[Music] so the ATF has been busy here in the past few weeks let me turn this thing off and I just talked with John Crump the other day about the ATF rating the polymer 80 Business in Nevada and the Tyranny that they're they're in they're uh being involved in in that regard but here just today the ATF um published a document that was called what is it called objective factors for classifying weapons with stabilizing braces now why is this important what does this mean what is a stabilizing brace um I'll show you right here this is an AR-15 style weapon but this is a pistol this is a pistol it has one of these stabilizing braces on the back and what does that mean so you can hold it like that and fire it onehanded what is the advantage of this over just a regular AR-15 well for one thing you can have an upper on it that is like a short barreled rifle but it's not a short barreled rifle because it's not a rifle it's a pistol according to the really ridiculous um gun laws that we have and and the ridiculous ATF regulations that are already in place but if you have a a short bar barreled rifle it has to be registered with the ATF and you can't just go anywhere you want with it you have to ask permission by the at just to cross state lines with it and you have to pay a tax stamp it you have it has to be registered with the ATF it's a big pain in the ass but since this is a pistol it's not yes yet it fires the same just the same except it doesn't have the stock um intended for shouldering so this doesn't have to be registered as of right now and there are millions of these in in this country and it looks like the ATF is doing what they can to try to create a registration scheme for these these weapons now what is the other benefit to having a a AR pistol with a brace on it well in some states even if you have some states you can't even have a loaded rifle in your in your vehicle you can't you can't even get a permit for that you can't even get government permission for that but a pistol you can so if you're GNA have a pistol why not have a pistol that has a higher capacity and ARS are very easy to oper operate very easy to shoot so there's there's a lot of not that we need reasons but there's a lot of reasons why people have these items and want to have these items and they they've been very popular so what does this mean that the ATF um has published this document today well it's not a a ban on these just yet it is supposedly a somewhat of a guidance for the industry and for customers and probably for law enforcement to see what the ATF uses is and and their determination of whether when you stick a brace of and they different kinds made by different people whether or not they are legal according to ATF or whether they're you know a federal felony to possess without being registered with the NFA now here is the actual document that was uploaded let's see this is the Federal Register itself and you can read the document but it gives there's a lot of legal ease involved but it it gives these five different factors and this is what they look at they're not going to make a decision about whether or not it's legal until they see what gun you're going to put put it on what accessories you put on it and then they'll make that determination according to these factors type and caliber weight and length length of pull attachment method stabilizing brace design features so these could be different compared depending on what brand of of of stabilizing brace that one would be using now type in caliber um weight and length they're not giving any blackl law on this no blackl law they're going to leave it leave it up to law enforcement to have discretion about whether or not something is a felony to possess or not assuming it's not registered and they have other features that they discuss aimo that's uh you know you know how how uh the eye would be lined up and and what distance U from the from the sites you are whether it's a secondary grip so whether or not it you have some something to uh some sort of forward mounted grip um presumably if you do then that makes it more likely for them to find it that it's illegal what kind of sites and Scopes you have on there again no blackl law here these are just these are just um sort of ambiguous or vague guidelines peripheral accessories they won't say exactly what it is but depending on what you kind of accessory you put up put around on the gun that could make it illegal could not make it illegal so there's a comment period And I suggest that you you comment you um I think it would be important for the ATF to see that there's just overwhelming comments against what they're trying to do now I talked to John Crump um who's the Virginia director of The Gun Owners of America the other day regarding the the PO 80 business but he had written an article let's see he wrote an article that's that's that's really good on this exact topic see if I can find it all right here it is so I'll link this up in the description but this is a really good a summary at amaland news of of what happened today and he goes over some of the the issues with this so as he says first thing that jumps out at you is a document says it does not have the force and effect of law well what the hell does that mean and that's that's just typical typical government stuff so this is what we're thinking but we're not going to hold ourselves to it but we could hold you to it you know but we're