Uh Rafy is just in the bathroom that he's going through. >> Yeah. Yeah, I'm with him. >> All right, cool. Thanks. What's going on, man? It's my first time meeting you. I know that uh I'm Kevin. I know you >> you know who I am. >> Um so you obviously understand why we're here. Um, so at this point, um, I know that you've already spoken with Pam and Jose. Um, we would like to speak to you, uh, and talk to you about everything that's going on. All right? So, I'm going to read you your rights so you understand what those are and then we'll go from there. Okay. >> I'm required to warn you before you make any statement that you have the following constitutional rights. >> Oh, never mind. Hi. >> Um, you have the right to remain silent and not answer any questions. Do you understand? >> Yes. You have the right to present your choice before you can wear your presentation. During questions or understand uh do you understand all these rights I've read to you? >> Yes. >> All right. With those rights in mind, are you willing to speak with me? >> Yes. >> All right. So, um I don't I don't want to reinvent the wheel here. I know that you already spoke with um Pam and Jose about what has been going on and for whatever period of time. So, if you want to go back and kind of start from the beginning and tell us what's going on and uh we we'll go from there. Well, so I have somebody in my life that is kind of um like narcissistic kind of thing to where like the world revolves around them, you know, and then it's like um basically one of those like um you do what I say or is not good for you kind of people, you know. >> Who is that? >> Um it's u like an ex of mine. >> Okay. Um I'm not going to name any names but um basically um it was like you know he like where he so all this stuff did not benefit me right it's more for my safety kind of thing like I got no value out of any of this just so you know we can be clear on that but because like I would used to be at threats of um he would either come here and hit me or you know all this other stuff like I got scars on the back of my head from him. Um I think this eyebrow was busted at one point from him. >> Can you say him? Is that the ex? >> Yeah. >> Okay. >> Like this scar right here is from like a couple months ago. So it's like >> was this all occurring while you were still in in a relationship with him? >> No. >> So you were already broken up? >> Yeah. Um the threats that were being made or the comments that were being made, how were those being made? >> Like in what aspect? >> Like he would tell you >> a lot of it was like over the phone kind of thing. >> Were there any text messages, anything written, anything like that so that you can I'm asking more so for proof of what you're saying that that is is true. >> Um I mean there's some text but most a lot of it's over uh phone calls and stuff like that. Okay. >> So, >> are you willing to show the text messages that say that, hey, if you don't do this, I'm going to hurt you or kill you or whatever that the >> Let me let me see if I can for you real quick. >> While you were with him, have you ever had to call the police? >> Um, let me come to your house or >> No. So, I've never called the police. I've there was times that I should have, but I never have. >> Have you ever had the police called on you by like a neighbor or somebody that was witnessing or hearing anything? >> No. >> So, the police have never responded to something like that? >> No. >> Okay. >> But I do have like, you know, pictures of a long time ago, but that's that's a long time ago. >> Let me see. >> How long you worked here, Chris? Oh, >> what? Two, three years. >> Almost four. Almost four. Mhm. What would you do with everything that you take in the cell phones and all that? What do you do with >> just give it cuz to him? >> Yeah, cuz like I said, I have no need for them, right? Cuz I already have a job, you know? I mean, so I don't need things like that. So, it was all to him. >> How often did he ask you for stuff? >> Um, at one point it was like every other day and sometimes like once a week and then How many times? What? One, 20 times. 30 times. >> Not sure exactly the amount to be honest. >> How would you do it? >> Um, a lot of it. A lot of it he did. So, he would just give it to him and he would do the stuff. >> Elaborate on that. What do you mean he did? Like he would do all this stuff like taking it and like >> like he would come up to you and take it or >> like come here and take it. >> He would come here and take it. >> Well, for me >> and he but he would walk out with it and stuff like that. >> But you have the stuff. >> Yeah. >> And you know what he did with that stuff? >> Honestly, no. Uh because he doesn't really tell me about his life and then or like you know what he does, stuff like that. >> Did he work here at one point? No. >> How long have you known this person? >> Oh, since 2021. 