He gets this reported to us and we'll do the process talking about bail and make phone calls for that. >> Sorry. We had to meet under these circumstances. Okay. Let's not do this again, though. We're happy to help, but let's not do this again. Okay. Good luck to you. >> Before the officers arrived at the sheriff's office, the night had already taken a serious turn. 15 a.m. on August 20th, 2025. Deputy Christopher Olen spotted a Toyota 4Erunner speeding down any Merman Drive. Behind the wheel was 24-year-old Annie Tran. When the deputy stopped her, he immediately noticed the smell of alcohol. Annie admitted to drinking earlier that evening. One by one, she went through a series of field sobriety tests. The horizontal gaze nestagmas, the walk and turn, and the one leg stand. Each test revealed clear signs of impairment. A preliminary breath test confirmed it. Her BAC was well above the legal limit. Annie was arrested for DUI, taken to the Pullman Police Department for processing, and later booked into the Whitman County Jail pending her court appearance. And this is where the body cam footage picks up. >> Now I hear you. >> Hello, Steph. Oh, sorry. Uh, my name is uh Depol and I'm with the Sheriff's Office and this is being recorded. >> Yes. >> Uh, you got your registration there. How about your driver's license and insurance? >> I got you. I think I left my insurance on my mom's car. >> Okay. But you do have insurance on the car. >> Yes, I promise you. >> Oh, that is because of your speed. on Merman. It's a 25 mph zone. And do you realize how fast you're going? >> I was at 30. >> You're going 36 miles an hour. That's why I'm surprised you're moving so fast. Let's see here. Do you use your app on your phone for your insurance? Or is it a car that you carry with you? >> Um, it was a car that I was carrying, but I was driving my brother's car, which is a Lexus Tacoma. >> Okay. >> Yes. >> All right. Well, you need to get insurance, proof insurance for this car. You got to have it in the car on your phone. Do you have a snapshot of it? Maybe. >> Let me find. >> That might be some homework for later. Let's see. Is there a reason you're not paying attention? >> No. No. I left it in my brother's car. It was in It was in the Lexus. >> Well, maybe take a picture of yourself. A picture would suffice. Uh, but you have to have some sort of proof. Okay. >> Can I call my mom? >> I'm not going to worry about it tonight, but you need to make sure you get it in. >> I will. Um, before I came here, the lights or the insurance didn't come yet, so I was waiting for her to just ship it over here. Did you recently purchase the car? Recently put it on insurance. >> I've had this car for 8 years already. >> Okay. >> This car has been 20 years. >> Okay. >> Yeah. >> You can also get a hold of the insurance company. They should be able to email you one specifically. >> I just left before they gave us the insurance. So before they mailed it to us. >> Okay. Uh anything to drink tonight? >> I had a drink 2 hours ago. >> Okay. How much you have to drink throughout the whole evening? >> I think about like two shots and then one drink. >> Two shots like a beer. out. What's one drink? >> One drink was 2 hours ago and it was just a vodka and cranberry. >> Okay. >> And before that drink, what did you have? Two shots before that. >> Two shots before that. Yes. Three all together. >> Three all together. >> So I made When did you start drinking? >> So three 2 hours ago. 3 hours ago. It was about like 10 or 11. >> Okay. Yes. >> 10 or 11. So 2 or 3 hours ago. That Okay. >> Uh so Andy, my job is make sure people are driving safe. >> Yes. Would it be okay if we did some voluntary field sobriety tests? >> Okay, step on out for me. All right, and let's go over here to the sidewalk. Let me turn these lights off so they're not flashing in your face. I'll meet you right over there if you can stand on the sidewalk. Okay, Annie, these tests are voluntary, so they can be stopped at any time. That's what voluntary means. Uh, do you have any reason that you can't walk? Sorry, I was going to turn off my lights. I didn't hit the switch. I'm sorry. Any medications you're taking? Any reasons? Any injuries you can't walk or balance? No, the only medication I'm taking. >> Doctor didn't say don't drive on that. You can take it. >> No, I can take it throughout the day cuz it's one throughout the day and that's it. >> Okay. Uh, do you wear glasses or eye contacts normally? Okay. So, for this first one, what I need you to do, stand with your feet together, hands to your side. Nope. Feet together, hands at your side. You see the tip my pen right here? Follow with your eyes. Okay. Don't move your head. Does that make sense? >> Follow. >> Yep. Follow with your eyes. Don't move your head. doing just fine. >> Yes. >> Try to keep your nose pointed straight at me. Okay. All right, we're go straight up this time. Okay, for this next one, we'll get you right here in the middle of the sidewalk. Imagine a straight line out in front of yourself. Okay, what I'd like you to do on that straight imaginary line, put your left foot on that line and put your right foot in front of it, touching your heel to your toe. Can you do that for me? Stay in that position. Don't move from that position till I tell you to start. Okay. When I tell you to begin, what I'd like you to do is you're going to take nine heel to toe steps down your line. Touch your heel to your toe each step. >> Hands at your side. Count your steps out loud. It's going to look just like this. No, no, no, no, no. Don't start yet. I got to demonstrate it for you first. I know you're excited. Let me demonstrate it. It's going to look >> This is really cold. That's it. >> Okay. Well, we'll get you out of here as quick as we can. It's going to look just like this. One, two, three. I took three, but you're going to take nine. >> On your ninth step, leave your front foot planted. Step out with your back foot turning to your left. Series of small steps. Back the way you came. One, two, three. Again. I took three. How many are you going to take? >> Nine. >> Nine down. Nine. Back. Do you have any questions? >> No. >> Okay. >> Turning back. >> Turning just as I had demonstrated. >> And then back. >> Yep. Do you have any other questions? >> No. >> Okay. Go ahead and start whenever you're ready. 1 2 3 4 5 6 7 8 9. Left leg over. 1 2 3 4 5 6 7 8 9. >> Okay, for next one again, just stand with your feet right where you're at. Hands at your side and don't start till I tell you to. When I tell you to begin, what I'd like you to do, uh, you can do this with your left or your right foot, totally up to you. When I tell you to begin, I like you to lift your foot about 6 in off the ground. Foot's going to be parallel to the ground. Legs are going to be straight. Hands are going to be at your side. Okay? Looking at your toe, I'd like you to count out loud. 1,00 1,002 1,003 and so on until I tell you to stop. Okay? Once you start the test, don't stop or pause for any reason. Uh, do you have any questions? Okay. Go and begin whenever you're ready. >> 100 1,002 100,004 105 100678 1009 >> Get to point your toes for me. 2011 2012 13 2014 2015 2016 2020 2021 2022 >> All right going to stop forgot to look at your toe >> I pointed >> but you pointed that's good how old are you again >> I'm 24 >> okay uh last test is a preliminary breath test it's not in lie of an evidentiary breath test. >> Yes. >> It's very simple. It's like blowing up a balloon. Big breath in. >> Mhm. >> Lift around the straw. Blow out for about 5 seconds. >> Okay. >> Okay. Big breath in when you're ready. And going blow. More air. