The baby's gone. >> On the bottom side, I don't see cold. >> She's super yellow. >> She's not breathing. She's not moving. She's all blue and purple. >> I see the throw up in the bed. I don't know what happened, but she keeps giving her milk. >> So, why did you tell Sarah to put Aurora down? >> Cuz I I could tell Aurora was no longer with us. >> On December 6th, 2024, officers responded to a residence after a young family member was found unresponsive and not breathing. She was pronounced and investigators began questioning the adults who had been in the home overseeing her care overnight. >> I can't talk to you. I got to let you go by too far. >> Yeah, >> I'm the roommate. She was fine last night. She came in. Her mother sleeps in that bed. >> Oh, them baby's gone. >> Too far. I think that's what they said. On the bottom side of the cold. >> She's super yellow. >> Here to confirm it. Let them take care of it. Who's inside? I don't know. >> Tom, who's here with you? >> Her uh mom. >> You live here? >> I do. >> Said he's a neighbor. >> Oh, you're a neighbor. >> No, I live here. She's roommate. >> She's actually right in the bathroom. I shut the door. >> It's a child. >> So, you're Sarah? >> Yeah. >> Is this your child? >> Yeah. >> Who's the father? >> The father's not here. >> When's the last time you saw her? >> I saw her about 3:20 right before I went to work. >> 3:20 in the morning. [clears throat] 3:20 p.m. And who's been here with her? >> I was his wife and him. They were here last night while I was at work. >> They stayed the night here? >> Yes. I came home after work at around 11:30 is when I got home from work. >> Okay. You're home at 11:30 p.m. last night. So, when's the last time that you actually seen her? It's about 3 4:00 this morning. Was she up and talking and moving? >> Does she have any medical history at all? >> No. >> Healthy baby healthy kids? Any like pre-term? >> She was 7 lb 4. So she wasn't pre-term. >> Did she take any medications every day? >> No. >> No allergies at all? No. >> So it was 4:00 a.m. this [clears throat] morning. You left traffic for >> Have you been here since 4:00 a.m.? >> Yes. >> Where were you, though? >> I was sleeping. I slept in till about 10:30. >> Still sleeping on think anything of it. >> Is that normal behavior normal for her to sleep in like that? >> Okay. I go to wake her up because we're about to leave late to go shopping and she's not breathing. She's not moving. She's all blue and purple. >> Were you here alone? >> No, he was here with me. >> So, what was the 3:20 p.m.? Was that yesterday? >> That was uh last night. That was before I went to work. She was f perfectly fine before I went to work. Him and his wife had her when I was at work until I got home. So, you left work around [clears throat] 3:20 and got back around 4:00 a.m. >> No, 3:20 p.m. She left for work and then >> I got back around 11:30 p.m. >> And she was still okay then? >> Yeah. >> And then you checked on her again at 4:00 a.m. >> Yeah. >> So, you called once you realized? >> Yeah. >> The mother told officers she left for work around 3:20 the previous afternoon and returned home near 11:30 p.m. checking once more around 400 a.m. before finding her unresponsive close to 10:30 that morning. She said her male roommate and his wife had cared for the child while she was at work and that the roommate was present when she made the discovery. Officers moved to speak with him next. >> You said that you live here. >> I do. We go outside. Yeah. Yeah, absolutely. >> Is this your girlfriend? >> No. She woke me up screaming. I've never dealt with this man. I don't even want to be here. >> Do your best if you can. You We've spoken over the years. You know, we have to ask a million questions. Just as best as you can. What What happened? >> I don't know. She was in bed. Sarah's got home from work. Sarah said she was fine. Everything's normal. The kids are in bed. They share a room with her. Sarah then went to bed. Woke me up this morning. We were getting ready to go shopping. Then she screams, "Get in here." Aurora's not moving. >> So, is there is there two bedrooms? >> Yeah. >> Is there two children? >> Yeah. Her and her kid and then my child, which I've got him upstairs right now. >> So, you and her are in one room and the children are in. >> No, she's in a room with uh her kids >> in your >> living room. Where does she work? >> Walmart. >> Overnights? >> No. She was home at 11 something last night and everything was fine last night as far as I knew. Yeah, everything was fine. My wife babysat. Everything was perfectly fine. Aurora threw up in the living room. I took a picture and sent it to Sarah. See, her daughter was perfectly fine. She threw up. I sent a picture of it to her dog to her. My wife babysits I don't. >> Okay, that's