The problem? The alleged bow and arrow turned out to be a BB gun and some feathers, and there was no clear crime established before the detention and search escalated. He repeatedly challenged the officer's legal basis while refusing to surrender his rights. But things took an even more serious turn when his property became part of the confrontation. Watch how this roadside detention spirals into an arrest, a heated confrontation, and a completely different level of scrutiny for the officers. >> Did I do anything wrong, sir? Why don't you ask the judge? The judge is looking at you right now saying, "Hey, did why did you tell him there's no time limit?" Why don't you explain to the judge right now why there's no time limit? >> Why you can just keep me out here for hours if you want to? >> With bugs flying all in my face and I can't swat them away. >> Well, you're super aggressive. So, >> I'm not super aggressive. Everything was fine. I explained myself properly, didn't I? I explained everything that was going on when you came up nice and cordial, didn't I? >> Have a knife on you. >> And you didn't take it off. You drug all that away, but you didn't take this away, did you? >> I didn't want you to cut me with it. >> Well, maybe you should have took it off of me. >> But you cuffed me and left it on me, didn't you? Yeah. Real professional there, sir. >> You're handcuffed. I don't have to worry about it. >> Yeah, why not? I can grab it. >> Didn't mean to throw that, sir. I meant to put it there. >> Guess what you just did. I meant to throw it with the other stuff. >> Guess what you just did? >> You You've got my handscuffed, so I was trying to get rid of it. Sir, >> now you're under arrest. [sighs] >> Now, >> well, when we get to court, we'll see how all of this >> You can't throw things. >> Illegal, search. This is fruit of a poisonous tree. >> Illegal. >> All right. >> I was just trying to get rid of it. I apologize, sir. I didn't mean to hit you with that. I was trying to put it with that stuff so that you guys didn't worry about it. Okay. My hands could still reach it even though he said I couldn't. I was trying to prove him wrong. >> You proved me wrong. You were right, sir. >> I was just trying to toss it over there with all that stuff. >> But now you're under arrest. >> Fine, whatever. >> So, >> this is absolutely ridiculous. >> I agree 100%. >> Did Did you feel that I was doing that on purpose, sir? That I was trying to hurt you? >> Simple assault doesn't have to be on purpose. time and all this that you threw it in his direction when he's [clears throat] standing right there. >> I was trying to toss it over there to that property over there. >> I didn't mean toss it and it go up. My hands are tied so I could only do so much. >> Did you have to do it at all? >> Yes. To get it off of me so that you didn't attack me. >> Okay. >> Apparently that was dangerous, but a box knife isn't. So, I was trying to get it rid of me. I in all honesty, I should have threw it that way. But it was not intentional. I was not trying to attack this officer. If I'm arrested, then it'll be shown in court. But all of this is illegal. >> Okay? >> You can't just stop people with no crime and just demand their ID and put them in cuffs if they don't give you the ID. Intimidate them, harass them. I should have been lit. Okay, sir. I'm sorry. No water. Fine. I've got to go all the way walk all the way back home in the sun out of water and I'm thirsty and I just threw up. I told you I just threw up from heat exhaustion. I'm walking through the woods picking up feathers. It's all I'm doing. I have a hatchet with a saw on it so that I can cut down saplings for walking sticks. I have a Bowie knife in case I get entangled in anything. I have a BB gun in case anything raid comes at me. I have a box cutter in case I need to cut any twine or anything. >> Do you have any other medical conditions that we should be around? >> Yes, I have a lot and I'm trying to work on them. That's why I'm exercising out here in the woods. I go on hikes through the woods. I'm trying to lose this gut because I have a hernia. That's what this band is. It's a hernia on my front. >> I just wanted to get your name and give you a ride home's all I wanted to do. >> I don't want to ride home, sir, because >> you could have told me that. But hey, it's okay. >> That was never It was never a question. You immediately wanted to. Noah was in my pockets. >> I don't want to argue with you anymore, sir. >> No crime, just in cuffs. Can we check your bottles out? >> You can check anything you want, sir. >> Okay. >> I have no problem. I'm very thirsty, just so you know. I haven't had water in a little while, and I have been out in the woods. I uh threw up about 10 minutes ago back here in the woods. It was all clear water that I had drunk from that bottle. Um and then in the process, I on myself a little. Uh it's liquid as well. Um I was weary and a little dizzy. Um, I think it's just heat exhaustion. [snorts] >> Yeah. >> Are you going to rem You're being really cool. You'll be cool like this. Take the handcuffs off. >> Yes, sir. >> I would have never not been cool and I've never been a threat to anybody. I would never be a threat. >> I would love to believe you, but we just don't do that. >> I know. I understand. >> That way they can check on you better. You can swap the balls away. No more weapons. Correct. >> Absolutely no more. I don't have any. The major problem here is that the officers moved from a report of possible trespassing and a supposed bow and arrow sighting to demanding identification, handcuffing him, and searching his pockets before establishing a clear criminal offense. A police call by itself does not automatically give officers unlimited authority to detain and search someone. A detention generally requires reasonable suspicion based on specific articulable facts, and a search requires its own lawful justification. The alleged bow and arrow was also quickly contradicted when the officers saw that he was carrying a BB gun and feathers. Instead of simply establishing what crime they reasonably suspected and why, the encounter became increasingly focused on getting his identity and searching his property. The later arrest arose from a separate act when he threw an item while handcuffed, but that does not erase the questions surrounding the initial detention and search. The officers needed a lawful basis for stopping and restraining him in the first place rather than treating the investigation as a license to detain him until they could find something to charge him with. After the arrest, the encounter shifted toward his medical condition. He explained that he had been walking through the woods, had become overheated, had vomited, and was extremely thirsty. The officers checked his blood sugar, blood pressure, and heart rate, discussed his health concerns, and offered to take him to the hospital. He declined because of the cost. While the officers continued monitoring him and eventually removed the handcuffs,
