So, basically, we got a call by another customer that there's a baby. The door is unlocked on the back side, unattended, nobody there with it. Baby look like she's Sweetie. Sweetie. It's a 712744. Said they were informed by a customer that they saw a kid in the car without anyone else. Yeah, the kid's awake. Or she's sleeping, but I rubbed her chest, she started moving. Who was the manager? We all are. All of us, okay. Yeah, let me call you back. I got EMT here. I got to call you back. Bye. Um So, basically, I got a call from my front end associate saying that there was a customer claim that there was a baby in the car unattended. The customer was here, but and decided to leave. Then, when we came out to address the situation, I couldn't tell if there was a baby in there or not. So, obviously, I opened the door and saw that baby was in there, but the baby's been in one piece since then. Oh my god. I'm going to take video of it. Yeah, you're good. Thank you. So, basically as you found her is pretty much what we've been doing. I just stand and make sure nobody comes and adjust anything. So, the baby but the baby's just been like that literally sleeping. Have you all seen anyone come by the car or nothing like that? No, we came directly out of school in the front of the There's a Huh? We can pull it up. video >> can pull it up and make sure whatever we need. Do you have your ID with you? It's in the office. >> It's inside. Okay, what's your first name? Eliana, E L L I A N A. Hey, what's up guys? What's going on? What you got? Uh store said that they had a customer come inside tell them that they uh Um said that they saw a kid unattended in the car. Um this front end and all the store managers end up coming out here. They uh walk up to the car see if the car's unattended no customer nothing like that around. Signal 44 is in the car seat sitting there. Uh they said that the car was unlocked they didn't open it or anything like that when I got here. Um Signal 44 a weapon? No, sorry. It's a juvenile for us. Juvenile, okay, okay. Um when I got here she was in the car seat didn't appear like she was moving or anything so I opened the door rubbed her chest then she started to move around. Uh medics got here they pulled her out and she's in there checking vitals. Yeah, I'm talking to my guys now. He said they're a little she's a little lethargic um but she could also be a little sleepy girl. So, we're trying to figure that out. She's got like a scrape on her knee. Did uh anybody come out and claim vehicle or kid? Not yet. Okay. I'm sure they're inside right now making a request over the the Yep. Cool deal. Well, I'm going to give these guys a call. What's that? I said they ain't even going to come out of this place. Um kid's getting checked out by medics now. When I pulled up manager said that they had a customer come in the store telling them that they observed a kid in the car unattended. Okay. All the managers in the store came out were standing around the car. They said that they saw her in the back seat and didn't appear to be awake. Uh might be our person right there. Um I get up to the car. I look in the window, juvenile's not really moving or anything. I open the door, rub her chest, she starts moving around. Uh medics get here, they take her out of the car seat and they're checking her vitals now. How warm's inside the car? It's not warm. It's like outside air temperature. Um that might be mom right there. Oh, let's go talk to Wyman. I think that's mom. Right there? No. She came out of the store and then did like one of those numbers. Oh, okay. So, I thought that might have been All right. So, I have um their loss prevention is looking at the camera to see if they can see anyone exit the car. Was that mom? No. But as of right now, we don't have any 43 on parent info. No one's came out of the store yet. They said that they haven't had anyone come up to them yet, so um they kid has a cut on her knee. Just like an open scar, but that's probably unrelated. She's a toddler, under two, I would guess. Anybody come up yet? Nope. Okay. So, assessing this kid, yeah, she's she's very young, 1 to 2 years old. He's saying that for his assessment, looks like she has a pretty nasty diaper that has not been changed. She's got dirt and scrapes all over her. She also seems like she's sick. He wants to take her to the hospital to get evaluated. Given the state that she's been left in and the fact that she was left alone, he's he's willing to just take off. But, as far as the legality of it, having the conversation with you guys right now. >> Yeah, give me one second. Hey, so medics said that she has a pretty nasty diaper, like she hasn't been changed