at 12:00 p.m. on a Saturday an officer stopped a vehicle following a 911 report of speeding and the use of red and blue emergency lights these are the events that followed hey I've been behind that guy CH okay you want to hang out right there for me that'd be great over here you want to not at this time morning sir morning I'm officer Stewart with the Tyler Police Department the reason for the con today is feet sir sir is your speed that's the reason why you've been stopped today yes sir okay you have your license appr insurance yes sir thank you he been foll me since Chandler he tried to run us off the bridge or whatever I do volunteer fire department and stuff and I I hit my lights on because he ran up on us or whatever I got a SE Ry dog in here on that bridge coming over from that last bridge I got you and I was like why is he still following who knows man who knows uh do you mind if open the door and that looks good by the way just scan the bar code inside your door come on that's all it was I've been while he following us or whatever you been running up on us and then right here at the P Mardo M right here P Mardo one second we try to get over5 was that traffic for me hey what kind of Nissan is this by the way s h SRA Sentra okay hey I know she got some lights back here what are those lights for Volunteer Fire Department volunteer fire department Palestine with Palestine okay why do you have a Michigan plates in if you don't mind me asking it's a rental it's a rental car so can you can you flash me for me real quick come again got plug them up plug them up he says that while they were in Chandler um this guy got in front of him and activated those back lights and we'll be with you in just a second same that um he activated those light those light strips in his back window that were red and blue I just he just flashed them for him and they do shine red and blue and so he got in front of him to try to get him to go around uh and then once once our complainant went around and he gunned it going 31 okay going excess of 100 and where he got caught up was at the loop at 31 in the loop 31 the loop okay got you okay um so we have first police officer he says he's a volunteer firefighter palis volunteer fire department he's got a he's got a like a sheriff's badge sticker in the back window too yeah and but it's a Michigan plate cuz he says it's a rental it tells me he put all that on there correct it's weird even though it's a rental yeah my supervisor get here um here shortly how can I how can I help yall out this it's going be it's going to be our call um so we'll once he gets here then then we're going to figure it out he's got a dog in the car too I don't know if that changes things for y as well Builder those red and blue lights flash they just light up they light up they flash yeah they flash um it's with the palisin fire department ver y'all need his information I got his right here okay aw I lit him up cuz I was running lar right there at the 700 block of west southwest and he was on 66 and 55 that's stopped him for I stopped him for Speed awesome okay so that's that's the only reason I stopped him we pull him here right here and we had them notify y'all just because I knew I was on 64 kind of parallel with them and I knew I would be able to get around to him and uh MH by chance yeah place right time well it was about it came out through our dispatch by SS and stuff like that so I with that guy up cuz he was speeding and everything I was like oh it's a Michigan play it's probably familiar so they were uh they were in Henderson go ahead they were in Henderson County 3 bridge but what's weird is is that he has a Tyler address this guy was falling huh the Board address Board address so he's got allergies essentially got going be Cy help with anything yeah go ahead he's put some red and blues on the back of his car that flash red and blue it's a rental car as well he's also put a badge on the back of it Count's probably end up taking this call but I'm just trying to get some information for yeah I what did he say he said he is a volunteer firefighter with I believe it's the palisin volunteer fire department and that's why he put those red and blues on his car but why was he didn't say I just asked if he'd light them up for me and they flash red blue I sent our complet on planet told me when they there on F 315 by the lake paling Bridge the guy was 30 miles hour l but that's a rental car so he put volunteer all he wants the issue is he's not an emergency vehicle operator during the time that's needed but apparently he's been doing this stuff around he's also a registered so heend county says it's said deal and everything I'll still ride I cled him going 66 and a 50 right there with light this way so I was like oh hey here's we can contact the caller originally he he was right here he he pulled up right behind me and he was like Hey I I want to talk I want to talk to you real quick so he gave me quick information parked right here and at Sam coming southbound this way he used his lights to make the guy pull over over to the side then cut him off and try to make him stop so he right now he's got the offense using the red and blue lights in order so impersonating B A volunte want to get him out of the car and hook him up real quick I okay hey can you step out so we talk for a second keep your window up I want your dog jump out okay so we just have some questions for you okay yes sir all right so what was the purpose of turning on your red and blue lights in hon County when we came over the bridge we were just leaving my girlfriend's house uh turn that way when we left from FL Creek Marina mhm uh we cross that first Bridge he pulled off of right there where the fireworks St is in the corner okay uh me and a couple other vehicles that were in front of us we're going to speed limit okay like he's been trying to pass us and know on the second bridge where that gas station is on the corner who was trying to pass you this guy in a white truck okay he was trying to pass me and two other cars in