He gets that he's >> Oh my god. >> Is that blood? >> I hope not. >> He will sell her, but he's also taking care of her child. Just cuz. >> I'm sorry to tell you THAT. >> NO. UH-UH. NO. NO. M. >> On January 23rd, 2023, emergency crews were called to a home where a three-year-old boy, Enrique, had been found unresponsive in bed. The man who had been caring for him, Tony, said the child had slept beside him and simply never woke up. >> Oh my god. >> Absolutely. I hear him. >> Stay calm. Follow these instructions. Do not touch the patient. >> Analyzing heart rhythm. >> Please wait. >> Did it say wait? >> It's analyzing it. >> Okay. >> Shock not advised. It is now safe to touch the patient. If needed, perform CPR as instrued. When last time start CPR, press >> where you find him. >> In the bed? >> Yes, sir. >> The gray sheet. It seemed he had thrown up. >> He threw up? >> Yes, sir. When did he throw up? >> I just noticed I went in and checked at the we got on the phone with the Mercy. >> Okay. >> And they said, "Was anything >> I guess he's in there?" So his airway may obstruct like uh he's not >> he's not cold either. >> Uh let me guess. So we took him and put him in the bed with him and then he gets up. He gets up. He's not breathing. >> You know what time? >> He said what time? He said about 2 2:00 in the morning he got up. They said he was weard. So you had pretty bad man with him. He said he blew up and everything like that and he just came he just came out and show you. Okay. >> He's not cold. He's not stiff. >> I know. What's wrong with you? >> I don't know. Didn't you sleep with you last night in the bed? >> Yes, cuz I >> I woke up and he was in this condition. Right. Right. >> What time y'all wake up? >> No. I just woke up about about 3 minutes ago if that long. >> And he was in bed with y'all? >> Yes, sir. just wasn't waking up. >> Yes, I tried to wake him up. >> Did he wake up in the middle of the night at all? >> Yeah, he was up in the middle of the night. I say about 2:00 was the last time. >> 2:00 a.m. was the last time you saw >> cuz I was asleep. Okay. >> Who is he to you? >> During the pandemic, I took responsibility for him cuz they didn't have a home. >> So, is he his father? Who is he? >> No. >> The other guardian as well. I've been taking care since he was 10 months old. >> All right. Where's this vomit that you said you noticed? >> Right here on this. >> And was he laying on this? >> Yes, he was laying. I had the pillow right here. He was laying right here. Not a lie. I can't find it. >> I said saw it. >> Oh well. I believe you. >> Is it sir? >> I believe you. Were you on this side? He's over here. >> I was here. >> He was over there. When you found him, was he laying on his back or his front? >> He was just laying on his side. >> On his side facing which way? >> His face facing that way. >> Okay. Anything covering his face up like a pillow or anything? >> No, his face was not covered. >> Laying there, honey. >> No. >> Is that blood? >> I hope not. >> He taking care of each other. As long as it's somewhere in the street. So, he's been watching the boy for over a year now. >> Okay. >> You know what I'm saying? taking care of him and all that kind of stuff like that. >> Tony told about he's I'm just here because I was going to ask that I was part I'm staying with him. >> Do you have any contact information for the the parent of the child? >> He's even watching the child. So the mama is in the streets. >> Yeah. If you want to get her number, it's his phone right here. >> He just he just handed me the phone and said it's mom. >> Can you see the number? >> Hello, ma'am. Can you give me a minute? I'm going to call you back from my phone. I'm going to get the number off this phone and I'll call you right back. Okay. Yes, ma'am. I was wondering if you could come over to uh Gibbs, maybe village reference your uh son. He had to be transported to the hospital. Right now, he's sick. So, we don't know right now. I'm waiting to hear something. We want to talk to you and see what we can find out about his medical history. Anything? Okay. All right. Thank you. >> He has a doctor's appointment sometimes. I watch the little boy cuz the mama is nowhere to be found. She's off and on. Put it that way. Can I tell you this? Yeah. >> I tried to tell him. I said, "Look, man, you can't even take care of yourself. Why are you going to take care of this little boy? >> She does not live here. >> She does not live here." Okay. No BS. What does she do? >> She's Yep. >> The way everyone's talking in the back because we had DCF come out here. >> What kind? She's falls under DCF. We have She called DCF. See, that's right. >> Okay. Right now. Are there ever any? >> I can't lie. Yes, sir. >> Where are they at? >> In this room. >> What kind? Uh, from what I know that >> I think I don't know. >> Do you see any today? >> I don't know. Anybody out there? >> Okay. >> I don't know. But if you go in this room, >> okay, 2:00 a.m. >> You're sleep on the couch. Tony wakes up. Message that you left the chicken in the sink. >> Okay. When you hear that, >> you