She drives a She has a She has a car. And she'll and I hear the when I'm my office is next door I can hear the kids in there if she's a There's more than one kid though? The other one the boy goes to school I think. Hey, you got no school? I know, I'm coming in with you. Come on. You uh You want to phone number for Yeah, yeah, you have phone number four? And then your information as well. I'm sorry. Okay. Um, I appreciate it. So, just stay here at the door with her. So, apparently she No mom yet. Apparently he says that she goes to work and takes the other one to school. >> work. Oh, she don't work? >> She does not work. Oh, so is this So, um, she's either sometimes she goes out and jogs, but usually her car's here or something. Oh, so she usually stays home? She's normally here, but when she leaves a lot, I'm not going to swear to it, but I think she leaves the kids here alone. Hey, hey, I didn't get to see the score watching TV. Yeah, so it looks like she put the Thank you, sir. No problem. >> like she put the chair to the door Uh-huh. and then uh unbolted everything and left. Nobody has her phone number, huh? What? >> Nobody has her phone number. Who? Mom's? Mom's. >> I just got it from the landlord. Oh, okay. I'm going to call the sergeant. We'll just make sure she stays in. I'm going to move out of the way. Hello. I went to the bank. You went to the bank? >> Oh, man. We've been here a long time. Yeah, what are you doing here? She was out in the roadway. She got a She was out in that roadway. Oh my god. I went to the went to the bank and I got stuck in the bridge. Oh my god. I'm sorry. They're going to There's somebody else investigating it, not me, but I'm so sorry. Oh my god. I I shouldn't You went You went where? I went to the bank. Oh, okay. But and then I just flipped around. >> I've been here for more than 15 minutes myself. >> And then I just went to the gas station. >> It took me about 15 minutes to get in here. Yeah. Oh my god. I got I got stuck in the bridge. I'm so sorry. I should have done I'm like shaking right now. I should have taken her. I left the TV on and then I was like, oh. I usually have to go out and get um my son on the bus and I leave her for a minute and then I come back. But I'm so sorry. All right. Well, there's another officer investigating it, so you're going to have I'm sorry. I'm sorry. I am like shaking. What is your name? Huh? Allison. Yeah. So then I I was trying to get more of these. Oh my god. I'm so sorry. That's all right. Let me turn off the TV. Oops. Do you want to read him a Miranda warning? Yeah. You want to do Ask ask I called my mom right now cuz she had to go to a she had to go to a doctor's appointment. >> Uh-huh. So I could take her. So she just called me right now and she got back from the doctor's appointment. >> Okay. You went outside? You went outside? She went outside? I got it. I'm sorry. I'm like shaking. Oh. Here. Come with me. That's my landlord. >> Yes. Yeah. Okay. >> Yeah. Huh? Where? What? Oh, okay. >> Yeah. I called and then I went to the gas station and we drove back. You want to show her the driveway? Um who do I have to wait for? The investigating officer. Okay. So she opened the door? She was on the road when I think she was crossing Allison Wilson when somebody stopped. Okay. So you guys called somebody? No, they called us. They're coming? >> us. What do you mean? Who's coming? There another officer just like us, but he's the lead officer now. We were sitting watching your child while you were gone. That's embarrassing. Yes. Got 13. 10-36. Yeah, it was the bridge opened at 12. It's 14 now. On the other side of the bridge. Wait, okay. And I I don't have a receipt from the ATM, but that's where I I came from. Okay. Okay. And so then I circled around when I went up the bridge and the bridge went up and I circled around, went to the ATM, and then came back around and I was stuck right here on the on the bridge. Okay. We just got to wait for the other deputy. So. Ma'am, do you have your ID with you? Yeah. In my purse. I went to go change a lot of tickets for that. And the child's first name? Alison. A L I S O N? What is it? A A L? A L I. A L I. Yeah. Okay. I must have wrote it down wrong in my head. Wrong. Yeah. Last name? Um, same. Are you able to get their social security numbers? Um, do you need those? It's not the birthday, is that enough? >> Nope, not for this case. Are you able to get them? Yeah, I just I need to find it. So, can you explain what you're doing? It's a child neglect case. And DCF is going to also be notified, so. The what? I said the Department of Children and Families going to need that information also, so if you want to find it. How old was Andrew? He's um, 11. So, am I in trouble? Does he go to Alamanda? No, he's in middle school. Which which school is he going to? Which school is Did you get a Did you get a Miranda card? Uh, yeah. Yeah, I don't even remember. I got to start getting one of these. Yeah, I know. Yeah, I just I just It's not necessary if you if you can come back and get that. For what? For DCF? Yeah, well, we still got to notify them. Yeah, we they're they're already notified. We'll do that afterwards, but just Cuz I have all the information for them if they do come out. Did you get to stay with them? Okay, I appreciate it, okay. Thank you. Hey, how you doing? My name's Deputy Wells with Sheriff's Office, okay. Thank you. So, I'm here in reference to the with your daughter. So, um before