fine. >> My wife is on her way. >> This is the rundown. She left for work at 3:20 p.m. Left her the baby in the custody of mom and she got home at 11:30 p.m. and the last time she made contact with her mother was at 4:00 a.m. She had to go up and go to the bathroom. She wasn't sick or anything like that. So, she didn't wake up until 10:30 cuz the baby normally sleeps in and then she called at 10:52 when she was purple and numb. >> That's about it. She hasn't really been like sick or anything like that. >> Has she been eating? >> She refuses to eat quite often. Do you guys want my monitor time for the time of >> Yes. What was your time for [snorts] >> without knowing anything in a situation where there's unattended? >> It could be an hour, could be 2 hours, it could be. But if we're worried this is going to get cleaned up if you're worried about >> No, no, no. I'm just My kids are going to be coming home and I don't want them walking into this situation. But I understand there's procedures. >> Is there a place at somebody else's house they can go to? I could try. >> No people coming. Okay. >> She going to be okay. >> I know people haven't talked to you yet. They're going to talk to you. She's passed away. Do you have like a a thing where you can set her in? Are you going to be okay or want one of us to take her? Are you good? >> Yeah. >> So, we're going to have detectives coming in. A lot of people are going to be asking you questions. Okay. I'm sorry that this has happened. We'll make sure we get any of the services you need. >> I just let her stay in my apartment. She lost her blade. She's not doing good. >> Okay. >> What did they say? They're considering it. I can hear Thomas. Where were you today? >> Bed sleeping. >> The bed's sleeping. >> Like I just got up. She woke me up. We were getting ready to go shopping. >> And she's a friend. >> Just a friend. >> How many rooms are in there? >> Uh, two. No, there's more, but there's more. There's the other side of the house, but I got the dogs running around in there. >> Okay. >> Do you think it's a good idea for her to be holding her daughter right now? >> I'll just say I could take the baby cuz she's kind of trapped in the bathroom. >> If she would like to relinquish her, then then yeah, she's comfortable holding her. comes at home at 10:30 p.m. Did you go back in there? >> Yes. Okay. >> I go in every night when I get home from work and check on them and make sure they're breathing and everything. >> So, you got home last night? You checked on her. She wasn't cool. >> No, she was breathing. >> So, at 4:00 a.m., how did she see? You said that she got up. >> She was awake running around acting normal like her normal self. >> At 4:00 a.m. this morning. >> Yeah. And she went potty on her little toilet. >> She's cleaning. She came in at 11:30 p.m. checked in. She was fine. At 4:00 a.m. this morning, she was running around in here. >> This child at 4:00 a.m. was running around. >> That's what she's saying. And then she went to use the potty and then she went back to bed. I don't believe. >> Can you see my eye twitch? >> Yeah. I don't believe that one day. >> What was the first thing that struck you as being wrong with the situation? >> Just like soon as I walked in here, like you could just tell like just instantly like baby wasn't moving at all. Was super yellow. Kind of tearful, but not really. Comparing accounts privately, officers questioned the mother's claim that the child had been alert and using the toilet normally around 400 a.m., calling it hard to believe. One recalled that upon first entering the residence, the young family member appeared motionless with an unusual yellow discoloration. >> You woke up what time? >> I woke up like 4 this morning and Scarlet another bottle and then I checked on a word. She's perfectly fine. Told me she needed to use bathroom. I brought her in here and that was around 4:30. Yeah. And that was the last time I saw her awake. I thought she was just sleeping in after waking up at 4:00. But this morning, we were getting ready to go to the store. Got to go in there [snorts] and check on her to wake her up and turn her over. She's blue, purple, not breathing. >> What time was [snorts] that? >> It's about 10:30 this morning. >> What position was she in when you checked on her this morning? She was laying on her stomach. >> Where was her head located in the right area? >> In the corner. She was like laying sideways [snorts] like she is now. >> So if I'm in the room looking here, is it the far left? >> Does her head like facing this way? >> Sick at all lately or anything? >> No. >> No sickness at all? >> She's been thrown off because she anytime she has dairy or like anything that has milk in it, she'll throw it up. and she's been refusing to eat anything [snorts] I