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. More. M more more more. There you go. So, you're over 21. Do you know the legal limit? >> Is it8? You'd probably be dead. 0.08 would be the legal limit. Sorry, >> you got the eight part right. You think you're Hold on. I'm trying to get a hold of testing. So 008 is the legal limit and you're 18. So you're over the legal limit. >> Okay. >> Okay. So right now you're under arrest for DUI. Go ahead and put your hands behind your back. >> Okay. Could I take my keys out? >> Yeah. We'll make sure we get your car parked legally and all that stuff so you don't have any problems. Let me read you something here. >> Can I wear a jacket before I go? >> Do you have a jacket in the car? Yes, I do. >> Okay, we'll get that. No, no, no. Stay right where you're at. >> Sorry. >> He's going to Here. >> I'll say goodbye instead. We'll do this real quick, miss. And we'll get a jack afterwards. >> I'm sorry. >> Okay. Make sure you listen carefully. Okay. You have the right to remain silent. Anything you say can be used in a court of law. You have the right to the presence of an attorney during questioning. You cannot afford an attorney. One will be appointed you prior to questioning if you so desire. You decide at any time to exercise these rights, not make any statements or answer any questions. Do you understand the rights I've read to you? >> Yes. >> Okay. >> Can you please pull up my shirt? >> Yeah. >> And I just want my jacket. >> Okay. Where's your jacket at? >> In back seat behind the driver's seat. >> Okay. All right. Then get those locks so they don't tighten up on you at all. I guess you're all locked up. All right. We're going to put this over your shoulders for now. Is there any way you could just like zip it so it's >> zip it too? >> Yeah. And pull up my shirt a little bit. >> Okay. On the side here. >> Yeah. Corner to corner, please. >> Okay. How's that? >> High blood pressure. That's why I'm like >> What's that? Why do you have You have high blood pressure for what? Okay, let's do this. I'm just going to hold your elbow here. We're going to go over here to the backseat of my car. Anything crazy in your pockets I need to know about? >> Nope. I just have my fanny pack and it has my >> Okay, before you get in the car, stop. Stop. Stop. I just got to make sure you got nothing crazy. Hey, don't. >> No, don't face the car for me. There you go. That's the back of my hand. What do you got in your pocket here? >> My napkin. >> It feels like a napkin. I'm going to leave that in there for now. Okay. Face towards me. And if you sit with your bottom on the chair. What else out of the car do you need? You got your little purse with you. >> My keys. And then I have my fanny pack with my wallet. My >> Let's see. For now, we can just park it here probably at the land. >> Yes. >> Okay. And does my partner here have permission to move your car? >> Yes, of course. >> Okay, we'll do that real quick and we'll get you your keys. And so, next step is uh we're going to go down to the pulling police station and do some paperwork. Okay, we'll walk you through that process. Uh we'll make sure your car is locked. >> Yes. >> And can you make sure that my windows are all locked? >> We're going to make sure it's locked, the windows are up. We're going to make sure your car is as safe as it can be. >> Yes. >> Okay. Anything else out of the car that you need? Um, I think my phone might be there. >> Okay, he's going to move it real quick. >> In my pocket or if I left it on the charger, so >> we'll double check. Okay, sit tight. Step 131 CD. Start me in case. That was pretty good. Is it? >> You're fine. Uh, pull it forward to sc actually. Sorry. Is her phone in there? It is. >> Okay. She wants to make sure she has her phone. And you roll her windows up. That's very important. Very well. No, I think that's it. They're going to lacrosse. Let's see. She got power locks. >> I got this right here. See if that locks it. There we go. Locked. Windows up. Perfect. Thank you, sir. Right on. >> How are you? Good. >> Are you looking for us? >> No, not at all. >> Oh, I just saw you go this way and this way. >> My coworker works over here. >> Okay. Second train. >> Okay. Is it all good? >> Yep. We'll go down to uh well, probably your office and use your BAC machine. Thank you. All right. Car is all locked up. Everything's still being recorded. I got your keys. I got your phone. Windows up, locked up, parked. Yeah, I'm I got it, bro. Guys really worried about me, I guess. Step call 13 out of PPD. Okay, let me write down a couple things here. Step call 13. Subjects attached. All right, hop out for me. Okay, wait here for one sec. All right, hold on this curb. It's kind of a big curb. >> Thank you for putting a deck over here. I appreciate it. >> Sorry, they were talking to my ear. >> Mhm. >> Like this door. You've been arrested before for anything? >> Nope. Neighbor. >> Negative. All right, we're going to go straight ahead. Brown door. Uh, did you say thanks for the jacket? >> Yes. >> Okay. Well, I'm >> I was freezing earlier. >> Really? It wasn't. It's not that cold. >> Walking with my friends in my room and I was like, I'm really cold, guys. I'm going to go home. >> Okay. >> All right. Wait here in the middle of this room. I'll pick you up on the other side. Do you need anything for me? >> Okay. >> Saturday night. >> Oh, I have Well, Pullman been busy. >> Okay. >> Oh, yeah. Well, I did see the wreck at that one. All right. Come on. a seat here in this brown chair. Let me pull it out just a little bit. Can we uh let's see. Yeah, let's have a seat. >> Yep. >> Thank you. >> How's that? Okay. All right. Okay. I got a bunch of boring paperwork here, but we'll get through it together. Some of the questions I've already asked you. >> If I duplicate any of them, it's because they want me to do it during this process as well. Okay. Uh first things first, I read your rights out in the field. I'm going to review again. They're essentially the same. Um, so pay attention. You have the right to remain silent. You have the right at this time to an attorney. Anything you say can and will be used against you in the court of law. If you're under the age of 18, anything you say can be used against you in a juvenile court prosecution for a juvenile offense. Can also be used against you in adult court criminal prosecution. If the