By the time this incident occurred, he had six DUIs on his record, but he said he didn't consume any alcohol on this day. just from what I'm picking up and indicators that I observed. Um, I'm going to be running you through some fields. Okay. I just want to make sure you're safe to drive. >> Sure. Sure. Well, we'll take care of what's his name? >> Winston. >> Win. Oh, that is a very >> I told your partner. It's a very proper name. >> 11 months old. >> I like them. Well, let me have you stand up, okay? So that way we can start this and get you all set to go. Okay. So, >> yep. I'd ra I'd rather not take field sobriety. >> So, you're not willing to cooperate with any test? >> I'm not trying to tell you that I'm not willing to cooperate. I just >> Okay. Well, I'd like you to try the test because right now I want to give you the benefit of the doubt. I want to give you the best to try the test. Okay. >> Yep. The SFSTs. >> Okay. So, are you willing to stand with your feet together for me? Put your arms down to your side. >> Right there. Right there. >> Down to your side. Stay just like this until I instruct you otherwise. Do you understand? >> Yes, ma'am. >> Okay. Any medical conditions I need to be aware of? >> I don't know what they are specifically, but yes. >> Yeah. Okay. What do they do? What do they >> I couldn't tell you specifically, but yes. >> Okay. Um and you said no alcohol. >> No alcohol. >> No drugs. >> No drugs. >> Okay. Um, and no recent head injuries. >> When my mother gets here, she'd be better off to take the dog. >> Yep. We'll worry about that a sec. Any recent head injuries? >> Worry about that. No reason. >> Okay. >> Sorry. >> Nope. That's okay. Okay. >> Trying to just do what you told me to do. >> Yep. So, just Can you see the tip of my finger? >> Yes, ma'am. >> Okay. So, I'm going to be moving my finger. I want you to follow my finger with your eyes and your eyes only. Do you understand those instructions? >> Yes, ma'am. >> Okay. Go ahead. See my finger? Look at it. All right. There she is. >> Okay. Well, we we'll worry about her in a in a sec. Okay. I don't want you to be distracted. >> No, I'm not distracted at all. I'm just looking at her and >> Okay. >> noticing that she pulled up so we could >> That's okay. We'll have her hang tight. Okay. Can you finish the tests? You can you can >> Can you keep looking? >> I can just hang tight with her. >> Like like you said, my mom just pulled up. >> Yeah. So, we're going to have her sit in the car. Great. >> So, can you >> So, if I understand correctly, the actual attention he got from the officer was first because he was having a little bit of road rage and then she noticed when she tried to light him up, he didn't stop and he almost hit some people. Wait till you see what his road rage cost him. Cuz I'm like, I Oh, I didn't realize you had the road rage first. I thought it immediately just showed he was driving erratically. Okay. Okay. But yeah, y'all will see. We actually get to see the conclusion of what happened with him on this one. >> Finish the test with me? >> No. No. >> Okay. >> So, you're not willing to continue with >> I'm not telling you that. I'm not willing to continue with anything. >> Okay. Then what are you telling me? Okay. Are you willing to >> I don't want to argue with you. >> No, that's okay. This at the end. >> I'm just gonna ask. Are you willing to do my tests? Are you willing to cooperate with SS? >> Of course, I'm willing to. >> Okay. Can we continue then? >> I'd rather just go see with with just to make sure that she can take my dog home. >> So, I'm going to tell you right now that's not an option right now. Right now, I'm I'm conducting an investigation. Okay. Are you willing to perform the test that I'm asking you to perform? >> Of course. >> Okay. Can we continue those, please? >> Okay, we can. >> Okay. Can you stand with your feet together for me? >> My feet are together. >> Nope. Touching, please. >> I need them touching. Your feet touching. >> Touch your toes together. >> Nope. >> They're they're short. I'm not >> I'm going to tell you right now. Okay. These tests need to be done a certain way. So, when I give you instructions, thank you very much. Yep. Arms down to your side. >> Arms down to my side. >> Do not move. Okay. >> Yes, ma'am. >> Keep using my finger. Keep following it. After six times, why is he wasting his time consenting to this? We could just skip this. He might as well just say, "I refuse. Take me to jail." He actually could have saved himself some charges had he said, "I refuse. Just take me to jail." >> Yep. I was playing with my dog at the park for the last half hour. And now we're here doing a finger test and I'm wobbling. You know, I