2020. Something like that. Between 2020 and 2021. >> So, basically when you started working here. >> No, it was before that. It was maybe maybe 2019, but it was like a maybe 2019 going to 2020. >> Okay. But >> so, uh, you're no longer with this person, correct? >> No. >> Okay. And you made a comment that you don't want to name names. >> Yeah. >> Why Why don't you want to name names? >> Um, because it's like this um like one of those things. It's like, you know, if I happen to say it, then it's like who knows what's going to happen to me kind of thing. You know what I mean? And I'm not the kind that wants anything to happen to me. >> Okay. So, you understand with us being here and talking to you, right, that there this is >> outside of the Walmart >> side of things, right? That was more of the administrative process. >> We're here on the the criminal investigation side of things, right? >> Yeah. And because there is the allegation of a theft that has occurred, a missing property, and there's evidence that they have to prove that you were involved in that in some way, shape, or form. Right. You're making some pretty bold claims saying that you were in a way forced to do what you did, right? >> But without naming the other people that are involved because it was more than just one. >> So me it was one. If anyone anything like I told him, if there was more than one, then I have no idea because to me it was just one to go. >> Well, he means his not just you, he means your ex as well. >> There's So, but there's more than one other person that was involved. >> Yeah. So, that I don't know. >> Did they show you the photos of the people that were involved? >> Yeah. So, I showed them cuz one of them is the same person just without hair. >> Okay. >> Um the other one I have no idea honest about on that one. But unless >> you were seen on video interacting with that person. >> Well, like I said, I don't know him physically. Like I don't know who he is really. >> Okay. >> Most of my talking was to Justin. >> Justin would send him or something. >> Mhm. >> Would just >> Yeah. >> Would send him >> that other person. You don't know him besides your ex. The other person. >> Yeah. No, just the ex. >> Okay. I don't I don't know if you're fully understanding what what we're trying to gather here, right? >> Not. But >> so there's Justin. >> Mhm. >> And then there's this other guy. >> Mhm. >> You're saying you don't know this other guy? >> I only know Justin. >> Okay. >> Physically. Yeah. >> That's And I understand that. But you interacted with this other person that that's that's why they knew that he was a part of the theft that you were involved in because they saw you guys interact. So you have to know of that person or knew that you were supposed to give the stuff to that person or what what have you, right? >> How did you know to give that person >> to not give that person >> to give the person that one person that you don't know physically? How did you know to give him whatever he gave? What would I give him? >> I'm not sure on that exact incident right now because they took all the paperwork and whatnot, but um that's all I'm trying to say is you're identifying Justin as the one guy that's involved in some of the incidents, but then there's another person that they saw you interact with. So, >> who is that? Like I said, it might be one of his friends cuz like I said, I'm a talkative person. Like I'm not going to, you know, not talk to anybody kind of thing. You know what I'm saying? Like I'll talk to whoever >> or like, >> you know, like I'm talking to you. But if we weren't like in that situation and you know, you ask whatever or talk to me, whatever, then you know, I talk right back without an issue. Like, >> right. The question the question is did you were you given instructions like hey this guy's going to come in here you know >> no most >> here's what he's wearing or whatever give him the give him the items. >> No it was mostly to Justin. >> Okay. So this other person that they showed you the photo of that you say you don't know. It was just a random customer that started talking to you and then you helped that person take stuff from the store. >> What photo did I help him take? >> I'm I'm not sure what it was. Like I said, I don't have to >> I don't know. I'll be right up with you. >> Okay. >> Well, they did show you the picture, correct? >> They just showed me a picture. >> You g Can we get you? >> Yeah, they just they just show the picture >> somebody. >> Okay. Are you're still looking for the messages? >> Okay. What would What would be an example like of what would happen if you didn't get the items? Let me tell you what happened. >> Um, a lot of times he would threaten me with that he would come here and um beat out of me and stuff like that. Um, and it's not just stuff that's like in the work, but um, >> okay. See, >> because like like because even if I do like this one little thing where you know I don't understand them, these are the words that he said. It's like He's asking who the AP is. >> No, this is um No, the app. He He meant to say app cuz I sent him the Uber thing, you know. >> Okay. >> He just misspelled app. So I think I don't know. But it's like >> I think he's asking who the AP is. >> M maybe. But I just know that it's like um there's that. Um >> so let me let me ask you this, right? Uh at any point in time in the 2 years that this has been going on where you've been claiming that you've been threatened by him with violence of some sort if you didn't help him help facilitate the theft of whatever the items were, right? Did you ever call the police or think to talk to a deputy about what was going on? >> No, cuz it would make it worse kind of thing. Cuz like cuz the thing is like where am I going to go? You know what I'm saying? >> Do you live with this person? >> Not anymore. I live with like a friend, but it's still like he still has access to my bank account and all that stuff. So, it's like there's there's a lot of things going on in life. >> Okay. How old are you? >> 27. >> Okay. Uh before working on the actual sales floor, >> you were part of the asset protection team. Correct. >> A long time ago. >> Like two two three years ago, right? >> Yeah, something like that. >> That's why Deputy Cavo knows you and that's why you know Deputy Barono, right? Oh, hello. >> So, the fact that you've had personal interaction with law enforcement, obviously in a work capacity, but it's to the point where you guys know each other. The that's that's what's making it strange to me that