going to give the officer's discretion or the agent discretion um whether or not to arrest you for a federal felony but we're just not going to hold ourselves to it but it might not be enforceable but it might be enforceable and then he goes into the what he calls the quote objective Parts typing caliber weight and length so it's left up to to interpretation and as he notes it seems ATF believes that heavy Firearms are impractical for braces so they're going to make it more illegal the heavier it is the lighter it is the more likely it is to be considered a pistol so as he notes this uncertainty is like giving the police the power to give you a speeding ticket without having the right to know what the speed limit is on the road um so check out the John crump's article he goes over a lot of the things but here's here's the biggest thing of of what they're doing is they're offering a free tax stamp and what that is is if you register an NFA regulated uh weapon with the NFA you're paying for what they call a tax stamp even though it's it's it's nowhere near the price of what you might think with a stamp and a lot of people are jumping on that thinking that all right that's great so they're making a lot of these potentially illegal depending on how you interpret their guidance but they say we can go ahead and register it for free now and so why don't we just do that that's a great idea and as as John points out here this is this has been done before this is the type of stuff the government does to try to you know they try to get a voluntary registry before they make it mandatory and they force it on you so there are millions of these things out there um you know you could have like boom just like that they get hundreds of thousands or even millions of of a style rifles or pistols registered with the NF voluntarily and as he notes Here I think this is a good point how would they handle this so if only 25% of the brace owners chose this option the ATF would be flooded with 1 million plus submissions being overwhelmed and they already have 100,000 applications in um in addition to the current application load that's going to create a backlog to create an even bigger artificial backlog for people who are already applying for short bu rifles uh silencers machine guns so a lot of people are saying here that this could be an intentional Cog in the system or roadblock to stop these things from happening so under the proposed guidelines ATF agents will have the discretion to do it and doesn't that just make you feel comfortable but look at this the Goa they're on top of it um the vice president of the Goa says basically the ATF is out of control and uh shouldn't exist in the F first place which is a great point they're not held accountable and they're trying to turn honest gun owners into criminals so check out that article uh that John Crump did it's a really good rundown of the ones that I've seen so far but the I think the the the the great guidance to have here is the organization that's leading the fight against this and that is the the Goa and if you whoops if you bring the let's see let me share the goa's website I just looked at this they've already issued a statement and this just happened today here we go all right Goa to combat at every turn the Reckless moved by doj to regulate pistols if there were any lingering questions as to how far the ATF has gone off into the deep end this document settles it said Eric Pratt ATF is the embodiment of the word infringement Goa is prepared to combat its actions at every turn Goa will rally the Grassroots to fight these regulations and if they eventually go into effect we will commence immediate legal action to protect gun owners they go you know pretty deep in into to some of the the problems with this uh things like caliber will be an objective Factor but it doesn't tell you what caliber weight and length Al also objective fa factors but they don't provide any specifics on weights or length so the factors are going to be secret and will be interpreted entirely subjectively by the ATF who I'm sure will be really fair so here's the the the the point of the thing is that they've agreed to let pistol brace owners register their firearms as short Barr rifles for free so as he points out it's a national gun registry just to save $200 and a lot of people are excited about it they're jumping at it so go join the Gun Owners of America if you haven't already sign up donate your money they you know where is the NRA you just hear crickets and the Goa is all already over all of these issues as you can see if you let them do it to bump stocks even though you don't care about bump stocks what what happens next then they come after the pistol braces once they register and come after the pistol braces what's next after that and it it it will be a Non-Stop slippery slope of of rights that we're going to lose if we allow this to happen so that's pretty much it you know it's hard to say what's going to happen with this um I don't know any of the inside workings of of the ATF I don't know what their what their subjective motivations are but it looks like that you know they're saying that this is not a law this is not a proposed law we're just putting it out there to help give people guidance on how we're going to enforce the existing laws that are already on the books of course that's sort of disingenuous because really in a in in reality in effect they