you don't want to give me your ID and you think you're going to run the scene you're now going to [Music] jail officer Schimmel in the small town of South Whitley Indiana an unsettling incident highlighted the tensions that can arise during routine traffic stops officer Brian Shimmel a member of the South Whitley police force pulled over Vivian Augustus and 18-year-old High School senior she was driving slightly over the speed limit 37 MPA in a 30m Fe Zone and had a headlight out viven who had never been stopped by the police before was understandably nervous as officer shimel approached her vehicle he asked her to roll down her window in her haste and nervousness Vivan struggled to locate her driver's license which was attached to her school idy lanyard around her neck F give me your other hand didn't have to be like this one to 10 all right get up roll over on your butt I have any injury please help me up which knees hurt no I have a knee okay ready going to count three 1 2 3 up how old are you 18 good job you're going to jail well refusing to identify can you please grab my things for me your what can you please grab my phone and my license for me yep take a seat and my keys take a seat this aggressive action was captured by both the gas station surveillance camera and the police Cruiser's dash cam though shim's body camera only began recording after the incident as viven sat confused and scared Schimmel picked up her belongings her student ID driver's license cell phone and wallet he then read her Miranda writes explaining that anything she said could be used against her in court and that she had the right to remain silent and the right to an [Applause] attorney all right Vivian are you injured in any way would you like the Medics to check you out yeah okay I'm going to read you your Miranda Rights okay I have to read these to you since you're in custody all right this is your Miranda warning before we ask you any questions you must understand your rights you have the right to remain silent anything you say can and will be used against you in the court of law you have the right to talk to a lawyer for advice before we ask you any questions and have them with you during questioning if you cannot afford a lawyer one will be appointed to you before any questioning if you wish if you decide to answer questions now without a lawyer present you will still have the right to stop answering at any time you also have the right to stop answering at any time until you talk to a lawyer if you understand your rights okay I'm not going to ask you any questions right now what I am going to tell you is you were pulled over for your speed and your headlight okay your speed was 37 and 30 not that big of a deal and your headlight was out on your driver's side just pulling you over to let you know if you would have just given me your license and your registration like I asked you to do you would have G to away a warning tonight okay but however since you decided to pull this right here where you don't want to comply you don't want to give me your ID and you think you're going to run the scene you're now going to jail do you understand I was trying my you were not how many times did I ask you I was ping my you were not I've got a body cam on it will show you not pulling your ID out when I asked you to step out of the vehicle you step out of the vehicle you don't get to sit there and tell me how I'm going to do my job do you understand what you got over for headlight and speed okay cracks her Window M ask her to roll it down the rest of the way cracks in another half pinch ask her to exit she refuses X until I tell her y tell her about four or five times exit the vehicle you don't want to go down this route refuse acit so pulled out put her in arm bar slam her to the ground got her in custody how old is she she said she's 18 okay so she's going to go to jail um of course my body can didn't turn on when I told it to you're going to have to back out man there's no room over there that's a gas station customer who criticizes shim's parking job you not plug up the whole damn parking okay well the problem ID and registration Shimmel explained the reasons for the Stop and his actions but the explanation did little to ease the tension how's it going my car are you out your daughter y so I'll tell you cuz I'm the one that pulled over so I pulled her over for Speed 37 and 30 and then the headlight okay or driver side headlight lights out oh okay okay pull over she pulls in here uh cracks the window they're talking to me I got it I got it cracks the window ask her to roll the window down a little bit more all the commotion and the rain I can't hear her refuses to do that ask her to step out of the vehicle she refuses to step out ask her probably four five six times exit the vehicle nicely ask her please refuse to do it uh wouldn't give me her ID want to give me a registration so she was assisted out of the vehicle plac into custody resisting arrest and identify okay okay that's I mean honestly I know she's 18 that's probably my bad cuz I've instructed her that you roll the window down like that much absolutely you don't have to roll down all the way as long as you can get the ID out the problem is is when I can't hear because the traffic and the rain and everything we're in a gas station you know you ask her to exit the vehicle and she refuses to do so you know what I mean then they go we go down this route yep so um Vivian father who was a retired state trooper listened as shimel justifi his actions stating the noise and weather conditions at the gas station made it necessary to remove Vivien from the vehicle I just want to let you know are you Dad yeah okay and my dad's are retired state trooper okay so so um do you have somebody well I already called a hook I wish you would have got here a few minutes earlier I would have just gave you the car but there's already a recer on the way so oh I can't just take my car let me see if they called him I got him he'll do it I was going to say wrecker or not well they've already been called but if they haven't if they're not in the truck yet I'll give it to you I don't have an issue with that okay um I just have to do a search incident to arrest make sure there's nothing in there she shouldn't have and then I'll give it to you okay okay you got your ID so I can yeah yeah Brent attempted to deescalate the situation inquiring about taking the car home himself to avoid Towing but was told it was too late as a tow truck had already been called shimel assured him he would check if the tow truck could be canceled so what happens next with her so she's going to go to jail for resisting she's going to get a ticket for the headlight and the speed um she'll go down the Whitley County Jail she'll be assigned to bond and then you can Bond her out okay or whoever doesn't matter who but she'll get a bond can I talk to her for a sec just to keep her chill just disregard him yeah you give me a minute okay there you are let me get the car search real quick as long as we're good well we'll get you to talk to her first I'll show you you're worried so I'm not worried well I want you to you're a dad right yeah I'm a dad I'd be worried so you P down she hasn't been patted down yet no but we'll get you to talk to her and then get that search and then we'll just give it to you you ready in the following weeks the Augustus family sought to obtain all available footage of the incident after 3 months they succeeded in getting the police body Cam and gas station videos which they promptly shared on social media contrary to schimmel's report the videos showed viven had fully complied by rolling down her window the Town Council initially hesitated to dismiss shimel citing his actions as flawed but not dismissal worthy however as the controversy grew and it was revealed that Schimmel had been previously suspended from another Police Department for similar misconduct The Narrative shifted the local prosecutor recognizing the potential disaster in any trial involving shimel dropped all charges against Vivien subsequently the South Whitley Police Department dismissed him from his position and that's wrap our video it highlights why body cameras and Community oversight are essential