get up and you say, "Hey, you I just when I first see him, he was in that room. >> He's in that room >> cuz Tony was in there with it." >> Okay. Where is he? Is he in the bed? Is he on the floor? >> He's in the bed. >> Is he under the cover or on top of the cover? in under the covers. >> Is he talking? >> No. >> No, >> he's not talking. >> No. Actually, he doesn't talk anyway. See, that's the thing. Don't breathe. >> He Right. He doesn't talk. When I got up, get me with the chicken. >> Go to the kitchen. >> Mess with the chicken. That's when he calls me. I go into his room like >> his eyes. >> No, he's just breathing. Right. >> I don't Well, I don't. >> Or is he just breathing normal? >> He's just breathing. Right. He's just breathing. So, you said >> right. It sound like a little pill. How you >> just like that little bit? Just a little bit. Tony said he probably we sit here. I go back. He said close my door. I close the door. >> So you close the door. >> No, no, no, no, no, no. Not this room. That room. Johnny's room. Johnny's room. I finish up what I was doing with the chicken. I sit here. I come back here. I'm watch TV for a little bit. Then I fall asleep. Next thing you know, not to I'm sleeping. He comes. Johnny. I hear him. Johnny. Johnny. I said, "What?" >> I jumped up. When he did that, I said, "Oh." I said, "What?" Next thing you know, I grab a phone and call 911. >> He won't sell her, but he's also taking care of her child just cuz. Just cuz see he the way he explained it he said he I rather him here than in them hotel shoots around the stuff she does. >> There you go. >> So Tonyy's a good guy in it. >> Yeah. Yeah. To that to that extent. But to the extent to the point where the boy should have been at school. >> How long is she here? >> She's not even here. She's in there to talk and next thing you know she's out. She's I want to say at least about 10 15 minutes. >> I'm just going to ask you cuz you're kind of painting the picture. What do you think got him sick? >> I think he gave him some medicine. I really do cuz now this happened >> medicine his medication his medication that he takes he did this one time before the boy the little boy had got to his pill and said he calls my name Johnny he's in RK's he's in he's in in Ray's mouth trying to get the pills out I'm looking >> okay so how long ago did that happen >> that happened a while that happened like say about two or three months ago >> Johnny I appreciate you buddy sir I'm just talking to you. >> What's wrong with my baby? >> We got a 911 call here and I'm sorry to tell YOU THAT. >> NO. UH-UH. NO. NO. NO. NO. NO. NO. He just said I'm sorry. He said I'M SORRY. HE SAID I'M SORRY. I'm sorry. I'm sorry. No. M. Please. Please. Please. Please. Please. Mommy. Mommy. OH, [screaming] MAMA, PLEASE. MAMA, PLEASE. MAMA, PLEASE. NO. MAMA, MAMA, NO. MAMA, NO. NO, NO, NO. I want my baby. I want my baby. Mama, no. Mama, no. No. Please get my baby. I promise. I promise. I promise. I promise. I promise. I promise. I promise. >> I I want to apologize for two things. One, I'm so sorry that this has happened to you. Right now, the other is I apologize that it's taken us a few minutes to to get to you to talk to you about this, but I promise you it's because we're doing our job and we want to do it right. Okay? So, we're taking care of things to make sure that we get justice for now. Okay? >> We've tried talking to other folks about our that happened here. So, we kind of want to get your perspective on things and what you think may have happened. Okay. >> I came here last night. It's like 12:00 1:00. Came and he was already sleeping and [laughter] that's it. And I heard him snoring. I heard I thought he was awake because I never heard him snore. He never snore. So, I thought he was awake. So, when I walked past his room and I said, "Is he awake?" Cuz I thought maybe he saw me and he started whining. So he was like, "No, he's asleep." And it sounded like a like he was like like he like a bird or something. >> So and I kept hearing it while I was here. So I'm like, "Are you sure you're not woke?" He like, "No, he's asleep." And he was like he stayed in the shower for a really long. He likes to shower. So he stayed in the shower for like an hour and a half. He said he stayed in the shower. And he said that when he got out of shower, he was walking around eating Froot Loops and like he was walking in circles, but he was like sleepy, but he was trying to keep himself awake, I guess. [snorts] And he'll go lay down and get in his bed by himself. And I left and that [clears throat] was it. And then I'm so sorry. >> We'll start with this. There's nothing to show that anybody hurt him on purpose or anything [clears throat] like that. He's he's not beat up or [snorts] anything like that. Okay. >> Okay. When we deal with children who die unexpectedly, >> um it's typically one of a few different things. You know, one is an underlying undiagnosed medical issue. >> Um another in this age bracket is that maybe they ingested something that hurt them. >> Okay. He's three and a half, right? Okay. Um