are creating loss they're absolutely creating loss but yet they're just not saying so they're just saying well this is just guiding our discretion so I I think unless you know what they're going to do I mean who knows um so it'll be it'll be Cur I think the the best way to respond to this is just flooding them with comments about what you really think about it and then also we have to act as as a you know with a United defense and if Gun Owners of America is going to take the charge or or take the lead on that then we need to get behind them and we need to help them you know financially to fight that fight now it also will be will be curious to see and you know this is this is the the era in our history where the executive branches are creating laws whether they want to call it law or not they're not even going through the legislator they're just doing whatever they want to do because nobody will stop them the courts won't step in and perform their job which is judicial review and the legislators aren't stepping in to to call off these executive agencies from their tyrannical actions so just because a leg ISL doesn't stop them doesn't mean that it's constitutional what they're doing so as the as I've been harping on since the since the election this what's going to be really important in this era other than the things I've already said is going to be concentrating on your state politics because there's a certain level of protection that's going to be offered to you by living in a red state or free state and your legislators are going to have the ability to make you know certain things legal um when it comes to gun rights so the they call this you know the trend of liberalization of gun rights in the red States Across America and what's fighting against that I mean you look at the laws in in West Virginia in in other states and look at how much more free a lot of the laws have become and just the last 10 years like in West Virginia now we have constitutional carry where you can carry a concealed weapon without having to get a permit from the government first and that is a dramatic um liberalization of what the existing gun laws used to be and the courts haven't liked it so while the the state legislatures have been trusting their citizens more with their freedom that they should have had anyways the courts through organizations like Bloomberg runs have been filing lawsuits and trying to get judges to go in the opposite direction and that has been successful and you can just look at the The Walker case that I have right now pending at the fourth circuit where the judicial law that will have been created out of that case is that anybody open carrying a AR-15 style rifle and I don't think that would apply to an AR-15 style pistol as well is you know presumed to be a mass murderer and that is the law that you have coming out of the Judiciary whether or not the state legislators like it at all so you also have to pay attention on the judicial front because whether we like it or not law is created out of of out of these Court decisions so if you add what's happening in the courts to what the ATF is doing do you trust this Judiciary that is resisting the state legislatures to to uh perform the act of judicial review at all to hold back the ATF to hold back law enforcement that are arresting people for having what used to be legal items no I I I wouldn't trust that at all a lot of people have asked the question uh you know so far you know regarding the the polymer items you know if you had bought these 80% lowers you know what do you do now do you can you sell them do you inform the government that you have them and you know what's going to happen with same thing with these pistol braces now with the pistol braces they're trying to get you to to voluntarily contact them and register so it will be curious to see how many people choose that option you know if you do do that if you do turn a pistol into a short barreled rifle presumably then you could take off the the pistol brace and just put a regular stock on it but then as some people point out then you have to now comply with the short barrel rifle rules and you have to notify the ATF even if you're going to cross over state lines and in a state such as West Virginia or Virginia if you're near the border I mean you might regularly cross over those lines or up in the Northern Panhandle of West Virginia I mean you're in you're in uh you know you're driving in and out of Ohio and Pennsylvania and West Virginia or down and and over in the Huntington area you're in Ohio or Kentucky or West Virginia all in the same day so that's what's going on with with the ATF and I don't have a whole lot to add other than I I agree with the the GOA that this is this is just a preview of Coming Attractions we know that they've been working with the B incoming Biden Administration um and they seem really excited to to execute their agenda for 2020 and and what's in the crosshairs we have we have uh pistol braces so make sure you comment follow the process comment make sure you've join organizations such as Goa and contribute to the fight and pay attention to the keep your eyes open as to the individual instances which which occur because it all important to see what's going to happen in the courts if any of these cases get there see Randy Weaver for a thousand Alex yep unfortunately the three branches are constituents and you are sering the Constitution