I'm here to help you, okay? I want to No, I feel like you guys are just taking his side. You guys are just going to take it side. That's how it feels. So, you guys think I'm the one that's doing everything and he's trying to take my kid. >> point did he No. No, I tried to get a phone out of his hand because he kept recording me trying to get a reaction out of me. Okay, did you hit him Yes, I pushed him and knocked the phone out of his hand. You pushed him? Yeah, I hit because he doesn't get to get in my face and scream like that. I'm trying to help you and trying to put this story but you got to explain to me from start. From start, I tried to wake him up at 2:30. He started screaming at me because it's 2/3. And from then on it just kept going. He kept telling me he wanted space but then went mumbling under his breath, called me a called me a called me a bunch of names. So, it makes me mad. He doesn't get to walk around doing that. So, at what point did it become What made it escalate >> Because he sits there like this. He goes there like that. And he gets in my face. Okay. So, he's putting a phone in the in your face and that upset you. >> Yes, because he he's the one that started this whole thing. Okay, then how did how did you push him? I pushed him like this and slapped him to get the phone. How did you slap him at? I don't know. Like open-handed slap? >> Yes, a slap like that. Okay. >> [laughter] >> And it's not fair. He has a bunch of videos of our fights. I want them off of our fights phone. Because he's going to post them. He already told me he's going to post them. That's illegal. We got to bring it down [laughter] a notch. He told me he's posting that but it's illegal to do that. I'll talk to him about it but we got to [laughter] bring it down today. You have a baby in your Yeah, because he's not going to take him from me. You're you're yelling in your baby's ear right now. Don't put your baby's hearing at risk, right? No. Right. You love your baby, right? >> Right. So, let's let's >> [clears throat] >> Okay. Breathe. It does not make her I understand I understand you're upset but let's breathe, okay? Okay. Okay. He's a little cute little guy. >> Yeah. Yeah. We're going to figure it out, okay? I promise. I'm going to go talk to him, okay? Is there anything else [crying] you want to tell me? No, but he just he's literally sitting there recording me eating my head because I get to that point with my Sounds good. Don't leave, okay? We locked her here. >> Hello. What happened here? What started all this? So, I woke up, told her I needed space to get ready, you know, let me get ready, whatever. Started getting ready, we got into arguments, she said I was being mean. What was the argument about? >> Cuz of how I woke up and I was like I guess I was being mean when I woke up. You know, I was kind of grumpy when I woke up and she's sensitive, she's real sensitive. We started arguing, it got heated, a bunch of was being said. But I mean this has been I don't know, I have videos of all this, it's been happening the last 3 days, but So you guys you woke up in the morning feeling you were kind of upset, you just needed some space, so you Told her I needed space and they they got heated. She's getting mad. It was verbal and at any point did it become physical? >> Yeah, it did. Okay. Not toward No, I I never laid hand on >> did? >> Nope. Did Did he Did she lay hands on you? Yes, and I have I have videos on my phone. >> video of it on your phone? >> Yes. Can I see it? Yeah, can I help you? That's fine, man. You got any weapons or anything? No, I'm not. Well, who is she to you? That's my sister. Was she here to witness all of it? >> She didn't witness all of it, but she ended up calling her saying a bunch of stuff like I don't And it got to the point where I was like after she laid her hands on me, I was like I can't do this and I started packing up my stuff and she just started yelling and screaming You're not leaving. Cuz like we have a kid together and >> And that is your kid biologically? >> That is my kid. That is my kid. >> And you guys live together? We were together for a year, we broke up for 3 months and we just recently got back together and she wanted me to move in and I was like yeah, I'll move in cuz I love my kid and I want to work it out and it just hasn't really >> Are you currently Have you been staying here? Yeah. How long have you been staying here for? Like a week. Only like a week? Yeah, it's only been like 3 days. No, I mean sort of, I don't know. >> of. Okay. Where did she hit you at? I turned around and she just like hit my neck, my back, like I don't know if they're slaps or like fists like that, but she Do you have any marks or anything? No, I just I just drove here. You got you're a little red back in the back of your left side. My neck? Is little No, like allergies or anything? Do you mind lifting up the back of your shirt? >> I don't have allergies or Nothing like that? I mean, I have like my nose Okay. Like my nose is runny sometimes. >> You got maybe like a a scratch or something on the left side of your Is that normal? I'll show you. You got Is that normal for you? Like that No, that's This is what I was talking about in the back of your neck. You see that redness? Is that normal for you? No. Okay. I'm not saying this is going to happen, but if she has to go to jail today, can you take care of the child? >> I don't want her to go to jail. I It's not a choice, but I'm asking you