don't I don't want to look. >> Okay. I'm going to have to keep following up. Okay. Can you take your hat off? It might be easier for you. >> Yes, ma'am. Oh, >> that's okay. We'll leave it there. Okay. Keep following up. Okay. It's going to go off the side. >> I can just throw it on the side now. I look like I'm >> ready. >> Yes, ma'am. >> Okay. So, what I'm going to do is we're going to do the walk and turn next. Okay. So, >> I'd rather not do that. I'd rather just have the woman pulled in front of this car uh pick up the dog that's in this car. We will worry about that with myself. Well, I'm not worried about we're doing that one. I'm going to give you one more. >> I I'd rather be done right now. >> Okay. So, I'm going to have you turn around. You going to be under arrest for OWI. >> Okay. We can do that. >> I tried to give you the benefit of the doubt, dude. But >> yeah, you know, do what you got to do. Yep. Absolutely. Well, and we'll make sure Winston gets in with your mom. Okay. >> Perfect. >> I'm not one to leave a dog >> strayed. >> Yeah. >> Step up on the ground. >> Y right there. >> Christopher's attachment to his dog Winston seemed to be an emotional tipping point for him. The thought something could happen escalated the arrest even further. >> Is there anything illegal in the vehicle that >> No. No. You know, you can go let my mom, my 67y old mom know. [screaming] >> Stay with her. You're not going anywhere yet. >> She can take care of the dog. >> Not going anywhere yet. >> Guy just dude. >> Okay. >> Jacqueline, this is a good question. I don't know if we closed this loop. He said, "I just came from playing with my daughter at the park to now y'all stopped me on the side of the road because he he don't he don't take it um he doesn't take accountability for how he got himself here." But yeah, I wonder did he have supervised visitation so another adult has her? That's what I was hoping. I I was like, let me assume there's a responsible adult with a daughter still cuz I ain't seen no sign of a daughter. [laughter] So yeah, hopefully she just went with another family member or her mom. Do not tense up. I'll >> tense up while I aren't. Buddy, >> you're going to go in a restraint chair. >> Yeah. Yeah. Put me mother. >> Here we go. Sometimes the handcuffs are a tranquilizer. Sometimes I said steroid shot, but if you have a better one that that illustrates how they amp up, I'll use that. But here he goes. His wrist jewelry came on and he's escalating. Some of them calm down. >> 2 years old right now. >> Oh, did he say dog at the park? Because I know he has a dog in the car, but I could have sworn when he said I was playing with my blank at the park. I thought he said doctor. H >> I know you want to >> do what you do. Go ahead. Beat you up. Throw me in the car. Do what you do. I ain't going to I'm do this and the other thing you guys are both lucky that you both >> Hey hey hey dude. Hey hey hey. Yeah. Did you get beat up in high school? You must you must >> stop. >> Yeah. Yeah. >> Stop you pissed off at yourself. You're going to go to the ground. not pissed off at myself. >> Let me finish my search. >> I hope you guys >> I wonder if the lady in the grass is the one he road raged against. I just saw someone when they the body cam panned over it was a lady standing in the grass and she had on like a professional clothing but I don't think it was a uniform 67y old woman who had glasses gone >> for no reason man you man you go I know where I'm going >> officers almost had him in there we have to pause it here because of YouTube guidelines but let's just say saliva went airborne a few times >> he described Well, hold on. If we don't have to be sub subjected to saliva actually being spit, why do we still see that all the time on other body cams? I'm glad they skipped it. I don't want to see it, but I see them let that fly all the time on the other body cams >> on the ground. Get on the ground right now. >> You the lawn crime person that had to edit this body cam footage needs a raise. It is so many [laughter] so many bleeps in here. >> You you ain't nothing but a Yeah. Put your knee on my chest. >> Put your knee on my chest. >> I got his leg down. >> Go ahead. Go ahead. You got my arms? >> Yeah. You got a female helping you? Yeah. Put your hand on my arm. you. Yeah. Grab my neck, you >> Yep. Yep. Good. Do that. Good. You guys are tough. You guys are so tough. >> Maybe me. >> Yep. >> There's a couple. >> Yep. Yep. Grab Grab 19. Sorry, >> I'll just hold it off for now. >> Yeah. You guys have no idea. That's awesome. All your names are on the police report. I can't wait. I can't. >> I bet he can wait when he sees how this is about to go. >> What if