that's right Magus I drive through West Virginia Pennsylvania every day just because of the highway the fort by 10 plus mags now you know another thing that that is crazy here is so you if you have if you have this with this magazine in it this is a 30 round magazine and and so you you take that out and you put a larger magazine in there I mean they have 100 round magazines they have the little drum magazines according to this rule just inserting a different magazine can make it now illegal illegal to possess because if it's just their opinion if that's all if if if that's the basis of the law if it's just their opinion you know they can change the opinions can be changed anytime they want and really without no do process and I believe if you read what they've written here maybe in the the the Preamble leading up to it they actually said well we don't even have to do this but we're just going to do it just just so you know because we're so we're so nice and we like to we like to give guidance all right so yeah beta mags beta mags that's that was a word I was looking for oops all right Dennis in my opinion if you can disarm the public it makes their ability to defend themselves against tyranny or crime um does that make sense well yeah I I think that makes sense I mean it's it's obvious that government all governments want to disarm their their subjects but what I've been saying for years and it's absolutely the truth is that you don't have to they don't have to take the guns out of the hands of the public they don't have to confiscate all the guns you don't have to make the guns illegal all you have to do is make the people illegal and they've been doing that for years so you you catch the wrong kind of lobster all right that's a federal felony you can't you've made the person illegal you didn't have to make the gun illegal now the person can't possess a gun or you you make a mistake in tax returns put a false statement on a tax return or a a loan document could be any number of things and boom there that's a felony you can't possess a gun so the the the justice system itself has been criminalizing the public and therefore disarming the public for years and years and I believe some of them have have had quotes to that extent that you know we don't have to criminalize guns we just criminalize the person I don't understand legal I understand lawful are you the same the same person that always makes that that comment I I don't remember if I said legal or lawful but as you know and complain about I use them interchangeably let's see old man you have to buy a card firearm owner identification before you can even buy a gun Illinois in three of the states well that's why I'm saying you have the option and and I definitely would is move to a free state you know move to a state like West Virginia where the legislature is devoted to well I wouldn't say devoted but they they they've done a good job in the past few years of protecting firearm laws firearm rights and I I think they will in the future to the contrary you can you can live in New Jersey or New York where you have very very few rights well well now you're NFA because of the window so you talking about the the window in the magazine I missed that part of the of the analysis if they put it in there I love the Goa I'm a member but they cannot keep up with Bloomberg's endless money yep and I did a video the other day about how Bloomberg's even spending money in West Virginia so the West Virginia legislature says that you know you corporate employers you cannot you cannot ban firearms in your parking lots and you cannot hire or fire employees based on their position possession of of firearms and Bloomberg brings his millions into or billions into West Virginia and files lawsuits and how do they do that they use the so-called domestic violence advocate advocacy groups and and use them as plaintiffs to say that well our our clients are scared of of guns and and U you know this is violating their rights to ban guns in their parking lots which of course is just a scam it's just a joke but but hey what it it's already cleared the first motion to dismiss hurdle in federal court here in West Virginia so it might not even matter what the legislature does if if the if the Judiciary legislates from the bench and I don't think that that is happening and as I explained in in that video um it was just a motion to dismiss so I don't necessarily even disagree with with the ruling but we'll we'll see if it if it ends up going going any further or or getting to trial because because uh you know these battles now are being fought in the courts increasingly and they're going to continue to be fought in the courts oh I saw a comment I wanted to put up and i' lost it here somebody said too too many pictures of these guns being put up on the internet and social media is the reason that they've done this and I think there's some truth to that and that's that's sort of what they put in their analysis is or their guid their so-called guidance is even if we've declared that a particular company's brace or the gun with the brace is legal like this so this already had its own letter if you buy it from the factory it came like this from Sig sour and with it came a letter from the ATF or a copy of the letter stating that that we've examined this brace on this firearm and we found that it's a pistol and and it does not have to be registered with the NFA