you just run a stoplight I mean stoplight no it was green it was it was red I had to stop and then the light turned green and that's why we are we what happens when those who protect us cross the line we're discussing a scary time when a woman was treated very badly by police for no real reason at all this isn't just a simple mistake it's a big deal that makes us ask important questions about Wren wrong and how people should be treated Yolanda Elliot on October 28th 2023 a police officer from the Bluefield Police Department saw a bus Yolanda Elliot was driving it she was just going about her day but the officer thought she had done something wrong he thought she didn't stop at a red light because of this he decided to pull her over did you just run the stop sign I mean stoplight no it was green sir it was it was red no sir my light was green cuz I pulled out right behind my bus well it was red because because when when we was getting ready turn our light was green and we had to wait on your bus to get out the middle of the road to go through it oh someone need your license and the information to this bus bus please I I seen your hand go up and I was like yeah it was completely red what world yeah like the car in front of me tried to go but they had to wait on you to get out of the middle of intersection cuz our light was green that's why I se my bus go cuz we had just happened light time bus might have been running it too going in front of it might have been yellow where's my and you're going have to bear with okay here it is but yeah that not life was green that's why we I never run a Red Light Special right there I mean it wasn't green that's the thing I mean if it was green on the bridge but when you went under it it was completely red because it was it was our light was green which means your light was was red for a good 5 seconds because we had to wait on you to get out of the middle intersection before our our bus I was paying I'm so sorry cuz I I mean the light turned green cuz we stopped at the red light it was green I mean it was red when we were sitting there at the red light yeah I had to stop and then the light turned green and that's why we all went all right give me a second Yolanda tried to explain that the light was green and nobody was around but the officer kept insisting the light was red when she passed through this argument continued for a while the officer requested her license and more details about the bus Yolanda scrambled to find her documents still shocked by the situation according to the rules in West Virginia a police officer should collect details and if needed give a ticket for breaking traffic rules the law states that if someone doesn't obey the traffic light rules they could receive a fine Yolanda kept saying she saw the light turn green which is why she went but the officer started to make things more complicated he even asked another officer to check if Yolanda's eyes looked strange suggesting she wasn't fit to drive look at me real quick look out that way I kind of like look out like this way no right here see that that yellow mon sign look right there 215 or 216 212 R down here real quick her pupil are really really super small she go back on a you want Yolanda Elliott I mean they think they're Exempted from getting pulled over but I mean obviously her light was completely green which means her light was red and she went through the middle intersection we had to wait don't Hur to get out of the intersection before our line could even move oh your Elliot subject is license two points it's your call control calling control count1 acus 16 from Bluefield hey hey can I um talk to our dispatcher please yeah hang on just take a minute thank you hello green over blue how are you I'm good how are you good hey can you can you run a uh triple on that Yolanda Elliot for me please see if it's got anything on her driving wise 10 do you want her to give it back to you over the phone or do you want her to yes give it to you over the radio just over the phone all right the officer then called for more help pretending the situation was different from what it really was he wanted to check Yolanda's driving records over the phone trying to find anything that could justify his actions however an observing officer mistakenly thought she had just put them on suggesting she was trying to hide her eyes this misunderstanding led to an accusation that seemed trivial but had serious implications hey just go up here and be like hey did you did he get your uh insurance card and registration card and look at her eyes I don't know she had sunglass while I walked up there yeah yeah she she just now put them on she didn't have sunglasses on a minute ago I told her to take them off I mean they they look more constricted than mine yeah when I looked at his I made him look the same direction she was looking and his his are about a half a size almost to a whole size bigger than hers is or hers was she's got a speeding ticket what did you stopped before she ran a red I mean a yeah red light we was sitting there and uh there's a car in front of me and then right before uh I mean our light turned green and we couldn't pull out because she was coming through the middle of the intersection I just w h that huh he like [ __ ] I just walked H that got drugs on him huh they probably got dope on him I mean the way she was talking was kind of like you mean do filter BR own her I mean cuz she didn't have those sunglasses on until you pulled up and and The Sun Ain't Even out right here it's and uh yeah her her peoples are more constricted than his were his wasad look up a yoland Elliot yoland Elliot the officer's statement suggested possible wrongdoing which is a big problem even though it wasn't sunny the officer wondered why she was wearing sunglasses this made him investigate more and he asked for information about M Elliot's past despite the clean record the officer remained unconvinced deciding to investigate further for potential drug influence Mrs Elliot was asked about her medication use to which she