response to a disturbance involving a
couple upon arrival a female was
observed crying outside of the

happened I came home he was out for a
long time I came home shower took a nap
went out
tonight to you know have dinner and just
hang out and then it it was just very
computational okay did you did you guys
spend the evening together or did you
get separated at some no I left I went
my home okay cuz he was very argument so
I came back to the room and I was like
you need to go you have to go and then
it was
just argument yeah back and forth is it
um cuz it's drunk yeah okay what's uh
what's the main issue why is it being
rude okay because his sandwich was light
that's so silly is this it's ridiculous
is this like a normal behavior it's not
I mean it's usually very patient and
very cool and we're okay okay how long
have you guys been married we're not
even legally here okay so how long have
you been together 7 years 7 years you
live get it back home yeah okay any

this I just needed him to come away
because it was like getting in my face
and I'm like I don't do that I don't

we have these times you get too drunk I
get too drunk everything happen it's

going home and go to bed hey what's

129 the female I guess her significant
other got into it right now yeah they
got into some sort of argument or
something she she said he left and she's
like so at what point did he grab you
I'm just trying to he up on top of me
and I when you were in the bed yeah okay
and I grab him cuz don't lean on don't
come on top don't act like you're going
to come on top of me then who slept who
first Howa how probably did cuz he was
on top of you on the back I thought
intimidated was it like a slab slab or
was it a scrap get off me get off me
kind of like that yeah okay do you think
he's going to have any injuries no okay
and at that point what did he you said
he you want to be aggressive with me

we're it's okay we're not I still need
to know what happened I understand so
after you Tred to get him off of you
push me down just tell me down

like in your chest area or hands my back
like I flipped over to protect me I

call us and at what point and I just I
get my phone my watch and I okay so call
you called through the watch and when he
heard you calling that's when he left

so I you know when I see a baldheaded
white man with a big belly the officers
escorted her back into the room and
completed their investigation I think he
was just over the top had too much all
day or whatever I was just Greatful have
my watch so I can say call get him away
from me did you not have access to your
phone or what did you use it's in my
purse okay so sorry to bother you guys

door if he comes back just give us give
us a call right away or front desk to

officer spotted the maale and was able
to get his side of the story uh so I
understand there was some
misunderstanding between you and your
lady my wife your wife yes she told me
you were not married so no we're married

she just never changed her last name no

uh actually it's our anniversary week
must be six years on Sunday okay yeah so
what happened tonight so basically well
went down to D Bal Street went to Irish
Uh Kevin ordered a Reuben sandwich and
literally it was like 40 minutes still
hav received it and so I asked the guy I
said what about our sandwich he's like
well sh be come up I said it was been 40
minutes M he said no you just ordered 10
minutes ago my wife didn't like how I
dressed it she left took an over we had
some text messages all that good stuff I
came back to the hotel room verbal uh
discussions she slapped me uh I
restrained her hands she called 911 and
I'm like I'm like are you for real I
just simply like okay I'm diffusing the
situation here so obviously I left mhm
cooled off came back haven't talked to
her since so you guys were not talking
or texting or anything not not since
I've left no you can look at my phone I
called her one time as I was heading
back over here to find cuz fly out
tomorrow out of Fort Meers got to rent a
car drive a whole n yards that that's
what happened why was the bed moved in
the room bed the bed there two beds
right and one of them when I got in the
room was like completely moved do do you
know why I have no idea no idea okay so
when you say you came back and you got
into an argument what she was she asleep
was she in the bathroom what was she
doing no she was I mean she was on the
bed she was on the bed lights were on
yeah she got furious with me and like I
said she slapped me MH I told her
because actually I was like I'll just
get another room if you go into the
bathroom we actually bought these plants
together she slammed those things in
there I didn't do anything mhm I I
nothing whatsoever so if a bed I don't
know what in reference to the bed got
moved or something okay but okay I I I I
didn't done anything she she literally
slapped me and I restrained her hands so
when she slapped you where were you I
was in the other bed closest to room to
the door or the closest to the bathroom
closest to to the room to the door to
the to the door did you come in so you
were arguing and you were in bed and she
was in bed no I I went well we we had
exchange words right and so I went to
lay on the bed okay she got frustrated
come over slap me right in the face I
might even have still an imprint from it
I'm not sure I'm going to shine the
light on you little okay you can you can
just sit normal oh yeah okay so she
slapped you like that yes so after she
slapped me and was ready to slap again I
literally held her rest to where that
she would not hit me anymore okay okay
and after that what happened after that
point I I think I packed my stuff I
literally you can see it I tried to call
her to see what's going on she is my
wife you know so but here's see the
redness on my face so she called 911 her
Act exact words were that she want
somebody out of the room mhm and I'm
like are you for real all right uh hang
out with officer H for a moment I'll be
back in a second hi I'm so sorry to wake
you okay I wasn't get in the door okay
uh are you on the phone with someone
uhhuh if you know my hang up I got to
talk to you hey I'm going call you right
back okay so the reason I'm waking you
up up again is because I was writing my
report so I see him coming back right so
I talk to him the story he gave me is a
little different so I need to clear out
what actually happened okay walk me
through it again he came home and he's
like yelling at me and I'm like get away
from me get away from me huh what was he
yelling about why did I leave him down
there and I was like just get away from
me stop go lay down get away from me get
out of my face go lay down I'm sorry at
that point you were in the bed yes in
that bed yes okay where was he standing
over top of me so I'm like leave me
alone just get away from me and I'm like
get away and just squatting at him tell
him get away from me okay and well there
was more oh yes there was more so like
walk me through everything he was like
you're not going to smack me like that
cuz I was like swatting him getting away
and he just like
gra grab my arm and like like you're not
going to do me like this I'm like just
leave please just leave so the whole
thing happened where exactly my you were
still in the bed he was on top of you
yes yelling at you so that at that point
you you were swatting at him oh and I'm
not denying that I didn't tell him to
get off of me now get away from me I'm
not the woman maintained her assertion
of self-defense but upon deeper
investigation it was established that
she was the instigator and primary
aggressor of the
altercation where uh where is your ID
again okay that's your Pur yeah okay
mean there something going on I mean
what am I dealing with why what's going
on
I'll explain in just a second can you do

to be a primary aggressor in this
altercation throughout my investigation

everybody um if you have anything
illegal on you and you're going to
introduce it to my vehicle or jail
you're going to be charged with it

arrested she is going to county in
Florida domestic violence is taken
seriously which I'm sure it is elsewhere
too but we have what's called a
preferred arrest which means if we could
determine a primary aggressor on an
incident we have to make that
arrest I know this
is not I I'm sure this is nothing that
you want to
happen know it's had
that our anniversary s Sunday Sunday
she'll be out before then

he told me you were so we're not legally
married I did not do anything on paper

ring but we're not legally married

will I see the jurge 8 or 9 a.m. what
time is it right now it's uh almost it's
almost
two and I can use my phone for someone
to come get me right yes you'll have
access to your phone uh after your whole
intake process it's not going to be
right away but once all the paperwork is
set and done they'll let

the woman was charged with battery and
spent the night in County custody do you