I talk to you though, just because of the nature of everything, I have to read you your Miranda rights, okay? Okay. Um do you speak English? She speaks English. Um Is she okay? Does she have any No, no, no. Does she have any No, she's extremely So, does she have any like needs or anything, special needs or she No. Okay, she Does she speak English, Spanish or Yeah, like a little bit of both. Okay. Um can I just say something? Like, I know like I asked him like if it would have been different if she had like opened the door and then I would have came out. The different place I went over to go to the bank and then I got stuck on the bridge and then of course they were they were waiting with her. And I was like you know Okay, well she was they found her and then they were here. So, I'm like I was telling the other guy how she would just push open the door and this door would open. Mhm. So, he had to change the lock cuz the door would just open on its own. So, we changed that lock. Um but you know, I had no intentions of like staying. I just went past and then I coming back, I got stuck on the bridge. Um I'm just like I asked them. I was like, you know, what's this? He's like, "Oh, we're going to make a report and all that." And then he's like, "Who lives here?" It's mom, dad and a sibling. Um I don't work. Just whenever I need something, I take her to my mom's. My mom was calling me right now cuz she just got back from my doctor. Um so that's who I take her to whenever I need to. Um I just don't I like I've never had any trouble with them or DCF or anything. The thing is is I just don't I have like up in here for 30 years since I was seven. My parents are in the car. Um, I'm just now like fixing my immigration status. I'm like a doctor. I went to school here and everything. Um, so like I don't want any all of this to like you know, I'm like the mother to these kids and I'm just starting to like he just applied for me. We've been married for 15 years, but he just applied for me. So we're doing like a whole like petition and we've lived here for 10 years with them. Ever since the older one was born. Um, and so me just GOING AWAY AND NOT like I got this whole process. Every time I do my the license I have, every time I do like my my renewal and all that, I do a background check just like I always have to be like in line which I've always tried to and I've done anything. Um, and then this would just be like um, okay, you're bad mother. Um, I know I'm not that I wasn't supposed to do that. And but just like a license or like my immigration process could just be like screwed over. My husband works in construction and we don't make enough money for me to go out and do my thing and have her. Um, so I stay home with them basically. And like I said, I just I was like, okay, I'll go and come back. I knew that was locked. Um, we fixed that because she would push it open and it would like she would she would just get out. It was locked, she could just push it open. So he's like, now we got to be careful. I told the other guy, when we open the door, she just runs that way. Like we teach her that way. Like she just knows that she cries she goes and I'm like um you know, that's why I shouldn't have left her. I should just put her in the car and take her with me. Um >> So I I want to ask you questions about everything you're telling me. I know you want to let me know everything get everything off your chest and I want to talk to you. If you want to talk to me I don't I want to ask you questions in in reference to everything going on, but I have to read you read you the rights before I do, okay? Before I ask any question. It says I'm required to warn you that >> Do you Do you know what I'm what I'm saying? Yes, and I'm going to ask you questions about so many things like what all this means. >> Yeah. Just I just have to ask this because this is a This is a because of the Yeah, because of the the situation because of the allegations. I I want to ask you questions about everything that's going on, but I have to read you this before I can do that, okay? Okay. It just says I'm required to warn you before you make any statement that you're following constitutional rights. You have the right to remain silent and not answer any questions. Do you understand your rights? Okay. So with in regards to today, so you normally I What you told me before you used to normally stay here? Yeah, it's me and her. He goes to school. And actually in the mornings I go out here to the bus stop. She stays here and I'm always like you stay The bus stop is right here with the bus stop. >> other child and his name is Andrew? >> Yeah. Okay. And she's Allison? She's Allison. >> Okay. So the reason I don't take her out there is because SHE GETS UM CAR SICK. So she stays here and then I'm on the lookout for the door and the bus the door and the bus the door and then I come back in here. But it's me and her while he's in school. Have you So you had an issue with the door before and she likes to run off she likes to run off and she's done in the past. No, she just Right, she pushes it out cuz you know, it's either that we have a bath and a front door. So it's just like she sees one of us leave and then she's like, "Oh, me too." So she'll follow one of us if we go to the dumpster. Okay. So it used to be like I closed that door and you would see her push it and she'd be behind you while you went to the trash can. So we had to fix that. And the