying to figure out. It's all stuff you can talk to the judge about. Yep. How? That's tomorrow. Going to jail. I ain't did nothing. Listen, in my report, I'm going to notate what you told me as well. So, there's two sides in the story. I know, but I'm not saying what you know to any report. What I'm saying is how how do you know that wound went over and got to the house? That's what I'm trying to figure out. Face car. In fact, he said the wound was over yesterday when he come. Watch your head. Be glad. Just watch your legs. His girlfriend was transported to the hospital for treatment by EMS, while the man was charged with battery under the Domestic Violence Act and booked into jail. Hey everyone, it's Trent, prior deputy sheriff patrol sergeant and K-9 handler. And this call is obviously a mess. And clearly, these officers have had multiple prior contacts with these individuals, specifically Carl and his 25-year-old son. We hear that one officer on scene say, "We're tired of having to come here." And then later on we hear Carl and that other officer talking about another prior incident where him and his son got into a physical altercation. So clearly there is just a bunch of issues and a bunch of drama here. But that is going to get taken into account when you are a cop responding to these calls where you have been there a million times and it's always the same thing, the same fights, the same drama. And at the end of the day, in order to solve these things, they're going to need to take it upon themselves to figure that situation out long term. whether Carl doesn't come around anymore or that relationship ends or whatever it's going to be. But ultimately, that is going to be up to them. And us as cops, we just have to keep going and going and going to these calls. So, right up front, it is just kind of chaotic inside this house. People are yelling and screaming, talking over each other, and then you hear that one officer just order everybody out of the house. In my opinion, that's a bad call. When you have situations like this and you're trying to investigate it and figure out who's the suspect, because right up front, they don't know. We know that the 25-year-old was the one that called 911, but that was that doesn't always mean that they are going to be the victim, and we've seen that on prior cases. So, you have to figure out what's going on. You have to talk to everybody, and you can't do that if everyone's yelling and screaming. Also, you need to separate all parties involved. You can't have everybody with an earshot or even eye shot of one another if you can avoid it because that could potentially compromise your investigation. If somebody's able to hear what another person is telling to another officer or see their body language that could definitely affect what they are going to say or not say to that cop that they're talking to. So because of that fact and there's so many officers on scene, it is totally feasible for at least one of these in involved individuals to remain inside the house. Even that woman could have stayed inside of her own home and an officer could have sat in there until they figured out what's going on. Is she involved? Is she not involved? Obviously later on they were able to deduce the fact that she was not an involved party. She's just a witness to this incident. And then that officer decided to have everybody go outside and went hands-on with her. Even though at the very end she did say, "I will walk out." He decided to still grab on to her and kind of push her out the door. In my opinion, that was a bad call. But that is just me money quarterback in the situation. I wasn't there. I obviously haven't been there on these prior calls. And we just see these little snippets of this body cam footage as well. We even see outside how that was incredibly problematic because we have still people talking over each other yelling and where her son is still seeing what's going on with her and that other cop which is making this whole process take way longer and he's getting mad. She's still staying mad. Carl had to get walked off. Even though Carl said, "I will walk over here." And he was complying. But that officer decided to still put him in handcuffs anyway. That was just his decision. But there is just a lot of things that in my opinion could have been dealt with a little bit better to make this process smoother. But again, I wasn't there. So for the domestic violence element, which is what Carl was ultimately arrested for under the domestic violence act, DVA, this can kind of differ from state to state, but I'm just going to talk about the city of Savannah and the state of Georgia where this incident occurred. So for domestic violence, it actually does not need to be a spouse, current spouse, prior spouse, significant other, boyfriend, girlfriend situation. It just has to be household member that is going to get into a assault battery type of situation with one another. And household member can is going to be defined as somebody that currently lives at that residence or has lived at that residence prior. Now, it wasn't established whether Carl had lived there prior or not. They were able to figure out that he doesn't currently live there. He doesn't even have a key. He just comes and goes sometimes. And that is not an established residency as these cops had already said. So they must have figured out off camera that he at one point in time did did live there and that is also his son. So it can go with either spouses or family members. In this case a parent and a son that is also going to qualify under the domestic violence act and that is going to be a mandatory arrest when you are dealing with these types of cases. So, but for something like this as well where you have prior incidents and Carl didn't go to jail last time between him and his son, you have a he said he said, Carl saying one thing, his kid saying another thing, you are going to need to rely on a witness. And in this case, that is going to be that woman. And it's not shown if they even talked to her or not and try to get a statement from her, but that's probably going to be majorly beneficial when you're dealing with this case and trying to figure out who was the primary aggressor here. Because she had contacted Carl and said, "Hey, uh, my kids here punching holes in the wall again that you had just got done paying for. You need to come check it out." Carl gets there and she says, "Go look in the room." Right? She lives there, too. However, yes, that is a 25-year-old that resides in that room. And yes, he is entitled to his privacy, but there's just a lot of inner familial drama going on there. They are still going to need to talk to her to get a statement to see what's really going on. So, I don't know if they did that or not. I don't know if they would have investigated the window situation, but because her kid lives there, even if he doesn't pay rent and he is in there vandalizing these windows, which we never see that either. I don't know if that was looked into or not, but even if he did break out those windows, that is still going to be a civil issue. It's not going to be a vandalism because he resides there as well. Either way, they're going to need to figure out their situation long term because I'm sure that they don't want these officers to come back and have to deal with this whole entire situation once again. But sometimes it doesn't go that way and they'll just continue to have to go back. And that's going to be it for this one. See you guys in the next one. [Music]
