So I was like, "Okay, well, you know, hopefully this doesn't happen again." And I didn't know if y'all were going to move out or what was going to happen. I know that it's kind of money's tight, I think is what y'all said last time. So y'all are trying to >> We're still I'm looking for a place to move. I don't care where he goes, but I need to get away from him cuz >> For sure. >> it's ongoing. >> Okay. >> And sometimes >> And so this is a domestic issue. Um uh So we're we're going to have to arrest somebody so this regardless and you're wanting to press charges as well. Is that what's >> Yes. Yes. >> Okay. Well, I mean it's up to you. >> did. Yes. He He I'm sorry. She's English. Yes. >> Okay. All right. Well, I'm going to go speak to him, okay? >> In [snorts] a domestic call where there is probable [music] cause, the arrest decision does not belong to the victim. She does not have to ask for it and she cannot stop it either. >> There is no There is no actual violence. I didn't like that. >> Well, you just told me there was some pushing. >> No, no. I said There was just a hand like like that. That's all I'm saying. There was no There was violence or nothing like that. >> Okay. Well, I'm Officer French with Turkey Bend Police Department. I introduced myself but I'm doing it again. Officer French with Turkey Bend Police Department. >> Do you remember me? >> Yes. >> So I came out here last time probably Septemberish, maybe August, September, somewhere around there. >> I don't remember you. >> And you were drinking last time and there was an altercation that happened last time. No one wanted to press charges last time and I said that this isn't going to happen again and you said it wasn't going to happen again, right? >> about anybody pressing charges. I think you let me in, didn't I? >> You let me in both times. >> There was no That's what I'm saying. >> Well, this is the thing. It's a domestic, okay? Last time I don't know if there was I think there was shoving that went on last time. >> I don't think so. >> And then I left. But this time now there's shoving and uh she's accusing you of hitting her in the face. >> I never >> Is that what happened? >> No, sir. I never hit her face. You should be able to look at it and know. I'm 42 years old, man. I know you just say this. I don't want to put this all on you but I've been in this thing. But I think you know I'm 42 years old, man. You know it. >> Okay. >> I don't do that way to my niece or any any human being unless I have to and I'm I'm doing it. I'm >> Okay. Well, so did you shove her in the face or did she >> her in the face. I didn't shove her in no nothing. >> Well, well, I just came in and I heard y'all talking about >> I shoved her in the face. He said he boxed her in the face, but it's not my from my hands or nothing. Her box in the face is from her at me. I'm guessing. I mean, that's what I'm looking at. >> Well, it looks like a abrasion of some sort whether she got hit or >> Come on, man. I mean >> Well, it's it's a circle area. >> Never ever ever hit or touch you. Never ever never would and never ever had, sir. >> So, you never touched her. >> Not like that in the way that you're talking to me, no. >> Well, you shoved her, so that's still >> No, no, no. The only way I ever touched her was say "Paige, calm down. I'm sorry." Or or or vice versa or something like that. I'd never ever hit her. >> So, you never pushed her tonight. >> No, hell no. >> You did not. >> Hell no. Hell no. >> Okay. >> And I mean hell no. >> Were y'all getting in an argument or anything like that? >> having a little discussion. >> And what was that about? >> I I guess we were coming home I I really I guess from Walmart. >> Okay. >> And then I come home with her mom. We got here and then there's um we had a little attitude about it or something. And I'm like, "What did I do? What did I do?" >> She had an attitude because she had to come get me. >> We actually and she Paige didn't go just her mom went. >> Okay. >> And Paige don't make no money. You know she ain't got no else to support anything. And she's mad at me for What What did I do? What did I do? I mean, I I mean, I was like, "What the hell are you mad at?" >> Okay. >> I just got back from Walmart and did the best I could for what I did and then went on to this. >> And who is that to you? >> That's my niece, man. >> Niece, okay. >> That's That's God's truth. I I I've been around, boys. I mean, if you got to take me to jail and