honestly replied about her prescribed ambient and pery noting she only took them at night the officer however focused on her pupil's size suggesting it indicated drug use despite her explanation of poor sleep Miss ell come here and talk to me for a minute won you turn place this way for me all right away from my son all right um do you take any kind of medication what's whatever I do what you tell well I want you to be honest with me okay when I ask you this during the day I don't take nothing okay at night time I take ambient and I take perose okay so how long ago since it was since you took the per sets be honest with you I'm trying to think I took it about 8:30 last night 8:30 last night yeah I'm not worried about anything y'all can do I mean y y'all need to do or anything like that well this is this is the issue I'm having is when I come up and talk to you people are are really really constricted I didn't sleep good last night well I'm going to be honest with you I sleep has nothing to do with your people SI okay okay all right um so um what I feel like we should do um to cause less trouble for the people on the bus we probably should call somebody to let them uh let them come get the people off the bus real quick because I'm going to run you through fil SOB test okay okay and then we're going to go from there right you want me to call my boss call somebody let let them know you got a bus out here and you you got stopped by the well what what about this bus right here he's got to go he's running another bus so let me call my BS make it make it pretty quick so we can get on the road with these tests okay the officer's decision to proceed with a field sobriety test despite Mrs Elliot's cooperation and the absence of any concrete evidence of impairment showcases a prejudiced approach the officer by asking about Mrs Elliot's private medical details seem to go too far the 14th Amendment of the US Constitution protects people's privacy this means they have the right to keep personal health information private and don't have to share it if they don't want to the officer kept pushing Mrs Elliot to be completely honest about her prescriptions also the officer's idea that her small pupils had nothing to do with how well she slept was like guessing about medical stuff which he's not trained in it's going to Che let me my B uh it's just going to take just a little while we're going to walk over here we going to do some tests on this fine okay yeah the par Serv okay my boss is coming okay is that your boss there yeah you want to talk to him want talk he's coming let's walk over here for minut as the encounter progressed the officer asked Mrs Elliot to do more invasive things like emptying her pockets and asking what was in her lunch bag it's really important to know about the Fourth Amendment which stops the police from doing searches or taking things from people without a good reason however the officer asked Mrs Elliot to do a test to see if she was drunk in this test she had to follow a pen with her eyes even though there wasn't any clear proof that she was drunk the officer still did this test showing that he was ready to think she was guilty even without good reason you got anything on you anything in your pockets or anything no anything in your other pocket just turn your pocket ins oh what's up than okay let me see what else what else you got in your pocket there all right nothing else there in Pocket there and I got money in my other pocket hold on I'll show you that you got your purse there with you or you carry your purse with you no okay got any any of your property on this bus my lunch bag okay you got any medications inside of that lunch bag yeah what kind of medications in there I got my uh B12 and you care if I take a look in it here in just a minute in a detailed examination of Mrs Elliott's encounter with law enforcement the officer proceeded with the rberg balance test a method not widely recognized for its Precision by the national highway Transportation safety administration Mrs Elliot was instructed to tilt her head back close her eyes and upon her estimation that 30 seconds had elapsed open her eyes and Signal the end of the duration all right let's walk over here on this line real quick okay all right you going to be able to fil some BR in those boots whatever you need me to do if I need to take them off I can't I mean it's up to you I mean if if you can walk them all the time okay all right I said what I want you to do okay turn well that's all right stand like care okay put your feet together Hands On by your side for me okay Hands On By Your Side just like this I've never done a f spr test never never all right well there's a first for everything okay you can see the tip of this pen right I can all right I want you to watch the tip of that pen with just your eyes on don't move your head okay okay you get the [Music] got [Music] [Music] all right same thing okay what typ pin just your eyes only don't move your head what all right same thing all right watch just the tip of this I'm going to make small circles in front of your face I'm going to come to the bridge in your nose but I'm not going to touch your nose okay okay all right so watch just a tip of that for me okay okay can you normally can you normally Cross Your Eyes did you can you cross your eyes as a kid yeah like I used to I haven't done it in a long time but I used to well just watch tip that for me okay all right one more time okay all right next thing we going have you do okay um is just another balance test all right well first off I guess we can do it right here it's pretty the uh modified rberg yeah we'll do it right here we'll do the other test Diner all right so what I want you to do take your hands out your pockets put your feet together for me all right even though Mrs Elliot followed the directions and finished the test the officer still looked very closely at her performance he focused on a small mistake she made in the timing being just 7 Seconds longer than expected this shows that the officer kept looking