This suspect was identified as
44-year-old Christopher Pearson. He was
transported to the hospital, treated for
his two gunshot wounds, and was later
medically cleared. The incident began
when the primary trooper attempted a
traffic stop to serve a theft-related
arrest warrant. Following the arrest, no
firearm was recovered after a search of
Pearson, his car, and the surrounding
area. Subsequently, Pearson and his
attorneys filed a lawsuit against the
trooper who discharged his weapon,
Kentucky State Patrol Trooper Grant
Robertson. The lawsuit alleges the
trooper acted with negligence and
committed battery against Pearson for
shooting him in the back while he was
unarmed and posed no imminent threat.
According to court records, Pearson was
charged with felony first degree wanton
endangerment of a police officer, felony
first degree fleeing or evading police,
felony first degree trafficking a
controlled substance, and resisting
arrest. He took a plea deal, pleading
guilty to all charges in exchange for a
10-year prison sentence. While he's in
prison, Pearson's civil lawsuit is
proceeding in US federal district court,
and his lawsuit has so far survived
attempts to have it dismissed.
Separately, the trooper's use of force
was turned over to the Warren County
Commonwealth Attorney's Office for
review. As of the time of publication,
we are unaware of any decision regarding
the legality of the trooper's use of
force.
>> I'm going to be honest, I question the
shooting here because if I haven't
clearly seen a gun, I want more before I
start sending rounds out, especially if
somebody running away. And if he shot in
the back, better be able to explain why
those rounds left your gun. That's
exactly why we're working with Peerless
VR to help improve real-world training
for police officers. Now, this simulator
allows trainers to take real incidents
like the ones you see right here on
Midwest Safety and recreate them as VR
training scenarios. Now, let's take a
look at this one. The moment in the
field has actually been recreated. The
suspect sitting there, his hands aren't
clearly seen, and officers still believe
there could be a gun. Now, the officer
training has to decide how to approach.
We know now no gun was recovered, but
when you're training through this
scenario, don't know how it's going to
end. And that's what I like about this
because officers can work through
communication, de-escalation,
recognizing a threat, and use of force
decisions in a safe environment cuz you
don't want the first time an officer has
to make a decision like this to be when
somebody's life is on the line.
