It's always good to keep in touch with the family. Yeah. Thank you, Michelle. Do you have an insurance that's current? Um, perfect. All right, give me a few minutes. Okay, just sit tight. Yeah, I tried uh to get over here real quick. So, um, she definitely had issues parking. Yeah. I mean, you can see that she almost she looked like she almost hit that car. She's improbably. Yeah. And, uh, you know, she's uh having difficulty even articulating. What she's saying? Yeah. Um, I would have grabbed the cigarette to see if you can smell her. If you want, I could just have smoking. Okay. Yeah, if you want to do that. You chat with her and see. Uh, if you want. Yeah. Try to see if you can smell anything. 16 292 to county 292. Can you change the location of my stop to Harding Road? Harding Road. Copy. 433. We'll move past. All right. So, yes. So, what I'm going to do is I'm going to have you step out of the car. Okay. Um I do know that you're just getting home, but you know, due to the fact that uh the way I saw you driving, you know, you're having a little difficulty with uh forming sentences. Try not. Well, the front the front's not tinted. though. Crazy. Um, but yeah, we're going to have you step out. We're going to go over here. Okay. My open. Yeah. Just watch your door. We don't want to hit the other car. Can I? Yes. 16 292 count. One out testing. 1692. One in custody. 435. One out testing. One out testing. direction testing 435. Are you going to do a D whatever? Yeah. Standardized field sobriety test if you're okay with doing that. If you don't feel comfortable doing that, um you have any issues with uh like mobility, your hips, your legs. My knee I I have a messed up knee. Okay. What's What's wrong with your knee? I have a um meniscus torn. Okay. So, would you have difficulty being able to stand on the opposite leg? Um, no. Okay. Do you have any issues with your eyes? Um, it says 1520. Okay. But do you wear any glasses or contacts? Not right now. Okay. Do you wear them? Like, do you have them prescribed to you? No. No. Okay. Um, right there. My house is right there. Yeah, I understand that. But, you know, like I said before, uh I mean, even the way that you parked, I mean, if you have tints and uh you know, you've been driving, how long have you had the car for? I had this car for since years. For years. My truck is right there. Okay. So, I mean, if you've had the car with the tents for years, it's you you can test my car. Open it. I'm not searching for No, but you can look. I just I can see last one was a violation. There's nothing in the car for speeding before that was fictitious in 2023. Would you mind just uh doing HTML? Yeah, thanks for the male subject. Hello ma'am. I'm sorry field township. I'm just going to perform an eye test on you. All right. Okay. So, I want you to stand feet together for Michelle. Hang out in that position. I'm gonna explain what I'm gonna do. And then I want you to follow the pen. Do you see the pen? See the top? Sorry. Okay. Just follow it with your eyes and keep your head straight. Okay. You have any issues with your eyes? Yeah. 1520. That's just like your your vision. Yeah. Okay. You see the top of the pen? Mhm. All right. Just keep your head straight. Okay. You have to blink. Blink. Okay. Follow follow the pen. Okay. I am I was out here and you decided to look at me. Yeah. Okay. You have to keep looking at the pen. I didn't move it and it's still out here. You understand what I'm saying? Okay. As long as it's out here and you look at it. If you can't see it, look in the direction. I can see the pen. You're moving it, but you're going along with it. Okay. Heat. Heat. Heat. Heat. Okay, one more. We're just going to go up and down. Okay. So, just follow until even if you can't see it anymore. Okay. Keep your head straight. I am. Okay. Don't look up. Just Just look up with your eyes. Keep your head still. All right. All right. Uh, you see that line over there? We're going to walk over to this line. Okay. So, you can go ahead lead the way. Just going to walk over to it. All right. I want you to stand right here on the line and face me. Okay. Okay. What I'm going to do is going to be called the walk and turn test. the the All right. Just just take it easy. I don't want you to fall. Okay. There's the curb behind you. So, uh, I want you to have your left foot on the line and have your right foot in front of it and place both of your hands down at your sides. Okay? So, get into that position now. So, my left foot on the line and then your right foot in front of it, heel to toe. Okay? And stay in that position. I'm wearing um boots, right? I'm also wearing boots. So, stay in this position. I'm going to demonstrate what you're going to do. Okay. I know. Okay. Uh would you mind just standing over here and just lighting this up so I can do the test? Okay. So, in the starting position, right, you're