going dude at the Bo Robinson Treatment Center in Trenton New Jersey a person who checks if things are done right by the government found himself in a tense argument with local police this Center is known for being very secure with wire fences the argument was about what rights people have in public and how police should behave yeah Alber Bo Robinson Treatment Center Community Education Cent facility in Trenton New Jersey and uh we currently have the Trenton Police Department pulling up and um you know we do have a bunch of uh Constantine wire and stuff like that looks like we have uh this guy coming out and he's got a he's got somebody in his truck there so more than likely he's um transporting them somewhere but this facility uh has a lot of Constantine wire and um I I don't have any answers for you so I'm just excuse you the auditor was using a camera to record what was happening near the facility he said he was trying to show things that the public would be interested in this is supported by the Constitution and some Court decisions like Glee versus kna in 2011 these say people can film government workers in public places he was only recording and not getting involved as he filmed a police officer approached and questioned his action suggesting that his recording might be consider harassment I'm on public property right now rep is that illegal can be harassment recording to harassment you can't turn the conciously protected activity into a crime do you have ID on you sir no I haven't committed a crime I ask what you're doing in front of the facility I'm taking uh pictures and video of matters of public interest that's all I'm going to say is that recording sure is excellent awesome well ask Move Along no I'm not leaving I'm on public property get a sergeant out here or Lieutenant you give me legal directives to leave you know I'm on public property there's um utilities here this is a public sidewalk correct so rainbow versus flowers I'm allowed to record police departments lick versus kif I can record anything out in public did you tell Google to stop taking pictures of their facility when they flew their satellites over or is it just me so I like a sergeant out here no problem I get one for you excellent the order to defended his actions by asserting that recording in public spaces is protected under the First Amendment as long as it does not obstruct police duties so these guys are upset and now called the police and obviously not doing anything illegal so officer you do have violation of uh people parked on the sidewalk why you go get them some summonses that's that's there okay so okay so where where does Trenton stop I believe this might actually be the end so cuz you have if you guys look you see these light poles that are sticking this way those are city of Trenton so the city of Trenton that goes all the way up to their their fence line even is this a public facility or private I believe this is a I think this is state so he's he's telling me then it's private which is private I'm 100% priv mean you got Department of Corrections here so right that's why I'm thinking it is right right me and me too I don't think that's the county that's yeah it's New Jersey uh Department of Correction you like speak of my sergeant or Ser not even have it come out oh you you're get me Direct to to leave or what you going to arrest I was just trying to figure out what you're doing here yeah you're telling me legal directives so I got a problem with that okay then way all right cool so we're fine now you do know it is posted no trespassing but if it's a state facility I'm still allowed in there is it's open to the public that's not that's not true no it's not so if I go to the police department you tell me to leave and I stay there if I'm not committing a crime I'm allowed to stay there That's the Law so as long if this if this is a public facility even if they have no trespassing it's still open to the public until I broke a law I I wouldn't be in violation of anything I mean I don't know why you give me illegal directives to to leave I just asked you to I didn't demand you but I asked you no you like move along move yes right under color of law your name and badge number you want record over your phone no no why don't you just say it cuz I know that's your policy say it say it name and badge number was not obstructing the facility nor engaging in any unlawful acts the auditor refused to comply citing his constitutional rights and the absence of any legal basis for the directive how you doing s uh name badge number Front police do you have badge number or no 92 92 okay so this officer here refused to identify himself verbally so I like to follow an I on him and he also told me to move along um under color of law it seems like that's a a legal thing that he's telling me to do and obviously I'm on public sidewalk and it's not illegal to be on public sidewalk recording so like the fallowing IIA on that gentleman there for those two incidents what what are you out here for um recording matters of public interest correct this is a correctional facility and they call because you were out yeah that's fine but that still doesn't neate what he just did what did he do he told me to move along under a color of law of a public sidewalk with to me the the threat of arrest even though he didn't say that and then he refused to identify himself cuz he told me move along on his thing I let him record my name that's not what your policy is your policy says you're supposed to identify yourself not just by pointing at your titty and saying here it is you don't say that to a judge right hey judge look at just you still can't say his name and bed's number you did he did no problem you know ego's got to go like to F complaint no I'm doing it right now listen state law is any officer any time could take any complaint I'm filing the complaint with you you have your ID I don't need ID I can do it an N give you my email address okay you like to need his email address that's you'd like to provide further tension arose over the classification of the property as public or private the auditor argued that if the facility was state-owned and not explicitly restricted Public Access should not be unreasonably denied this discussion highlights the often blurred lines between public and private spaces in government-owned properties and I haven't broken a law you guys know that here said you did yeah what no I I totally agree with it I mean but telling me to move along yeah but under color law you like yeah you need to move you guys you guys can see uh you know there's no parking on the street but yet these guys are uh on the sidewalk I guess your name badge number your name and badge number I'm sorry I can't hear you you guys you have your seat belt on no so we don't wear seat bels oh what are we doing in this town so you guys don't have a policy to wear seat belts either have a good day sir as the dialogue continued the auditor expressed his intention to file a formal complaint emphasizing the importance of procedural accountability and adherence to lawful conduct by police officers he referenced legal precedents supporting the Public's right to gather information about public servants activities on public property asserting that his refusal to leave was justified based on his rights Sergeant excuse me Sergeant yes sir I heard you have a good day all right no problem I'll do an IA on you you just want to walk away you got your officers here with no seat belts