lock wouldn't lock. The lock would not keep the door. And she just runs she likes running. She likes to run. She can run that way. You know, she knows it's fast she can run that way. Or she'll run all the way down straight to the bottom but it's a closed street so she can do that. Yeah. But not this way. And there's cars but like the neighbors know there's kids. Do you have a car seat in the car? Do you have everything? And today you're home alone with her. Why did you leave her at the house alone? Um I went to the bank to deposit money. So you went TO THE BANK? AND SO I CROSSED DO YOU KNOW WHAT TIME YOU LEFT? I DON'T KNOW. They they gave me a time when I CAME IN. AND I SHOWED UP. OKAY. UH I TOLD THEM I was like I don't have a receipt for the ATM but I went I deposited it. In person? Yes. Yeah. Will they see you when what time you got back? Thank you very much. Yeah. And so he's like, "Oh, well I've been here." And then I was like, "Yeah, I was on the bridge right now." Bridge just finished closing but after it closes you have to wait until uh the light turned red so I had to wait again. Does she normally stay here by herself when you run errands? No, no, no. It's like, okay, if she's sleeping it's like, okay, the only thing I have here is like Publix but we'll go walking the shoulder or that's the only thing that's close. Why Why'd you leave her alone today? I I thought I could run and come back. The kids TV is like, "Okay, let's go. Let's go. Let's go. Let's go." Turn everything off and kind of just kind of pick her up screaming and put her in the car. And she would have She would have So, she was watching TV. Yeah. And she would have possibly gotten upset if you pulled pulled her away from the TV. >> "Let's go." Put you in the car. Like, All of a sudden, you want to leave. Yeah. So, then I would take her and be like, "Come on. Come on. Come on. Come on." Put her in the car. Or, you know. And she doesn't go to any preschool or anything yet? No, no. She just turned three. Just turned three. And sometimes you drop her off at grandma's? >> Yes, but I'm not on Jupiter. And I have a neighbor right over there that's like IF MY MOM WOULD YOU SAY SHE NEEDS THE constant supervision? Yes, she's a toddler. Like I said, No, no. Again, like Like I said, if we go throw away the trash, we close the door. And then we realized that she she could just push it open. Um She'd be behind it. >> When was that? When did you get that fixed? Like, when was Uh Maybe it's a month. Month? Cuz the other one was not locking. We You could put the lock on it, but the door still flew open. Okay, then. So, So, she was watching her TV like she's doing right now. So, she's watching TV like she's doing right now. Yeah. You knew there would have been a fight if you had to put her in the car. >> Yeah. Take her with you. So, you thought she would be okay by herself. I knew I had it locked. Okay, I didn't think the fridge was going to open. Yeah, so do you know So, So, just let you know why we're here. We got a call at I believe it was 9 Approximately like 9:45, 9:50 in the morning. Someone was driving down, saw your daughter running down the street. They were three blocks down. And they had turned from PGA on Ellis and Wilson, and saw your daughter running. Yes. So, that's the sidewalk cuz we go for a walk. We go for a walk, so she goes That's where we go. >> Yeah. So, she goes she'll go straight. Yeah, but so she >> That's like our So, she was running down. So, the uh concerned citizen, luckily she stopped. She She first stopped and put her hazards on cuz she thought maybe you were chasing after her or something. Someone was chasing after her. >> yeah. And uh so, she was waiting to see if uh like the mom or grandma was behind her. But, she didn't see anyone. So, she pulled over to the side street, and she got out, and then she was even further down on to PGA. >> She just wants to get Yeah. Yeah. So, she chased after her. And apparently, she started to cross over to Ellis and Wilson to go on the other side, but she yelled at her. She's like, "Stop, stop, stop, stop, stop." And then when she heard, she apparently came to her, and she was able to get her in her car. So, she walked her back. Okay. And then she called us. Okay. And um I don't know the exact time thing, but I think it was almost an hour until I think what time you came back? 10 almost 11? 10:45? No, it was like 10:30 cuz the bagel business is 10:30, and so right after that that's Yeah. So, she was definitely concerned about her cuz she didn't She didn't You didn't see her obviously. There was a lot of concern. And she wasn't verbal with us cuz she's She's making sounds, but I don't think she's not talking yet. >> yeah, yeah. So, she's just nonverbal right now, but >> Yeah. Like words and phrases >> She's making words and noises yeah to actually talk. So, she didn't know exactly where she lived. She ended up pointing us to this direction eventually. Yeah. Cuz she goes straight, and then she comes back. Like when we walk Yeah. >> I came here. Yeah. >> And I saw your door was wide open, and those two chairs were Over here. So, she used the chair. >> So, you used the chair to unlock the doors. And that's why so then we cleared the house to make sure nobody nobody was in danger inside. >> And um But do you understand like the severity of why they need the supervision? Like you know Cuz honestly cuz honestly it per Florida state statute it is neglect if you don't have