I grab a towel to wait? >> Absolutely. Yeah. Wipe your face. Wipe your face. >> Yeah. Grab my head and smash it down. >> I'm not I'm turning you away from you. >> Oh, yeah. You're turning turning me away from me, huh? >> Yeah. >> Yeah. You're a tough guy. >> Yeah. >> You're a real tough guy. >> Yeah, I would. >> They're all Yeah. You're real tough. >> Oh, you're so tough. Fortunately for his dog, Winston, he was left in good hands. >> I grabbed toys, too. I don't know. >> Can handle? >> Yeah. Um, no. Here, let me put them put this on for your >> um Winston got some energy on him. I wouldn't have been brave like that cop. I'd be like, here is his collar and leash. Do what you will. Keep your windows cracked so he don't jump out. Ain't no way Winston's a little too active for me. But I'm glad Winston got somewhere to go. That's your car, right? >> No. >> No. Whose car is that? I thought he said it was yours. >> The red one behind. Okay, don't worry about it. You're all set to go, ma'am. It'll be Elers's. >> Yes, ma'am. Yes, I will. So, okay. Thank you so much. Drive safe. Roll the window up cuz I think he tries to jump out. >> Unfortunately for Christopher, he had to be transported to jail in the spit chair. >> Roll onto this. Bring this knee up and then roll onto it and up. So, roll. There you go. Good. Just like that. And then >> we're still at the air. >> Yeah, I can clear it. It >> hurts. Yeah. Take a seat. >> Thank you, sir. Put your hands down a little bit. >> There's a hole right there. >> Yeah. >> Oh, I'm sorry. >> Yeah, if that was his mom. Looks like she didn't try to make excuses for him. She just took care of the dog, which is good because we have seen moms inter interfere in traffic stops. They don't make it any better. It's not going to help anything. You didn't see how your child was your your adult child was acting before you got here. They're still going to jail. Um, so yeah, but Noir said, "Okay, so maybe mom showed up because she knows her son has a drinking problem and not to challenge the arrest." She was Yeah, she did pretty good. I didn't hear anything. I'm like, "Was that mom? instance with mom. >> That wasn't ankle. >> All right. >> Okay. They just said mom for my my hearing. I'm sure they mentioned it earlier, too. >> Yeah. >> I'm sorry. >> I want you to be comfortable. So, I'm not going to say >> I got the weak arms. They don't pull that hard. >> Yeah. >> What's that? >> What's that? All right. >> Should be. >> All right. Legs done. >> All right. We got the ankles. >> Yep. >> Yeah. >> Hands will be next. >> Um, >> I'll break your breakers. Get your hands off my >> dude. Stop pulling my hands back. >> Well, quit pulling my mother hand off. I'm not trying to do it. Look at me. There's eight of you. What the are we talking about? >> All right, let's get someone grab >> bunch of tough guys. >> 19 of you on one dude. Yeah, >> you guys are so sure you can't move. >> I was trying to see what her wrist said. Let me I'm slow down. I I I'm curious. Oh, wander lust. Okay. I thought that's what it said, but I was like, maybe I'm making that up in my mind. Make sure you can't move. >> No. Yeah. Yeah. >> Better tight. >> No. >> You better sense it tight, mother. >> You let me go for half a second. You're about to get bust. >> Do you want me to? You guys are so tough. >> Just I mean we're going to have to go to the hospital either way. Yep. >> Um so because it's 7 months, >> so it's going to be boring if he refuses. So I can do all the paperwork >> while we're out to the hospital. >> Okay. >> Um should we just go out to Waka um hospital WH considering we're going to jail? >> Yeah. Seven. >> Seven. >> Okay. Yeah. Yeah. >> Yep. >> Deal. >> Here we go. Drive me to jail. Throw it down. Grab that. >> Yeah. Nice little operation here. What state is this he? We'll see when I when we look at everything. If I didn't if cuz I forgot if they said it. I already forgotten. But uh yeah, it's nice little nice little vehicle here. Lot lot of technology going on. be seeing you again. Me? Oh, for sure. >> All right. Where are you going to see me? >> Kids at your house. >> Oh, yeah. I don't have kids, so that's easy. >> That's fine. >> Where we at? I'm lining up. You see? >> Okay. Um, there's alcohol in it. Thank you. The dog was running around and he pierced one of the closed ears and it sprayed all over the >> A blood alcohol test revealed Christopher's BAC was way over the legal limit. It was reportedly 223. He had faced a number of charges after his arrest, including operating while intoxicated, throwing discharging bodily fluid at a public safety worker, battery, or a threat to a judge, prosecutor, or law enforcement officer. Bail jumping plus