juvenile court decides that you were to be tried as an adult, you have the right to talk to an attorney before answering any questions. You have the right to have an attorney present during the questioning. If you cannot afford an attorney, one will be appointed for you without cost. If you so desire, you can exercise these rights at any time. Do you understand these rights? >> Yes. >> Okay. So, the sentence here says, I have read or have had read to me the above explanation of my constitutional rights and I understand these rights. Is that true? >> Yes. >> Okay. So, where it says signature as I got you all bundled up in your coat, I'm going to just put handcuff. >> If later on you want to go back and sign, let me know. Okay. Next statement is I understand my constitutional rights. I have decided not to exercise these rights at this time. Any statements made by me are made freely, voluntarily, and without threats or promises of any kind. >> Yes. >> Is that true or false? >> True. >> Okay. I'm right handcuffed again. >> Need to check your mouth. Do you have any piercings in your mouth? Any food in your mouth? >> No. >> Can you open your mouth wide? Cutting up that way. I don't see anything in there. No. >> You don't feel anything else in there? >> No. >> Okay. All right. Uh, this next part is a bunch of reading. I can read it to you. I can let you read it. I can read it while you follow along. Which would you prefer? >> Can I please read it by myself? >> Yeah. >> I'm going to give Buffy a to read here. I'm going to read the top part. We're kind of team player this one. Okay. So, this up here says implied uh consent warnings for breath. It says, "Warning, you're under arrest for I'm going to check this top box that says RCW4661502. RCW 4661504 driving or being actual physical control of a motor vehicle while under the influence of intoxicating liquor and or drugs." right here where it says further. Start there and I want you to read everything all the way down to here. Okay? Take your time. Don't skip any words. Make sure you read it completely. Okay? >> I'm not under 21 and I drank a few hours before driving. >> Mhm. >> That's it. >> I'm not asking you any questions about that right now. >> Yeah. >> Did you start reading up here? >> I read from being under 21 of the age of driving being actual physical control of the motor. >> Did you read all of this all the way down to here? Make sure you read this whole section. Otherwise, I got to read it to you. I want to make sure you read it completely. Okay. >> Yes, I read it. >> You started up here. You read every word from there all the way down to here. >> Yes. All the way from RCW from under being 21 all the way to the bottom. Yes. >> Okay. Let me ask you this. Um because normally I read it to you, that's totally fine. You can read it. Uh did you graduate high school? >> I did. >> Okay. Is English your native language? >> Yes. Okay. You understood everything you read? >> Yes. >> Okay. So, this question right down here says, "I have read or have had read too many of the above statements. Is that true?" >> Yes. >> You read them completely. >> I read it from top to bottom. >> Okay. >> Yes. >> It seemed a little quick. So, I want to make sure you agree with that statement. Okay. I'm put handcuffed again. >> Mhm. >> The next question is a yes or no question. Will you now submit to a breath test? Yes or no? Yes, I've already done it. So I can >> uh well the first one is a preliminary breath test. Remember I told you it's not in lie of the evidentiary breath test. This is the evidentiary breath test. This the breath test referred to up here. Refer to this. >> Oh, >> it's a different test. >> Do you want me to reread this to you? >> Can you read it one more time? >> Okay, I'll read it out loud to you and you can follow along, too. Okay. Uh, warning. You are under arrest for RCW4661. That's up here at the top. 502 or RCW4661504. Driving or being an actual physical physical control of a motor vehicle while under the influence of intoxicating liquor and or drugs. Right here where it says, "Further, you are now being asked to submit to a test of your breath, which consists of two separate samples of your breath taken independently to determine alcohol concentration. One, you're now advised that you have the right to refuse this breath test and that if you refuse a your driver's license permit or privilege to drive will be revoked or denied by the Department of Licensing for at least one year. >> Mhm. >> And your refusal to submit to this test may be used in a criminal trial. Two, you are further advised that if you submit to this breath test uh breath test, excuse me, and the test is administered, your driver's license, permit, or privilege to drive will be suspended, revoked, or denied by the Department of Licensing for at least 90 days. If you are a age 21 or over and the test indicates alcohol concentration of your breath is 0.08 or more or you're in violation of RCW4661502 driving under the influence or RCW 4661504 physical control of a vehicle under the influence or B under the age of 21 and the test indicates the alcohol concentration of your breath is 0.02 02 or more or you're in violation of RCW4661502 driving under the influence or RW4661504 physical control of a vehicle under the influence. Three, if your driver's license permit or privilege to drive is suspended, revoked, or denied, you may be eligible to immediately apply for an ignition interlock driver's license driver's license. Four, you have the right to additional test administered by any qualified person of your own choosing. For those not driving a commercial motor vehicle at the time of arrest, if your driver's license is suspended or revoked, your commercial driver's license, if any, will be disqualified. For those driving a commercial motor vehicle at the time of arrest, if you either a refuse this test or b submit to this test, the test indicates an alcohol concentration of 0.04 or more, you'll be disqualified by the Department of Licensing for uh from driving a commercial motor vehicle. Okay, so I read that all to you. I'm going to sign that I read the whole thing to you. Does that clarify the points? You read them now. I read them. >> Yes. But I have a question. >> Okay. >> So, >> I'm more prone to having hypertension. So, >> hypert. So, high blood pressure. So, anytime I do drink alcohol, >> it is raised >> and >> your blood pressure. >> Yes. >> Okay. Well, that's fine. I didn't measure your blood pressure. I just measured your breath alcohol. >> Okay. >> That's all this that's all this tests. Okay. Do you have any other questions? >> Okay. So, I'll ask you this one again. Since I remed you again, will you now submit to a breath test? Yes or no? >> Can I call an attorney? >> You sure can. Let's put you on the phone right now. Let's see if this door is open for you. Perfect. Okay, stand up for me. Come right back in here. We get you on the phone with attorney. You can talk to them. Okay. Do they have an updated