Okay? >> You're going to walk in a straight line, counting counting out each step. Don't start until I finish telling you how to do it. Okay? I'm going to demonstrate it first. You're going to count all the way nine steps. Then, you're going to pivot, turn around, do the same thing back. Okay? So, I'm going to demonstrate it for you. You're going to go, you're going to start one, two, >> three, four, five, six, 7, 8, 9. You're going to pivot around. Okay. >> Don't lift your right foot off the ground. Well, she's going to have to keep making reports >> and then Well, there's if they're still trying to find them, they're still trying to find them. I mean, I can't >> They can't find them. I can't find them. >> They're probably has a warrant now. >> And there's many. >> Yeah. Whenever they see them, they'll they'll >> whenever I need police contact and whenever >> No, it's not how that works. All right. Right now, we're going to deal with this. Okay. right now. So just just listen to me quick. Okay, >> I am >> all right. So the this police officer show me the following. Okay, listen. Number one, you have been arrested for driving while intoxicated NJSA 39450. Two, the law requires you submit samples of your breath for the purpose of testing to determine alcohol content. Number three, a record of the taking of the breath samples including the test results will be made. Upon your request, a copy of the record will be made available to you. Four, after you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or your urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of an interlocked ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in an independent in addition to penalties imposed by the court for any other offense of which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as the refusal to submit to breath testing. Even if you agree to take this test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? >> I do not understand. Are you saying that I can have an attorney attorney straza? >> So that right here mean that I do not have an right. Listen. Number seven. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. So, will you submit samples of your breath? >> No. >> No. >> I would need an attorney, right? Is that what you're saying? >> No. I I just I just read it to you. >> I would need an attorney. >> Will you submit >> ultimately? Don't you need an attorney for anything? >> Listen. Listen. I'll read it to you one more time. Number seven says, >> "You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath." So the question number nine says, "I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath?" >> One question, you don't have a right to have an attorney for any under any understanding and you can only do a sobriety test. You have >> I just told you I just I just told you this is about giving. I don't understand. I'm just trying to understand. >> This is about giving samples of your breath. >> You don't have an attorney to do a sobriety test. You don't have to. >> No, you don't. >> You don't have the right to. >> You don't have to have an attorney present to do a field soriety test. >> Have public res. >> What's the Yes or no? Is the is a question. Will you sub? >> I just don't understand, sir. >> Okay. So, what do you want me to read you again? >> Number seven again. >> Can you please read it to me? So number seven says you have no legal right to have an attorney, physician or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Okay. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit the samples of your breath? >> Is that the state of New Jersey or >> I'm asking you, will you submit the samples of your breath? This is New Jersey. >> Is New Jersey in in entirety? >> So, what's your answer? Can I request your permission as a police officer? >> I don't have I don't have any advice for you. I just have to answer the question. >> I do not need to submit I'm reading I'm reading you the s the paper from the state >> as a state of New Jersey. >> So urg this is New Jersey attorney general standard statement for New Jersey. >> I I do not understand. I cannot. >> So you won't Okay. >> So you're refusing to blow. >> I don't understand. >> You don't need an attorney to blow into a machine. >> What he is telling me is that that I have to comply to a certain thing for me to breathe into something to get me in trouble. >> So listen, I I I read you I read your I read I wrote down your response already. Okay. So look, your answer is not acceptable. >> You also have a I do >> and I understand what you're telling me to say. Do you want to read it yourself? >> You're reading it to me and what I'm telling you is >> I I read I read the same thing to you. Seven >> and I'm also not arguing with you. >> Okay. So, what's your answer? Will you take the test or not? >> I do not understand what you're saying. What I'm trying to say is I do not comply under the reasoning of that. I do not understand what you are saying and I'm asking you to repeat yourself. You are complying with this and I still do not understand what the reasoning is. Which part don't you understand? What part? >> He's telling me that I need to do a breath advisor under the understanding of the fact of blank. I do not understand. >> So look, I'll read it to you one more time. It says here, you have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. Do you understand that part? Continue. >> You have no legal right to refuse to give or delay giving samples of your breath. Okay. >> Sure. >> Okay. So, number nine, I asked you, I repeat, the law requires you to submit samples of your breath for testing. Will you submit to samples of your breath? And you told me, I don't understand. I will not provide. So, that's what I wrote on the paper. Is that is that your final answer? >> Yes. >> Okay. All right. So, I have to read you one more thing. So your your answer is not acceptable. The law requires that