if you're being threatened to commit a crime that you know is wrong because you used to work to catch that. Oh, >> right. Why would you not have been like, "Hey, I need to put a stop to this cuz I don't want to I don't want to lose my job. I don't want to I don't want to get in trouble. I don't want to go to jail." Right? That's kind of a normal thing, especially if you've already worked doing that job, right? >> Why wouldn't you not have reached out to law enforcement if that was actually going on? >> Um, more than likely out of fear kind of thing. >> You just spent 5 minutes scrolling through text messages >> and there was most in there >> cuz we go back more and more then you can find it but a lot lately and stuff that's been all over phone >> if you can can you search on your phone >> I don't know >> if you go back into like the generic text message part where all the messages are there not just the individual text like not just the individual message thread right go back to like just the messaging app >> on the top if you scroll down on the top it says search >> if you can remember a phrase that he utilize to threaten you. You type in that phrase and it'll bring up whatever message. >> Chris, how long you and Justin live together? >> Um, we lived together for two two and a half to 3 years. >> Did you move then you moved to his uncle's house? Correct. >> Yeah. >> Um, that's Justice, correct? >> Mhm. >> Okay. That's the other guy we're talking about. >> Yeah, that I don't know. >> Okay, Justin. >> Mhm. >> And this guy always connected together. >> They might have been friends. >> You have to know who that guy is cuz he used to give him drinks and this and that. You have to know who that guy is. I mean, you know Justin for four years or four years. >> Yeah. But doesn't mean I know him. >> That guy never came around. No, because he has when I tell you there's friends that I've seen maybe once or twice that live um like in for example like I know of them too but it's still like I really don't know them. You know what I'm saying? Or who they are exactly? >> You happen to know his name? It's like like Bren Bren or something like that >> cuz I mean if I'm together with my boyfriend for the past four years I'm going to know his friends. >> Well the thing is >> and they've been coming in together every time. I understand you're scared. >> No cuz the thing is is um like when we were together this was I not around. You know what I'm saying? So it's like >> here's the deal, right? You're looking at at some pretty serious allegations because of the amount of theft that has occurred, which you helped facilitate in various different ways. Whether you checked out the key to go into the cage >> or whether you disabled the fire alarm, there's a lot of different stuff, right? If you want to sit here and take it all yourself, then by all means, understand that you're going to get the full wrath, right? However, if you're making these claims that someone else is directing you what to do, telling you what they want, what they need, whatever, and you're doing it out of a fear of violence or threats against yourself, right? Then it would be who of you to indicate and identify the people that are involved because at the end of the day, I'm just a I'm just a police officer. >> I'm what what they call law enforcement, right? I enforce the law. Okay? when it go gets to the point where it goes before a judge and a prosecutor and a defense attorney and it's actually in court, all of those mitigating factors that could come into play is that's when it comes into play. More cooperative that you are in the investigation side of things right now, the better it ends up working out for you in the long run because the judge, the defense attorney, the prosecutor is going to be able to see this whole video. They're going to be able to watch everything of what's going on. They're going to see all the videos of what happened, all that stuff, right? They're the ones that if you are cooperative, then it's going to be something where they can help you in the long run where it could be avoiding jail. It could be less fines. It could be probation. It could be all sorts of different things. I can't sit here and make you any sort of promises cuz that's not my job. I can't do that. I all I can all I can say is that there's a possibility and I know that because in my career I've worked with people who have decided to be cooperative and it worked in their favor. I've worked with people who have not been and it has zero effect. There's all sorts of things that can happen. Okay? So, I'm not sitting here trying to make you any sort of promises or twist your arm or anything like that, but you're making some pretty stiff allegations that somebody is kind of forcing you to do what you've been doing for a two two-year period and you haven't notified law enforcement at any point in time that you it it's at a point where you kind of need to be like, "All right, this is what's going on. Just be straight up, right? And just tell us exactly what's going on, who's involved so that we can go investigate further." >> You understand what I'm saying? >> Yeah. you you got to be able to help us help you. This this is the time where we help you as well. It's not just hey, you're going to jail. That's it. You know, we are trying to help you as well. I'm the same. >> And if you are concerned about threats of violence or something like that, there's other resources that we can take in the court system, right? We can tell the judge of what's going on, why there needs to be no contact order put in place. And then if that no contact order gets violated, then that's when that person, whoever violates it, can end up going to jail and get