I don't have to I I haven't committed If you tell me what statute I violated, I will give you my name. >> Watch how this officer repeatedly orders a man to take a seat while struggling to explain exactly what he did wrong. The man keeps asking the same simple question, what law did I violate? But instead of getting a clear answer, the encounter turns into a back and forth over detention, identification, and the officer's authority. And this gets even more interesting when the man refuses to hand over his information without a legal reason, asks for a supervisor, and keeps his camera rolling the entire time. Eventually, he asks the question that matters most, am I free to leave? And the answer completely changes the ending of this encounter. >> David, hey. Hey, come here. Take a seat. Take a seat. Thank you, guys. Thank you. Hey, thank you for your time. My vehicle's over there. Thank you, guys. Thank you. You may have a wonderful day. Thank you. Carry on. Carry on, gentlemen. >> And that's exactly how this encounter ends. After repeatedly demanding information and keeping the man there, the officers ultimately tell him that he is free to leave, and he walks away without giving them the additional information they were demanding. The important legal issue here is that a temporary detention in Florida is not supposed to be based simply on an officer wanting to identify someone. Under Florida statute 901.151, an officer must have circumstances that reasonably indicate the person has committed, is committing, or is about to commit a criminal offense, and the detention cannot continue longer than reasonably necessary for that purpose. The statute also provides that when the inquiry does not establish probable cause for an arrest, the person is to be released. That's why the man's repeated question about what law he supposedly violated was so important. Instead of simply accepting the demands, he kept asking the officers to identify the legal basis for the detention, and once the officer finally told him he was free to leave, he did exactly that. The lesson here is simple. Officers have authority to investigate actual suspected violations of law, but that authority still has legal limits. A person does not lose their rights simply because an officer wants answers, wants identification, or wants them to sit down. When someone is being detained, there has to be a lawful basis for that detention, and that detention cannot continue indefinitely without the required legal justification.