you submit samples of your breath for breath testing. If you do not answer or answer with anything other than yes, I will charge you with refusal. Now I ask you again, will you submit to breath testing? >> No. Okay. Thank you. >> I think it's three of them. Three different ones, right? >> Yeah. You remember what they are? >> Um he has he has it written down. It's November >> 205. >> Take this. >> Just uh ask why. He has them all written down, I believe. >> What was that? >> You need to use the bathroom. Uh let me see. >> 602 to uh Officer Lewis. He still in the building. >> She needs to use the bathroom. If you could take her, please. >> She'll take you. Okay. No problem. >> No, it's okay. That's fine. >> I just we we have to read these forms to you. You have to jot down your answers. That's all it is. It's >> just part of our paperwork that we have to do. So, whatever you want to answer, it's at the end of the day, it's up to you. >> Yeah, she is. We have to do the what? 20 minute alteration first or finish that off. >> No. Okay, that's for that, right? Actually, yeah, you're good cuz she she's not submitting samples. So, it's okay. >> Do you have the ticket? >> I do. Uh, he's writing the refusals now. >> Okay. >> I do need the one for the uh, do I have to send them to my directly yourself? >> What do you need to know? >> Do you directly? >> Send what? >> The tickets. >> The tickets. >> No, that's something you would do. What? You would you would call him up and show him your tickets and then he would call for discovery here for records available. >> I have to ask you some stuff. Are you a registered sex offender? >> No. Okay. >> So, you got to do all the uh all the DWI forms and then call up somebody to take it right. >> After that, read the Miranda. >> Yeah. We didn't fill those out. >> We didn't even fill those out. If she's refusing for this. >> Yeah. I mean, you can still ask her if she wants to ask you the question. She says that's why I was out today. >> Then just write up, you know. >> I was crying. I was crying cuz he beat his daughter up. That's 11. That's why I was out. So that's why I was out today. So you can put him down. Maris Kennedy all the way. There's my phone on the way, sir. >> In a little bit. >> Um, I actually didn't jot it down yet. What do we have on here? Let me see. >> 55 sounds about right. >> I say she's about a buck. >> Buck 60 on here. So, probably >> whatever you got on there. >> Yeah. 55160. So the questionnaire forms since she's refusing on here, she might not even answer everything else, right? >> Yeah. Just do the Miranda first, you know, and then you can ask her that stuff. >> Where's the thing on here? >> There's a Miranda >> implied consent form. >> No, no, no. Miranda form here. >> You could even find it in the uh in the >> It's not on here, right? >> Go to community server. >> Term server. term server. Yeah. And when you go into uh this uh community, you just look for uh just type in Miranda form. >> Oh, >> I always read the this first >> and then the cuz then I flavor that. >> Yeah. >> I don't understand. I will not. >> She said she said I don't understand. I will not provide. And then I was like this one. Yes or no? She said I was okay. Is that is that uh >> sometimes you don't even have to ask for this but uh >> I said if if she refuses to read the bottom one word >> does not respond or gives any any ambiguous or conditional answer shorter than yes the answer is not simple that's fine I've never played with them either it's just I read this you want to get samples >> and she kept asking me she's like well I don't understand so I kept writing reading over number seven cuz that's the one that she's asking about and then eventually >> this is so small in here. >> HPD forms. >> Why do they write the deal so small on this ticket? >> Yeah. I don't know why that that format is so You need You want me to read it out to you? I have it over here. >> Oh, I got it. >> This one right here, right? Why is it printed out like this? >> Is that 205 or six? >> Uh, let me see. >> Almost had a fight with that guy down there. >> Yeah, two. Really? Yeah. >> This one right here. Right. >> What's the case number? >> Uh 22-36165. >> 36165. >> Mhm. >> This one right here. Right. Serge. >> Yeah. She doesn't want to talk. She doesn't have to. And then you just say, "You don't have to answer any of those questions." >> Yeah. Let me read this. Give me a witness first. >> A witness first. >> All right. I'm trying to read read you something real quick. All right. So, go ahead. >> Before we ask you any questions, you must understand your rights. Okay. >> My rights is that my daughter got to beat the [ __ ] up. Hillside didn't do [ __ ] to [ __ ] save her [ __ ] life. Her [ __ ] baby father is still [ __ ] running around. Y'all still ain't [ __ ] him. Y'all still >> I understand you're upset about that. Okay. I'm sure they're doing ahead. Read it to him. Read it to him. >> You have the right to remain silent. Do you understand this? >> Read it to him. >> So you're You don't want You don't want me to read you your rights? >> My rights is to what? That you're going to continue? >> No. I'm trying to I'm trying to read your rights. >> While my baby father is still out here whipping [ __ ] asses in my building. >> I'm just trying to read your rights. Okay. >> Okay. Cuz I wanted to have a couple of shots before I came home while he doing what? Continue. >> You have the right to remain silent. Do you understand this? >> Yeah, I understand that. Yes, I understand. [ __ ] Go ahead. >> All right. Anything you say can and won't be used against you in the court of law, ma'am. >> Anything you say can be used against you in court. You understand this? >> Do you understand this or no? >> Do you understand this? >> I don't understand. >> No. Okay. >> No, sir. >> You have the right to talk to to a lawyer and have him present while you are being questioned.