front the gas station on that second bridge right there I guess I don't know yet old bridges used to be in the water got gas St he tried to come up again he already and I was like what he doing well then he SL back over or whatever pushed us off pull off in the little area there the boat do is p off where the boat was uh there F was back up on the road go backing so so explain to me this is a r car correct yes sir why do you have why why is this on there uh we put that on there why did put my dad did your dad did yeah why did he I so why did you put the you where you work at your you call him on the what volunteer agency were you with again Lake paltin East Volunteer Fire Department Lake paltin East they have anything like that who's that Thanksgiving I'm going to go talk to her Le try to get a supervisor so we can verify he works okay that's or anything to verify that you're with that agency uh no you don't okay I work out of state a lot or whatever I just got back in town my car what state do you work out of I work all over the United States all over the United States okay do you have certifications in other states right what what other states do you have it in uh no I do I don't volunteer anywhere I uh merchandise on Depot okay but when you're with the volunteer aspect of it and everything like that are you certified in the state of Texas to do anything like that for volunteer fire department yes sir uh em certified any kind of fire certification P code certification I work uh em uh VST VST at headquarters where's headquarters at uh over on Glenwood overall Glenwood the cotton somebody is it on is it on your car audio I see yeah I say hello he doesn't have any sort of well not ific just verification that he works for a volunteer doesn't have it at this time at least he works at a headquarters off can you hear me can you hear me hey can you uh absolutely can you verify this can you verify with officer spiritart or Tyler PD that I volunteered at Lake Pal well that I'm on Lake Palestine I just got pulled over or whatever of my light bar someone try to run me off the road my hit my light bar whatever keep them off yes I just need you to verify yeah I know can you just verify can you just let them know that Vol Department that's all they need does need verification right piece of paper something that says that you do that can you can you ver can you just let them tell them that I'll volunteer late volunteer of like 500 and I'll take them out of my way windows and everything for yall I mean that evid you said you ran his name and everything and they didn't come back with any sort of certifications whatsoever y'all can have if y need them that b i I don't know what all is going on know Count's working on it too he says he with white pal East volunteer fire department he's giv me the name of his lieutenant and his chief as well I passed that along the county I can see if I can get that information for you I help that way the would get off his them on or whatever stay unpluged the only time I've ever used them is when I got paid to let you know you have your C with fire department or do you just go out there and throw throw water no I'm just new out there said you've been doing it about a month you said go there on grass okay so you just go out there throw water on fire I'm like a reserve like only because they need help or something help are you on call today no I don't know how that volunteer stuff works I don't know if y'all are on call or no I'm not on I don't get paid I'm not noon day I'm not bu I'm not ESD one or two I'm not volun that them lights were not even plugged up until that dude hit it and do it and I F them on and put them right back off and unplugged them or what I was like what the hell is he doing she was trying to get a hold to Henderson County on the phone because it crosses over Smith County Henderson 911 disect I could be in Anderson County and sometimes it go straight to Smith County or sometimes you live out in Cherokee County you call 911 and sometimes it goes to Smith County and you have to request transfer to Cherokee County or and County so so where' you flip on the lods a second ago uh at the first Bridge right there at the Flat Creek Marina that's the only time they ever came on and that's when he Tred like I don't know if he trying to push us out the way I don't know what he was trying to do he looked like a young kid and I so I had my dispatch checked this where he work checked with crystol with Anderson County he's not with Anderson palon or Frankston in any official capacity then they contacted Jennifer out of Cherokee County and he has tried to work for Lake Palestine and Cherokee multiple times but it's never worked for them in any offici capacity I don't think realiz I know at this time he is not surpris not a longer firefighter anywhere but honestly it's irrelevant that's why you you're saying he can't get paid because of his P or whatever so he said all he does is show up and throw water throw water grass fires so that yeah so what do yall want to do how can I help out well I mean you I've got an offense in the city so I mean we don't have an offense in the county we had to notify Henderson County and see if they want do anything with it um and then because the other time it happened on the loop so I mean it's up to y'all honestly before we do any more questions you think we need to throw no I wna I want to because he spoke to the complaint he spoke to the complaintant so I want to see what I think we're instead of 372 371 because you said he a volunteer firefighter not he's using the vehicle to impersonate a public official not a public official which can be anyone anointed by the government a town a stewardship or an agency official public a firefighter is firefighters are elected by the city usually most likely and they have some kind of certificate he's saying he's part of that affiliation and he's used the lights in order to get people out of his way using it to get people off his butt or to keep whatever he's using it for it doesn't matter he's using