supervision over the minor. And you so Um is there Where's dad work? Where's dad work? He's uh at a construction site and he will he'll get off. Is Is dad >> Cuz he's always like, "Don't go to the trash. Take her. You just take her." And you know, you're like, "Mom, you're like, I can go faster if I do go there." Like if you take the wheelchair He's going to come back. Don't grab him. I don't know Is that Is dad Is dad able to come back here No. No, no, no. Cuz he's like he just started the job site and he would be mad at me that I called him away from I'm not trying to make your situation worse or anything like that, but we still have and everything, okay? So whenever we get a call by the welfare and it is meets the the criteria and it's a felony to leave a child unattended or unsupervised, okay? So just based on the totality, I do have to place you under arrest for neglect of a child. >> No, I can't. Okay. No. No. No, I can't. Okay. Come here. Okay. We're going to go with our partner. We're going to wait for him. We're going to try to call We got to call your husband. Can I call my mom? >> I'm going to be completely We're going to let you call him if you need to. I'm trying to be as transparent as we can. Why would you Why would you do that? >> Okay. Cuz that is my job. I can't. I can't do that. How far does your mom live? How how far does he He lives in Florida. My dad. Well, we're going to we're going to make those phone calls, okay? I can't. No, my son's going to come home from school. Then why don't you want to mom, later. I can't. Okay. I'm going to I'm letting you know, okay? I can't. I'm letting you I'm letting you know. We're going to make it as easy as possible for you. >> Sir, I can't. I I never leave her. Yeah. I know. This is she's like mom mom mom mom mom. I know. I can't. Please, I can't. Hold on. Let me sit down. >> Yeah, sit down. Where's Where's Where's your phone at so we can make this phone calls? He's working right now. >> your phone? Do you know the number? It's over there. What you prefer? Your mom come here or your husband? Or your mom's? My husband will explode. What? You want him to call your mom or do you want to call your husband? We need someone to call. We need someone to call. I don't know what to do. If you sit If not, we'll see if someone No. We're trying to help you out here. We're being as transparent as possible. I understand What happens? Where are you going to take me? You have to go down to Gun Club for processing, okay? Why? >> being charged with a crime. Why? >> And then after the afterwards, you go you'll get first appearance, you'll see a judge, and they'll give you probably a court date. So, I'm not getting out today? I don't know if quicker you go down there to do the processing, the quicker the process can start it so you can get out of here. >> I got a night board so maybe be able to go Yeah, hopefully later today. Okay, cuz it's only 11:00. Can I talk to one of my neighbors first? Like and tell them what's happening. Ma'am, I'm being I'm trying to be as helpful as I can with you. I'm giving you all the courtesy as I can. Yeah. But I'm letting you know I have probable cause for a felony, okay? So, you I have to put you in I have to put you in this car. I have to put you in the car, okay? And I'm trying to be as courteous as I can to So, we'll make phone calls for you and everything and and not make a scene cuz I don't want to use force on you. I don't want to do anything like that. You know I'm just trying to be very cooperative and I don't want that to happen, okay? He's going to put that in the report, how cooperative you've been and everything. I'm going to say what you said like you the juvenile and that you're just going to the bank real quick and she had you know she had to utilize the chair to get out of the house. I'm not leaving. I'm just So, your phone's going to go with you or we'll get the we'll make it we'll make those phone calls for you, okay? And we're going to stay here until one of them comes or until DCF comes and they'll probably call them. They'll come. Okay. So. We have to stay here until And of course we have to I don't know start the processes and everything else in the court to get all that started so you're not there any longer than you need to be, okay? Bye. You see if you go go with him out to his car. >> Is this going to take all day? My son's going to come home at 4:00. Okay. Well, hopefully your grandma will be out of the car. Hopefully gram grandpa or your grandma. Who do you prefer? Well, my parents don't live back here. What's their phone number? Uh my dad's Jose and my mom's Concepcion. Do they speak English? Yes. And they watched her before in the past and everything so she's familiar with them. >> Yes. Okay. I don't think my husband will be understanding. We'll be We've been married for 15 years. Mhm. Uh we have the oldest boy. Mhm. So, he's very strict. You got to watch him. You got to watch him. You got to watch him. He's the one that works. He'll tell you I do everything so she doesn't have to do anything. Mhm. But at the same time I have to go and do some side jobs and take it to grandma's house. Well, when you you're going to see a judge either tonight or first thing in the morning. Either tonight I I I I don't know when. Yeah. One of those two days. >> Can I close the car? Uh yeah. >> The window. Um Yeah, do you Yeah, I'm not going anywhere. Okay. And then my husband has the other car. Okay. But, this