for problems instead of being fair and understanding if this case pequs your interest hit the like button share the video with your friends and subscribe to our channel for more captivating cases like this when I tell you to begin all right I'm going to tell you to touch your head back you're going to touch your head all the way back okay okay um when you tilch your head back you're going to close your eyes when you close your eyes I'm going to tell you to begin all right when I tell you to begin I want you to estimate the passage of 30 seconds in your head all right once you once you get to 30 seconds in your head you're going to tilt your head back down and say stop all right and that's going to be into that part of that test okay okay let me get let me say this again I'm going to tilt my head back count assume 30 seconds tilt my head back close my eyes assume 30 seconds sit my head back up open my eyes and say stop yep right okay all right so go ahead and touch your head back and close your eyes yep you good take your sunglasses off right tilt your head back and close your eyes for me okay all the way back grab again stop all right how long was that let say 30 seconds you say 30 seconds or how'd you get the 30 I counted how'd you count one two three okay all right cool good deal 37 seconds no you're good you're fine was I I mean was I right on it well not right on it but yeah not right on it but just to be nosy then Mrs Elliott was asked to do another test to check if she was drunk in this test she had to close her eyes tilt her head back and touch her nose with her finger when told to do so like the other tests this one was meant to see if her body reacted in a way that might mean she was drunk even though these tests can be tricky and mistakes can happen Mrs Elliot tried her best to follow the instructions next thing we have you do is called the finger in the nose test okay like I said you going to keep your feet together heard about this one there you go well what do you know about it kind of sort of like that you ain't going to put your arms out like an airplane though all right but I why don't you do I want you to make a fist and turn your palms towards me down just like this there you go take your poined fingers and stick them straight out to the ground all right stand like that until I instruct you to do otherwise okay when I tell you to begin it's kind of similar like the old the the last test we've done okay you going to tilt your head back and I'm going to have you close your eyes all right when I instruct you to imagine that the tip of my knuckle here is the tip of your nose and obviously this is the tip of your finger okay exactly like this you're going to come up if I say if I tell you your right hand or your left hand you're going to bring your right hand up touch Tippy nose come back down immediately without me telling you to okay so if I say right hand you'll come up touch tip of it bring it straight back down without me telling you to okay all right just say right hand and I T yeah I'm I'm going to explain it to you as we go through it okay okay all right go ahead and tilch your head back close your eyes for me okay til your head back a little bit more there you go left hand right hand left hand right hand right hand left hand okay all right following the completion of the finger to nose test the officer still unsatisfied introduced the walk and turn test this test required Mrs Elliot to walk heel Toto along a straight line line turn and return similar it's a test designed to assess balance attention and the ability to follow directions factors that can be influenced by a myriad of conditions unrelated to alcohol consumption all right what I want you to do I want you take nine Hill to toe steps on that line I want you to turn I want you come back non heel to to steps okay I want you to count your steps out loud for me and I want you to watch the line while you walk it's going to look exactly like this one two three and so on until you get to nine once you get to that nice step you're going to leave your foot on the line you'll come back nine he to toe steps one two 3 and so on until you get to nine I want you to turn in same exact direction that I just turned okay keep in mind I want you to watch the line while you walk Keep Your Hands On By Your Side count your steps out loud once you begin the test don't stop until the test is completed do you understand I do okay I do go ahead begin for me one two three 4 5 6 7 8 F arms up holding on to his hyber pants Oh Mrs old toe steps offline all right all right yeah yeah um is it you want to get her personal items out throughout these tests Mrs Elliott was subjected to a series of assessments that not only challenged her physically but placed her in a position where the slightest deviation from the expected Norm could be seen as an indication of impairment despite the absence of clear evidence to support the officer's suspicions the tests continued each with its own set of criteria and potential for misinterpretation the final test presented to Mrs Elliot was the one leg stand a test that demands a high level of balance and concentration the participant is required to stand on one leg with the other held 6 in off off the ground and count aloud until instructed to stop all right so turn around and face this way for me okay you can stand on you can stand right here and face this way this way yep all right put your feet together Hands On by your side for me okay next test I'm going have you do is called the one leg stand test okay what I want you do once you pick whichever foot you want to use I want you pick it up approximately 6 inch off the ground keeping your foot parallel with the ground okay it's going to look exactly like this do six approximately 6 inches don't start until I tell you to okay all right it's going to approximately be six inches off the ground parallel with the ground with your toe pointed out I want you to look at the tip of your toe while you do this test okay I want you to count out loud for me 1001 100002 1003 