so we're not looking at, you know, the co-sleeping or anything like that. So as far as his medical history, are you familiar with any medical issues that he has? >> No, I don't. >> Okay. Does he have a doctor that he goes to regularly? >> Pediatric Dr. Ed Peters >> when he stays over here with Tony. Um does Tony have help with looking after him at all? Does anybody else? >> Yes. His best friend um Johnny. >> Okay. Yeah, we talked to Johnny >> when I come and I bathe him and I help him feed him and like other than Yeah. But Tony mainly and then he has two god he has a god a god sisters that come over here sometime and he goes to their house sometimes. So, as far as medical stuff, he had no known medical issues at all. No known health problems. >> Okay. >> And that was my first time hearing of the story, so it kind of not really alarmed me. It was unusual. >> Yeah. And so I don't know, like he never had any really problems. >> Okay. >> He said you could hear him snoring and that kind of like >> Yeah. >> Um were were you in his room or outside of his room? >> Outside of his room. >> Outside of his room. Did you go in the room at all? >> No, ma'am. So, I I know that we talked about medical stuff. Um, and I don't know if you know this, but Tony was so upset over everything that he got into like hyperventilating. He had a panic attacked up to the hospital, too. So, he's like sedated up there. We haven't had a chance to talk to him yet. >> Um, he is obviously very distressed by what happened. So, >> what I feel bad about is because we can't talk to him yet because he is sedated. We don't really, you know, have details from him about So his best friend wasn't here. >> He was, but he was on the couch. So >> where was Ray? >> Well, Enrique was in his room and then Tonyy's room. So we're trying to figure out what happened. And what happened? >> Did not talk to me. >> All I know is Johnny called me, but I didn't see the call. I didn't call him back because I figured he called me because I had called him last night when I called his phone that because Tony wasn't answering when I first got here and so I called Johnny's on Facebook. So I fig maybe he saw the miss call and he just called back. >> Do you have any concerns for him? >> No, I think take very good care of him when I see him. He's healthy when he does wellfed like he always um when he bring him around there for us he always make sure he packing Pampers, make sure you got his his favorite snack. He drank a special water. So he would always make sure that. So I had no I had a good dad. >> Yeah, he was taking care of a good caraker. He had, you know, bedtime at a certain time, you know. He even had him go into the little jumpy thing like a regular little thing so he get exercise in and be coing with other kids and stuff. I really didn't have I don't like Ace, but his parenting skills didn't have anything about the relationship that we got together. But I thought he was good. >> Sure. So other than personality, he's doing a good job. >> Right. >> Any hazards over here you're worried about? I never been in this house. >> Oh, you've never been inside? >> I never been inside. >> Been here? >> Yes. If Yeah. It's all up in here. >> What? >> I don't know if they sell my what they sell, but it's history. >> Is Ace involved in any of that? >> I hear rumors, but I can't say for certain cuz I never seen nothing. >> At some point, we're going to search the residents and look for any hazards. What rumors have you heard? It might help me. I understand. He was a >> Yeah. >> But I don't know to what effect that is. DCF investigation one time with the um because he was born with like marijuana system. I guess after they did the umbilical cord. >> Oh, okay. >> It was concerns for what other was in there because it was untraceable. But um they kind of just closed it out, gave some resources and closed it out. But basically cuz he was at my house, they felt like I was safe at the time, you know. So that was it. And I know DCF been around here a couple times when they be arguing and fussing about who going to keep him and this that and the third. But I never she most kind of kept me out the loop of that kind of stuff. So I just hear rumors, you know? >> Anything far as like chemicals and stuff and he normally keeps that out of cuz RK is where he does put stuff in his mouth. He'll pick it up. You feel me? >> Where does he normally keep like the chemicals and cleaning stuff and stuff like that? Um, and the like I know that sometimes he has the bleach on the floor in the kitchen under the sink, but Enrique's got in so much trouble about that he she probably doesn't touch it anymore. >> He never said anything to you about him and Johnny fishing medications out of Enrique's mouth. >> No. >> Okay. Again, this is coming from Johnny, so I haven't had a chance to talk to Tony about this. Um, but that's something that Johnny described us, which is obviously concerning. You know, as a mother, I'd want somebody to tell me if that had happened. Um, are you familiar with any medications or anything that Tony