put in front of her. >> What was the last thing that she ate? >> Eggs and pancakes I made around like 10:30 yesterday morning. >> Yesterday morning. Yeah. So, the last time she ate was yesterday morning. >> And then they had her [snorts] lunch around like 2:20. I don't know what she ate >> cuz I was leaving for work around that time. >> Okay. But from the time you got back um from work, >> she had dinner. She ate two hot dogs. That was around like 5:30, 6:00 when we usually eat dinner. >> Okay. >> But I was at work. >> Why am I being taken down to the station? Am I in trouble? >> No, I didn't do any of that. I was sleeping. >> Let's talk. This is normal for situations like this. Not even if it's a child. Everybody's going to be here because it's an unattended. So, everybody's going to get removed from here and there's really no place to work. So, that's why it's not you're not in >> What do you mean everyone's getting removed? >> Well, it's because it's an unattended. We basically take over the house and has to be investigated. >> Does my wife need to go down to the station, too? >> Was she here last night? You said she was babysitting, right? >> Yeah. >> Yeah. Cuz you were here. You saw her. She was throwing up. That'd be important. >> The mother had by then described the child's ongoing feeding issues and a possible dairy sensitivity along with her account of the morning. Officers told the man he was being brought to the station as standard procedure for an unattended investigation, not as a suspect, and noted his wife would likely need to be interviewed as well since she had witnessed her vomiting the previous night. He is now being transported for a formal interview. >> Your wife, are you guys splitting up or you just What's the living situation? Cuz it seems kind of I I didn't get a great grasp on [clears throat] what the living situation is. >> Okay, so I had an affair on my wife with Sarah. >> My wife is aware of it. >> Yep. Sarah then needed a place to stay [music] and me and my wife kind of let her. >> It's also the understanding wife. >> Yeah, I was dumb. My wife has been telling me to get Sarah out of the house for month now, 2 months almost. And I was like, she's got nowhere to go. She's got the kids. She's got nowhere to go. I don't really know much, man. >> That's all right. >> My wife babysits. I refuse to. I won't watch her kids. They don't really like me much. The kids, >> why don't they like you? >> I don't know. I don't know. I'm more worried about my own kids than other people's. So, the reason I don't watch the kids or allow myself to be left alone with them is I am on the registry. >> What level are you? >> One, everybody knows I didn't do it. Everybody, the girl admitted it, but I waved my right to appeal. >> How old was the kid? >> Uh, she was uh 14, I think, and I was 18. She was touched by another person, and that person and me didn't get along, so somehow I got blamed. Well, I had Matt Porter as a public defender who told me that if she goes on stage and cries, I'm going to lose. That my best bet is to take uh 6 months in jail, 10 years probation, plead guilty and wave my right to appeal. Couple years later, it came out that I didn't do it, that the other person did. He got arrested. I took a picture. It's got a time stamp of Aurora. She sat there on her knees and she threw up. I took a picture and sent it to Sarah and I said, "Every time you give her dairy, she throws up." >> Yeah. Can I see that? Yes. I hate you feeding her dairy this morning. And this was at 3:45. And that's her sitting there. >> What room is this? >> Living room. >> Did you talk to anybody else over the phone? Um, text message, take any other photos about what happened at the house? >> No. >> I didn't think anything of it cuz she throws up all the time. >> Uh, nothing from this morning. >> No. I got woke up and we were going to go for a um a ride to [clears throat] Walmart to go shopping for groceries because we get food stamps. I asked Sarah because my son was in the bed and with me. I said, "Can you get me a pair of clothes for him?" She went in the bathroom. She goes, "Yeah." Then I'm going to wake up Aurora. Had she been laying there a while? >> I don't think so, but that's tough to say without >> I was just saying a better look. >> Well, she had been moved completely. Sarah was holding her. >> Do you know where she was originally? No, she was just in her bed. I don't know her position, but I know that when I went in there, when Sarah yelled to me, Sarah was holding her. Okay. I said, "You've got to put her back down right now." I left and I called um 911. >> The man disclosed that he is a registered offender stemming from a case at age 18, stating he pleaded guilty on his attorney's advice and was later exonerated after another