a question now. Are you going to be able to take care of the child? I don't want her to go to jail. You shouldn't have hit her. She's going to hate me. I don't want to do it like I don't want her to go to jail. >> It's not up to you anymore. It's up to the state of Idaho when it comes to domestic violence. Since you guys have a child in common, you guys are domestic partners, okay? I'm just asking you a simple question. Can you provide care for your child? Okay. Can I see the videos? Relax, brother. It's going to be all right, I promise. No, cuz I don't want it to happen. I love her. Listen, I'm not saying it is. I'm just I I'm making hypotheticals. Making hypotheticals here. It was just a question. I didn't mean to upset you, all right? Is this your only video for I I I think I got to wait I think I go into the room the bathroom after this one. Like we need to like find it more. Yeah. because you don't get to do this. You You don't get to do it. YES, YOU GET TO DO IT. YOU DON'T GET TO YELL AT ME. WHAT I DID to you. Because of you, you can Don't call me names, YOU DON'T CALL ME NAMES, YOU DON'T CALL ME NAMES, YOU NO, DON'T CALL ME NAMES. THIS IS WHAT WE'RE IN ABOUT. I don't know if you can see it. She I showed the camera to her. No, BECAUSE YOU KEEP GOING. Because you keep going. And this is where she don't call me names and in the bathroom. And this is where she starts hitting me. I mean, no, hit me. I'm not hitting you. I'm not I don't hit women. Exactly. You don't I don't hit people either. You hit me multiple times. You hit me You put your hands on me. You hit me. Hit me. Hit me. Okay. Okay. Yeah. She hit me right there. Really? And she starts hitting And I'm just in the bathroom at this point. She's hitting me. She's hitting me. She's hitting me. Does it show her hitting you? Yeah, it just did. You don't get to You record She hit you while you were still in the bathroom, right? >> Yeah, like I I showed the camera to her and it was like right in her face. That's when she like tried to hit the camera out of my face, but I like went like that. Okay. And as I was like that, she was hitting me from the back. And I don't want to press charges or anything like cuz I love her and I understand. I just she I think what she needs is like the year we were together, it our relationship was never like this bad. Like it it got bad towards the end just because like we didn't have a place to live. We just had a kid like 4 months ago or whatever, so we ended up having a 3-month break. And I thought like that 3-month break was going to be good. >> Right. And we got back together and this week has just been the worst it's ever been. Like she's laid hands on me. 2 or 3 days ago it was It was like 3:00 at night. I'm surprised no one called the cops, but 3 days ago she laid hands on me and then today was the the second time. >> How did she lay hands on you 3 days ago? Same way. We're just arguing. She got up in my space, and I was like, "Hey, like back off, like you know, same same kind of same kind of thing, but it was in the room." I don't know. Every time like when she starts screaming and yelling, and I try to like take my kid to a different room, she's always like, "Don't take my How many times would you say you were struck in the back? In the back. One to five or like Approximately number. Four or five times, like maybe like once in the neck and then like in the back a couple times. Hey brother, let me ask you a really important question. Where was the kid during all of this? I grabbed the baby and I took him to the balcony to stay out there cuz they were Before before before that he was in the rocker. Would you say the baby could hear what was going on? I'm just going to add you as a witness since you were here. You didn't see anyone get hit or anything, right? >> No, I did not see anything. You just heard it. I I was I Yeah, when I first walked up I stood at the door a little bit, and then I kind of knocked really loud, and they couldn't hear me, and I knocked really loud again, and finally my brother came and opened the door, and I automatically went to the baby and went straight to the balcony cuz I could hear She's saying that three nights ago he pinned her down. She has bruises all over her arm. Cuz initially she's saying that he didn't touch her, right? And so now I just got the warrant. Yeah. What you What I would do is talk to her about that. Just going to add it to your report. Okay. Ask for photos of the bruises, and then say, "Can you hand the baby to my partner so I can take pictures?" And then you can hook her up. >> Okay, we'll do. So, let's talk about three days ago, okay? Mhm. When he hit me, when he pinned me down? Yeah. Well, he's trying to get me in trouble. I know. He's trying to get me in trouble. He provokes me to that point, and this is literally from him. Which one? It's across my wrist, right here, holding me down, here. Okay, let's start at what day exactly was it? Do you remember? >> No, just three days ago, about three days ago. He started another argument. >> So, the 19th? >> Mhm. Okay. Another argument, screaming. He starts telling at me it's my fault, calling me a calling me stupid, screaming at me, and then he's like getting on top of me because I told him I had I wanted space. My bedroom. So it was on the bed. I said I want space. Give me space. And then he doesn't give me space and I start having a panic attack and I'm screaming. I'm freaking out. I'm hitting myself too like