no you don't need to adjust your screen you did see what you thought you just saw that is one police officer's canine chasing another police officer and no this is not a dramatic reenactment this is not uh cops this is not reno 9-1-1 this is not super troopers this is real life and this happened in the eastern panhandle of west virginia let's watch a little bit more of the footage so this happened on april 11th of 2022 devon stanton was being arrested here what he was charged with was fleeing from a police officer and you're about to see his actual arrest him being taken into custody through the use of a canine and this canine appears to be absolutely completely out of control not only that but he appears to have been just put on somebody who was not fighting with the police who was not resisting with the police yes you saw that correctly so first the dog chases the state trooper off the screen and now once the handler actually has the dog supposedly in his control now the dog just basically latches on to the state trooper and they haven't even gotten to the guy they're trying to arrest yet this involved corporal welcome with the berkeley county sheriff's office and his canine named mates now corporal welcome's police report states that devin refused to obey commands and started to get up off the ground and that the canine team was able to gain compliance with the assistance of other deputies on the scene and we were able to take the mail into custody that's pretty much it there was no allegation that devin posed any immediate threat to the safety of the officers nor any other alleged justification for attacking devin with a canine in lieu of just taking him into custody without using a dog as i've previously explained generally the law is that where canines are deployed that a warning should be given along with an opportunity to surrender and that deploying canines on suspects who have already been subdued surrounded or who are not actively resisting or evading arrest it's likely going to be excessive force even with or without a warning under federal law so deploying canines on suspects who pose no immediate threat is generally going to be unreasonable they should only generally be deployed where they're in situations where there exists some serious immediate safety threat where it's a tense fast-moving situation devin was not fighting with them and that any alleged resistance appears to be only passive in nature he doesn't appear to be fighting with them or trying to evade or resist in in any way it shows other officers present who were able to subdue the suspect if necessary but they're just sort of putting the dog on him and and watching this dog who just previously was out of control and apparently attacked another police officer we i already submitted a foia request to several agencies in this jurisdiction to try to get any body cam footage which i know exists so far they have stonewalled those requests citing that there's an ongoing investigation so stay tuned for updates it definitely does warrant hopefully an unbiased investigation so as always thanks for watching you'll find more information about this at the blog at the civil rights lawyer dot com if you want to learn more about these cases and your constitutional rights please make sure to subscribe what do you think about this footage this is just absolutely outrageous i've already shown it to one former canine officer and he just could not believe it so if you want to support the channel please make sure to not only subscribe but click the join button and become a channel member or sponsor remember freedom is scary deal with it see you next time