individual confessed. He also presented a text message and photo from the previous afternoon documenting her vomiting, which he said he'd sent to the mother, citing a possible dairy reaction. He described entering the bedroom to find the mother holding her in a repositioned state before telling her to put the child down and calling 911. Investigators now turned to his wife, who had been babysitting the night before. >> So, who is the female with the two children that's residing with you and Tommy? Sarah is my adopted c. Well, not technically adopted. My cousin adopted her brother. Like the family dynamic. We called her our cousin. >> Okay. All right. It's fair enough. Um, so how long have you known Sarah for? >> I've known Sarah just over 2 years. I met her right after Aurora was born. >> Okay. And when was it that Sarah kind of moved in with you guys? um she did not move in with me. My husband and I separated. >> Okay. >> Back in end of March, beginning of April. >> Okay. >> And then in May, she had moved in with him with obviously my profession. Okay. >> I live with R.J. my roommate upstairs in the apartment too. >> Okay. So then Sarah moved in with Tommy, but you had like gave the blessing like it's okay to do so. >> So originally Sarah was living upstairs. Okay. With R.J.? >> No. Okay. I moved R.J. in after I took over the apartment. >> Okay. So Sarah was living upstairs. You took over the apartment from Sarah for any particular reason? >> My husband and I separated, >> right? >> And um because of the uh situation, we decided that it would be better for me to stay close. Um because we wanted to co-parent as seamlessly as possible. Me and her just kind of swapped apartments. Okay. She moved in with Tommy downstairs and I had moved in upstairs. >> Does Tommy and Sarah have any kind of relationship >> in the past? >> In the past they have, but currently no. >> Okay. They're platonic currently. >> Yes. >> Okay. And how long have you guys been babysitting for Sarah? >> I've babysat for Sarah for a over a year and a half. >> Okay. So, you know both kids pretty well? >> I do. [clears throat] >> All right. So, one of the children was a little bit I'm just going to use underdeveloped. It's probably the wrong term, but I'm a guy. Uh, one of the kids was underdeveloped or underweight or not where they should be for their age. Was there any other issues with this child? >> With the baby, as far as I know, there has [clears throat] not been any other diagnoses or health problems that have been raised by the doctors. >> Okay. Have you noticed anything else with the baby? Is it like a fussy eater? Is it like only specialty formulas? So, it I know she originally when they noticed that she was starting to not be where they needed her for the weight, they did switch her to a specialized formula. Um, she was doing good on that for a while. Her last appointment, as far as I know, was the one, well, not her last appointment, the one prior to that was when they had admitted her. At her last appointment, it was a followup, I believe, for the admittance to the hospital. But this was only concerns for the baby, >> for Scarlet. >> For Scarlet, not for Aurora. >> Aurora's had concerns with her eating habits and um problems throwing up. The doctor had been aware of the situation. Um they tried uh this is something unfortunately that she's been struggling with with for months, a couple of months now. So then they thought it was a full out milk allergy, not just like lactose intolerant. Um, so they [music] switched all of the stuff to lactoseree, dairyf free. Some days she would eat whatever you gave her. Other days she refused to eat anything, even if [clears throat] it was something she liked. There would be days where she would eat and throw up. There would be days where she wouldn't eat and throw up. There would be days where she would eat and be fine or refuse to eat and be perfectly fine. >> Ever seen her with any marks or >> she's kind of a stumbly kid? >> She's two. So >> yeah. So she trips over stuff on [clears throat] the floor, missteps on the sofa, falls off [music] a few minor but like no signs of or anything like that. Sometimes they'd be like on her elbow or on her knees, her legs, like running into stuff. Um, I know she's gotten a few on the forehead from bonking her head. In the past, we went through a headbutting phase and she had one for like 3 weeks that was about this big. >> Okay. So, you're down there. There's Tommy, yourself, three kids. You said Aurora is fine at this point. Describe what fine looks to me. What's she doing? So, she was sitting on the floor wrapped uh with the blanket around her. And >> can you tell me which floor? >> Uh the floor in the living room. >> Um okay. So Aurora's there. She's got a blanket around her. She's on the