one? Well, they don't. Have a seat. Let's [Music] see. Is it okay if I call you Annie? >> Yes. >> Okay. Mr. Samberg, this is Deputy and I'm sorry to wake you up. I have Annie here. Uh, she's been under arrest for DUI and she requested to speak with an attorney. Are you available to take that call? >> Sure. Yep. >> Okay. I've got you here on speaker phone. I'm going to leave the room so you guys can have some privacy. And Annie, when you're done, if you just stand up, I'll know you're done. Okay, stay in there. Well, actually, you can come sit right here if you want. >> I was going to ask you if I could use the bathroom cuz I haven't peed in the last like 2 to 3 hours. >> Okay, have a seat real quick. Okay, need to use the restroom. >> Can you wait 20 minutes or do you use it right now? >> Like right now. >> Okay, go ahead. Stand up for me. >> My pants are really tight. >> Okay, I got to take these off so I get to your handcuffs. >> Take off my purse, too, just in case if that is a problem. Okay, let me get the handcuffs off first. I'll let you take that off. How does that sound? >> Yeah, I can see that. >> All right. All right. Careful. Whoa, whoa, whoa, wait, wait, wait. There you get it off your wrist all the way. Go and take your purse off. Yeah. Set it right there. Nothing crazy in your pockets. >> I didn't think you did. All right. Where's our light switch here? Okay. Right in here. This isn't locked. So when you're done, >> is there not toilet paper in there? No. Over here. >> Yep. There's toilet paper. >> When you're done, just come on out. This door's not locked. >> I think you can. >> Yep. Just twist that. Come on out. When you're done, twist the handle. Come on out. Come on out. Come on out. >> Well, I push the button really hard. There's I don't know which button is. Just push really hard. One's up here. That's not it. Try that one there on the side. Push button up top. There you go. All right, let's put your stuff. You want to put your coat back on? All right, go and do that. Put this over here for now. Zip that up. All right, hands behind your back again. Do you want to zip up your Got it. Okay. hands behind your back again. Get your hair all fixed. >> Thank you. >> Okay, let's not get your sleeves caught in here. I'm going lock them so they don't get any tighter on you. All right, have a seat again. Go and sit. How's that? All right, everything's still being recorded. Okay. So, you read your implied consent warnings. I read your implied consent warnings. Now, you talked to an attorney. Do you need me to reread your warnings one more time or do you want to read them? >> Okay. Um, I'll just take the breath wiser. >> Okay. So, my I have to ask you a question formally. Will you now submit to a breath test? >> Yes. >> Okay. You check your mouth again. Tongue up. There you go. I don't see anything. You don't feel anything in there? No food? No chewing tobacco? Nothing? >> No, I don't do that. >> Okay. I got to ask. All right. After we check your mouth, we got to wait 16 minutes and then we'll get on with the instrument. >> Sit here for 16 minutes. >> We both get to sit here for 16 minutes. >> Awesome. Let's see here. I'll for now. >> Can I ask a question? >> You can ask whatever question you want. So, if I have anything higher than what I was previously tested with, which was a 1.1 >> uh on the the PBT, the preliminary breath test that you took on the side of the road, you're a.18.1. Okay. So, I'm getting my numbers. >> That's okay. That's okay. >> 18. >> Uh-huh. >> And the normal one is 08. >> The legal limit, the per se limit is 08. Yes, ma'am. So what would happen if I was still over the number? >> If you're over a 08? >> Yeah. >> So >> am I going to be in jail or >> if you're over a 08? Yeah, you will be booked into jail. But since you have >> this is just holding facility. This is P police department. The jail's in Kfax. Uh once you're booked into jail, there'll be a little bit of paperwork to do and uh you'll be allowed to bail out if you want to, but you have to prompt to show up for court. >> Yes. >> Okay. So, that's the steps going forward. >> If you're over 08? >> Yes. >> Uh, as soon as we do the breath test on here, it'll print out the results and I'll show them to you. We'll go over. Okay. >> Would I be able to call my mom? >> Uh, yeah. You've been cooperative. I can let you call your mom on the way if we're going to jail. Uh, >> I just don't know if she's going to answer cuz she has >> Well, you're I'll give you your phone cuz you've been cooperative. I haven't had a problem with you. I don't think you're going to arrange for an ambush of me or anything. >> I'm not. I promise. Uh, where's your mom live? >> My mom lives in Tacoma. >> Okay. >> So, my husband >> You can work on uh if you do end up going to jail, you can text her. You can give her a phone call. >> Doesn't really speak Vietnamese, so it kind of has to be through me. >> Oh, okay. Well, you're welcome to do whatever you need to. You >> in that eventuality, it's a 15minute drive to KFax. >> Okay. >> Do you work or are you a professional student? >> I am a student right now. >> Okay. >> Um, >> what year school are you in? I'm a senior. >> Okay. What are you going to school for? >> Kinesiology. >> Okay. What are you going to do with a kinestheology kinesthesiology degree? >> Physical therapy. >> Oh, that's a really rewarding uh career field. I think in another life >> I've been in it for a long time, right? So, it's been 3 years since I've been working as a PT. >> Have you Okay. Have you been doing that locally? >> I've been doing in Tacoma, not anywhere here. Um, yeah. I was just >> like in the summers basically. No, I've worked there when I was in um during my community college time, so about >> two years ago. And then I did it for 3 days while I was home for summer. >> I've had two knee surgeries. So, I've worked with a lot of physical therapists and PTAs and >> you what you guys do is really hard. So, >> well, I just I bet there's a lot of people that just don't take your advice. No, I've actually heard a lot of people don't really think that physical therapy is like beneficial at all until they do it. So, it's more outsider. >> Yeah. Yeah. Yeah. >> Yeah. >> Well, it can't I think like when you have a big injury totally. >> When you have a big injury, that's when you know that physical therapy is going to be like beneficial to you, but if you have like a minor like, oh, my back aches a little bit. >> It seems like they send everybody to physical therapy first. >> They do. They do because that's like their preliminary before like any kind of surgeries or any kind of like >> Sure. Sure. Sure. That makes sense. >> Yeah. I just hear people that like people have back problems and they're like, "I have back problems." Like, well, you're 400 lb, so it kind of comes with a tear. Physical therapy is probably only going to help you a little bit. Like that's not your main problem. I think overall since I've been working in physical therapy, a lot of them has been