this. Because when I do it helps me focus on the pain in my head not the >> just slow down because I'm I'm writing it down too. So he pins you down. >> Yeah, because I'm freaking out because of >> And how does he pin you down? >> Grabs me by my wrists. Let me know. Yes. And he's like, "Stop Bailey. Stop Bailey. You're going to get the cops called. You're going to get our kids taken away. Stop. Okay, and then after he grabs your wrists he's yelling at you in the face. >> Okay, and then is that Pretty much it and then I get off him because I'm kicking like this. Swing like moving my body around because he's not going to pin me down like that. >> Okay. And then I got up and we started screaming at each other when we And that's it. Mhm. But the thing is the difference between me and him is I don't record him doing that to me. Yeah, and that's fine. Let me get my phone so I can take pictures of it, okay? Now when he was holding you down like that, what was the reason you didn't call the police? Because I I've been by men before and you guys haven't done anything. And I've been by men like my whole life. Nobody does that though. Nobody helps me. Yes, that's the only reason I don't call the cops. Do you mind if I take pictures of it? >> Yes, go for it. >> you mind if my partner holds the baby so we can >> Yes. Okay. I've literally been by everybody I've ever been with. Is there any other Can I see your other wrist? No, there's not on this one but there's a >> in the sun so just hold your wrist like full fist like this. And then this one. Is there any any other bruises I should know about? >> There might be some on my legs from me kicking but that's not from him but that's me kicking. Okay. These are from him. We have to get 360. We get pictures of that as well. All right, so right now you're under arrest. There's a warrant for your arrest, okay? Just relax. Why? >> issued a warrant for domestic violence in the presence of a child. >> That's literally him. Are you serious? That's literally him. That's why I don't call the cops. Are you serious? >> Relax. No. Relax. You're taking MY KID. RELAX. RELAX. RELAX. NO, DUDE. You're taking my kid from me. WHAT THE I HATE YOU. I HATE YOU. NO, THAT'S NOT FAIR. THAT'S NOT FAIR. I HATE YOU. THAT'S LITERALLY HIM. I'M NOT THE DANGEROUS ONE. RELAX. Have a seat. Calm down. No, that's not fair. Yeah. Yeah. Have you standby here real quick. I'm going to go interview. So, right now the judge issued a warrant for her arrest, okay, in the presence of a child, okay, since your child was on the balcony and could hear it. But, she did make a statement saying 3 days ago that you pinned her down on the bed. Can you just Can we just go over that situation real quick? >> No, I never did that. Okay, do you know anything about No, I never pinned her down. 3 days ago what happened is we got into an argument and she got really heated and she started hitting herself. Started punching herself. Started She had a clump missing out of her hair. Started scratching herself. She was hitting her She grabbed the wall and hit her head against the headboard. And I was like, "Hayley, stop." I did grab her arms cuz like she was hurting herself and I was like, Where Where was this happening in the apartment? >> It's in the bedroom. And then as as soon as as soon as I grabbed her arm she started screaming and I let go. And I was like, "All right, I'm not going to help you." And if she's saying stuff about her wrist, that's because, you know, in the bed like we we like tie up stuff, you know. Okay. So, if she had If she had bruises on her wrist it'd be from like Okay. It'd be like stuff. Like if she has like bruises right there or on her ankles like that, that's sex-related stuff. >> I'm going to sit in the car with him. But, like all the other scratches and bruises she she beats herself. Like hurts herself when she gets really mad. She has a clump missing out of her hair on this side and this side. And I just try to help her, but like I can't help her if she's like screaming at the top of her lungs and hurting herself like that. At that point I just get my son and go to a different room or the balcony or wherever. Okay. So, like I said, that's kind of what's going on, okay? She's going to be transported to the Ada County Jail. I'm going to provide you with a domestic violence packet. Anything Do you need any like anyone to come out and talk to you about what happened today? Like any like >> No, I mean no, I don't need that, but I'd take the packet and >> Okay. Well, the packet's going to have a bunch of stuff on it. It's going to have a bunch of resources for you, okay? Along with a little guy here. And so, we'll get you guys some help if you need it. Do you have a way to You guys have food for him, a way to transport him safely? >> Yeah. All my stuff is in the house and all my clothes are in the house and all my clothes are in She's going to pull up and she's going to help us gather stuff. Okay. Well, you have you have standing in the house since you you've been staying there, right? >> Yeah, all my stuff and Okay. So, I mean, let's let's grab that stuff and let's get everyone home safely, but let me grab that packet for you, okay? When? Cuz you told me today he didn't hit you. Okay. And I'm going to document that in my report. Listen, I'm I What you told me about what him holding you down on the bed, I'm I'm annotating that in the report, OKAY? THE WOMAN WAS ARRESTED AND CHARGED WITH DV in the presence of a child.