would have in the house? >> I mean, he takes medicine. >> Do you know if Tony does anything other than And again, we're just going to go in there and look. It doesn't matter, you know. >> I mean, I don't know. I know. He just wants to >> Is there anything else that that we didn't >> Oh, I thought that was Mley pulling up and that's you. I done hung up on her. >> Excuse me, y'all. Enrique was rushed to the hospital, but he could not be saved and was pronounced that morning. Tony, overcome at the scene, had suffered a panic attack and been taken to the hospital himself where once he was treated, investigators sat down to question him. >> Can you kind of tell me what happened? How the kid got sick? >> You want me last time? Last thing I remember him eating was some >> What time was that? >> 10 something. He had just a little bit of food just at night. Yeah, he just had >> this morning. >> No, last night. >> Last night >> he was sleeping. I said, "Man, you can go to sleep." I got to tell him he can go to sleep cuz he kept laying on my bed. I said, "You get in the bed and lay down." >> Is this something that normally happens? >> Yeah. Yeah. Yeah. Yeah. Yeah. Ain't nothing normally happen. Just laid him down and he he went on to sleep. So this one I woke up uh five of them. He was still asleep. So then I took medications. >> Four medications. >> I put back to sleep. I took uh normal um diabetic medication and have a blood pressure medication. I woke up it was like 7 to get up put him on the party cuz I potty trained him if I lay down too long. >> Yeah. So, let me get it. Couldn't get on the party. He never responded. Call the Amberland. Then we talking to the the dispatcher. >> You think that was at 8? >> Yeah. I think that was at 8. >> I mean it's noon now almost >> noon. >> Mhm. Right now it's 11:45. >> I don't think the lights went out last night. So the clock wouldn't have been reset. I think it was about 8. Well, my my roommate, he called the 911 dispatcher. I thought it was 8:00 on him. >> So when you woke up this morning, it looked like he wasn't feeling good or was sick or something. What? Then when he sees it, then he reach out. He get on up and you know he got time to go to the party. He didn't do that. The lady on the phone, she said, "Lay it down." Police showed up. Ambulance show up. >> Is there anything at the house the kid could have gotten into your medication? Any alcohol? >> Really? Cuz like my medication headboard on my bed cuz he got his own room. So if I'm in my room, he'll come, you know, play thing. We going to play. Well, last night I said, "You want to get in my bed?" He kept climbing up on my bed. I said, "You going to lay down in the bed?" When like it was 10 months and stuff, he used to sleep with me. He always like playing and jumping in my bed. When he went to the party, that's when he got in my bed. So then I said, "Well, I thought you were asleep." That's when I laid him in my bed. >> Is there any at your house? >> Okay. Could he have swallowed some of that? >> He couldn't swallow. >> He doesn't go after that. That's >> No, he don't even mess with my pills. >> Doesn't mess with your pills or nothing. Okay. >> Tony told them he had no idea how the boy had fallen ill. He'd taken his own medication and fallen asleep with Enrique beside him. 3 days later on January 26th, investigators returned to the apartment where they had found several kinds of unsecured to question him again. >> Did y'all have a romantic relationship at some point? >> Yes or no? >> And was that brief or was it a long ongoing relationship or was that? >> Well, what you consider brief? >> Was it like a month? Was it like years? >> A little bit longer than that. Like 6 months. >> Six months. Who's the father? >> The father. >> Okay. Does have fathers? She told me um God who was father was you know she would tell me different things but she just got to the point where she couldn't maintain >> couldn't maintain for him or couldn't maintain for herself or both >> both it was like an ongoing battle trying to help her and trying to help him and trying to help her. So it got to the point where I just couldn't help her. I had to just try to help him. She came to me and you know she said she couldn't do it and I had already been in his life. You know, >> there's no doubt you cared about him. >> He said behavior-wise, I know the, you know, the nonverbal um would be something they would bring up, which you >> Oh, but he he it's not like he was nonverbal. He just didn't talk to her. >> Gotcha. >> Would he talk to you? >> Of course, if I did something, I don't think I did anything to him, but hell, I want to know what happened to him. >> I know this sucks, but we're waiting on the medical examiner's office cuz I got to run all their labs before they tell us anything. And it'll probably be like four to six weeks. >> Can you help me understand what happened the night that he got sick? >> Yesterday I took my medication and my medication makes me sleep. >> Which medication was that? Your medication. >> About what time would you have taken that? You take