injured before like in big situations where like firefighters, athletes. >> Sure. Sure. >> Or just big car accidents. Um other than that, we had a lot of athletes come in like younger athletes. >> Yeah, >> pretty much it. I don't think we had a lot of sedentary people. >> Yeah. Well, that's good. Do they pay you for that or is that like an unpaid internship? >> No, I've gotten paid for every year that I've worked. >> Good. That's Yeah, I think I I would do that in after all my surgeries. I thought that would be a good idea. >> It's honestly worth it if you had like more than one surgery. I would say >> Oh, yeah. Well, especially joint stuff like >> you have to like if you didn't do it. >> I've had a lot of PT friends so I didn't have to go through insurance and everything. So, >> I had three ankle sprains, third degree, and then I had another >> Oh, I didn't know there were degrees. >> Yeah. So it just depends. Uh third degree is probably >> third degree is like the least >> the highest. >> Well, the highest. Okay. >> So first degree is more minor and third degree is more like >> you know >> in my line of work it's the opposite. Third degree is the lowest and first degree would be the worst. >> Oh no. First degree is the the most minor and then third degree is probably the most like injury prone to the point of breaking. >> Okay. >> Yeah. That's usually where all your ligaments are are prone to ripping apart. But >> did your ligaments ripped if you had a third degree sprain? >> Yeah. >> How do you get a third degree sprain? >> I was pull bolting. So >> Oh, like land on it wrong type of Oh, >> it's great. 90° I was in high school. 90°. Um, >> you're making my knee ache right now just talking about it. >> Don't want to talk about it, though. A lot of a lot of things happened when I was in high school. I had a lot of minor sprains, had a lot of third degrees, and then that's it. >> Okay. Yes. >> Before I get too carried away, I'll make sure I get all your information correct here. You don't have a middle name. >> No. >> Uh, I see the Tacoma address here. >> Yeah, that's >> Is that where you would like everything sent to? >> Yes, >> that's the one. Okay, let me get that all written down here before I get distracted. >> How much people did you guys have come in for tonight? >> What do you mean? Like in jail or here or >> just a general question. Been here for three. >> You see that gal right there? She is wearing a black uniform. She is with the Pullman Police Department and this is their facility. >> I'm with the sheriff's office. So, I don't know how many people they brought in. >> Probably a few. >> Yeah. >> Uh the sheriff's office. You're the only one for the sheriff's office tonight. >> So, >> okay. >> You're special. >> It's not a great prize to win, but >> it's definitely not. >> It's It could be worse. I've had >> I just had that question cuz I've seen so many people get pulled over since I've been up here >> and then just literally like >> and there's a wreck tonight and everything. Yeah. I don't know that I don't know what happened on that. >> I don't know. I saw a college cab and I saw a car flipped over. >> Okay. >> And that's it. After that, I walked inside and I was like, "Oh my god." >> Yeah. >> Um Yeah. I mean, it's pretty tame. I mean, today's first day of classes, right? >> Yes. pretty tame tonight for I mean I said from a rollover crash but uh normally see more cars out driving this time of night. >> I usually am not out at all for the last couple years. So >> Gotcha. Well, things happen. It's not the end of the world. So you want to be a PT, huh? Or is PTA? >> What do you have to do after your degree here to be? >> I'm very finished this year. Um, I have to apply into colleges, which I'm planning on doing in Tacoma or Seattle, and then I have three years left, which is primarily >> Is that like a master's degree you have to do or doctoral? >> Yeah. So, a year of No. Um, one year of just like in class and then two two years worth of clinicals. So, three sessions. >> Do you get paid for that or is that an unpaid? >> Oh, no. So for three clinical sessions, you do about 10 to 12 weeks each clinical session. You don't get paid for it. And a lot of people that I've met said that they did not go to work during that time. So everything is through loans, >> but at the end you'll be Dr. Tran and then you'll be making the big bucks. >> Well, let's just hope I don't have this on my record because I'm kind of screwed now. Well, so how that works is right now you've just been arrested. You haven't been charged or convicted with anything. >> I don't know. >> That's a long road. >> One that's been arrested. So, this is >> Well, I'll let you in a little secret. Uh, in the world of criminal offenses, DUI is pretty minor. Now, if you have two, >> I've heard that DUIs with college degrees is a lot more because they look into the records. They might, some places might do a background check on you, but like I said, you haven't been convicted of anything right now. No. >> So, that's farther down the road. Lots of things can happen between now and then. Uh, this is your first offense like you told me. So, they look on that very favorably. The thing is to remember is make sure you learn from this, >> of course. >> And don't do it again. >> Never again. >> If you if you've been drinking, let's play it safe and just no driving. >> I thought that after a few hours that I would be okay. Rule of thumb is two hours for every drink. >> Oh, I've heard that it was 1 hour for every >> I hear that a lot. And you know what? Those people get arrested a lot, too. So, I'm guessing the 1 hour rule isn't very good. >> No, I'm pretty sure that's not >> Well, I don't know the medical side of that. You might know that better than I do. >> I think I do a little bit. That's why I asked you guys. >> No, we don't measure that. We It doesn't take into account your blood pressure or anything like that. Um, my blood pressure prior to drinking is usually high. Um, >> well, I don't have a blood pressure cuff or a pulseox in check. >> I'm just letting you guys know prior with my medical condition. That's >> okay. Um, so yeah, you'd probably be surprised how many very successful people have DUIs. It's pretty common. >> It's okay. I don't really want to ask about that. >> It's not something I am proud of or anything. Well, like I said, it's your first one, and they take that into account. We're not trying to ruin anybody's life, but I want to make sure we don't do it again. >> Yes. >> And at this point, I just got to do my job. >> Yes. >> Nothing says I can't be super nice to you, though. Oh, yeah. You're being super cooperative. >> Uh, you're doing better than a lot of people. I've had plenty >> full grown adults over there crying, asking for their parents. And >> my neighbors at the retreat. I saw their video on >> Which one was that? >> She was one. I don't remember her name, but she was here. Your >> It wasn't a video of mine, was it? >> I don't I don't know. >> You