She's okay. She's fine. Um she's just a little intoxicated. So, basically what happened is uh my officers were out. They were doing overnight parking enforcement. There's a church right down the street here. She was in the parking lot and she crashed basically up into a fence. Um, I don't think the damage is too crazy, but she was leaning up against the fence. Um, officer talked to her. Uh, they did some field sobriety testing. She thought it was 10:30 at night. It was probably like 4 in the morning, 3:30. Um, she failed the testing and so the officers arrested her for suspicion of drywall intoxicated. Anytime someone's arrested for that in New Jersey, they're given the opportunity to uh provide breath samples, which she's doing right now. Okay. So, um if she's able to provide breath samples, we'll have a reading and she'll get a copy of that. We'll be able to see what her um alcohol content is if she is impaired by alcohol. Um if she's not able to get breath samples, then in the state of New Jersey, she receives a summon for refusal. But either way, she will receive a summon for driving under the influence. Um we have no oblig, you know, nothing in that. in New Jersey. However, um driving under influence is a motor vehicle violation. It's not criminal. Okay? So, she's not looking at any criminal charges. She's looking at motor vehicle offenses. It is obviously a serious motor vehicle offense, but it's not a criminal motor vehicle offense. Um so, in order for her to be released to you, I have to have you read what's called a potential liability. So, because she's intoxicated, her vehicle was towed. Okay? That's standard as per the New Jersey law. Whenever we release someone who is intoxicated, we have to release them to an adult who is capable of taking care of that individual. Now, the important part for this, when you read this, she cannot operate a vehicle until she's sober. Okay? >> If you sign for her and take her with you, you are responsible for her until she is sober. If she operates a vehicle while she's in your custody and care under the influence, you can be charged and held civily liable for anything that happens. Okay? So, I need you to read this form. Okay? >> You can read it sitting there if you like, but seriously, take your time and read this form. It's important information. Um, but we have to have either you sign it or willing to accept it for her to be released to you. Okay? You don't have to. You're an adult and can make your own decisions. Um, but this is just the stuff I have to inform you of. Okay. >> Okay. >> Uh, her car will be held in impound for a minimum of 12 hours. >> And where is that? >> The Hey, Maria, where was the toe? >> East East Orange. The >> It's a CNL towing. We'll get you the address. >> Okay. Thank you. >> Okay. >> Okay. So, she won't lose her license or anything for this. >> Well, right now she's innocent until proven guilty. That's some of the great rights that we have in this country. Um, she will have a court date and she'll appear in Verona Municipal Court to answer for the charges uh put against her. um some of the charges if she is found guilty, they do hold um license suspension, stuff like that. But that's all stuff that gets fig figured out in court. Okay. >> But as of right now, her license is not suspended. Um like tomorrow when she's not intoxicated, she can operate her vehicle. Um but she will have a court date and then she'll figure that out in court. And then if she is found guilty, most likely, you know, there's license suspensions, stuff like that. But that's all through the courts. >> And how long can they hold that? How long can they >> we we hold we will be holding the card cuz she's a registered owner for 12 hours. >> Um she can have it released to someone else, but she needs to that's got to be in the morning. So 12 hours is the hold on the Okay. >> Okay. Do you understand the form? >> Yes. Yes. >> Do you need me to explain anything to you? >> I'm responsible for basically anything. >> So, right. So, from this when I release her to you, um, while she's in her intoxicated state, she cannot operate a vehicle. If she does, they're going to the Yes. Okay. >> So, if you could just print your name, street address, city, and state. Okay, let's see this little bit. If you could just sign here, you're basically acknowledging the receipt. This is your license. You can take that back. All right. Just give me one second. Okay. You're welcome. [Applause] Okay. So, you get the original copy of this form. Okay. That's for you to keep. Um, here's my business card. All right. Like I said, my name is Sergeant Shepard. On the back of that card is the case number for this incident. Okay. >> Okay. >> So, she's probably going to want to retain an attorney. Um, I can't give you legal advice, but the case number is going to have the incident reports, all the summones that she's going to receive for this. Everything's attached to the the case number. So, >> she she basically have to get an attorney for this. >> I I can't give you legal advice. However, yes, you're going to want to speak to you're