in a while. They said she's dirty all over. They said that, based off of their evaluation, she appears to be sick, and they want to take her to the hospital. But, on the legality of the situation, they wanted to talk to us about it. 682 for that phone. I just figured I'd ask you, Weston. Cuz they're probably thinking of trying not to kidnap a child, given the circumstances, but Sir. Ooh. Lieutenant Zarate. Officer Bixler, how you doing? Doing good, sir. So, what we're seeing right now is obviously no one's came out to claim this young lady. My medic is assessing the She's a Okay. Don't have an exact age on her, but she's really young. Per the assessment, she looks like she has a pretty stale, old, dirty diaper on. She's pretty dirty, except herself from head to toe. Got a few scrapes and bruises on her. Um he wants to transport her to the hospital to get evaluated by a physician and given the state that she was left in, he's ready to take off right now. But as far as the legality of it, again, you know you guys >> okay, so let me sort the legality. Aside from all those things, which I'm not saying they're right, but they're not an immediate threat to her health. Is there anything he's seeing, fever, anything like that? >> As of right now, we're not seeing any immediate life threats. We can hang as well. If you We'll wait for a few minutes. Yeah. Um I know I can't So the fire department probably got there before we did. The battalion chief isn't around now. Um Well, I spoke to the guy a couple of weeks An incident just happened. As I was going out 200. Okay. So they must have been going to something else if he never showed up here. Yeah, yeah, he may do We've had a few different calls for >> Okay, that's fine. So All right, so I I'm trying to figure out a timeline. That's what I'm trying to do. Okay. Yeah. So that was a good 7 or 8 minutes before we got this call. So anyway, yeah, I'm just trying to figure out a timeline. I hear you. We have no problem If you Yeah, if you would for a few minutes, I'm going to I just want to get a timeline down and if he's willing and I'm not trying to put the I'm not trying to throw him back on him, but if in his medical assessment, this would fall under implied consent that a reasonable parent would want their child checked out, I'll back it 100%. Okay. Fair enough? Understood. Yeah, understood. We'll give it a few more minutes and see if anybody comes out and claims and if not, we'll figure it out. Let me go do some more digging on times and and all that kind of stuff. >> I'll stay in communication with you. Thank you. Yep. Um I'm going to talk to loss prevention see if they have anything. All right. That's Okay. Do you have anything to add? Yeah. Okay. Uh 8:53. Hey, do you want to name him right now? No, no, we're good. We're good. Should I follow you, Oscar? Huh? Should I come with you? >> Who said is here. I don't know if you want to know. All right, so that's the vehicle. What time? Uh they pulled in at 49 after. They got out at 8:52. 8:52. So, make sure kids wearing orange, they entered the store at at 8:53. Our suspect pulled into the parking lot at approximately 20:50 hours, exits the vehicle at 20:53 hours. Suspect description. It's going to be a white male, brown hair, wearing a pink polo and khaki shorts with white shoes. He's also going to be accompanied by a white signal 44 wearing a yellow long-sleeved t-shirt. Could you put it on a DVD for me? I can't. I appreciate it. I'll be back. Yes, sir. Um Do y'all know if they made a page? No, we have not cuz we can't even put a name or anybody. I thought his name might be Thomas, but I didn't want to call him Thomas cuz it would pop up on the front window. Okay. And when you tell me I can go ahead and make Is it my outfit? It should be by now, but It's been 40 minutes. What's the RO's name on that car? Maris Ask her a Melissa Ask for the husband. Thomas? Of Melissa Sievers. If you can. Where to? Uh his vehicle. Uh attention all units. Can you make an announcement? Yep. So. I'll be back. Thank you. So I got him on video pulling up and leaving. He's walking with his other kid. He walked He was walking out of his car at 8:53 yesterday. Yep. All right. I'm going to back up here. So I got him on video. It's all right. So this is my lead paramedic hence okay. So what's what's the plan? Kids welfare is in your hands. If you think he needs to go to the hospital that's in his best interest her interest whatever it is her. Transport to the hospital. I'm not going to say I'm not I'm not going to tell you to do it. But if that's >> anything life can life threat at this point. Okay. Well, this is why you're a medical guy. I'm an ex-medical guy. But still