you feel that way, then you have to, but I'll tell you that's a total lie, man. I I didn't do that. I've been on parole 5 or 6 years. I've never ever on domestic violence. You check my uh record. Never have put hands on a female. >> That's why I'm home. >> Okay. Well, do you have your license on you? >> Uh yes. >> Or an ID card? >> Yes, yes. >> Okay. >> No, no, that's I'll get right there. See it? >> Yeah, I see it. >> I told you that I did that way. I saw you and then you stopped there. There you go. >> Okay. All right, I'm going to be right back, okay? I'm going to get her license and stuff. Could you stay over here with them, please? Thank you. >> If you genuinely did not touch someone, you say you have no idea where the mark came from, that you did not even notice it until the officer pointed it out. That is [music] not what happened in that room. >> Um do you have your ID and do you have your ID? >> I need my >> I need it. And I need to speak to you for a little bit, okay? >> Okay. I got it. Cancel this call. >> You want me to call her on your phone? >> Hold on. I'm going to have to call you back. >> Uh I can. I just got my stuff reset. It'll be quick. >> Okay. I'll just call him and do it on the phone. >> Oh, I'm going to go to my computer. To me. Is it just y'all three in here? >> Uh no, my spouse is in the bedroom. >> Okay. >> My my son is in here. >> My son. >> Your son is, okay. Got you. >> My son [music] is playing video games in the bedroom with headphones on, so he didn't >> So he don't even know that. >> what's going on. >> [laughter] >> I'm sorry. >> That's good, though. So, he's not in this. Uh could I speak to you outside real quick? I know. If you want to put some jacket on or some stuff on. >> I'll put my slippers on. >> I'll be right back. You'll be all right. So, uh y'all said that y'all had to go pick him up at Walmart. >> He His car broke down and >> And I'm assuming you drove and went and got him. >> Yeah, I had to. >> Okay. Yes, for sure. Uh and did he go over there and talk to her as well? >> did. Okay. Like, I'm not going to be able to get charges on that cuz I can't prove it, but Um But, that being said, uh So, you came to pick him up. Was he like kind of upset or anything like that when you picked him up? Or >> No, other than just that his car was broke down again. >> Yeah, just >> Uh no, he was fine. He was fine. >> And then when he got here, what happened like at that moment then? >> I I was in my room watching TV, so I don't know. They were arguing. I could hear them arguing, but they always argue back and forth especially when they're both drinking, but it's never turns into anything major. And then I heard her saying, "Get away from me. Stop it. Stop it. Stop it." And then I heard something. I don't know what who from where. And I jumped up and ran out there and my spouse came with me because obviously he's going to back me up against my brother cuz I we don't know what's going on. Carpet was shoved all out of the way. She was screaming for me, "He hit me. Mommy, Mommy, he's hitting me. He's hitting me." before I even got out there. And when I got out there, he hightailed it to his bedroom. >> That's awesome. >> And I said, "I'm calling the cops on you. You know that, right?" He was like, "You got to [ __ ] do what I put her in her >> So, I'm going to have everyone write statements. I'm taking him to jail tonight for domestic >> Well, I asked him. I said, "What did you do?" >> Don't say anything or anything like that so he don't get riled up, but I just I have to get y'all's statements. >> Well, he admitted it. I said, "What did you do, Jason?" He said, "I put her in her place." >> Got you. >> And so >> Okay. So, he hasn't admitted anything to me. He says he hasn't put his hands, but then he did admit to shoving, so he did put his hands on her regardless of what happened, so >> Her eye is turning >> Yes, I can see there's still discolored and abrasion that happened, so let me get statements. I'm going to have everybody write what kind of happened and then I'm going to take it and then I'm going to take him to jail, okay? >> Okay. >> He spent the whole conversation in that bedroom telling Officer French he had been on parole for five or six years. No domestic charges, never put his hands on a female. The whole accusation was a total lie. >> Don't tell him anything. Just keep it settled, okay? >> snorting his medications on top of the alcohol. >> Okay. >> And that's what