additional charges. You understand what I'm saying? Like we're not trying to just charge you with what's going on. >> There's we understand obviously that there's more than just you involved and everybody that's part of it is is responsible in some way, shape, or form, right? So that's why the blame needs to go to everyone. If you want to sit here and take it, then by all means. It makes it easier for me because it's less paperwork. I personally don't really care if you want to tell me everything. I want to know just out of my pure curiosity. And those guys are from what you're saying, they're the ones that are making you do this crap. So, they're the ones that are really responsible for it, right? [clears throat] So, why not catch the actual bad guy, right? I used to work drug cases and I would would start with the the lowest rung on the ladder of the the user, the person that would go and buy it, but I want to get to the top of the ladder. This is very similar in that sense. If you're saying that they're telling you to do this stuff, you're that low rung on the ladder. I want to get to the top of the people that are making you do it, that are going and taking the stuff and whatever they're doing with it, whether they're using it, selling it, get trying to get profit, whatever they're doing, that's that's the end all be all goal here. And just keep in mind that you're protecting them. If we pick them up, they probably sell you out >> 100%. Guaranteed. >> So, >> as soon as I as soon as I get them >> every on his own, bro. >> Yeah. I'm going to do the exact same story right now and then be like, he told me to come take this all and I gave it all to him. Chris always been honest with you, buddy. >> Listen, at the end of the day, the jig is up. Just all we want is the truth. That's it. Like I said, the part with the thrings and stuff, that that is 100% true. >> Okay. >> Times where I should have probably called when I didn't, that, you know, that's that one's on me. But it's like, you know, it's like the thing is is like what would happen after the fact, like when it's all over, you know what I'm saying? because um like I don't want to live in fear kind of thing like after it's done watching over my back and stuff like that and it's like you know what I mean cuz like if he goes to jail hypothetically and stuff like that it's like and he gets out it's like you know >> let me level with you. >> Mhm. >> Obviously you're part of the community. Okay. I worked for Do you know World Manners? Are you familiar with World Manners >> down south? Yeah, in Broward by Fort Lauderdale. It's a gay community. Predominantly a gay community. I worked there for 12 years. >> That's where I worked a lot of my drug investigations. >> A lot of meth guys, highle meth trafficking cases. And that was one of the biggest things, right? They were all concerned that, oh, this person's going to kill me. He said this, he's going to do that. What I have learned in the community is they're a lot of talk, right? They want to instill that fear in you to do whatever they want you to do, but they're very, very, very rarely actually come back and do anything because at the end of the day, they try to do something to you, what are they going to what's going to happen to them? They're going to get arrested again. They're going to get additional charges and then it's going to even be on top of that, there's more charges that can be related to like tampering with a witness or something like that with the court process. Most times, almost every single time, everybody just goes their own separate way and they know that, hey, yeah, this guy, I used to I used to with this guy, but now not anymore, right? Because things went bad or whatever. That's most likely the case that's going to happen here. All right. Now, added protection that that can be got from the courthouse and the court system is a no contact order, restraining order, injunction, whatever you want to call it, but it's a court document that's signed by a judge that says that you guys can't have any contact. And if either one of you violates that, then that person can go to jail. All right? So, I understand that you may be concerned that this dude is going to do something to you, but it's extremely rare that that ever happens. one. And two, there's other legal protections that can be put in place to help you so that that doesn't happen. >> Cuz he also carries too. >> He carries a gun. Okay. >> Sounds like >> Has Justin ever been to jail? Been arrested? Well, I've he had an issue with a cop where apparently he got hit by a cop down south and I think Fort Lauderdale that I don't know if he got arrested for that. But um >> is what's is Justin Hispanic? >> He's like mix. So black, Puerto Rican, white. What's >> Barb everything? >> Now after you guys live together. So when I first started um when it first started he came up because I used to live in Sassa Florida up north of Tampa and he would come up there stay there and then we moved into his house and then you moved up. >> So you know where Tampa is like it's like an hour north of Tampa first citrus county. Um, I lived up there for like 10 years cuz I used to live in Clear Water before that, >> but I'm originally from P County. >> Okay. >> But, um, >> so I guess all your family's older. >> Well, most of them are gone kind of thing. And then the other living family that I do have like up in P County, um, they're going to going through a whole thing too. They're they're [ __ ] up and down with the cops and this and that. That's like you never did. >> Have you? >> So when I was younger, >> you were a kid. >> Yeah. But then I got exposed. But besides that, now you be clean the whole time. >> Versus these