it like I told explained to him if you think under implied consent it's in the child's best interest given everything we don't know right now that they go to the hospital and get checked out. I'll back it up. But I'm not going to tell you to do it either. I Oh my god. That's makes all the Uh there's somebody over there by the car. Shout out to right here. Yeah. Do you have your ID buddy? No. Okay. What's your name? Thomas. Shane. Son. Is this your car? This is my wife's car. She's Okay. Okay. How many kids do you have? Three? Okay. Who was the other kid in the car? Yeah. Okay. Yes. Why is mommy mad at baby sister and my Avery? Well, because we were just concerned about her. You were out here for 20 minutes in the store. 20 minutes. You've been in the car the whole time. You know she's not supposed to be left in there even with him cuz he's under age also. So So you have to be 18? No, but you got to be like a reasonable age. He's very smart. Yeah. I just ran in to get the groceries. I got three of them. Mhm. Sir. Yes, sir. Are you the father? Yes, sir. So this is where we stand right now, sir. Is she also here? Yes. So just so you're aware, for our assessment, while we're not identifying any life threats, she does look like she's sick. Looks like something might be going on and all we're concerned about is her well-being. Now obviously we're very limited on what we can see, but we strongly suggest that she go to the doctor, get evaluated, go to the hospital, be evaluated by a physician. And if they don't find anything, then from there she'll be medically cleared. Yeah, she's Yeah, that's his sister. We getting her life vest. We were on the paddle board swimming all day. But she's not sick. Um medic right here. can you hear me? I'm just going to ask you a couple of things. Do you hear me? What? You're on speaker phone. The medic's right here. What's your mother's name? Melissa. So, Ms. Melissa. Yes. Um, you're speaking with Lieutenant Zarate with Marion County Fire Rescue. Okay. So, ma'am, um, currently the position we're in right now, your daughter was found in the vehicle alone. Uh I believe I was in the the vehicle which is where the story Somebody had called 911 just because they were concerned about your daughter. Um Per my medic who did the evaluation per our assessment, your daughter does look like she might be sick. Um Your your husband was telling me telling us that she had come from from work all day, so that would explain her being covered in dirt. However it would be within her best interest for her to be evaluated by a physician. Our suggestion is that she goes to a local hospital to be evaluated. And if they find nothing wrong with her, well, then she'll be medically discharged tonight. But if they do do do an evaluation and they find something going on, then we'd be able to address it early. That is our our professional opinion. And we want to be there with her. Yeah, absolutely. So, yeah, you would you guys wouldn't be barred from that. As far as I'm concerned, you know, you guys could follow to the hospital and be in the room with her. That is our suggestion that she go home. Um, I think I can take her to be evaluated. I hear I hear I hear you, ma'am. So, are you denying medical transport? Um, yeah, I would prefer to take her myself, but I can take her to be evaluated. But again, this is for your daughter in the back of the ambulance. I got you. You would uh you would be most in the way. For us to to take her to the It's a public place. Can I see my daughter? Yes, you can absolutely talk to her. Yeah. I think that Okay. All right, good. Um Give me just a few moments. I'm going to relay this information back to the music paramedic in the car and then we'll get back to you shortly. Absolutely. Just give me one moment. What's the problem with my back? I'll get you a blanket. Do we have a bunch of She's going to want to see her. Absolutely. We got a bunch of guys in there so I just want to make room for you, okay? I hear you. Give me one moment, okay? Thank you. She's on on her way up there right now. I need to go finish catching up. Let me call back in and let her know what's going on. I have to go back. All right, sir. You got to stay with me. All right, bye. Why do I have to stay with you? Because we're doing an investigation right now so you just have to stay with me. It's not that you're in trouble or nothing. You just have to stay with me. If he didn't get out of the car, this wouldn't have been an issue. He didn't get out of the car. Okay. Why Why Yeah. Like I was telling you, you're not free to leave right now. I know. I just don't know why he's he's yelling at me. I'm not yelling at It's for your safety and