floor. >> Yep. She was playing with a couple of toys just sitting quiet. >> Toys were. >> One of them was It's a cube and it's got like nuts on it and little like rubber strings and you have the different shapes and stuff that you pop inside and it rattles and stuff. Um, she was playing with that and then she was playing with I think one of the plushies, one of the stuffed animals. Um, but she was just playing with them. Sarah got ready for work. She didn't even notice. Sarah had left and she got a little upset at that. >> Is that a normal thing? Does she normally get upset when Sarah? >> She does normally get upset. She kind of she doesn't really cry, but she does the mhm whine. After a few minutes, she was perfectly fine. She had calmed down and stopped making noises. She was went over to the toy box and was looking for other toys. I had gone upstairs while I was cooking [clears throat] to um let R.J. know that I had started dinner. >> Okay. >> While I was talking to him, Tommy had called me and told me that Aurora had thrown up. He said that she was just sitting there. Paige had walked over. I believe >> Paige, your 17. >> Yep. My 17-year-old Paige had walked over to her to say hi, see what she was doing. And she had thrown up. I had told her, "Bring Aurora to the bathroom. I'll come right down." Um, so Paige had move taken Aurora into the bathroom. She had left Aurora there to go clean up the living room floor while I took care of Aurora. >> What color was it? >> Like a yellowish brown, I guess, which would make sense if it was like eggs or whatever. Kind of yellowy. and then whatever she had to drink or whatever else with it. I asked her if she was okay and she said she uh was sleepy. So, we told her to sit on the sofa for a little bit. She sat perfectly quiet just watching TV for a little bit. About an hour later, she asked if she could go take a nap. She said she was sleepy and I said, "Okay." So, she went >> around about what time that was. >> Uh, that would have been, let's see, about 5 5:30. I had let her go to bed. When dinner was done, I was about 6:00. I went in and checked on her. She had already fallen asleep, but since I had turned the light on, she had >> Where was she? >> In the back bedroom. So, when you first walk in the front door, it's the door to your right. >> And that's where she normally sleeps. >> Mhm. And then Sarah usually sleeps on the big bed. And then there's a crib which is Scarlet. So I I laid Scarlet down because she was getting kind of fussy. She holds her own bottle now. She has gotten to that point. So I left the bottle with her. She was drinking it. Um since I had turned on the light, I checked on Aurora and she kind of just looked at me and said good night. I left them alone. Sarah got home after 11:00. Um it was about midnight, 12:30 when I went upstairs. I had to work super early this morning. So, I left Daryl downstairs with Tommy. Okay. >> And then I got up this morning, six o'clock, went to work, didn't stop downstairs at all. I wasn't aware of any situation until my husband called the store. >> So, do you or uh Briana watch her kids while she's at work? >> Briana watches them. There's been very few times I've ever been left with them. >> Do you know how old Aurora and Scarlet are? >> I don't know the exact, but Aurora is two. Scarlet is not quite one yet. Take me through whatever you can remember from when Sarah left for work yesterday. >> Right up through until we walked in the door. >> Everything was normal. Aurora was sitting on the floor. She plays with my son. Sometimes she goes over on the couch and I'll just cover up with a blanket. She threw up around. You have the screenshot. And I took the picture immediately and sent it to Sarah. >> So, what did she have for dinner >> last night? We had hot dogs. I don't remember if she even wanted to eat. She's being watched by the doctors for being underweight. Okay. Because she doesn't like to eat. Aurora being lactose intolerant. So, if she has milk, dairy, or stuff like that, she gets sick. Sarah gave her eggs and stuff for breakfast and I believe that's why she threw up. >> How was Aurora's behavior after she threw up? >> Normal for her? Like, she's not a loud kid. >> She's quiet. So, nothing different. She said her belly hurt and then she went and laid down. >> Where did she go to lay down? >> In her bed. >> About what time is that? Like lay down for bed or lay down because her stomach hurts? >> Just laid down cuz her stomach hurts. She likes to go and lay down in her bed. >> Okay. >> Now, the room isn't really that cold. The the front door was wide open. That's why it was really cold. >> There's no heater vent in there. So, the heat comes from the bathroom, which has a heater vent right there. >> Got it. All right. Was anybody watching her