two individuals right here versus Martinez and whoever this white guy is, which I know you know who it is. you're afraid, which is understandable. I understand you're scared, but on the same token, they're also part of this. I mean, there's nothing to say that, you know, as it is, he's not going to come back to you and talk to you anyway. >> Yeah. Well, so would you rather be protected by us or or be or just take the chances with this guy? >> Well, he would be the ring leader. Okay. that would he's the one who's doing all the stuff. And then this is also his ex. >> Okay. >> That is who I'm technically living with at the moment. >> This guy. >> Yeah. >> Okay. What's his name? >> Brendan Moer. >> Brendan. >> Moer. >> M O S E R. >> Okay. Yeah. Anyways, >> that name. Okay. >> Yeah. But it's like he really is not like it because it's like he's still >> Yeah. Let me cuz he's still in love with him. >> Okay. >> But he don't love him. >> But then he still will do anything for him kind of thing. >> Okay. >> But he is like the main person for everything. >> Is there anybody else that would No, it would be just >> Brandon and Justin. >> So So Chris, walk me through. How does how would it work? Justin Justin would text you or >> Well, he would call and like if he didn't text, he would call. >> Okay. >> And say what? >> Um that he needs this. >> He needs like this uh whatever item. Um and it's like when you tell him no or you know another day, whatever, it's like not happy. just like um um cuz like even if I tell him no cuz he likes to go down a little man and stuff like that and I I don't like going out to work. >> Yeah. He he loves he loves >> Justin does. >> Yeah. Yeah. I don't I'm not really that big of a person to go out. I'm more of a homebody kind of person. >> You said he was arrested in Broward. I don't know if he was arrested, but I know he had like a run in with one time, but I don't know if he's physically been arrested. >> Yeah, that's Justin's correct. >> Yeah. Okay. >> So, so Justin So Justin calls you says what? An iPhone 15 >> or whatever. Yeah. >> Okay. >> So, kind of just kind of walk me through it. How how how did you do when he calls you to say >> well the things that you gave you know >> when he calls you for the iPhone I need this iPhone. How did you do it? >> So to be honest with you 90% of the time he would just come in. I would give it to him. He would walk at the door with it. >> But is it not in a lock facility or box? How would you get access to the box? >> Um we we have a key system that we can get keys out to open things up. Is that a like a manager? It has >> um for that one. Yeah. For other things, it's whoever can get, you know, but um like 90% he got and took out on his own. >> He would just tell him >> he would, you know, Chris, I want this or however he called you, you would just >> and whatever was inside of a lock container, he would open it. >> And not like I want to do it, but it's like one of those things that, you know, I understand. No, no, I understand >> because like I have my own job. I make my own money. I don't >> physically me I don't need >> Would Would he tell you that he was sending in him and just hand him stuff too or >> like one time and that was for like an SD card? >> That was for Brendan, right? >> Yeah. But it was not for Brendan. It was for Justin, >> right? But he sent him in to get >> Yeah, it was but and under that I honestly don't remember. Honest honest to God. Did um when Brandon come in? You say you you are with Brandon now? >> I'm staying at his house at the moment. >> Where is that? Wellington or >> Yeah. Off of um where >> Ben Creek. >> Ben Creek. >> And you're staying with him, but >> it's a whole >> What is What does he do for work, Brendon? >> He has two jobs. He one's he works at Polo and then the other one he works at a restaurant off of Palm Beach Island. >> Back in the island, right? >> Yeah. like north of the north part of the island. >> Ah, okay. >> Do you do you know if he does favors for Justin, too? Like giving him stuff as far as off the >> um I know he he buys Justin's a lot of stuff. Um anything after that? Like I don't know what they do on their personal time when I'm not around. So I'm not I can't answer for that part. But >> I was just wondering because if you're going to tell me he was also like a loss prevention guy for another or something. >> No, he he's one of those people that just loves um serving. >> What does he drive? >> What he drives? >> Um I'm not sure the year, but it's a Volkswagen Tiger one. >> It's a SUV, right? >> Yeah. Nice. >> Yeah. >> Yeah. It's older one. >> I got a 2023 Nissan Versa. Cool. >> Does Justin have a car? >> Yeah, it's a GMC Acadia uh 2017. >> Um does anybody else live at the house with you and Brendan? >> Um well, Brendon's mom and his other siblings. >> Four four or five other siblings. >> Okay. >> So, pretty much you're here alone. So, >> what in life? Yeah, >> it is what it is. It's life. It's how things happen. >> Now, this is the time where you got to recuperate after this thing. >> Yeah. Know, >> you can't just let this be a a stolen. You got to move forward. And we're going to do our part with this, too. >> To make sure that you don't get mistreated anymore or get >> Well, the only one that mistreats me is Justin. You know, >> we we'll take care of that. Okay. >> I do appreciate you. I'm being truthful. Okay. >> Um, good. All right. >> Nothing more. >> Okay. >> Okay. >> Well, unfortunately, you are going to lose, you know. Um, >> I'll tell you what, I'll wait outside in the back with you. That way you don't have to walk to the home front. Is that what you mean? >> Yeah. >> Okay. Or at least when we get outside then you can do all the necessary