those lights to direct traffic in a way that he's using that authority to make people move out of way witht purp of that I do and uh what was what was the refle again 3711 3712 also fits but the sergeant I've been arguing for that for a few minutes which one yeah my mom was wondering if if y'all take me to jail is she going to be able to take my rental car that's a good question how long how long have you had this r car I haven't until got my car I just picked it up yesterday day before yesterday I mean I don't see why we wouldn't be able to release it to her yeah that's fine with me am I going to jail that way let my mom know we're trying to still figure that out a little bit okay we still like I was tell I was telling her my mom and like why don't you tell that the guy was pulling a gun out on did he pull a gun out on you yeah had a gun had a pistol did you see the pistol yeah P up his he was so he that's why he went he P up the back side of the car whatever he why didn't you tell me that earlier my mom I want you to tell him that did he tell his mama that hey did y'all ever get a hold of dispatch or anything no she kept trying to get through she was trying to her me ain't been on the charge quick question okay when that guy pulled up beside y'all and they were think what did he do the guy M the guy on the white truck mhm I wasn't really paying attention I just know like when he uh was behind us he was really close and then we were driving and he just kept following us okay did that guy ever like put y off p y out anything like that you think that my I was I was singing the music pull a gun or anything like that um not that I didn't see you didn't see it that would have been notic that's cuz that's what he's saying now okay I don't when I'm when I'm not driving I don't really pay attention I don't either it's all good I pay atten when you are driving so all right come on man I just got she's call and get an address real quick for her okay you want to set your phone down real quick go ahead and turn around put your hands behind your back for me can you get it yeah turn put hands back at this time you are being placed under arrest for impersonating public servant all right we come here in front of my car go spread your feet for me you don't have anything sharp dangerous on me that might hurt stab poing anyway no guns no hand grenades no drug something like that okay I ask how impersonated oh we've got multiple reports of you activating your overhead lights you said that you're with a volunteer fire agency we checked your dispatch and all the surrounding areas where that you're claiming it to be around Lake Palestine East and nobody's saying that you work for it what the hell are you serious that serious how you doing I didn't mean to just kind of dip off like that real quick I just want to talk with him and then he started talking to you so I was like okay he we'll go what happened so uh familiar with Chandler at all the lake paltin area ah not super clear but not uh so between real quick okay before I get going you wear section 37.0 of the Texas fun code no it's basically stting that if anybody lies to police officers and it's material to a case you can be criminally charged as well okay so now you understand that understand now that I've told you that tell me what happened so uh coming down the southernmost Bridge of 315 mhm um he was doing about 30 mph over a 55 mph Bridge Okay um I slowed down once we got to the end of it coming up where there's a campground in the church mhm uh he flipped on those red and blue lights was he in front of you at this time he's in front of me okay uh he flash after did you think that he was a undercover cop or anything like that when he turned those on or not at that moment it was wasn't until he started putting his hand out the window and going like this as in telling you to pull over motioning for me to get over okay um I called Henderson County dispatch and asked if they have any undercover units mhm at that point I noticed what I had thought originally was uh Hampshire plate was until I got closer I saw it was Michigan okay but I read them off the uh the number okay um they told me no okay they don't okay um at that point they said that they would be having one of their officers contact me okay once we got two1 there with the 31 and 315 is M he started come this way okay he almost took out somebody on a in a car okay SW sideswiping him mhm uh and once we got around to the 49 overpass mhm he gunned it okay had to least G 120 he was gone okay I didn't catch back up to him until he had got caught out a red light okay um by the miracle go plant uh us to be Kelly Tyler out there out on 346 on the that's still 31 right there still 31 that's uh for my understanding that's their area yeah once we got closer million dollars in the bass boat that's about it I love that one thank y'all I appreciate y'all very very much uh once we got past the miracle go plant when I never caught back up to him mhm um further down he got into it with a biker okay and they were just hauling up to the loop and they transferred me to you guys okay I made a stop on him because he was going 66 and 50 yeah everything see I asked the y'all dispatch and they had called me back after all these others called me back I was like was that planned or did he just happen to be there at the right time I just happen to be there CU they were coordinate with me what's going to happen now okay real quick I'm going to have you fill out a sworn statement everything just to have it R it's going to be that officer over there in the ball he's going to come over here and he's going to have you fill it out and everything just everything you just told me WR down articulate did almost hit me over by where the in the vicinity of that Chuckies okay Chuck SE is gotcha um he whipped it over if I had it almost went up on that curb okay he would have got me he was charged with impersonating a public servant his previous charge carried a deferred sentence of 10 years in prison following this felony charge the