it the same time every day. Tony, >> no sir. No sir. I ain't taking sleep. No sir. >> Johnny described a situation where got in his mouth push him out. Yeah, I have to refresh my memory on that cuz I don't remember him getting no pills in his mouth. >> He said that um it was a time that Johnny was over here. He said it was maybe 2 3 months ago. >> Yeah. >> I can't imagine why he'd make it up though. >> Yeah, that's what I'm saying. >> Makes sense. >> That don't make no sense. >> He doesn't have a dog in that fight, you know. >> Exactly. >> Tony, we're just trying to >> No, I understand. That's what I'm saying. >> It seems to me like that most likely happened. There's no reason. >> No, I'm not saying it didn't happen, but why would I Why couldn't I get the pills out of his mouth? Cuz kids squirm shaking them, >> right? Shaking them. I've been looking for them. It was brand new pack of Tylenol release kind >> to get into them, but he would use them like a shaker. >> Yes. >> Is that something that he still does? >> No, he got enough stuff to make noise with. This was when I first met him. You know, >> my biggest concern is that, you know, all those medications that were in your room and I they're necessary, you got to take them. The biggest concern is that they're not in child resistant caps. >> They're within reach that he can reach them on the nightstand or you can be on your bed and get him. That's what I'm worried about. >> Do you think he could have gotten some pills? >> I don't think he would have. Honestly, it had got to the point like if I leave out my room, I go use the restroom. I know I'm being in the restroom for a minute. I would shut my door. He's not going to open my door. >> The night just happened. Did you Was there anything that stood out to you that could make you think that maybe he got some pills? Was there a cap off? Were there any medications missing? Did you notice anything out of place? >> No. That That's the whole thing. >> If I'm a three-year-old, I'm not going to I'm not going to be sneaky and try to put everything back perfectly. Like you said, I mean, I'm playing with it like as a Was there anything out of place to you your medications that you remember? Cuz we're really we're just trying to figure out what happened. And I respect that. And I I will be the first one to tell you. But I don't >> cuz like she said, it's got to be choking. There's no signs of choking. So it's either something that was likely something. I not me, but in my experience, something that was ingested or some sort of defect that was undiagnosed, which you know, 2023. I mean, it's possible, but of the three, the ingesting is what we're probably what we're thinking is the most likely, >> honestly. Um, again, there's a lot of testing that needs to be done, but we're just, you know, it's not normal for this to happen to a 3-year-old. Thank God cuz it's a it's a tragic thing. So, we don't live here. I can tell from talking to you today, sir, you cared about him. You really did. And I think you're you're trying to help us get some answers. If there's anything you can think of, please be honest with us. >> I'm being honest with you. I really whatever, like I said, whatever comes, I pray he hadn't got nothing to mine, but I can't say that he did. I'm going to ask about this just because obviously you did a search of the house. You did a search of your phone. Okay. I am aware of the sorts of activities you're doing out of your house. Is there any possibility that he got into any narcotics? >> Not [clears throat] from me. I'm going just say that. So that's why I'm saying it ain't necessarily got to be from me. Everybody get high. >> But Tony >> Johnny get high. Cam get high. I get high. Everybody get high. >> Does anybody Cuz I I know where you keep yours. Okay. It's out of reach of the kids. If somebody were to leave something with Henry to the child, who would it have been and what would it have been? >> That's what I'm saying. I can't say who would have been. >> Is it common for Johnny to keep his dope in the bottom drawer? It's your house, man. >> Right. But I don't, like I told you, 90% of my time is spent in my room. That's why my room is set up like it's set up. If it was on me, I'm willing to take it as a man because I love that job. I would never have >> Let me ask you this. Do you think you did enough to protect him, to keep him away from that? >> Obviously, I I didn't I didn't do enough to protect him, period. >> Sorry. >> And that >> Thank you for talking to us. That gives me a lot better understanding. When I can get you updates, I will. >> Weeks later, the medical examiner delivered the answer investigators had been waiting for. Enrique had of toxicity after ingesting a lethal dose of the Tony was charged with aggravated man of a child. After an initial mistrial, a jury convicted him and he was sentenced to 20 years in prison. Enrique's mother, Cameron, who prosecutors said had bought at that same home the night before her son, was convicted of the same charge and sentenced to 19 years, followed by 20 years of probation.