remember cuz I'm I'm very memorable. >> Bar stool. Um, she was crying. Hysterical. >> She was on a bar stool or she was on the bar stool channel. >> Bar stool woo. >> Oh, that I saw her on TikTok, on Instagram, everything. >> And then I figured out that was my um my neighbor. >> Oh, boy. >> Yeah. I guess she was really close to one of my roommates, so I figured that out after. >> Okay. Okay. >> Yeah. >> Well, here's to hoping you don't end up on any of those >> Well, >> websites. >> I don't think so. Fingers crossed been okay. >> Yeah, they normally go for the ones that are acting really crazy or >> She was crying and hysterical, so I guess. >> Yeah. >> Yeah. >> Well, thanks for not being crying or hysterical. >> It's okay. I thought it was kind of time, but I guess I was over the limit. >> Yeah, >> I'm just a little like shocked right now. That's it. Okay. Um Yeah. >> Says we got two more minutes, just so you know. >> Yeah, >> we're just waiting. >> Oh, thank you for letting me use the restroom cuz I haven't >> Well, the other option is I let you wet your pants and that doesn't do either of us any good. >> Yeah, >> I'd rather let you use the restroom. Could be worse. There could be people in here screaming and kicking the doors. I would literally sit calm. I'd be scared. >> Well, I you'd be fine. You'd be still sitting there, but you'd be fine. >> One more question. >> You can have as many questions as you want. >> How much people do you guys usually have of like during syllabus week or weekends? >> Depends like >> I'm just curious cuz >> how many people we arrest? >> Yes. For DUIs or >> Oh, for DUIs. M on a busy night or the whole weekend? >> Busy night and whole weekend. Uh, it varies. I mean, we can have busy weekends where we're just going to like big calls and we don't have time to stop cars or like sometimes you get a drunk driver because they crash. Otherwise, if we're going like from burglaries to fights to we don't have a lot of time to be checking in with people who are driving. >> Uh, so a busy I mean I mean there so the most I've ever arrested in one night would be three >> just by myself here in Pullman. Um, so imagine if there's three or four or five deputies working and they probably have five or 10 city cops working. They don't all get that many, but if half of them got one every night. >> Mhm. >> It adds up. >> So every single person you have to go through the whole process like this. >> Yeah. >> Oh. >> So they have an instrument here, they have an instrument in Kfax, and they have an instrument at WSU. >> Okay. >> So if they were busy, sometimes there will be two people here waiting to use this machine. Yeah, >> we would just gone to WSU. Nobody would have bothered us there. Nobody goes there really. So, >> I only go there when it's super busy. >> Is there a mouth covered for? >> Yep. They're individually wrapped. Oh, yeah. All right. Did I watch you the whole time? Yes. Did you smoke, vomit, or put anything in your mouth? No. Was a collision involved? No. I'm not going to ask you where you were drinking. What do you want me to put for ethnic group? >> Uh, Asian. And I'm Vietnamese. >> I can put Asian. >> Yes. >> Okay. See if this works. This never works. Didn't work. >> Oh my gosh, it worked. And it marked female for gender. Is that okay? >> Yes. >> I got to ask everybody. >> Of course. Understandable nowadays. >> I don't assume. All right. So, the instrument is making some noise. It's checking itself. Once it's done and successfully checked itself, we'll go to the first breath test. First of two. >> Pretty simple. >> Get two. >> Yep. Very similar to the preliminary breath test. Big breath in as big as you can. Place your lips tightly around the straw. Blow out for about 10 seconds. I'll tell you to keep going. Keep going. I'll coach you through it. >> What if I can't blow the >> Just blow as long as you can. It'll be fine. Uh, it gives me a little bar. It shows how long you've been blowing. It doesn't give me any results or anything. >> How long do you usually do it for? >> It's not a big It's not a big volume of air. >> So, it's just kind of steady stream. You don't have to blow like a hurricane's worth of air. >> I was trying earlier. I was like, "Oh my god, I don't know how this works." >> Well, biggest thing is on on the one out there, you kind of put your lips to it. Just put your lips around it slightly and make sure there's a tight seal around the tube. It will help. Don't worry, you'll be just fine. Okay. You can do it standing or sitting. It's up to you. Big breath in. As big as you can. And when you're ready, go ahead and blow. Very good. Side mouth blow. Okay. Plenty of air. Plenty of air. Keep going. Keep going. Push. Push. Push. Push until you're out of air. All right. Stop. So, you blew a lot of air. Oh, it did not like you doing that. >> Okay. Oh, that's a lot of air. >> Okay. So, big breath in. Take a deep breath. You don't have to blow quite so much air. Oh, like I said, open your mouth wide, >> wrapped around the straw, and then blow. Okay, big breath in. Take a couple. >> Take a second. >> Yep. Breathe in and out a little bit. Just remember, big breath. Get your lips around the straw rather than pushing them into it. That way you get a good seal. Whenever you're ready, plenty of air, plenty of air. Calm down. Calm down. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. All right. It's not liking how you're doing that >> again. >> Yep. >> Can I take a second? >> Yeah, go ahead. And you can sit down too if you want. That's totally fine. >> That was a lot of air for me. >> Well, you're blowing a big volume of air. You don't have to blow that much. Just >> blow air. >> Yeah. Just take a chill pillow. Okay. Breathe in a couple breaths. Cleansing breaths. Okay. Big breath in. Oh, you stand up, too. Big breath in. Go ahead. Plenty. That's plenty of air. Plent. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Stop. All right, that should work. Have a seat for me. All right. You see the difference? You don't have to blow so much air. >> Yeah. >> So, instrument's going to check itself again. Once the instrument successfully checks itself, we'll do one more. Then we'll be done with the two breath tests. Once it checks itself a third time, prints out your results. I show them to you. >> Do you know the results the first time? >> Nope. Like I said, I don't see your results. It just shows me how much air you blown on a little bar. >> I'm just nervous. I don't want to disappoint my mom anymore. >> Well, >> oh, it happened. >> It It happened. I recommend starting with, "Sorry, I messed up." And I'm going to learn from my mistake. >> I'm Asian. Yeah, it's a little complicated. >> It's a little hard. >> Yep. Well, >> yep. >> It's a long process. Uh, and like I said, you haven't been charged with anything yet. You haven't been convicted of anything yet. It's just the start of the process. Our prosecutor is very understanding. They're not trying to ruin your life or anything, but we can all kind