going to want to speak to an attorney. Like I said, these aren't criminal charges, okay? They're motor vehicle summones. However, there's serious motor vehicle summones because she can lose her license. There is potential for uh jail time with this, but that's something you can speak to an attorney, and that's very rare. Um, but that's why you speak to an attorney. Okay. Um, again, this is pretty straightforward. Um, I've marked it on the sheet. It's a refusal to submit the breath test on here, miss. It's a refusal to submit the breath test and it's a DUI. 450 was what the statute's called. All right. So, they gave her the opportunity to uh submit the breast samples. She wasn't able to provide breast samples. So, it by state law, it's a summon for refusal. When you receive your license, you're required if you're arrested for driving under influence to provide breast samples. If you don't, we have no choice. It's a summon for that. Okay. They're finishing up processing her. Once they're done, we'll bring her out and you can take her home. Like I said, in the morning on my business card is a number for records. Okay. Call records, provide them with the case number. They're going to need uh some information from her to get the vehicle released. They will provide her with a form when she's able to release the car. And then you can get it from CNL Tone. I wrote on the front of the card the name of the business that has the the vehicle. It's called CNL Towing. It's in East Orange. Okay. Um, so just give us a few minutes. Like I said, they just got to finish up and I'll get out of here. Do you have any questions? I know this is a lot to take in and it's probably a, you know, crazy situation. I get it. remember. >> So, it like I said, it it appears right now that the only thing she hit was the fence at the church. Okay. If that's the case, you know, let's just hope that I don't know where she was prior to this. I don't know how she got there. Um, you know, if that's the case, if all that happened was, you know, she hit a fence at the church, she's looking at a DUI criminal. It's a motor vehicle violation, not a criminal offense. Obviously, if she hit someone, god forbid, then that would be criminal. So, let's just hope obviously that didn't happen. And there's no EV, you know, there's nothing indicating that she did. >> But I don't I know it's not a good situation, but it's kind of the brighter side to the situation because we've seen it. People driving under influence, they get into accidents, they hurt people, then that's criminal and they could go to jail. You know, we had people go to jail for a few years for hitting people while they're intoxicated. So, I know it's a lot to take in, but if that's all that happened, just hitting the fence, you know, thankfully, you know, >> where did you say you guys pick her up? >> If you like right when you walk out this front door, like straight ahead, there's a street. It's Montros. There's a church right here on the left left hand side right in that parking lot. Like I said, the officer was just driving around um doing overnight uh enforcement for parking and just saw her car like pinned up against the fence. Um so he went to go check on her and then we know one thing led to another obviously that's how we ended up here. Okay. Um but like I said, talk to an attorney. Um everything we do in law enforcement is recorded. There's body cam video, there's dash cam video, all the stuff back here when they're dealing with her, that's recorded. So, just talk to an attorney. We instant reports on what happens. Um, >> and if I have any question, I can call you. >> Yeah, I'm So, I'm I get done at 7:00 a.m., but I'm back in Friday. But any one of the other supervisors will be happy to help you in the morning if you have questions or if you need to call me Friday, feel free to. But like I said, it's pretty standard. I know it's a lot for you guys cuz you probably never dealt with something like this, >> but it's pretty standard from this point on. She'll be released to you guys with some summones to appear in Vonal Municipal Court. Talk to an attorney. They'll walk you through the process. You'll go speak with the prosecutor, see how the case is going to work out. Like I said, some of the penalties are, you know, normally license suspension or it depends. First offense, you know, stuff like that. couple fines. >> You have to call this number in the morning. Just >> that's how you get the car back, >> okay? >> Through records. So, the phone number for records is on there. They open up at 8:30. However, you most likely won't be able to get the car till the afternoon. >> Just call records. They'll tell you what they need for when you come cuz you need to get a release from them. Okay? So, you have to come here, get a release, and then you have to go down to get your car. Okay? Um, just try to do that. >> You got to come here. upstairs is records. >> Oh, okay. >> So, literally the the side building, the side doors right on the street here, >> there's a bunch of the town hall. Just go upstairs to records when you come