as a short bailed rifle so according to this guidance they could watch the social media of Sig sour and even other owners or commenters and if they see that if they can change their opinion based on the social media based on the marketing Bas based on the comments to to find that well the intention actually is to shoulder it and therefore we're going to change our opinion that this is now a pistol I mean it's just absolutely the definition of arbitrary and capricious uh so you know I think that's it it'll be a good test to see you know what they how far they're able to get with this and I think that's what they're doing as well they're going to they're going to judge the resistance to see if they can get away with this and if they can get away with this they're going to try to get away with something a little a little further down the road and so it it's going to be important to show a lot of resistance to this here and both in the comments and lawsuits and in and in defense of particular court cases is if if they pop up Magus mve to West by God Virginia that's why I'm here I'm glad glad to have you here Magus would a suspended sentence be viewed as a conviction well generally speaking a sentence that is suspended is just meaning that you are getting probation instead of being incarcerated and that if you violate the terms of your probation then you're going to be you can incarcerated so you have to have a conviction before you have a sentence so yeah there um something with a suspended sentence would be a conviction and I assume you're asking for determination of whether somebody is is allowed to leave lo I don't know is it legally or lawfully possess a firearm whether or not they're a prohibited person I have to ask that that Tabby guy or girl I'm not sure if he or she likes lawful or likes legal yes Mike that's correct the state does not own your rights nor can they take them away not in theory but they can in in real life and in practice unfortunately polish the ATF not likely in the next four years you want your rights quit voting for morons yeah there's a lot of Truth to that though and here's the problem is in West Virginia we we voted in a republican super majority allegedly and we can pass all the the protections that that we want but it doesn't stop the federal government from imposing their will on us and it will be up to the attorney generals and the legislators to to to defend their people against the overbearing federal government in the years to come so make sure that you have a an attorney general who is who is proun at least our attorney general here in West Virginia is has been very proun and I think he'll he'll uh he'll fight that fight so it's going to be important to analyze what state you want to live in you know if you care about these things you know I you know there's going to be a big difference you know between the states and we're really I think going to get back to the principles principles of federalism in the last four years that they took attacking Trump they did I think weaken the presidency and for them to turn now turn around and try to use an Obama era level of federal tyranny one good defense to that is going to be the point point out everything that they did and said in the last four years to try to to constrain president Trump so I think the presidency is going to be weaker because look what they did to president Trump and look who's going to be the president now so it's going to be more important to embrace the principles of federalism and states rights once again and to to try to exercise the the powers of State sovereignty that's right West by God Virginia well it's Friday night and I just wanted to do a quick video about the ATF issue since it just came out today and hopefully maybe I can get with John Trump uh John Crump again and and get his thoughts on on what all this stuff really means in the end I don't know how how the you know what the conventional wisdom is is as far as what the atf's going to do what they're not going to going to do I don't know the politics of it but you know I know the I know the the HDE your dog aspects of all this stuff and you know when all else fails it's always good advice to you know if if you think it's even possible even remotely possible that you may have broken a law that you did something wrong or that somebody might think you did something wrong well if you if you do if you do break the law don't tell anybody about it and nine times out of 10 that's how people get in trouble if you break the law don't tell anyone about it just picture the the fish on the wall the Taxidermy with the little slogan underneath it that says if I'd only kept my mouth shut so that's what I do know about um so you know if if you if you have any issues and if if if you don't know what else to do you can always just keep your mouth shut so I appreciate you you're listening and I'll dig more into this issue and it just popped out today and see see what ends up happening but I think I'll also play my my uh my great extended intro that probably is Enough by itself to if not get censored by YouTube to at least get demonetized so I'll go out on that note and um um appreciate you watching and I'll see you hopefully sometime next week Heen people [Music] like fighting for it you no one can tell you how you should feel time like what wrong is a you make up in your own mind you should hurry where you got time no matter what