of learn how this is just not a good idea. >> I've heard it from a few people, >> right? I hear that from a lot of people. They're surprised like, I didn't think it's like that. From my perspective, I see it a lot. It's pretty easy to get there, you know. So, >> well, let me ask you this. They're trying to make the law even lower standard. Do you think that's a good idea or a bad idea? >> If it's lower. >> Yeah. >> I feel like nowadays a lot of people get wasted really quick and the retention's a lot higher. So, I understand if they lower it. Um, I feel like 08's still okay, though. >> Still a good one. Okay. >> Yeah. >> Do you think you'd be more upset if someone hit you and they had alcohol in their system? Do you think >> if someone hit me while I was driving? >> Yeah. >> Yes, I would be upset. Um, >> a little different perspective than it being you, right? >> Other than this happening, I would be really upset >> just cuz of personal reasons, that car is my dream car. And also my mom had done that prior to me being born. So >> Oh, okay. >> Yeah. >> It's got sentimental >> a lot of >> somebody hurt that car. >> Dreams and hopes. >> Yeah. >> Yeah. So sometimes when I do see problems going on with the car, I'm like, "No, please don't die on me." >> Oh, that's a good That's a good thing about older cars. >> They're easy to fix. >> The Toyota. >> Yeah. And they run forever. >> Yeah. I just hit almost 200,000k. >> Oh, yeah. Hopefully it can last me maybe 100 or 150k. >> I bet. I bet. >> I think it can, but it's a little slower. >> You got regular oil changes? >> Yep. >> It's the best thing for a Toyota. >> A little oil leak. It's okay. You can get that fixed, too. >> Yep. Yeah. Toy Toyota Toyotas are good for that. >> Mhm. >> Yeah. I definitely I don't think I would be happy if someone hit my car. Especially seeing what happened tonight. >> I don't think it was college cab's fault. Um, >> I don't know. I wasn't there. >> I don't know. I saw the car flip and that's it. >> Were you there when it flipped or did you just see after? >> I saw it right through the trees. >> Oh, okay. Second breath. Big breath in. Whenever you're ready. Perfect. Just like that. Keep going. Don't stop. Don't stop. Don't stop. Keep going. Keep going. Keep going. Stop. Okay. Just about perfect. Should be happy with you. There you go. All right, have a seat. It's going to check itself again. When it's done, it'll print out your results. So, I'm going have to ask if you need to use the restroom cuz you already did. >> Uh, no. I think >> perfect everything. >> Can I ask one of those questions? >> No, you ran out of questions. No, I'm kidding. Go ahead. >> Um, so I had to sign something for PT school regarding like conviction. >> Sure. >> Is this part of my conviction? If that did happen, >> remember you haven't been convicted of anything yet. >> But if that did happen, that's just my question. >> If they were asking if you've ever been convicted, most times they're asking for like felony crimes. >> They do. >> This is a misdemeanor crime. This is not a felony. >> How long do you misdemeanor last for? I don't >> Well, technically misdemeanor will stay on your record if you're convicted of it. >> Okay. >> Forever. But a lot of places either don't ask about misdemeanors or if they do Every place that I've signed up for has asked if you've had a felony. >> Yeah, that's very common. >> Felonies are pretty serious. >> But don't they do a deep dive into your history and record for >> They may uh but if they're only worried about felony offenses, then that wouldn't trigger anything for them. Okay. So, you did two breath tests, one and two. Each breath sample is tested two different ways. The first breath sample, you were a 104 and a 11. Second one was a 109 and a 117. Remember the legal limit is 08. >> I know. >> Okay. So, you're still over the legal limit. So, it means you are going to be booked into jail. >> Uh, how long will it be for? >> Uh, if you choose to bail out, you should be able to bail out within a few hours. >> How much is bail? >> Bail would be $500. >> Could I bail my cell phone? >> You can. >> Okay. >> You'll probably need a ride after that. >> Um, >> so you'll have to >> I can find one. >> Have to work on that. So, what happens after I get build? >> You'll have to prompt to show up at court. They'll give you a court date. >> Will I need my parents there? >> No, you're an adult. This is all on you. >> Will this be in Pullman? >> Depends on which day. They will tell you if it's in Pullman or Kfax. They'll make that very clear to you. >> Can I do multiple calls to find a ride? >> Yeah. Yeah. Yeah. >> Okay. >> I'll give you your phone on the way to Kfax so you can do whatever you need. Okay. >> All right. Let me explain a couple more things to you before you get too emotional here. So, anytime you're arrested for DUI, as you read, there's two parts of it. There's the criminal part because it's against the law. Yes. >> And there's a civil part, which is the suspension of your driver's license. You can appeal the suspension of your driver's license if you'd like. This is the form to do that. This is a request for a DUI hearing. There's a $375 non-refundable fee. You have to make the request within 7 days of your arrest. That's all printed here. Uh, this is going to go in your property. Make sure you don't lose it. Uh, any valid license in your possession is still valid for 30 days from your date of arrest. They're going to send any notice of your suspension uh of your license to your address on file, which would go to the Tacoma address. So, if that changes, you need to update your address with DO. Okay. Yeah. I'm going to mark the box here saying I've given you this sheet of information. This is your notice of right to a hearing. Says I've been given written notice of my right to a hearing, including the steps required to obtain a hearing. and understand that this is a notice of suspension, revocation, or denial of license will be mailed to the address of record on file with the department of licensing. So that's the Tacoma address. >> Is there any way we could change it because I won't be able to get the mail at home because I'll be here? >> Yes, you can log in and you can change your address online. If you want to change your mailing address or your physical address or both, you can do that. It's free >> and that's through mail >> through So if you log into Washington DO on their website, I'll put that at the top here. Yeah. Washington DO. >> So what happens when you appeal it >> up date address? So an appeal is basically mini trial all around the suspension of your license. Make sure you read through this. It'll tell you all the stuff you need to fill out. Attorney's name if you want to file an appeal, all that information. Okay, that's all on here. Uh most attorneys will talk to you on the phone for free. Give you kind of an idea of what the cost would be. Basically, make sure if you want to update your address, make sure you do it on the do website. Do