is the one that has Carson's car seat. The other one's just for work. Um his mom lives in Boynton, so it's pretty much just my mom. Okay. It's me and whoever I can get to >> Okay. help me once. He took the house keys. The other car keys. Am I taking a bag with me, a wallet? Uh you're allowed to take your phone with you. I would only take the bare minimum. Take your ID with you and that's it. That's what I would Just take your phone and your ID. >> I think he still has it. >> Okay. This is the one that we use for her, car seat and stroller. Okay. And his is just full of work. Okay. You uh parents >> Yes, sir. >> for a minute or for how long? >> It wasn't Yes, sir. Okay. So, just let you know the the daughter, Allison So, she was found in the street over off PGA, okay? Oh, okay. So, and your daughter wasn't home. Okay. >> Your daughter went to the bank. Okay. So, so it was almost an hour. Yeah, but sometimes a little kid open the door That's what she said it's happened before in the past. >> Yeah. But, she has to bring the daughter with her. I know you said I know you've been super cooperative, but if we transport you anywhere, it has to be in handcuffs. Uh-huh. And you're being charged with this. It's called neglect of a child cuz you have to have constant supervision. Yeah. The child, that's what it's called, okay? All right. We'll go your car and take care of you. Yeah, she's going to go to the hospital. It'll be that one right over there. Yeah. It'll be over here. You see your phone here? Put it right here. Oh, you know what? You're going to have to take your piercings out. Really? >> They won't Yeah. Oh. Yeah. Okay. Hey, sir. Yes, sir. Her piercings are going to have to come out. It's going to be a few minutes. Say it. Yeah, yeah. That's my phone. Okay. Give it Take it Okay. You know what? I can do it. Okay. Thank you, sir. All righty. Right back. Uh is this your stuff? It's still here. I see that Dad, my brother-in-law is on his way. He'll be here in 5 to 10 minutes. Oh, okay, great. Yeah, I'll wait I'll wait till he gets here. Oh, is that your my sister. No, that's your sister. Yeah, sometimes you know my construction sometimes several days. >> Oh, okay. Okay. He just said he's out 5 minutes. Do you want to wait for him? I don't necessarily need you unless you need to be here. No, it's it's completely unless you need unless to be here. I guess Maybe let's wait for Dad to get here see how he is and then if he's good then we can just go. Yeah. Thank you, sir. All right. Yeah, we'll talk we'll talk to Dad see if he's cuz she did reference Dad. Yeah, being mad about it They're leaving, right? Yeah, they're done. her in the past not to With me she's still saying the answer is first time. Well, I think it's the first time cuz that's not true. She said that a month ago she was going out to the trash and she would push the door cuz the door was locked. And she would run out to follow them cuz she wanted to follow them. I'm going to get them door alarms. Yeah. So, I it'll go it'll wake the whole complex up if she does that. Yeah, I also don't know if she says she's not I don't know if she has any kind of special needs or anything. For your child? Yeah, she says she doesn't know. So, she just makes the Well, sometimes I will say with bilingual kids we see a speech delay. Yeah. Cuz they're trying to bring in Spanish and English and it they delay it it delays it. Okay, I didn't get that. I mean Yeah. Their brain's working so hard. They're learning both uh learning both languages at the same time. I she speaks both languages. Yeah. Is she speaking to her in Spanish? Does she do both? Is she able to talk to her or she I know she's making the noises but >> Yeah, but I don't know say yes. I say my she speaks everybody. But do they speak Spanish to her? I guess they Yeah. Do you guys speak Spanish to the child? >> When some weekend or some when you when you have a like a 1 hour 2 hour I think better all day. Better teach her Spanish. >> And then make homework. My kids every day have homework. And you have elementary, middle, high school and college. Yes. Yeah, the last one college day the day other one in Jacksonville University. Nice. Yeah, the last two 20 years after. Yeah. And then everybody went to the you put in high school and the old one and the other two and the new one. How is mom this year your daughter that just was here? Did she go to school? She got a Is that your daughter? Yeah, he go to the Santa Fe Community College. Yeah, nice to Oh, there she is right now in the kitchen. Yeah, Santa Fe Community College he go to Is that dad? Yeah. Okay, we got no more Now, we can't let him in. Okay. Can Can I leave now? Uh Uh Yeah. Can I still work? Yeah. Everything you need I'm Let me get your phone number really quick. >> Okay. 651 Yes, sir. 655 455 655 655 Yes. Yes, I talked to her. I leave it. Everything okay? You need me, call me, please. So, they're going to have questions, obviously, about just the house or anything. She said she might try to work with you guys, maybe to get chimes on the doors or anything like that. Yes. So, your wife was arrested for it's called child neglect. Okay. So, it's just neglect of a child for his One of the elements is failure to low supervision of a child. So, this morning your daughter, Allison, Mhm. she was found she was she was home alone by herself. Your door was wide open and Allison was found on the side of the road. Oh, but she's okay? Yeah, she's