I DON'T WANT TO TALK TO EITHER of them. >> I'm the one arresting you. You can have a seat in that chair later. >> I got to read this to you. All right. Rhode Island law requires you to submit to a chemical test of your blood, breath, or urine for the purpose of determining the chemical content of your body fluids or breath. You have the right to have an additional chemical test perform at your own expense. You'll be afforded a reasonable opportunity to exercise these rights. Access to a telephone will be made available for you to make those arrangements. Did you want to make a phone call? >> I haven't been subject to a field sobriety or an alcohol test. The only reason that it was so is because you asked me to read your badge number to get out of the car and it it felt >> recalling me asking you to do a field body test at which time you decided you wanted to climb from your driver's seat to your passenger seat and you kept saying no, you're not going to do it. >> The only reason I was outside of the driver's seat was because you made me read your badge number. I didn't make you do anything. Okay. >> He He said, "What's my bouch number?" And he made me grab the driver's seat. >> Everyone can leave the room. Yep. >> I would like to speak to my mother. I don't know my mom's phone number off the top. >> Get her phone so I can get her mother's phone number. >> You're not going to dictate how this goes. Okay, this isn't my first day on the job. Have a seat. >> I'm not having a seat. >> Your mom's number. >> Pick up the phone. >> Can I have my phone? >> That's your mom. It's your number. >> I would I would like my phone. >> Doesn't matter. That's not how this goes. >> Where is she? Is my mom out there? Is my mom out there? >> She's my home. >> No, she didn't. >> Yes, she did. >> What do I have to do to do I dial 9? >> Just dial the number. >> [screaming] >> Court records indicate this suspect, [music] Katherine, was charged with her first offense of DUI with her blood alcohol concentration unknown, refusal to submit to chemical [music] test to determine her blood alcohol concentration, and resisting a legal or illegal arrest. She took a plea deal, pleading no contest to the DUI charge while both other charges were dismissed. Catherine was sentenced to one year of probation, and her license was suspended for one year. She was also ordered to participate in 10 hours of community service, attend alcohol counseling, pay $783.75 in court costs and fines, and lost her license privileges for 9 months. You may have noticed that the officers were unable to get Catherine's blood alcohol concentration because of her refusal. In many other DUI cases, officers often get search warrants for a suspect's blood to determine their BAC level. So, why didn't these officers do that? Well, the answer likely lies in Catherine's behavior. The body cam footage caught her acting erratically and disorderly. So much so that I'm surprised she wasn't charged with disorderly intoxication. So essentially, when a DUI case is already strong enough, officers may decide not to take the time to get a blood search warrant. Based on Catherine's behavior, though, my estimate is she was around.16, which is double the legal limit. People in that range typically experienced significant loss of judgment, exaggerated emotions, and slur speech. All of which Katherine displayed. The real question is though, how many more times will Katherine have driven like this if the cops didn't catch