you want me to list uh your address, your local address here >> for the rest of the records >> on my side of it? >> What's your local address? >> Um I don't remember it. Yes. >> I will put that in our local files, but again, you still have to uh update it with the Department of Lancing. Okay. Do you understand what I just told you about all your notice for right to a hearing? >> Okay. Where it says signature? Will this be sent to mail or would it be through email? >> Be mailed. >> Um, okay. So, I'll just have to change my address. >> Like I said, you can do it online. It's free. You don't have to reprint this one. As long as it's updated online, everybody's happy. >> Okay. >> Any other questions about that? >> No. Um, you said that I was able to just bail myself out with the knee tonight. >> You should be able to. Yeah. >> Okay. >> Should be no issue with that. All right. If I let you out of your handcuffs, you're not going to like scream and kick me and attack me, are you? >> No, I think >> Well, I've seen people change their mannerisms on a dime. Go and stand up for me. All right, let go your fingers. All right, we're going to go back out the way we came. Hold on to your what? Satchel. What? What should we call this? >> Fanny pack. >> Well, it's not a fanny pack. It >> is a fanny pack. Oh, you're just >> Yeah, I just >> Oh, you just don't wear it that way. Okay, I'll grab your paperwork here. That'll all go with you. >> I want you. >> You do. All right, I'll pick you up on the other side. She was low. 104. >> Yeah, she blew 118 on the side on PBT. So, don't speed on merman. >> Or do and make sure I catch you. What happened on the rollover? Somebody just turned in front of somebody going straight, I'm guessing. >> Yeah. >> Drunk. >> No, >> not drunk. Born driver. >> No, just not our first week here. >> Listen, left turns are confusing. >> I know they don't have those in Oregon. >> Oh, I love People give me that. I'm from Idaho. I'm like, you know what? We got the same signs as Idaho so you wouldn't be confused. like, "Oh, thank you so much. Stop." I'm trying. Same for the west side. Like, I'm from the west side. I'm like, "We have Westside signs just for people like you." They never call and complain cuz I'm not what? >> You're not Doug. >> I do get a lot of complaints, but not for those things. Doug gets a lot of complaints. >> [ __ ] Doug. He gets complaints every day. >> Well, I have something to live up to, then, I guess. Well, >> not you. >> Yeah, I know. All right. Have a good night. Right this way. Your phone's out in the car. I'll get that for you. [Applause] >> Yep. That's what I'm going to give you. Your phone once you're in the car. All right. Same seat. All right. Seat belt on. I'll get you your phone. All right. There's your phone. What kind of music do you listen to? >> I listen to everything. Country music. >> Country music. Anything you can't stand or don't listen to? >> Screo. >> Screo? What's that? Yeah. Oh, like scream rock. I don't listen to that either. All right. Well, no promises. >> What's that? >> You can make a few calls. All right. Undo your seat belt for me. As a reminder, everything is being recorded. Step on out for me. Oops. Just grab that piece of paper. They're going to meet you over there at that brown door. Corrections officer will have some questions for you. >> A couple questions I need to ask you. Have you had any breathing difficulties? >> No. >> Okay. Have you experienced a loss of taste or smell? No. >> Have you experienced nausea or vomiting or diarrhea? >> No. >> Have you been in contact with anyone diagnosed CO 19? >> No. or has been placed in quarantine? >> No. >> Is there any possibility that he could be pregnant? >> No. >> Okay. >> All inmates will be body scanned to check for contraband and all property items will be searched. Introduction of contraband such as controlled substance, alcohol, marijuana, other intoxicants, cell phones, or other electronics into a correctional facility is a federal criminal offense. You'll receive amnesty for criminal charges for introduction of contraband into correctional shel if you honestly and accurately provide information about any contraband before entering the booking area. Anything you might have there on your person that you may not have found in the search. >> Do you have anything? >> I don't. I just have a napkin in my pocket. >> That's okay. All right. Come on in. >> Just what size she >> tissue? Take your shoes off. Let me check if my roommate. >> Yeah, you can briefly check it. Not your roommate over my >> Is she worried about you? >> Yeah. The office does not have a >> Yes. >> Do you take your jewelry off? >> All of my jewelry? >> Yep. >> Do you have a pair of small scissors? Cuz one of my jewelry is tied on to my wrist. >> Just like scissors. >> It's just a >> It's just a bracelet. >> She thinks she's going to bail out. >> Okay. That's not right now. >> Is that okay? >> Yep. >> Sorry. >> She's been cooperative thus far. >> This one? No. >> Yeah. Let's hold up on that. If you bail out >> that the one that's tied on a >> long time. Yes. I've had it on since I was a little kid. >> It has the Asian uh clasp. >> Well, you're lucky cuz normally they make you take it off. So, he must like you. >> If she's going to bail out, I'm not going to bother with it. If she doesn't bail out, then we'll worry about getting it off. >> See, that's why he's the boss. >> Okay. I'm going to have you go in swing right here. After I close the door and you take all of your clothes off, stop. >> Sorry, I didn't get your name number. >> That's okay. >> I'll do better next time. >> I don't think she was in locals when I looked. There you go. That works. >> I really wish I didn't go out tonight. Too late to see. >> Well, you still wish you didn't. I'm glad you didn't do this somewhere like in Spokane. This would be an entirely different experience for you and not in the >> go. Okay. Come on in here. Put your feet on the yellow line here. You're probably going to be looking at that bullseye there. Just wait. I'll take your picture in a moment. No smiling. Okay. Go ahead and step on the gray footprints in there. Facing the blue guy on the wall. Bring your hands down to your side with your palms open facing forward or backward like I've got mine here. There you go. Stand up still for just a second. Go ahead and step out. All right, we'll come in here. I will get a PC sheet for you. >> He gets his report to us, then we'll do the processing and talking about bail and make phone calls for that and everything. Okay. >> Um, I have my roommate Carissa coming soon. >> Okay. >> If she does call, I think I told her the right address. >> She'll figure it out. There's only one. >> Yep. So once I get here and once I get his report, then we'll go through what the next step's going to be. Okay. All right, Annie. Sorry we had to meet under these circumstances. Okay. >> Let's not do this again, though. We're happy to help, but let's not do this again. >> Okay. Good luck to you.