okay. Okay. So, someone a certain citizen passed by and saw her and they didn't see anybody with her. She saw her by herself. So, the the citizen stopped out and parked their car and ran after your daughter. And the citizen got your daughter from the road. Okay. I have to thank to him. Yeah, so she gave me the She called us. And she spoke Spanish, too, the the citizen. So, she said she's like, she's like, "Hey, yeah, no, no, no." And then so, apparently she said she was about to cross to go over Allison into the plaza. And she said a lot of cars were coming and she was in the road saying, "No, no, no." And then she called us. Okay. So, um and then when we came here, I saw your door was open and there was a chair right in front of the door and it looked like Allison got on the thing to unlock the door. Okay. Cuz your wife said she left to go to the bank. But she didn't want to bring Allison with her because she was watching TV and Allison would have been frustrated if she brought her. So, she left her here by herself, which you know, she has to keep supervision on her. Yeah, of course. So, that's why, unfortunately, she was arrested cuz the daughter had gotten out of the house, wasn't supervised, and was found on the street. I have to let you know, she's a good little wife. Yeah. And I work 45 hours just to get her what she needs. You can compare what I drive, what she drive, just to get everything to my kids. So, she doesn't have to work or do anything and take care of it. So, unfortunately, that happens. It happens, but she's a good person. My wife, sir, she's a good person. She With Andrew, we didn't even have any problems. She was there with Andrew. So, you don't find any records, anything about my my son Andrew, but she's always been there. Lottery? You know she loves him? Yes. Yeah, so It's a tough situation. I think I think we're all just for I think everyone's fortunate that Allison's okay. Cuz it could it could have been very bad, but hopefully I'm glad that a it was a good guy who saw Allison and not someone No. Has your wife been saying you had to like change the lock on the door? Has Allison tried to She She likes following you guys out the door? She said she She said she changed the lock. Sometimes when she goes to the the dump the to the trash, Allison will try to follow her out the door. Yeah, I mean I believe she she she she make a mistake, but she's always taking care of my kids, always. I never had So, in the moment she called me, I have a crew. What I work in construction. I work for Wise Company and the safety patrol of the whole construction. I'm just right here. Today, it just moved me a little farther. So, usually I'm here in Water Ford like 20 minutes. In the moment they call me, they move me to some some place else to take care of some some urgent right there. And then my mom says that's why I was talking to her. And yeah, I'm putting in it from here, but now I was like 45 minutes from from my house now. Cuz sometimes they move me around, depends the company what they need. So, everything on the toy, you see everything. No, no, no, my wife she's amazing. She always take care of the kids. She doesn't have any habits. She don't drink, she don't smoke, she don't do anything. We like You can you can actually talk to the neighbors. You can talk with uh the last apartment right there. You can talk with uh Miss Curry. He knows my kids and everything. He's a veteran. So, he always with us and he always I I live in this apartment for almost 14 years. So, everybody knows me here around around here. >> Yeah, we've never been here before in the past and like I said like I told her we didn't have any previous here that we saw that I saw with you guys, but um Well, I'm glad she's she's fine. The biggest thing that she's okay. That's the biggest thing cuz obviously um I'm glad the you know, nothing severe happened. I'm glad she's good, she's okay. She was just running on on the road over there, okay? Thank you. All right, Don. So, I have a few questions for you, okay? So, my name is Sarah and I'm with the Department of Children and Families. Okay. The officer the deputy's obviously the criminal side. I'm child safety side. So, I'm here to see um to investigate what happened and also see how we can prevent it from happening again in the future. So, I spoke with your wife and we spoke already about getting you guys door alarms. I will drop them off, they'll go on the door, I'll show you how to install them. If your daughter opens the door and the door alarm is on, it will set off a really loud alarm. It'll probably get your neighbors to even come outside. Um so, we're going to do that. But, tell me this, what is your first and last name? First name Juan. So, you didn't know what happened obviously because I was the one who called you to inform me of so you got home talk to me about is this the first time she's gotten out of the house or it's happened before? She tried to but it never happens. I mean I mean she she managed sometimes to push a chair and get it out around doors. My wife is always on top of her watching her so I'm shocked because I don't know how she she she how the whole situation happens and how she managed to get out. So Iran told me she went to the bank. Does she ever normally go to the bank and leave her home alone or this is the first time that you're aware of? >> the first time. She never leaves Alice on the car seat. She just dropped in my took some 24/7 and she