Behind the wheel is 27year-old Brianna E. Mahoney with her friend Kaye in the passenger seat. Moments earlier, they had been hanging out at a house and then stopped by a bar called Thatchers. According to them, they weren't being served there. Brianna admits to having like one drink and says they are now on their way to her boyfriend's house. But instead of driving straight, Brianna backs the car up awkwardly, an unusual move that immediately catches the officer's attention. What begins as a routine stop quickly escalates into a DWI investigation led by Officer Owen Law. >> How you doing? >> Good. How are you? >> Good. Double police license registration insurance. Yes. >> I stopped there. It was kind of funky. Backing up and then you just came into the uh >> Yeah, we were trying to figure out I'm going to my boyfriend's house. She's dropping me off. >> Okay. Where's that at? >> Where are you guys coming from? >> We're coming from right over there. >> Thatchers. >> Thatchers. I was trying to see if they had food. I was hungry. But >> but they weren't serving us. So >> food. >> Yeah. >> All right. Anything to drink tonight? >> Like one. >> Like one. Where was that? At Thatchers or >> Yeah. >> Okay. Um, so again, no reason. How come you backed up like that? How come you didn't just go straight? >> Street that way. >> Okay. All right. Um, do you have your license on you as well? >> Yes. Mine? >> No. No. Driver. >> I mean, you're not wearing your seatelt. >> Oh, well, Google for now. Any points on your license? >> I shouldn't have any. >> Shouldn't have any. Okay. All right. Let me check it out real quick. >> Thank you. >> Sorry. I'm going to have one out testing. >> Yeah, I have more. 2417 road here. 24. >> Brian, do you mind just hopping out? I want to speak to you a little bit further. >> Again, everything's being recorded in my body warn camera. You can leave all that stuff right in there. >> Thank you. >> Awesome. All right, we're going to walk right over to here. >> Okay. >> All right. So, obviously your driving was a little funky when I saw You can face me. >> Okay. >> Um was a little funky. You're kind of slurring your words a little bit. You admit that they're having something to drink. I want to put you through field sobriety test just to make sure that you're good to drive. >> All right. Um what time did you get the Thatcher over there? >> Maybe about like 20 30 minutes. >> Okay. Thank you. >> All right. Um did you were you guys anywhere before that? >> No, we were just like hanging out at her house. >> Hanging out at her house. Okay. Where's that at? Wan. >> Wanuk. Okay. All right. And then you're dropping her off at her boyfriend's house. >> Okay. Do you have gum in your mouth right now? I do. Okay. Do you mind just spitting that out for me? >> Right on the road. >> Yep. That's fine. >> Um, do you have anything wrong with your eyes? >> I'm a little bit like a >> sighted. >> Uh, yeah. Like nearsighted, farighted. Kind of both. >> Okay. You're wearing contacts or anything like that? >> No. >> Okay. All right. Um I'm going to have you face me this way. All right. So, you can face me this way. >> Okay. >> All right. Um so, anytime anybody gets pulled out and you get put put through, they're called standardized fields soiety test. It's the same three tests you get put through in the same order, same instructions, everything like that. Okay. Um do you have anything that would hinder you in the ability to perform balance tests? >> I shouldn't. >> No. No leg injuries, back injury. No. >> Okay. Um, you wearing contacts right now? >> No. >> No. Okay. Um, so I'm going to have you face me. >> All right. Put your feet together just like this. Your arms at your side. >> All right. Can you see the tip of my finger? >> Yes. >> Okay. With your eyes and your eyes only, I want you to follow my follow my finger. Okay. Don't move your head at all. Do you understand? >> Yes. It's okay. That Yes. >> No. So, So I told her All right, perfect. The next test we're going to do, it's the walk and turn. Okay, we're going to pretend there's an imaginary straight line right here. All right, I'm going to have you put your left foot on that line and your right foot touching heel to toe directly in front of it. Okay, you can do that right now. Okay. >> So, your left foot on the line, your right foot touching. See how my my feet are touching? Heel to toe. >> Yeah. >> Just like that with your arms at your side. You got to got to touch them in front. >> Heel toe. >> All right. Directly in front. So, your left foot on the line and then your right foot directly in front touching heel to toe. >> Do you see how mine are? >> Yeah. >> All right. They got to be touching heel to toe directly in front. See how it is? You're off to the side. Can you get him like like this? >> I mean, you're not even on line, but >> So, we're actually going to use this line. You can walk right over here. Okay. >> Yeah. >> All right. So, you're going to put your left foot on the line and your right foot directly in front touching heel to toe. They got to be directly in front of each other. See how you're kind of off the side like this? Your toes got to touch the heel. Just like that. See how mine? >> Yeah. >> See how you're off to the side? >> I'm actually not like I look like heel to toe. >> Can I call my lawyer? >> You You can't. All right. You got to You got to go through these tests. If you if you don't do these tests, you'll just be placed under arrest at that point. All right. So, these tests are in your best interest. >> Okay. >> All right. So you see this >> like