resistance. All right, Chris, >> not bail jumping. [laughter] Can you hear me? Can you hear me? Okay, I'm assuming you can hear me. So, before I ask you any questions, you must understand your rights. You have the right to remain silent. Anything you say can will be used against you in court. You have the right to talk with the lawyer before questioning. Have a lawyer with you during questioning. If you cannot afford to hire a lawyer and want one, a lawyer will be appointed for you without charge prior to any question. If we decide to start answering questions at this time, you can also stop during uh any of the questioning. So, with you waving those rights, are you willing to answer my questions? >> Nope. Okay. >> Online records show a judge initially set his bond at $30,000. On May 21st of 2025, Christopher entered a plea of not guilty. The case was supposed to be bound for trial in August of that year. But on July 11th, he pleaded no contest to operating while intoxicated, throwing/ discharging bodily fluid at a public safety worker, and battery or a threat to judge, prosecutor, or law enforcement. He was sentenced to a term of six years in prison plus extended supervision after his release. >> I didn't want to spoiler alerted, Mindy, but I when you said what happened to your I think you said your brother, I was like that sound like kind of what happened to him. He got six years in prison. That's why I was like, yeah, a lot of choices he made that day cost him six years, which oh well. All right, let's look at his charges. Yeah, it still could have been more charges for him lovable. I feel like we're missing something. We'll see though. Okay. So, we have first charge was a OWI, operating while intoxicated. We're we're well verssed today on that one. So, we'll keep going. And then we have throwing or discharging, no throwing or expelling bodily substances at certain public safety workers or employees. Prosecutors generally must prove the defendant intentionally threw, expelled, or caused a bodily substance to come into contact with a protected public safety worker and the public safety worker was acting within the scope of official duties. Possible defense arguments. The contact was accidental rather than intentional. The defendant lacked the intent required by the statute. The alleged victim's account is inconsistent with the available evidence. These were hypothetical defenses. Not saying his defense argued any of this. Just want to clarify. The next one is battery or threat to judge, prosecutor, or Leo. Class H felony. Prosecutors generally must prove the defendant intentionally made a threat or committed a battery prohibited by the statute. The alleged victim was a judge, prosecutor, law enforcement officer, or other protected official identified by the statute. and the defendant acted under these circumstances required by Wisconsin law. Possible defense challenges. A defense attorney may challenge whether the statements were protected speech rather than criminal threats. And y'all did say threat cuz you y'all were like, "Are those threats over?" Because there was so much bleeping. Um, but the other thing they could have argued was the alleged battery never occurred. The prosecution cannot prove the defendant intended to intimidate or harm the protected official. He got those six years. So yeah, some things were proven. 0.2 anything is crazy work, right? How was he standing and driving? Oh my gosh, it's so many people that by the grace of God, their lives were not taken with him behind the wheel. Yeah, I'm glad they charged him with that bodily fluid, too. Noir, that's crazy. He had a valid license, Jacqueline. That's crazy. >> What is one piece of advice you'd give every client? >> Shut the [ __ ] up. >> Should you delete texts after getting arrested? >> No. What is the biggest mistake people make after an arrest? >> They talk to the police. >> What's something people think is illegal but isn't? >> Not talking to the police. >> What is your favorite part of being a criminal defense attorney? >> Standing up for people. >> What's one legal television show that gets it right? >> The wire. The wire. The wire. >> Would you prefer a high-profile case or more of a low-key case? you know, low-key because high-profile. They're going to see how the sausage is made and I'd rather just get a phenomenal result for a client and then no one knows about it. >> What is the fastest way someone ruins their own case? >> By talking to the police, [music] >> come on. play. Grab [music] the couch. Got your name on the screen. You send me that link. I said, "Girl, [music] let me see." Yeah. You laugh. I lean in close. [music] >> We already know the vibe. One more kick.