never leaves Alice home so No, it's 26 something. That's the mistake I I can think about her but she she she did but she's always with my kids. Well, sometimes things happens but now we're here it happened and we're just going to prevent it from happening again. Mistakes happen. Unfortunately, this one she had to be taken into jail for for it but let's prevent it from ever happening again. Okay, so how about you? Do you ever leave the children at home unattended? No. Okay. I don't I work full time. My wife doesn't work so she's here with the kids 24/7. Does mom use any drugs or alcohol? No. Okay. How would you describe mom to me as a mother? Very good care of my kids always. She's always have the house clean for me. She cooks. She's amazing with my kids. She play with my kids. She is studying with my son that the books right there with my son get out of school and everything. She's a good person. That's why sometimes that kind of thing happens to people. It should not happen because I know this situation the way I see it, she's always been taking care of them. She's never left them then. She's always with them. So, I I I'm shocked because when I spoke with you, I was like, "What do you mean?" Yeah. I like I like she's in the house. She's always with them, man. She's always taking care of them. She's always feeding them. She's always changing diapers, giving my kids a bath. She's always there for them. So, So, she just made a mistake. >> bad decision she took to go to the bank. Um probably because I had some money cash in my deposit because usually she transfer them from my account, from her account. So, she might have had some cash she wanted to deposit to to have it in her account, but it is I mean Okay. She's an amazing person. I mean, believe me. She right now I feel so bad because she's now with something, okay? She get be did a mistake, but now she's in jail. So, how we can begin from now? And we only can move forward. So, talk to me about this. Did you put another lock on the door? Uh no. The house it has been those locks. Um they are gray need to those silver ones, and the chain is always been there. Okay. So, all those locks have been there since you guys moved in. You didn't do anything to them. These two locks are new. The one on the bottom. Yes. The the the homeowner of the apartment he took care of them. He stole it from me cuz the old ones you can see right there the door. Um one day it jammed and he didn't want to hear old thing so he replaced it for me and installed it for me. And >> When did he replace it? Uh that was like wow 4 months ago. 4 months ago. Okay. Do you guys usually lock the top with the chain? >> Yes. Yes, always I I lock the top and you know sometimes I This is what I do because I know how she is and how she behaves and she's very curious about everything around So that's what it does. Lock the lower, pull the bottom, pull the bolt and put the chain. And my wife sometimes tell me but that's too much. We're here. So I say always and I tell my wife it's not enough because I know the way I see the way she is. She's very curious right now about things. She's in the age where she she's very curious about I always keep those doors locked and kitchen is always been locked. So >> What is your work schedule like? Well, I work from 7:30 to 4:30 from Monday to Friday. Sometimes I work Saturday if they call me. Okay. But usually I'm with my kids on the weekends and this weekend I was with them. Okay. All right. Um How's she doing overall? Are you guys teaching her Spanish? Uh well since my my first uh born Andrew he born he chooses to speak English with with with even in the house. He can understand but he I don't know like choose English? English over anything. I think I don't know. She might speak in Spanish. She might do something Question so that is an open case from your end. Yes, open case. I'll have my case open probably for a few weeks. I'll see what the judge says about the one seat six of her one seat at the next hearing. See what he decides and then >> And you will move forward to whatever I'll move forward. But I also will need to come back and give you guys the door alarms and I'll see and make sure that you guys actually install the door or they install the door alarms. I would like to get maybe another lock on the door considering that it doesn't seem like those ones are working. And then I'll probably I'll see what I can do to help you guys. Maybe she might need some speech therapy. She seems like she's not really talking as much. I know when they're bilingual they speak the two languages there is sometimes a delay in talking. But I'll see what I can do to help mom and dad during this time. There's a lot of services that I can put in that are beneficial. So sometimes we get involved for things like this that are a mistake. But it turns out we can help them with whatever else they need. The safety plan I said the door locks. Sometimes they have like the deadbolts like this but there's up here like an extra little thing that she can't reach to with the So there's a bunch of different So we'll just have to wait to see if she sees a judge today or tomorrow. >> No, no. Yeah, she it's earlier on she might see someone today. Worst case scenario it will be latest will be tomorrow morning. And then after she sees the judge, the judge makes a decision on bond or anything like that. If it is tomorrow first appearance you guys are more than welcome to go to first