makes him go nuts. Like he like this. And he he does this every around the first of the month. >> what medicine medications does he have? Does he have it all with him? >> psychotic. Psychotic If you look on top of his dresser, you'll see all the powder from the impression of the pills. >> Is it things that he like has to have? Is it or >> It's his psychotic medication. >> Okay. So, he probably has to have it then. Okay. >> And he has had those in the UK used to before. >> Okay. >> So, we were worried about him fighting with y'all. >> Uh he probably won't. I don't think. Uh he might. If he does, we got the harness, so we're probably pretty good. >> staying out of your way. >> But yeah, I I understand. Let me get these statements for y'all and uh you can go It's Yeah, yeah, yeah, for sure. I just want to brief talk. You drinking water? >> Yeah. >> Okay. You fill out the statement for me? Uh you don't have to do it. It's voluntary. >> I got my glasses. >> You got that Where's your glasses at? >> I think I got them in the car. I got them. Yeah, you look good with all that. >> What's all this crushed up over here? >> All that's um pills that have been crushed up. Been smashed on and I got a muscle. >> I don't think you're supposed to be doing that. >> No, no, not like that. I mean, this is just this muscle here. This is a I want to I'll tell you. I don't even take them. This one. Yeah, but I used to take them. This is a muscle I'll take. That um >> Then why do you have them if you don't take them? >> Well, I I should cancel them on on my doctor's side of it. It's for nightmares. And and then they're they're um the uh This type of pill if you can just like chew pull apart. >> Got you. >> I tried to pull apart but that's what kind of that went down. >> The officer cannot turn prescribed medications into a charge without a lot more than powder and a family's word. >> I got one eye glass. I can sign something. Till I get ready to I got >> Well, I got a statement for you. You don't have to fill it out, but it's your side of the story. >> Yeah. >> You're going to put your name, birthday. You don't have to worry about driver's license, your address, your phone number. And then you're going to put what happened, okay? >> Okay. >> If you'll do that for me. >> Right now? >> Yeah, right now. Do you have a pen? >> That's why I got to have a better pair of glasses. I can do it with one eye. I don't need a pen if I can write on something there's a table. >> Okay. Well, if you'll fill that out for me, I'm going to have them fill them out too as well, okay? So, I get everybody's side of the story on paper. So, everybody has a fair chance, okay? >> Okay. Can I go to some >> No, you can't. >> Can I fill it out on that red box over there? >> Yeah, sure. >> All right. That's all. >> Do you want me to Or you can pull it out and put it by the bed so that you're not on the floor, but Here's a pen. I'll be back. Uh I got some statements. I'll let you have the clipboard. And here's this. I don't have another pen. Does someone have a pen? Okay. And then I'm sure you can use that table and you're going to put essentially put what happened. Um if you have any timestamps or time periods that you know of. I mean, you probably don't. It just happened abruptly, okay? Um I just need name, date of birth, address, and phone number so that we can contact you, okay? And you'll put it in chronological order or in the order that it happened, okay? >> I know I would cheat a woman but >> That's okay. >> [music] >> All right. I'll be right back. I'm going to call dispatch real quick, okay? >> Officer French is collecting written statements from everyone in the house right now, and that matters more than it looks. >> The wife lost all the evidence you guys obtained. We have no ground to charge you, okay? So, you're under arrest. I'm taking you to jail, okay? >> Oh, yes. For what? >> Domestic battery. >> Domestic battery? >> Yes, sir. Yeah, you don't need that. Do you want your wallet to go with you? Do you want any belongings? >> When am I going to um >> Like medication? >> Absolutely. Yeah, like medications. >> You'll have to see a judge on Wednesday. >> Wednesday? >> Wednesday, so Wednesday. >> You'll see a judge on Wednesday. He'll set your bond. >> All right. >> I just hope I don't eat cuz I'm cold. >> Do you have anything on you? >> No. >> Did you have his wallet? >> Okay. >> We're going to bring your wallet with you, okay? >> All right. Yeah, that's