mine. So. So. Wait, what are they saying? I I don't I don't know. I don't know. That's what the paramedics told you. They people called in because they were concerned because they seen your building in the vehicle device. But that's all. And we got here, they got her. You know, of course we evaluated her. You know, that's Here we are now. Why Why is he like yelling at me like I'm Oh, well, like I said, it's just for your safety and ours. Just wanted you out of the vehicle. I was about to tell you that also. Like just to stand out here with me. How long was this? Who's? How long was this? I told you last time. I don't know. Can I see my daughter? Like the lieutenant said, that's with Manatee Fire Rescue. You'll see your daughter. So thank you. Did you see her? No, I didn't see her. By the time I got here, she was already in the back of the ambulance. They called you guys and all you guys. Mhm. Yeah. Does this ever happen before? Pretty sure. I mean, have you Oh yeah, yeah. Yeah. So what do you think Ava alive is? Well, leav- you know, I wouldn't recommend leaving her or your son or in the vehicle. Like nobody's safe. I wouldn't recommend it. Mhm? What did he say? I'm not sure. I didn't hear what my partner said. That's your partner? Yeah. They're all your partners? No. That's That's my sergeant. The one who spoke to you. I know. I can tell. Yeah. Did you see the other kid come back out to the car at any point? Come back out to the car at any point? I don't understand. Or only when we made the page. I think when we just made the page it was all time consuming. We were out there the whole time. What time did the Do y'all know what time the customer came and told y'all and y'all went out there? I got a call from my person at It was at 59, wasn't it? So I called Johnny, then I called Jennifer about the EOT, then I called Johnny again. She called me about 8:59. 8:59? >> Yeah, can you get a shot, uh, heavy set African-American lady at grocery door? She was over by, um, Yeah, yeah, I I saw them. Okay. She was the one that, uh, said something. 8:59? Okay. So, from 8:59 to >> 8:59, y'all went out to the car, and y'all didn't see anyone else come or go? No, I didn't see you. Him for That's all I needed, thank you. You dropped the the problem with the information, right? Yes. Dude, what what What are you going to do right now? Um, I'm waiting to see what they're going to do before I start questioning him. Okay. Um, Well, let's go over here so they can get to you. Okay. Um, But, if you'll give me the family kid's name and stuff or whatnot for their paperwork, No, the better concern. Okay. Yeah. So, uh, I just wanted to reconfirm something. I went back in there, talked to them. Um, I was like, "At any point in time on the camera, did you see a kid running away from the car by himself and the dad come back out?" And he said, "No." I said, "What time were y'all notified?" They said 8:59, and then they immediately came out to the car, and no one came or went. All right, where um, Where You can really talk to him again, and I'm going to be over your shoulder. >> Yeah. Cuz I know exactly what Or or I'll talk to you. So, we're going to get the story out of him. What direction you guys want to go? Same direction or did anything change? No, no, I I just um we wanted to confirm that the kid did leave They The kid was in there for over a half at least a half an hour unattended. Got it. Um so yeah, he's just going to give you guys the name and information and all that stuff and Is there an age limit that's appropriate in the state of Florida that you can leave the a child? Figure it was 18. You know, if a minor is a minor. I was going to say if the car catches fire with a 13-year-old in it, that's that's the wrong age. Yeah, absolutely. Okay, so but but I think it's it's pretty much, you know, it's not too hard to argue that even if he in a car with a whatever she is, with no means to communicate if something goes wrong, that's not responsible adulthood. I agree completely. Yeah, so it's the court's favorite words, it's all in how you articulate it. You can make it sound rosy and and and cheery or you can make it sound doom and gloom. Just the words you choose. Yeah. So. This one it kind of writes itself, so. It does. Do we know what the 10-52 is on his wife? No. Do we know what the 10-52 is on his wife? No. I'll send your wife going to be here. She's She's here now, though. She says Oh, okay. Thank you. They're here. Wait, they're not going anywhere. Oh, I just I was just wondering if I could help him with the stroller or whatever he may be doing. I just Yeah, no. We just Morning. Okay. Um but no one's going anywhere till y'all get there. Okay. All right, I'll