in. They're going to give you the release, okay? Cuz she'll get charged every day the car is an impound through the tow company. So, that's why we say come as soon as you can, but call record so you get the car as soon as possible. >> Okay? But you got to come here first to get the release. They won't release the car to you until you get it. Yeah. Yeah. Okay. >> Um, so we'll be a few more minutes. Do you guys want some water? Anything like that? >> You're okay. All right. Um, that's dispatcher San Tuli. If you need something, just raise your hand. I'll help you. I'll come out and talk to you. Okay. All right. >> Thank you. >> You're welcome. And so we're going to give these to your daughter, okay? Okay, cuz these are her tickets, but I want to just explain them to you cuz obviously she's a little impaired, so I don't want there to be a miscommunication. When she wakes up, she doesn't remember what exactly we told her. So, she's going to receive five motor vehicle summones. Um, they're all listed on here. It's DUI, careless driving involving property damage, reckless driving, refusal to submit a breath test, um, and failure to report an accident. All right, those are the five basic tickets that we have to give her. Um, on here we have to we have to write in the next available court date. It's 713 at 9:00 a.m. The court is virtual. Okay, the phone number for the court is all up top. Every all information for the court's on the ticket, okay? So, you can read read it later. But the court number is on here. Okay, they have court today. There's court in Verona today. If you call them, they'll walk you through the process, tell you what you need to do or what she needs to do really, but they'll let they'll help you out. So, you can call the court today and say, "Hey, you know, I received the sum, my daughter received summones, whatever the case is." They'll give you a court date. They'll tell you what to do. It's all virtual nowadays. So, they have links through Zoom. They need your emails, things like that. That's why we tell them to call court. Okay? So, you can call your court date not till the 13th. However, call court before the 13th. >> So, like today would be preferable because there's court at 9:00 am today. So, the court clerk will be there. >> So, the numbers are >> the numbers right up top. I circled it at the top. Okay. I got to give these to her. I just wanted to show them to you real quick. Okay. So, the court, it's circled up top, the Verona Municipal Court. It's the same building, same floor as records. >> Okay. But they have court today at 9:00 a.m. and everything's done through Zoom. So, if you call the court at like 8:30 or maybe when they get back at like 11, you can speak to the court clerk and she'll tell you, "Hey, we're going to push this court date to, you know, maybe the 13th doesn't work for her." They'll adjust her court date so it does. Okay? That's why we always tell people call the court so she doesn't miss court. >> Okay. >> All right. So, you have any questions about that? >> No. Okay. We're few more minutes and then she's going to be coming out. Okay. >> All right. >> You're welcome. Should be out in like 30 seconds. I just wanted to give you this. This is Officer Clark. He's one of the officers that uh is doing the report. So if you have any other questions, you can call him as email him or call him. >> You have a question. >> Is she still required um representative? >> I'm sorry. What' you say? >> Is she still required for an attorney? >> Is she Does she need an attorney? >> Yeah. >> She doesn't have to. >> Yeah. The board has >> Well, there's public defenders, too. So, speak to the court. I don't know what your financial status is. Okay. in the state in the country, right? We have rights afforded to us. One of them is if you cannot afford an attorney, won't be provided to you. So, she also has a right to speak to a public defender. But the judge makes a determination if she qualifies for a public defender. That's why you need to talk to the court to see if you qualify for a public defender. If you don't or if she doesn't because she makes too much money, whatever the situation is, then she will probably have to seek either private counsel, but she doesn't have to. But that's totally up to her. That's her right as a, you know, a citizen. That's anybody in the country. So that's, you know, I would recommend to speak to an attorney, but talk to the court first. >> Yeah. Talk to the court. They'll they're very very helpful. They'll walk you through it. Um and maybe she could talk to the the prosecutor first, but just talk to them. Okay. We don't we don't handle anything that happens in court. Yeah. So, >> but if it was me, if I was in your situation, I would, you know, obviously speak to an attorney, >> but she's free to do whatever she wants. Okay. >> All right. Do you have any other questions? No, that's she'll be out in like 30 seconds and then uh be on your way. Okay. >> Thank you. >> You're welcome. All right. If you have any questions, just give us a call. Okay. >> Thank you. >> All right. Take care. >> Good. You