fine. Yeah, well, I'm here cuz I don't want to be freezing. Do you have kind of have a few words about the false sister? >> Do you what? >> Hold on. Cuz the rest of you are doing everything, I mean, it's us. And pull my pants up a few inches just a little bit behind my butt, okay? >> [clears throat] >> All right. >> Can I have a few words with my false sister? >> No, sir. >> All right. >> No. >> Got it. It's in front of my camera. >> Perfect. >> Is it unlocked? >> Is there anything in the backpack? >> Just a backpack. >> Okay. >> All right. >> Watch your head. Here's his belongings and then your backpack is Okay. Okay. I'm going to go give the Lars card and now run to the jail quickly and get that turned in, okay? Thank you all for coming out. >> Hey, you're welcome. >> All right. See you in a little bit. >> Every question he had on the way out the door >> [music] >> was about himself and Officer French answered every one of them. >> Officer French coming in. Uh he's being arrested for domestic third. Um I don't have any other charges. Um So, it's a it's going to be a misdemeanor charge. It's not He didn't do a lot of damage to your eye. He did a little bit. Um so, I can't charge any higher off that. Now, if the prosecutor deems that he's like, "Yeah, bring it up." >> [music] >> I can bring it up, okay? So, >> does that mean, like bring it up? To a >> To a higher charge, to a felony. This is the uh uh since it's domestic, misdemeanors, uh this is a the highest misdemeanor you can be. It's class A misdemeanor. After that goes a felony, okay? >> Okay. >> Um [music] uh which I understand that, you know, what he did is not okay. We we all understand that and that's why he's getting arrested tonight. >> That context is in Officer French's report now and that report is what the rest of this case runs on. >> Uh so, anytime there's a domestic situation cuz y'all live together, um we by law we have to give a Lars card, okay? And what a Lars card is is there was this young lady that uh had domestic situations that the cops came out there, but they never had uh uh enough to arrest the guy on because, you know, it was hearsay back then, but they changed the laws after that because she ended up getting killed from domestic situations. So, usually with domestic situations every time it happens, it gets worse and worse the next time. So, last time he Did he hit you last time? >> No. >> Okay. So, last time, you know, he didn't hit you, and then this time he hit you. So, next time it's going to get worse. So, the reason why we do the Lara's card is to advise you to either the parties get help some way, or if you need a place to stay, they can offer a place to stay, or um >> [music] >> um and >> Right. >> also kind of get you on the right direction to get him away from you in some sort of fashion, which I know y'all have, you know, financial things. That's why he's living here and all that stuff, and y'all said that last time. So, um um There is a phone number on here. I'd like you to call it, or one of y'all to call it, and uh just to They ask you a series of questions to make sure you're okay, and if you need to go get seek help for therapy or anything, they can do that. And there's a lot of times I can do that for free. So, it's just free help, and that's what, you know, uh they're wanting to do. So, I'm going to go ahead and hand it to you since you're the victim, but everybody in the household can read that. Um >> [music] >> uh I probably wouldn't let him really read it too much cuz he's not the one that needs help. You know, he's the one doing the damage. I'm going to get out of here, and uh I'm so sorry that these things are happening, and I don't um I don't like that. And but, you know, uh calling the hotline, that might get y'all on the right direction, okay? That That's the best solution here, okay? >> All right. Thank you. Thank you. >> I'm going to do my side of things and make sure that uh he's good to go in the jail, okay? >> Okay. Thank you. >> All right. Y'all have a great night. >> Jason was arrested that night and taken to the Sharp County Detention Center on a domestic battery third degree charge, which Officer French confirmed on camera. That is a class A misdemeanor, the highest misdemeanor level before a felony begins. What happened in court after that? We do not know. Is a misdemeanor the right charge for a second domestic call to the same address knowing the first one never resulted in anything at all?