see you. That's Pam. That's Pam. That's Mom. Mom doesn't have a license. She's now going to go get it. No. No. >> Get her back. Pam. Hey. Sorry. We're not going to shuttle people back and forth all night. You want to take custody of the kids? I will. Okay. Fire rescue says the little one needs to go to the hospital and get checked out. Okay. >> Are you okay with that? Um yeah, that's fine. >> Or put me on the phone with mom and I'll explain it to her and she can do that. >> She knows and she said that she would take them. Well, but I want to make sure they get there, so I'd rather they do it. And they'd be more comfortable doing it with some of the findings. Fire No, fire rescue. Oh. With some of the findings they've got. Let me call her. All right. And what's her name? Melissa. Hello, Melissa? All right, this is Sergeant Booksler of the Sheriff's Office. Um is this lady your your sister or your husband's sister? Your sister, okay. She's here. There's no reason we can't release your son to her to him if you're okay with that. But waiting for her to bring you back here accomplishes nothing, but slows everybody down, okay? Fire rescue's checked out your daughter. They've got some things they're concerned with as far as her well-being. I would feel better if she goes to the hospital with them and gets checked out. That way we we know if something happens between here and there, she's in good hands. Are you okay with that? No. Yeah, well No, your fire rescue wants to take her to the hospital. Your sister will take your son. Well, you need to figure out something quick cuz they're not going to sit here all night. All right? Up here up here to Walmart. How long's it going to take you? Okay. All right, well, how long are we talking about before you get here? Cuz the post office says the Denali's 2 minutes down the road. Although I know where the city of Denali is, so be a little bit more specific with me. Okay, all right, fair enough. So, you're going to be here within a half an hour? All right, fire rescue will wait as long as they can, but if they deem it necessary, they're going to go ahead and take your daughter to the hospital. All right, and your your sister's here, so she'll know what's going on. All right? Thank you. All right. Mom wants somebody to go with the child to the hospital. She's in the middle of it. Yeah. What I told her was she's in your care. You think she needs to go to the hospital. If you guys she figures she's at least a half hour away. If you guys deem it's not in the child's best interest to wait that long that you're going to go ahead and take her to the hospital. Yep. Okay? Okay. So, you tell me you got to go or you know whenever whenever that line gets here you deem it's not appropriate to wait any longer let me know and you go. I understand. All right? Okay. We likely won't be taking any family members with us en route to the to the hospital. They can meet us at the >> Okay, well that's your policy, so >> we can have that conversation with the family. I I know. Yeah, yeah, no problem. I didn't you know If I'm going to always want to tell you as well is the family is like no I'm I'm going to go you know one of the Yeah, we have ways of dealing with that. >> Absolutely. We'll deal. I mean have a conversation with my medic. All right. All right, thanks. Thank you, sir. All right. Young man, let's go over here and talk to your aunt, okay? You stay here with her, all right? All right. Have you Mirandized him? Um I haven't. All right. I got a card. All right, I'm going to read you something here. You have the right to remain silent. You understand these these rights I've explained to you? Yes. Have you made up your mind you wish to speak to me? Sure. Correct. you. Why are we all out here in the parking lot of Walmart tonight? Because I left my son and my daughter in the car while I went in and did some shopping and my son came in there to get me. How long were you in there before your son came and got you? About 10 minutes. What time did he finally find you in the store about? Um gosh. What time did he get there? 