stuff. >> All right. But now if you're running you don't >> No, I know. I know. >> You got to suffer the consequence. >> No, I know I promise I won't run or nothing. I don't have a pretty good run. >> I'm not as I got fatness and everything. [laughter] But um listen >> listen. I lost 25 lbs in the last month. >> Must be nice >> cuz No, you know why? Because my daughter >> I couldn't keep over. It seems like Justin and Brendan are both very close to you in your personal life outside of here, right? >> Um, it's like yes and no kind of thing. It's like >> Well, in a sense, those are like your people >> at the moment, >> right? >> Mhm. >> Have you let them know that you got called in here today? >> They have no idea. >> Okay. >> No, cuz by the time that I came in here because they told me about like their excuse was something about a schedule change. >> Mhm. And then I've been in here the entire time. So, >> okay. Uh, it would be who of you to not alert them >> that this is going on because I'm just going to be straight up with you. They will most likely be facing criminal charges as well. >> Mhm. >> So, if anything, you'll see them there. I don't know how quickly we're going to be acting on it, but it will be addressed. It's not going to be it's not going to be something that we just look away from. Okay. >> How how um I know you don't know because you're just the sheriff, but um what do you think is going to happen to me after all this, you know? >> So, here's my my question and we kind of did a superficial and interview with you uh to get the basic info, right? >> Where is all the property for the last two years? Where is it? >> That I'm going to be straight up cuz Justin has it. >> Okay. >> I'm not sure exactly what he physically done with the property. >> He [snorts] might have sold it for his personal gains, but none of it came to me. >> Okay. >> So, like I said, I'm not sure what if he has any left or anything like that. >> Okay. >> But it would all be >> because that would be that would be something that would be beneficial obviously if we can recover some of the property. Um, you know, if you know, we we limited it to Justin and Brendan, right? If you know more >> Yeah. No, I >> if you and and I'll go even outside of that. >> Mhm. >> If you know of something else either going on here at the store, right, with other employees or other customers or whatever, if you know something like that, they could help us with some sort of >> criminal apprehension. or if you know that's going on outside the store, whether it's theft rings, if it's drugs, if it's anything, any sort of crime related, right? That type of information. I'm not going to ask you to provide that to me right now. If you if it's is something that you might have knowledge of and you want to talk to us, I'll go off camera so that all that that whole conversation occurs. >> Yeah. >> Not on the record. Right. >> I would say if you know it's all confidential and whatnot, >> just keep your eye on Justin kind of thing. Um, like I said, he does have a a weapon with him. I don't know if he carries it with him all the time or if it's in his car. >> What kind of >> um Glock? Um, I think either Gen five. So, I think that's what it is. A gen five Glock. >> Do you know what caliber? >> Uh, I think he's I think a nine. This one. Put your the palms together. Put your palms together like a crane. There you go. >> Ready. >> Go back around. >> Containment. Containment. The black one. >> Oh, black like this. Yeah. Driver, PASSENGER OF THE VEHICLE, STEP OUT OF THE CAR NOW. THIS IS THE PALM BEACH COUNTY SHERIFF'S OFFICE. >> DRIVER, rear passenger, step out of the vehicle. Only the rear passenger. >> Only the rear passenger. You two sit. You come. >> Rear passenger. Face away from me. >> Begin walking back towards me now. >> I NEED HANDS. HANDS ON MY SIDE. HANDS. >> Keep walking back. Keep walking back. Keep walking back. Walk to my left. Walk to the left. >> Put your hands up on the dashboard. Both of you inside the vehicle. How many people? >> Passenger. Passenger. Front passenger only. Step out of the vehicle and face away from me. Front passenger. Begin walking back towards me towards the sound of my voice. Hannah, go in front of me. Continue walking back towards me. Take him out. Pull him back behind the car. >> Hey, leave him with and that over. >> No, not right now. >> Put it >> shoot over and start calling your guys back towards you. Step back towards my voice. Back back. Slow down. Keep walking. Walk. Walk. Walk. Walk. Walk. Walk. Take it. Anybody else? They should decide. All right, let's get the truck. Right. What's going on, dude? Like a movie or something. >> Just so tired. Just so tired. I don't know what's going on. >> I have nothing. Yeah, >> you can check the whole car. >> Yeah. I'm just like I'm mesmerized right now. This is a training exercise. No, one of you I one of you I want, one of you I don't. >> Okay. >> Okay. So, relax. So, three are going to get to go to the market. One isn't. Okay. So, relax. >> Okay. Is there going to be anything in that car that we need to know about besides a little bit of weed and stuff like that? We don't care about that. Yeah. >> Yeah. And then you can check everything. >> You were in the driver's seat. Are you the owner of the lab? >> Yeah. Okay. >> Weapons. >> Just a bunch of skateboard stuff. >> You guys are cooperating. In there tell me all eating your lunch in 10 minutes. Fair enough. Of course. Full. Yep. >> You're Justin Martinez, right? >> Yes. >> I'm here or we are here. >> Mhm. >> Because uh you are have been indicated as being involved in crime. Uh so that's why I'm here to investigate that further. >> Okay. >> And I'm going to talk to you. Okay. >> Yeah. Uh before