and so on until I tell you to stop okay keep in mind I want you to watch the elevated foot count out loud for me keep both hands down by your side keep both legs straight um and don't don't stop the test until I said it's completed you understand I think so all right you don't count I'm just hold my leg out you to count tell meop yep you just you just count out loud for me like I told you to okay I count out loud yep like I told you to okay all right you ready to begin go ahead1 100023 1004 10056 10078 10090 1012 134 2015 2016 2017 1 18920 okay 20 seconds I heard 30 all right you walk over here with me real quick okay despite completing most of these tests the final two posed a challenge for her especially the one leg stand test given that Mrs Elliott is a 60-year-old woman who mentioned experiencing sleep deprivation her struggle with these tests could have been anticipated yet she managed to pass four out of the six tests suggesting her sobriety the officer was unsatisfied with the test outcomes so he decided to search her belongings for medications so what are you going to have in this bag you got any of your medications in here you care if my officer takes a look in there oh I don't care okay I mean I've got a bunch of junk in here all right well just lay just lay out to the side and he'll go through it okay okay just lay to the side for I'm about to freze all right so you said the last time you took the the the perker sets was it 8:30 last night yeah you don't know when last night though yeah it was like about 8:30 last night it before I went to bed what time did you go to bed it was about 8:30 what time how long I didn't go to sleep uh I was still awake at you took the ambum and didn't go to sleep no I didn't go to sleep last night I just couldn't go to sleep I was TOS of turning my did you take any of it this morning no no I didn't take nothing this morning I had you don't care if I look at you no I don't care I won't you do me a favor and just sit right here on this curb right here for me okay hey I'm going to come get you in a minute I need you to drive um Cliff truck um me the boss man yeah well um she is possibly going to jail for DUI really yeah so she takes ambum and perker sets and she said she took the perer sets last night she said I she told me 8:30 first then she said that she could couldn't basically she's like around late last night so um I'll talk to my sergeant and see what he wants to do we're uh we're pretty short staff today so um she uh there might be a chance that she gets to go home today behind you oh let me look oh you're good come on yes ma'am yes ma'am uh there's a good chance that she might go home today and she'll have a warrant for DUI um but I'm going to see if she'll go do a uh a blood draw at the uh at the hospital we'll get her blood and then uh we'll have that sent off to state police crime the culmination of these events led to Mrs Elliot's arrest for DUI based on the officer's interpretation of the situation rather than concrete evidence offered the option for a blood draw to confirm her sobriety Elliot consented hoping to clear her name the discussion that followed her consent revealed a misunderstanding or misapplication of the law regarding her medication and its compatibility with her CDL casting further doubt on the officer's handling of the situation you're going to be placed under arrest for the UI okay do what yes ma'am so I'm going to give you an option um we can go to the uh the hospital and we can have a blood draw you can consent to a blood draw Y and we'll go ahead and do that I can do that okay all right cool deal problem all right I appreciate it yeah listen to me you cannot you have a job to drive people around for a living right you cannot take perco setes and Ambi them and drive then why did the doctor put it on my CD the doctors do that I don't know why they do that it's not legal for you to drive they should tell you at night time you should not drive period once you've taken that medication it takes a while for that medication to come out of your come out of your system yeah cuz I just had my CDL done last month did you do a drug test then yeah I mean I I can show you my CDL I have nothing to hide from y'all I mean I've never done come up on the drug test where'd you do the test at drct uh John where did I do my CDL CDL what's his name uh Princeton CDL what I do where I doctor drug test physical does she do n ner okay he he done all of it and U well you want to take your off put them in your pocket so they don't drop and he did he did every bit of it and uh everything's listed on my CDL and they had to get my my my family doctor to come back and sign off on it well they dropped the ball because you ain't supposed to take it and drive okay go ahead and turn around for me I'm going to have to go ahead and turn around put your hands on you back despite the blood test returning negative for alcohol and any intoxicating substances and despite Mrs Elliot holding a valid CDL she was still fined for a traffic violation the repercussions extended Beyond legal matters as she lost her job due to the officer's comments to her employer a decision that seemed to stem from a premature Judgment of her situation in the aftermath Mrs Elliott faced not only the financial burden of the fine but also the loss of her employment and the challenge of clearing her name she is now preparing to take legal action against the Bluefield Police Department for wrongful arrest and against the city for her unjust dismissal seeking compensation for the damages incurred so that's the end of Mrs Elliot's case from a simple stop by the police to a big issue that got everyone talking it's not just about what happened on the road it's a lesson on how quickly things can change and why knowing our rights is so important we're really Keen to know what you think so please leave a comment below and until we share another interesting story keep an eye on the little things that remind us how important fairness and understanding are in our lives thanks for watching until next time