9:20, maybe 9:25. >> 9:20 you said? Yeah, that's when we got in there. So, he probably 9:30, 9:35. Okay. How about if we back up to when this all started and you start being honest with me? I am. No, you're not. Cuz I've got you on video. I know what the time frame is. Okay. And it is not your time frame. So, why don't you start by telling me the truth and read through it again? And I'm don't know the exact time. What time was it tonight? >> I don't have to tell you. You tell me what time it was. You left two children unattended in a car. I would know exactly what time I did it, how quick how long it took me to get back out here. And you're telling me it took you at least 20 minutes after your son found you? I was in the store 30 35 minutes total. Let's go with 40 minutes. And your son was not in the car. Your son went in the car with you. Or or went into the store with you. I know this for a fact. Yeah, my son came into the store with me. >> With you when you went in. Correct. In fact, when you came back out to the car, you bailed on your son, left him in the store. You didn't know where you were for a couple of minutes. When they I said told him to come on and he was in the toy aisle or whatever he was in. >> And he was wandering around cuz you'd already made your way out here. Told him to Did he Was he on your heels? No, he wasn't. 7 years old, you left him in a Walmart unattended. Even for 2 minutes, that's all it takes for somebody to snatch it. I'm scared to death >> Yeah, you should be. And I ran and he's over here doing push-ups and jumping on this car. I have three children and it's hard to deal with. Yeah, raising kids is hard. I get that. And I have one that's elderly. But let me let me tell you something, okay? You went in the store at about 9:53. Yes? 9:53. >> 8:53, I'm sorry. Okay. All right? That about right? I'm listening to >> Your son went in the store with you, right? Yes. You were in there for 35 to 40 minutes before you heard a page to come back out to your car, right? >> came right out to the car. The whole time you were in the store with your son. Yes. The whole time your daughter's out here in the car. Unattended, correct? Car is not locked, correct? Car was not locked. Did you know it was not unlocked? No. You thought you locked it? Yes. Okay. Cuz we have a we have a light issue on the back. Okay. So you're telling me that you were in the store for 35 to 40 minutes with your son with your daughter out here in the car. She was asleep in the car. And nobody was watching her. On the water all day. Nobody was watching her. Except for Except for the managers when they became aware of this, stood around this car for 30 minutes watching her to make sure nothing happened because you were in the store. Do we see a problem here? I can't lose custody of my daughter. >> do I Custody's not your problem right now. Do you see where this is going? Set your cup on the truck, you're under arrest. Can I ask why I'm under arrest? For what? >> Cuz you left your child in an unattended car for 40 minutes. The fact that you still don't know why you're going to jail is crazy. What is the charge? Child neglect. Child neglect. Just common sense. My bad. Do you have anything on you that you should not? Any weapons, any guns, drugs, knives? I think he's got a lighter in his pocket. I got a lighter in here. Fishing The lighter's in there. Don't reach for it. Don't reach for it. I'm not reaching for it. Sit right there. All right, I'm asking you one more time. You got anything in your on your pockets, any on your person that you shouldn't? >> fishing equipment and that's it. That's it. All right. Lean up against the car. Spread your feet. Wider. Thank you. So Walmart's not going to call us and we're going to end up putting the charge on. Okay. So you came into Walmart with fishing gear? Yep, we got fishing poles and we got bait. Okay. >> [clears throat] >> Spread your feet. >> You ever been arrested before? Yeah. In Florida? Uh yes, twice. Okay, for what? Uh It was a misdemeanor possession charge. Okay. What about in South Carolina? Yeah. For what? Uh violation. Of? Misdemeanor. Okay. All right, go ahead and have a seat. Stick your feet in. Watch your knee. Who's driving? Who's driving the ambulance? Yeah. He's back there now. Let him know we're clearing out the path for him, so They can't wait to take her to the hospital, so they're going to go ahead and go, and uh What's wrong with her? She's just not acting healthy. She's not She's not acting right. They're not comfortable with it. >> So, I I'm Okay. Okay. Okay, well, I I I was just wanting to tell whoever that they're trying to get that path clear for them, so they don't have to back up and stuff. Um can you tell me what happened? Cuz I'm not I've heard a little bit. >> Thomas is his dad, right? Right. Biological dad. >> Okay. All right. He abandoned her in the car. He was in the store for over 40 minutes with her in the car by herself. That's not good. So, he's going to be going to jail tonight. And she's got She's in light of everything, the way she's acting, um they're not comfortable releasing her without a trip to the hospital to get checked out. Maybe it'll be nothing, hopefully. Maybe there's something there, but she has not moved around much the entire time we've been here.