I talk to you, I'm going to read you your rights. Do you understand those? Yes. We can go from there. All right. >> I'm required to warn you before you make any statement that you have the following constitutional rights. >> You have the right to remain silent and not answer any questions. Do you understand? >> Understand. Underware. If any questions with those rights in mind, are you choosing to speak with me? >> Uh, yeah. I mean, I'm just curious of what's going on. >> Okay. Um, give me a second. Let me uh get everything uh together and I'll come back here and talk to you in a second. All right. >> Okay. >> All right. So, this is why I'm here. Who's that? me. Okay. Who's that? Me. Who's that? Like what's really like going on? I'm just like confused. >> Why would I have these photos? >> I don't know. Do you know where these are from? I mean, it looks like Walmart from the shopping cart. >> Yep. Okay. So, here's the deal. There's a reason why I'm here. There's a reason why we made contact with you. There's a reason why all of this just happened. Okay? >> It's not because we just decided to cherrypick you out of the air. Right? We've done our research. We've gotten the report from Walmart of what occurred there. Okay? Now is your chance to tell your side of the story, okay? Because obviously there's more to it. I don't understand why everything happened the way that it did and that is why I would like to speak with you to give you the opportunity to kind of clear the air and explain why you did what you did there. >> Okay. understand that there is a very sophisticated audio and video surveillances in there throughout the entire store and in the parking lot. So everything that occurred as you can see just by these photos, you know, we're identifying you off these photos. That's how I got your name. Okay? So that's why I'm here. So, I don't know how long it's been going on for. I mean, I have a very good idea of it. Um, but I'd like to hear your side of the story of what's been going on at Walmart. I know that you're not the only one involved, right? That's why I showed you the picture of the other guy. Um, my thoughts and feelings in this point in time >> are that you had some sort of opportunity, maybe somebody approached you, maybe you needed money. I don't know the the full story, right? >> Mhm. >> That's why I want to talk to you. Okay. Um because there may be reasons as to why you did what you did, but as I said, video shows you going into the store, selecting some things, and walking out of various different exits. and taking those items without paying for them. So this is the basis of this investigation is a theft investigation. And it's not just one occurrence, there's multiple, which is kind of why it got elevated. This district just decided to utilize their unmarked cars to do it. That's why you guys got called out the way you did. Um, however, it is right now it's looking like a like a felony. Now if there is mitigating circumstances or reasons behind why you did what you did there there may be some change to that but I don't know until I speak with you. >> Do you understand that? >> I do understand. >> Okay. >> So I'm a pretty fair guy. I'll sit here and hear you hear your story out. I'll document it as such so that if it can help you in some way, shape or form, it does. But at the end of the day, when a business is the victim of a crime, which they are of theft, and they wish to prosecute, my hands get kind of tied in the sense that I have to go forward with the investigation. Now, as I said, there's some sort of mitigating circumstance or mitigating factor as to why it occurred. That's where you and your statement would come into play. >> Yeah, I was just getting groceries. >> Okay. What kind of groceries we talking about? >> Um just uh regular household groceries. Um, >> can you name some of the >> Oh, like >> uh rice, pasta, frozen like chicken nuggets, hot dogs. >> Okay. How often did this occur? >> Uh, it was only twice. >> Okay. And on those two occasions when you took those items, did you drive or sorry, not drive, but walk out the front door? >> Walk out the front door. >> Yeah. >> No. Which where did you go? >> Um out like or I think it was like not like the front door. It was like one of the side doors. >> Okay. So, don't those side doors normally have alarms on them? >> Uh >> yeah, I guess so. I don't know. >> Like the fire doors, right? >> Yeah, I guess. Yeah. >> So, how did you get out of those doors without the alarm going off? >> I don't know. I just it nothing like alerted or anything. Uh-huh. >> You just walked up to the door, pushed it open, nothing sounded, nothing. You just walked out. >> Yeah. >> Okay. All right. I appreciate you giving me something, but unfortunately it's a half truth. >> And I don't know that. >> I mean, as far as like what exactly? >> You didn't steal just groceries. >> No, it was groceries. I I got uh all it it was like all food. Uh I think anything else that wasn't food was just uh like body wash. >> Does that have an itemized list of items that you took? >> Okay. >> It's not just groceries. >> I I it was groceries and like I don't know what else I could fit inside that cart. Like it was literally just >> There were three different occasions, right? There's more than that. because we have evidence that suggests that you have been doing this periodically over the course of two years. Okay. Um, and at least in the past couple months here in Royal Palm, uh, at this the Walmart at 441 in Belier in March, there's an incident on video that includes you taking wireless gaming headsets, uh, a wireless mouse, a sound a JBL Bell soundbar and a JBL Bluetooth speaker and a car battery among other things, but these are