what happens when a night out takes an unexpected turn today we discuss the case of Olivia a 19-year-old whose decisions one evening led her down a path filled with crucial life lessons caught in the headlights of a routine traffic stop Olivia meets the reality of impaired driving through a series of field sobriety tests this case uncovers how she faced the law due to choosing the wrong path on February 26th 2021 officer Frank from the UCF Police Department stopped a car because it was driving on the wrong side of the road and going too fast the person driving the car was Olivia a 19-year-old girl when the officer went up to Olivia's car and knocked on her window she said something that she shouldn't have you know why I'm stopping tonight because I ran bicycle cuz you ran a bicycle what she said showed she had been drinking which made the officer think she was driving drunk after that the officer started to ask her many questions to find out more about what was happening how you doing good good my name is corpor proud of the police department do you know why I'm stopping tonight because I ran a bicycle cuz you ran a bicycle is that what he says I rad no so you were back on uh Lake picket you were on the wrong side of the road you almost struck the curb numerous Tri at times you were going 15 M yes you were going 15 miles over the speed limit and then when you made that left-hand turn you almost ran off the road over here where are you coming from tonight downtown downtown my shift shift where do you work at okay and where you heading to right here you live in night Circle yes you go to UCF yes the conversation took a turn when officer PR asked Olivia how much alcohol she had consumed Olivia admitted to having one drink specifically vodka but claimed it wasn't much the officer then asked for her vehicle registration and proof of insurance hey how much hair you drink tonight one drink what were you drinking tonight vodka vodka okay how big was the Vodka not big at all not big at all all right drug test me right now okay well I'm not worried about drugs okay bre okay well that doesn't work that way okay so let me have your vehicle registration proof Insurance please okay while searching for her documents Olivia accidentally revealed a fake ID in her purse okay Olivia let me have the fake ID no the the one that was in your purse get that one let me have it please do not please do not charge me with this Olivia give me the fake already Olivia give me the fake ID thank you you've been what two jayen I don't belong there I do anything what you to jail for okay what you go to jail for I don't need your credit cards following too close you went to jail for following too closely that's not an arrestable offense so what I went there for it and I'm really scared what were you charged with burgly con when I was just using self-defense and it was dropped before it even made the State's Attorney's office I don't I don't need your credit cards so what do you need from me uh to step out of the vehicle okay come stand right at the front of my car right there okay so uh here's the thing I'm very concerned that you shouldn't be operating a vehicle I'm concerned that you're operating a vehicle in the State of Florida in the County of Orange and the jurisdictional limits of the University Central Florida while you are your normal faculties are impaired by a chemical controlled substance do you have any problems participating in the standardized field sobriety exercises for me no sir officer PR then began to assess Olivia's State more thoroughly suspecting intoxication the officer inquired about her health asking if she was under any care or had conditions like diabetes or epilepsy Olivia disclosed she had a panc disorder and was taking medication for it along with adal for another condition which she had taken earlier that day she also mentioned consuming Red Bull are you under the care of a doctor of a dentist um no okay are you diabetic or epileptic I am I have panic disorder you have panic disorder okay do you take medication for that yes what do you take um I take a 5 Mig tablet and I take a 10 migam tablet of beum so you take 16 Mig of that one one drug 10 Mig twice a day 5 Mig total twice a day in the morning you take two 5 migr tablets correct con totaling 10 milligram all right um other than that any other kind of physical defects or anything I need know about Aderall you're on Aderall when was the last time you took adderal 4 or 5 p.m. today 15 milligram 15 milligram okay so besides the Aderall and the other drug that you told me about the other prescriptions there anything else that you're taking Red Bull Red Bull okay I understand that um do you have any physical defects as far as like anything your neck back legs arms knees ankles anything that would prevent or inhibit your completion of the exercises no no okay very good even though Olivia tried to help and answer the officer's questions she was getting more and more nervous after asking questions the officer started the first test this test is often called the eye test or the horizontal gaze nystagmus test if you failure to pay traffic fine 29 she does have ch out of Florida with officer safety for battery she is a current student we she everything she's saying is right all right a proper contacts okay all right Olivia was trying hard but during the first test her eyes were moving in a way that showed she might be under the influence the officer seeing this decided to move on to the next test known as the walk and turn test he pointed to a white line near some parking spaces and explained to Olivia exactly what she needed to do Olivia was to walk along the line placing One Foot In Front of the other heel to toe and then turn around and come back the same way this test was meant to check her balance and ability to follow directions we're going to we're going to step right over there to the by the clubhouse right there okay keep walking we're just going to go right by right in those parking spaces right there all right see this white line that's right in front of us yes okay here's what I want you to do I want you to step right on that white line for me okay perfect just like that for are you comfortable doing this in your shoes or you need to take your sandals off okay if you want to kind of hang onto your dress a little bit I don't want you to trip over it okay here's what I want you to do see how this line is flat level free debris and well lit yes okay what I want you to do is put your left foot on the line put your right foot in front of your left heels touching your toes as Olivia tried to follow the instructions the officer noticed she was having trouble she couldn't keep her balance well and her steps were off the officer quietly noted these mistakes indicating that Olivia might not be sober okay you may begin M arms m a pivot miss miss miss off to the left with right miss miss miss arms okay here's the next thing we you do face me next came the one leg stand test in the one leg stand test the officer tells the driver to lift one foot foot about 6 in off the ground and start counting like this 1 1 1 one 2 and keep going until the officer says to stop this test lasts for about 30 seconds during this time the officer watches for four main things if the driver hops to stay balanced puts the foot down too early sways to keep balance or uses their arms to help balance the officer is checking to see if the driver has trouble with balance and coordination which might mean they have had too much to drink go ahead and begin look down at your foot look down at your foot 10023 2014 20156 1789 10 and 19 120 121 122 stop okay the officer saw enough signs of impairment he decided it was time to arrest her for driving under the influence the officer calmly explained what Olivia needed to do next asking her to face a tree and count to 30 as part of the arrest process but when he told her she was under arrest Olivia was surprised and begged the officer not to arrest her she even offered to take a breathalyzer test right there hoping to prove she wasn't drunk I got one more thing I want you to do for me okay can you see that tree right there yeah okay here's what I want to do face the tree spread your feet okay nice and wide okay can you put your thumbs like this W your thumbs okay and then you're going to put like your ski put behind your back like that I want you to count to 30 for me okay start counting to 30 6 7 8 9 all right 10 you are under arrest for driving Under the Influence I'm sorry what under arrest please don't please don't please don't please sir I beg you I am not drunk I will do a breathalyzer test I will do anything you guys need me to right now in front of you okay step over here at the police station Olivia took the breath Eliza test she had offered to do and the result was shocking as we close