when she was in her bed? She went in there and laid down. My wife was babysitting and she went in periodically and checked. >> Okay. Do you know about how long she was in her bed for? >> No, not offh hand. >> Uh, did she ever come back out of the room? >> At one point in time, she came out, got her diaper changed. >> Okay. You know about what time that was? >> No, dark out. But that's after 5. I was playing my video game. Like I said, I don't watch them. My wife watches them. So, I worry about my kids. My wife worries about them. What happened after she came out to get her diaper changed? >> She just went back to bed. >> So, she was in bed for quite a while then. >> Yeah. My wife um brought Scarlet into the room and checked on Aurora, too. >> So, she's not back there just by herself. We keep all the doors open. >> And my wife goes back and periodically checks on her. >> Were you awake when Sarah got back home? >> Yes. >> So, you recall her coming home? >> Yes. >> Aurora or Scarlet wake up when Sarah got home? >> Scarlet did. I know that because Sarah came out, made her a bottle. Aurora, I don't know. Once Sarah comes back, she watches them. I don't know if Aurora woke up or not. >> So, after Aurora went to bed, did you see her at all for the rest of the night? >> No. I'm in the living room and then I went to bed around midnight. My wife went to bed and got up and left for work. She had to be to work, I think, at like 6:15. She or 6:45. She had to get picked up by the cab at 6:00. But once I went to bed, I didn't get up until about 10:00 this morning. 10:28. I called Milton to see if he'd be able to give us a ride to Walmart. And I was still laying in bed at that time. He is the one that has my children right now. >> Yep. >> I was trying to set it up for me, Sarah, and three children. Sarah went into the room to wake up Aurora and started yelling for me to get in there. >> What did Sarah say when she went back to the bedroom? She [snorts] screamed for me to come in there. Tommy, come here. At the top of her lungs. I said, "What do you want?" And she yelled that Aurora was blue. So, I ran in there. She had moved Aurora, flipped her over, and was like holding her up. I said, "You've got to put her down." And I went back into the bathroom, pulled Sarah out, and I called 911. Then you guys showed up. >> Where exactly was Sarah? Like, where was she? Was she sitting, standing, >> leaning over Aurora? She was holding her up like leaning down. >> Okay. So, so she had her like propped up or was >> So, why did you tell Sarah to put Aurora down? >> Cuz I I could tell Aurora was no longer with us. >> What made you think that Aurora was uh Her lips were purple? I called 911 immediately cuz Sarah was saying Aurora wasn't moving. She was holding her and she was just laying there. I feel like this probably happened because of Sarah. >> What do you mean it happened because of Sarah? >> The baby threw up. Okay. I seen in the bed there was throw up. I seen the throw up in the bed. I don't know what happened, but she keeps giving her milk. I don't know if they're related or not, but even right here, I took a picture of her right when she threw up and she looked at me. The poor baby. Are you not allowed to see it? >> No, I am. I don't necessarily uh get any satisfaction out of it, though. You know what I mean? >> I'm sorry. I'm sorry. >> No, you're good. >> I literally said that to her. I hate that you give her dairy. And then she tells me I fed her eggs, sausage, but Sarah sneaks her milk all the time. >> Sorry. Do you remember if Aurora was cold this morning when you touched her? >> She was. >> She was. I thought you said that you didn't touch her, though. >> No, I don't. The room where Sarah was the bed. She was right there. I only touched her enough to tell Sarah to put her down. That's >> You touched Sarah or you touched Aurora? >> I think Sarah and Aurora. I'm sorry, man. I I forgot to say that. >> So, could you explain that to me? >> As best you can remember how Sarah was holding Aurora and then how you how you grabbed onto them. >> So, the bed would be like this. Sarah was like holding her up a little like up at an angle just like and I put my hand on Sarah and I said, "Let's go put her down." >> Here, this is the worst. But I've got my gruff here if you want to show me. >> I want to say was on her side up like this. So, if we're in the bedroom right now, the black shelf is right there. >> Mhm. >> I guess up like this. put my hand on Sarah. >> Said, "Put her down. Let's go." And I brought her out into the living or into the bathroom, I'm sorry. >> So, you put your hand on where on Sarah? >> Arm on her arm. >> So, how would you have felt Aurora? >> I did this. You got to put her down. >> Oh, you you touched the arm that was touching the child? >> Yeah.