the things that the loss prevention guys could actually identify on video. So, there's that. And then I have two more incidents that are all literally itemized that they watch you on video do it. So, this is what I'm trying to say. I understand that you're trying to downplay your involvement in it, but at some point in time, you got to be a man and own up to your mistakes. I don't think that you're a bad guy. I don't think that you're doing this to try and hurt somebody. You're obviously have some sort of motivation outside of just being a bad person. If you were a bad person, you'd have a terrible criminal record, you know, all sorts of crazy stuff, right? >> Yes. you probably had some sort of certain circumstance that you needed to do this to for some reason or you're trying to help somebody out or you had an opportunity or whatever. I don't know, right? But I can almost guarantee you if we were to go to your house, we'd probably find some of this stuff. This is very unique items and they're pretty high dollar value items. >> You know what I'm saying, >> right? Unless you're going and trying to sell stuff, I don't know and make money. I I have no idea. >> So, do you want to be honest with me now and tell me exactly what's going on or do you want to keep along the same theme of I'm just stealing the groceries to help a friend? >> I told you I wasn't coming at you with some some [ __ ] dude. I'm not making this stuff up. The only reason why we are here today is because we have very good documentation and it's not just a piece of paper. It's all video and audio. >> There's like seven >> there's like 15 different items of video just video of you on these three different occasions. >> 150 different video clips. So, I'm again, I'm not lying to you that I'm making this stuff up. It's all on video of you coming in, selecting the merchandise, leaving. So, what's up? Yeah, it's stupid decisions, man. Stupid. Who is this other white guy? That's uh my friend. >> What's his name? >> Brendan. >> Why Why was he there with you? >> Thank you. I appreciate it. >> Uh he was just like he's just my friend. He was just hanging out. He had like he was just with me. >> But he knew what was up. I mean, you're leaving out the fire exit door. You're not going checking everything out. And he was even picking some of the items. I mean, I think he was he was just helping me uh like shop or whatever, but that's it. Okay. Was it just the two of you? >> Yes. >> Nobody else involved? >> What? >> Usually when I ask a question, I know the answer to it. Like you're talking about like like walking out the door and everything like as far as I mean he didn't have anything involved with it. >> He did. >> I mean like I'm talking about as far as like >> um anything like >> uh one other person. >> Who's that person? >> [clears throat] >> Let's get some make me a box. It ain't easy cuz that one is working and he's a snitch. Yeah, but you can make it once I'm ready to dip. Or you can pre-make it and hide it somewhere. I need to get to sell though. You can't cuz we only have the bald one working. Who is the bald one? >> Uh it's just one of the APs there. What's is that male, female? >> Uh, male. >> White, black, Hispanic, >> black. >> Okay. >> So, you get this is what I'm saying, right? Like, what's this making a box? So, he puts together in a box for you and then you go get it. >> Uh, yeah. He It was uh I think that's when um I got that speaker. I think he >> No, cuz this is in May. And the speaker was in the speaker was in March. What's the code for? Uh it's just for gas. Uh so like Murphy's gives you um like a code. So you talk about getting stuff from Walmart almost on a daily basis. Right? Cuz on the 27th, when are you off next Monday? Can I go get some today or can you get me some for me? So he was actually taking stuff on your behalf as well. Well, it it's cuz like we would talk and then he would just say like text me um like this day or whatever, like text me like tomorrow or something and I would text him. >> Okay. >> Okay. All right. Um, I think I mean it's sufficient at least for me that uh it doesn't show that you're threatening him in any way, shape, or form because uh again, Poker my cards up. >> Yeah. >> When Walmart figured this all out, obviously saw that there was an employee involved. They made contact with him. He got terminated and one of his excuses or one of the things he said was that he felt like his life was in danger and that he was being threatened. Right. >> So, is it true? Do you He sent you pictures of guns. Do you own any firearms? >> I own a firearm. >> Okay. What do you own? >> Uh, it's a G19 MOS. >> Glock 19? >> Yeah. Glock 19 MOS. >> Do you have a dot on it? >> No. >> Okay. No. >> Um, where is that right now? >> It's in my car. >> Okay. >> It's in a holster. >> Um, >> okay. So, uh, have you ever threatened anyone or Chris in particular with that firearm? >> No. No. No. Never. Never. >> What What is the purpose of you having that firearm? >> I just like guns. >> Be a stupid question. I just want to hear. >> No, I just I I like guns and like I it just like interests me and um that's really it. >> Okay. >> Uh, have you ever been arrested before? >> No. Okay. Um, never. You've never been arrested anywhere in the United States? >> No. No. Like I've never like been uh like taken in and put in whatever. >> Um, all right. So, let me I got to give my sergeant a call uh real quick and give him an update on what's going on and then I'll get right back with you here shortly. Okay. So, give me a couple minutes. Okay. They were all charged with grand theft, conspiracy to commit theft, and organized scheme to defraud. Thanks for watching. Be sure to subscribe for more videos like this.