appearance it's at Gun Club. And obviously if there's any kind of orders or anything that will be up to the judge to decide or he could say okay this is her bond you can come get her have her you know just whatever they say in the morning. So booking So dad there There is something I want to discuss with booking can So, Mom is going to see a judge either today or tomorrow. The judge has the option to put something called a no contact order in place. He might do it, he might not. I'm not the judge, so I don't know what he's going to do. The judge very well could put a no contact order in, so Mom cannot see her child, Allison, for a few days, for weeks, whatever the judge agrees on until the next court date. Would that be harsh? I mean, it's a first offense. It depends, but like I said, I'm not the judge. But I want If she does get a no contact order Is that a first offense or is it no way I can work and Okay. take care of my daughter if that's okay for Is that possible in this situation? I'm the I'm the only income in this house. So, but I just want to let you know that if that does happen, it's something that you should follow cuz you she can go back to Typically for domestic violence, I know it's domestic violence is automatic. So, like if it's a domestic between like that and Mom or anything like that, then that is an automatic. But something like this, I don't know. I don't think it's automatic. It's up to the judge's discretion. Yeah, it's Wouldn't that be a little harsh though? I will say it's up to the judge, but the the type of charge that it it is, it's child neglect and child She didn't get child abuse, but there's two charges, child neglect and child abuse. She got child neglect. What is that? Which one is worse? Child abuse. Child abuse is usually physical injury. So, neglect is kind of like that. Neglect is just And one of the stipulations in what it in this case is a is a not supervision. Yeah, supervision. So, it's not It's not Yeah, there was no form of abuse or anything like that. So, he the judge may very well could look into her past, see hey, we she's never been arrested, she has a clean history, it might have been just a mistake. He very well could put the no contact order in, but I want to talk with him about Dad just in case it does happen. He needs to know that if Mom breaks that no contact order, and they find out, she will go back to jail. >> So, how would that work? Do you understand that one, Mom? Yes, so if there is So, how how would that work? She will have to stay at my parents' house? You know, in the worst case Probably anywhere where it works. The next room. Yeah, but or Or does the baby have to be somewhere else in the you know Mom just can't be around the baby. So then she could go to grandparents. Baby can go to grandparents' house. Because she will have to have to have to take care of the 7-year-old. Yeah. Yes. But it would be And then you'll have to go to work. Yeah, so I mean, Dan, I'm sorry. >> It's a worst-case scenario, but We have to be prepared. >> want to tell him just because if that does happen on my end, we might have to do like a safety plan. Um but we'll figure it all out once we get there. This So you guys you guys can call the headquarters at 688-3000. >> Okay, and what is that? And that's that's our main line. Then you can you can inquire You said your sister got arrested and you're trying to ask about her first appearance. So they will catch her out. Yeah, if you guys want to go down >> to be thankful that today nothing happened. She's safe. She's alive. She's well. >> Yeah. And >> guys want to go to first appearance, you can talk to the judge. I wish she didn't have to, but If you want if you guys want to go down there to talk to the judge. So first appearance could be tonight. They do usually have evening ones. That's why I would call. Or they could say, "Oh, it's going to be tomorrow at 9:00 a.m." You know, that's Okay, got it. So I gave him the number to call so you guys can find out about first appearance. Okay. If any one of your family or anybody or you or them want to go to talk to the judge, they can do that. First appearance is open to everyone, so. All right, I'm going to step outside, call my supervisor, and then I'll come back inside and let you guys know what >> I'm just glad Allison's all right. Okay. Glad to hear that. Thank you so much. All right, I'll be right back. All right, sir. All right. Yeah, I'm good. I mean, I'm glad she's not hurt. I mean, and I feel bad for my wife because believe me Oh, she's a good >> know she's a good person. I work with her all the time. And she would be heartbroken now. I understand that. I think I think She made a little mistake. I think your wife, when I was talking to her, she agreed that she made a mistake and you know, it's just a judgment error. And you know, it's fine until the one time it's not, you know, and then And I'm just I'm just glad that the Yeah, I'm glad she's good. The citizen was nice lady who saw her. She ran after and Cuz I I work on the street every day. There's not so nice people out there and there's people that speed a lot. So I kind of I'm glad the unfortunate didn't happen. So she's You guys are very very lucky. Thank you. Appreciate it. All right, I'll be right back. Yeah, yeah, give me a few seconds. No shoes. She was charged with child neglect and sentenced to a pre-trial diversion program. Thanks for watching. Be sure to subscribe for more videos like this.