going to be uh left foot on the line with your right foot in front, hands down to your side, and you're going to take nine heel to toe steps counting out loud. I don't know what that is, but I'm I'm going to demonstrate it for you. Okay. So, you're going to look down at your feet, hands down to your sides, and you're going to step one, two, three, all the way up to nine. Okay. Once you get to that nine step, you're going to keep your left foot planted onto the line, and you're going to take small steps like this, turning around, and then you're going to continue in the same manner. Crazy. Like, this is crazy. Is it are you having difficulty understanding what I'm explaining or I just listen I could take the the the steps that way but turning this is not a ballerina class. Okay. So, uh I just was able to demonstrate it fine. I'm wearing boots just like you're wearing boots. Do you understand the instructions? My step that way and then turn around and then do you understand how to perform the test the way that I uh describe them to you? If not, I can demonstrate it again. It's no problem. All right. Okay. So, I want you to be in the same position that I I told you. I told you to stay in that position. I'm freezing right now. I'm cold. Okay. So, I'm going to do nine steps that way and then turn around and then take another nine steps. Okay. Would you like for me to demonstrate it again? No. Okay. So, you understand the instructions? Yeah, but I'm cold. Like, well, I'm I'm also cold, so No, you're not. You got a bodysuit on and a vest and everything. I just have like a vest and a sweater. Two. Two. Three. 16. 300. You are 5 6 7 8 9. Turn around. One. I'm sorry. I can't. Two. Three. Four. Five. Six. Seven. Okay. So, the next step, uh, the next test that we're going to be doing is the one leg stand. Okay. So, with, uh, right now, I want you to put both your feet together and have your hands down at your sides. And with whichever leg you feel comfortable with, I know you said it was your left leg that you had the miniscus tear, right? So, if you feel comfortable standing on the opposite leg and lifting that leg, it's fine. Um, I want you to raise your leg, uh, when I tell you to do so, 6 in above the ground, approximately the height of a soda can. And you're going to have your hands down on your side. You're going to look down at your your foot. You're going to count 1,00 1 1,002 1,003 1004 and so on until I tell you to stop. Okay? Do you understand? Yeah. Okay. When I tell you to begin, you may do so. Um, just wait one moment. Okay, you can start. 1002 I'm sorry, I can't I don't 100 I can't like my leg my knee is unsteady. I told you that. Yes. So I can't I don't have balance. You can stand on your right leg. I I did say whichever one you feel more comfortable with. I I'm standing on this leg, but this is it's it's 10,00 leg has to be straight the same way that I uh I demonstrated it. Just like Do you do you not feel comfortable with doing it or? No, I don't. 100 1 2 100 3 1004 1006 1007 1008 10090 I I don't You can stop. All right. Door alpha, please. You say so. No, no. [Music] Okay. So before we get into anything, what I'm going to read to you is the New Jersey Attorney General Standard Statement for motor vehicle operators. Okay. So you have been arrested for driving while intoxicated, which is title 39450. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of your refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of an ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you were found guilty. You have no legal right to an attorney, physician, or anyone else present for the purpose of taking the breast. Wait, wait, wait. Right. No legal right. Yes. No legal right to nothing. Like so for um giving the breast samples. Oh yeah. I'm not I'm not doing nothing. I'm not not giving the breast samples or or not going to refuse to give the breast samples. I'm I'm refusing I'm I'm refusing all of that. Okay. Well, I I just have I have to read all the way up until the end. Okay. So, you have no legal right to an attorney. Uh uh these penalties may be in addition uh in addition to the penalties imposed by the court for any other offense of which you were found guilty. You have no legal right to have an attorney, physician or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you is alone. 54. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples. I will refuse. I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of breath for testing. Will you submit the samples of your breath? I need a verbal answer. I'm not I'm not I need a lawyer. Your answer is not acceptable. The law requires that you submit samples of your breath for breath testing. If you do not answer or answer with anything other than yes, I will charge you with refusal. Now I ask you again, will you submit to breath testing? I need a lawyer.
