Go ahead and put your left foot on that line. Put your right foot in front of your left foot touching heel to toe, like so. Don't start walking yet. >> Okay. >> Okay. So, yeah. Put your arms down at your side. Remain in this position while I complete the instructions. Don't do anything else until I tell you to. Do you understand so far? >> Yeah. >> All right. When I tell you to begin, you're going to take nine consecutive heel-to-toe steps on the line. You're going to turn around and return nine consecutive heel-to-toe steps back on the line. When you turn, you're going to keep your front foot on the line and take a series of small steps around with your outside foot. >> Okay. >> All right. I'm going to demonstrate three steps each way, but you're going to do nine, okay? Can you get back in that position? All right. So, it's going to look like this. >> nervous. >> One, two, three, all the way to nine. >> Okay. >> And then returning, one, two, three, all the way to nine. Do you understand those instructions? >> Yeah. >> All right. You can go and count the first step as number one. >> One. Two. Three. 4 6 7 8 9 1 2 3 4 5 7 6 8 9 >> Okay. >> Do you want me to go? >> No. All right. So, the next one is something else. Again, while I'm doing the instructions, can you stand with your feet together? Arms down at your side. Don't do anything else until I tell you to, okay? When I tell you to begin, I want you to raise either your right foot or your left foot approximately 6 in off the ground. Keep that raised foot parallel to the ground. Keep both legs straight and your arms down at your side. While in that position, you're going to watch your raised foot and count out loud in the following manner. 1,001, 1,002, 1,003, and so on until I tell you to stop. So, it's going to look like this. 1,001, 1,002, 1,003, until I tell you to stop. Okay? Keep While While you're doing that, don't start yet. While you're doing that, keep your arms down at your side. Keep both legs straight. >> Okay. >> And keep watching the raised foot. Do you understand those instructions? >> Yep. >> All right. Give me just a second. Are you ready? >> Yep. >> All right. You can begin. >> 1,001, 1,002, 1,003, 1,004, 1,005 >> you lift your foot. >> 1,006, 1,007, 1,008, 1,009 >> Go ahead and pick your foot back up and continue. >> 1,001, 1,002, 1,003, 1,004, 1,005, 1,006, 1,007, 1,008, 1,009, 1,010, 1,011, 1,012, 1,013 Sorry, I made a mistake. >> You can stop. The So thing I'm going to ask that you provide is a uh a breath sample on the PBT here. Just gets us a better idea. If you have nothing to drink tonight, you should be fine. Um and we'll go from there, okay? >> Yeah. Do I have to do it? >> You don't have to do it, but here's the thing. So this tests for alcohol and alcohol only, okay? If you refuse to do it, that's well within your rights to refuse, but then I have to go based on everything that I've seen and I need to make a decision as far as whether or not to arrest you or let you go based on everything that I've seen. >> Okay. Do you recommend that I I've never like >> I mean, I would recommend that you do it, but obviously it's your decision. >> If I don't do it, I get arrested? >> I mean, I think you're impaired based on everything that I've seen, your performance on the test. I think you have been drinking tonight. Is that true? >> No. >> No? Okay. Well, if you haven't been drinking, then there's no reason not to. >> So if I don't do it, I am automatically like arrested? >> So like I said, I think you're impaired, but this test only for alcohol. Okay? Just alcohol. >> Mhm. >> You're telling me you've had nothing to drink. >> It's like not my car though, it's my friend's car. >> I know. It's I know. But it's one of those things. It's like I said, it's your decision to make. >> Mhm. >> Um if I was driving and I had nothing to drink or if I felt like I was under the legal limit, I would by all means provide the breath sample, but that's just me. So >> It's just like not my car. Like I really don't want to get in trouble for it. >> I get that. >> Yeah. I'm not going to lie, I did have a little drink. >> Uh-huh. >> And I just my friend made me drive because she had a little too much. >> Yeah. >> More than me. >> Mhm. >> And she made me drive her car. We live really, really close. >> Yeah. >> So >> what I mean? I've been I've been young, too. I I I know what it's like. You know, you probably didn't plan on driving home today. >> the breathalyzer, but like I'm not going to lie, if I take it, I might go to jail. >> Okay. >> It's not It's not my car. >> I know. All right, so with this you're going to take a deep breath in. >> Okay. >> You're going to form a tight seal around this with your lips and blow a steady stream of air until I tell you to stop, okay? >> Okay. >> All right, deep breath in. You got to blow out. Keep going, keep going, keep going, keep going, keep going. All right, very good. All right, so you're 0.203. >> Is that way above? >> I'm sorry? >> Is that way above? >> The legal limit in Illinois is 0.08, so yeah, you are quite above. Um so at this point time you are going to be placed under arrest for DUI. We can get whatever you need out of the car. I understand it's not your car, but what do you have in the car that you need? >> Just my purse. >> Just your purse? >> Yeah, I can I can leave it with her though, it's fine. >> Well, it's it's probably better that you take it with you. So, ma'am, you just turn around. >> Ma'am, ma'am, ma'am. >> Just turn around, put your hands behind your back. Thank you. Just unfasten your seat belt. Can you call for me? These aren't too tight, right? All right, so you're going to walk over here. We're going to have a female officer come and pat you down. >> Can I go home or go home? >> So, you should other stuff. Um it should be less than a couple hours and then we'll >> How much money am I going to have to pay? >> You're not going to have to pay anything. You can just Just stay with this officer here. You're not going to have to post any money. >> Really? >> Um yeah, you're >> going to go on my record? >> You're going to be released on your signature, but basically I mean, as of today, yes, you are going to be arrested for driving under the influence which is a misdemeanor in our >> Can I get my phone and stuff? >> You will get your phone. >> It's my phone. >> First is your phone, correct? >> First is my phone, most importantly. >> Okay. So, stay here with Officer Dempsey, okay? >> The driver was arrested for driving under the influence and transported to the police station where breath test indicated a BAC of .207. Following the booking process, the driver was served with citations for DUI, speeding, and improper lane usage and was released on their own recognizance. The confiscated fraudulent identification and vaporizers were submitted into evidence for destruction.
