There are some people who, I mean, they wouldn't be as cooperative as I am because technically I have not broken any laws, so technically y'all searching me and doing all this is unwarranted. >> Okay. And it was all consensual on your part? >> It I That's what I was saying. I was saying that there are some people who wouldn't cooperate as nicely and all because technically I haven't broken any laws or anything like that, but I mean, I'm not trying to be a dick or anything like that, so I just I want to have a good relationship with y'all. >> Police approached a man because he was openly carrying a lawful toy and quickly escalated the encounter by detaining him, conducting a search, and demanding identification, even though he immediately explained that his possession was legal under state law. Calm but firm, he repeatedly cited the legal basis for carrying the item, cooperated with the officers, and answered their questions while asserting his rights. After verifying his license and confirming that the toys were lawful and that no crime had been committed, the officers found no grounds to continue the investigation. Ultimately, with no legal basis for further action, they had no choice but to let the man leave without issuing a citation or making an arrest. >> How you doing, sir? >> Because I don't know what kind of gun this is or anything. >> Okay. >> to go ahead and take it off you so we can talk safely. >> Okay. >> You good with that? >> Oh, that's fine. >> Okay. Do you have another weapon on you anywhere? >> Yes, sir. >> Where's that at? >> It's on this other hip. >> Okay. >> It's kind of tight. >> one at a time. >> going to let go of your hand, okay? >> Okay. >> I'm going to pat you down, okay? Make sure there's no more weapons. You okay with that? I'm not searching you. I'm checking you for any other weapons. >> I have a pocket knife on me if you consider that a weapon. >> Well, it is a weapon, but I'm worried more about firearms right now. >> I don't have anything else on me, sir. >> I'm going to pat you down just real quick, okay? Do you have any ID with you and that's it? >> It's in my back pocket, sir. Do you mind if I reach for it? >> it. >> Okay. The black powder thing in the state of Texas, and then there's my concealed carry. >> Thank you. >> Black powder thing in in Texas, I've got it on my phone, but basically the way the law is written, here, I'll just put this on the ground, that way I'm not reaching in my pockets. >> Okay. >> Uh the way the law is written is black powder is not considered a firearm in Texas, so the laws consider regarding concealed, open carry, all that stuff do not pertain to black powder firearms. So, under their definitions of firearm, the state of Texas does not consider black powder a firearm. So, it's whenever you were out it doesn't the laws pertaining firearms about concealed and open carry do not apply. >> Okay. Well, let me ask you just I mean why do you carry that and a regular gun concealed? I mean I understand why you concealing that. You're trying to abide by the law and everything. Why do you carry that just >> Conversation starter. >> You mind telling me where you work, sir? >> I'm a student right now. >> What are you studying? >> I'm doing aircraft mechanics. >> Oh, really? >> Yes, sir. >> You still live on Teresa Drive? >> Yes, sir. >> Here you go, sir. >> All righty. I'm going to reach down and get my wallet. >> Where Where did you purchase the guns at? >> How is that pertinent? I'm just curious. >> I'm just talking to you right now. >> Oh, okay. The black powder got from Cabela's shipped straight to my house because it's not considered a firearm. So, I'm going to put this back in my pocket. >> good. We're just checking on a few things and then if everything's good, everything checks out, we're we're probably going to just be on our way, okay? >> Okay. >> You want to go find some shade? >> We can. I mean >> Serial number of We get called every time somebody has a pocket. So, that's >> Are you serious? >> Yeah. >> Well, there are some people who, I mean, they wouldn't be as cooperative as I am because technically I have not broken any laws. So, technically y'all searching me and doing all this is unwarranted. >> that, and it was all consensual on your part. >> It That's what I was saying. I was saying that there are some people who wouldn't cooperate as nicely and all because technically I haven't broken any laws or anything like that, but I mean, I'm not trying to be a dick or anything like that. So, I just I want to have a good relationship with y'all, you know? >> Yeah, I appreciate that. >> It's just And I mean, if I hadn't had my concealed on me, then I probably would have had an issue with you and with you ID'ing me, but because I had my concealed on me, I know that y'all are legally or I am legally required to show ID with the concealed on me, basically. But >> Yeah, I'd much rather be answering some some more serious calls, you know, honestly. >> Yeah. >> Yeah. So, what are you waiting on? >> Uh just wait for them to tell me that you're clear. >> Uh didn't they say that I was clear? >> They said the guns are clear. >> Okay. >> All right, man. >> All righty. >> We're going to we're going to uh step back. You can collect your firearms, okay? >> Okay. >> And uh I guess that'll be the end of it. Appreciate your good attitude. >> Yes, sir. I'm like I said, I'm not trying to be a dick or anything. >> Right. This is kind of a new thing we're running into, you know what I mean? >> Yeah. >> And uh I mean, I'm pro pro-gun, pro-firearm. >> I'm not sure about the open carry thing yet because of this kind of a problem, you know what I mean? >> Yeah, and again, I mean, that's the whole reason that I'm doing it. I'm doing it to one get conversation started, two get people who wouldn't normally educate themselves or, you know, even think about it a custom to law-abiding citizens carrying a firearm because let's be honest, the media smears firearms like only criminals need it. >> Right. No, I'm I'm on the same page with you, okay? The problem that we face from our point of view is, you know, good people can carry firearms legally. They just have to have them concealed, okay? The problem that we're facing that if everybody carries a firearm out on them, the bad guys that aren't supposed to be carrying firearms are going to try and get away with it, too, you know what I mean? It's going to be harder for us to uh differentiate. >> But here's another thing also. >> Let me ask you something. Um just your opinion or whatever. >> Okay. >> Just uh just curious. Why do they want to carry them openly instead of concealing them? What's the difference there? I mean, if you can carry it legally already uh concealed, why are you pushing for the open carry? >> Just different firearms that I can carry openly. I can do it and I have in the past, but I'm more conscious of it and I'm more like, "Oh, am I printing or am I showing?" And I don't want to have to worry about that. >> holsters. They had a really good holster. It's inside the waistband. >> Mhm. >> And it doesn't print. On on my 160-lb frame. >> But I mean, Yeah, and I mean, again, I mean, I understand your point of view and everything, but then also, I mean, I'm somebody who is somebody who thinks everybody should have pure constitutional carry. Meaning if they want to open carry, they should have the right to do that. If they want to conceal carry, they should have the right to do that. And right now in the state of Texas, we do not have the right to open carry. It's a felony or misdemeanor or whatever it is to open carry a modern handgun. And I don't think that's right. And that's why I'm part of the group and that's why I'm doing what I am doing. >> You got no problem with the guns. Here's the deal. As far as Texas goes, the definition of either a firearm and handgun where they intersect, okay? As far as black powder, yeah, that is an exception. However, you also see the definition within the penal code where it defines what a handgun is. Okay? >> Okay. >> We're looking at it specifically whether or not it's a violation of unlawful carry of a handgun, right? Right? >> I'm sorry, say that again? >> I said that's what we're trying to determine whether or not it meets the elements of unlawful carry of a handgun. >> Okay. Yes. Yes. >> Because prior to that, it gives us the definitions of what is a firearm and the exceptions thereof. >> Yes. >> And what it is or defines what is a handgun. >> Yes. >> Okay. It actually meets both, correct?