that. >> Put your foot like that. >> So your foot is off line. >> All right. >> Okay. So you're touching >> on the line. >> I understand you're on the line. >> Yeah. >> But your feet have to be straight. You're off to the side like that. All right. They got to be straight. Just like this. Right there. Okay, this is the starting position. I don't want you to move from this position while I explain the test to you. Do you understand that? >> All right. So, from the starting position, you're going to take nine heel to toe steps, counting out loud. On that ninth step, you're going to take a series of small steps, turn in the opposite direction, and take nine heel to toe steps. It's going to look something like this. Okay? One, two, three, all the way to nine. On that nine step, you'll take a series of small steps. Turn in the opposite direction and take nine heel toe steps. One, two, three, all the way to nine. Okay, I want you counting your steps out loud. I want your steps touching heel to toe. All right, I want you to stay on the line. All right, got it. >> And your arms directly at your side. All right. Do you have any uh any questions? >> I guess not. >> Okay. Once you begin the test, don't stop the test until you conclude it. All right. >> Okay. If you have no other questions, you may begin the test. >> 3 4 5 6 Check it out. >> We're okay here. >> All right, you're good. You can come right back over here. All right. >> Call my lawyer. I'm not asking you any questions or anything like that. These when when you sign for your license, you agree to the state that you're going to perform these tests, right? Do do you want to you want to do the last test or >> honestly? I just like I would like to call my lawyer. >> You'd like to call your lawyer? Okay. So, what I'm going to have you do is just place your hands right behind your back. Okay. >> You're going to be placed under arrest at this point for suspicion of DUI. >> Okay. [Music] I get it. >> Do you have anything on you that you're not supposed to have? >> No. >> Okay. Um, out of the car, what do you need? Do you need your cell phone, wallet, stuff like that? >> Cell phone, wallet, that would be great. >> Okay, we're going to walk right over to your car. I got to search you real quick. All right. >> And uh where's your where's your phone and your wallet? >> Right. Right inside there. >> Right in front. Yeah. >> Okay. Um do you have home keys that you need or anything like that? >> Yes. >> Okay. So, we'll grab all that. >> She's being arrested for driving while intoxicated. She did not perform the test adequately. [ __ ] >> I can't. That's hard to do in like real life if you really think about it like that. Like really, can you do that? Like I can't do that. >> I I get it. I get it. It's your friend. It sucks. >> But it it is what it is right now. >> Yeah, I get it. I understand. >> So, she's going to she's going to be afforded the opportunity to provide breath samples. >> Okay. >> If she's not intoxicated, the breath samples will show that. She'll be released if not but she's refusing to do the last cell. >> What do I have? >> Who does this car belong to? >> This is she belongs >> this she's the registered owner of the car. >> So like what do I have to do here now? Now now it's getting serious. >> So now so you also can't drive. Is that correct? >> Yeah. Well I could drive but it's fine if you don't want to. I'll do whatever you want. I'm I'm I will apply to whatever you want, but I just want to make sure everything's like accurate, good, you know? >> Yeah, >> I got so and I'm a nurse myself. >> I like know how things work and I my ex was actually a lawyer, so I kind of know about this. >> Okay. >> So, I I understand. I just I I'm not disagreeing with you guys. I understand. Do you do you think your boyfriend could come and pick you up? Are you able to get a ride out of here? >> My boyfriend probably could come pick me up. Yes. What you do is so you're not going to rain. It's just >> I mean it's not raining. >> If you could tell it's not raining but it's fine. We're going to go with that. You're going to say it's raining. Okay. >> I'm going to call my boyfriend. All it's motor vehicle. >> I guess I am. >> No. No. It's just there's only two things we can arrest people for for motor vehicle wise. One is DWI and the other's for driving while suspended. But that's a it's neither here nor there. >> Driving while suspended, >> which you're not you're not suspended, so don't even worry about that. Yep. Well, great. That's probably the hardest part. >> I can write it down if that's easier. >> I just hate this. Like, why is this such a big thing? >> Listen, you made a mistake and that's all. All right. If I told you that I never made a mistake, I'd be lying to you, okay? So, let's just chalk it up to that. Nobody's here to judge you or anything like that, okay? You're a human being. >> Everything is like the full judgment. >> No, it's believe me, that's not our job. I see it. >> The whole thing is if it was your daughter like you would she would have been off and like everything would >> Oh, no no no no no no no no. Those days are long gone, my friend. >> They're not gone. >> Oh, they're gone. Trust me. I've been doing this for 22 years. They're gone. >> They're not gone. It takes a little bit of time. >> It takes like an hour. >> And what kind of a father would I would be allowing my daughter to get into that situation? >> Forget a police officer. >> It's a short trip. >> They gave you my phone, Kaye. >> Yeah. No, no, they have. >> Yeah. So, you can make a phone call later.
