So, Stephanie, is this uh is everything
on here correct? Yeah. Okay.
What you been up to
tonight?
Um, hang out. Just hanging out. Yeah.
Looking for your registration. Yeah.
Okay.
[Music]
Is that your registration? Yeah. Okay.
What about proof of insurance? Um,
how do you know Nina? She's my best
friend. She's your best friend? Yeah.
Where does she live? Um,
okay. Yeah. Do
you know where you're at right now?
Yeah. Where you at?
That is still your registration. Um,
proof of insurance, please.
What does it look like? What does it
look like? Yeah. Well, your proof your
insurance. Yeah. Just piece of paper
that says, you know, insurance like
insurance company, State Farm
or Geico or something like that.
I don't have that. Okay. Yep. That's
your That's your registration again. Go
ahead and uh put you can put that away.
Uhhuh. Um take your seat belt off. Step
out for me, please. Yeah.
Go ahead and search the front of the
car.
That's fine. That's fine right there.
So, what are you doing tonight? Let me
try to figure out how you ended up right
here. It's kind of a weird place to
park. I was with my friend.
You with your friend? Yeah. Who's that?
Um, my friend Haley. Who? Haley. Haley.
Oh, okay. I thought you said it was
Nina. It was Nina, but we were with
Haley before. Okay. What were you guys
doing? We're hanging out for like a
military party. A military party? Yeah.
Do you know where? Um, JBL. JBLM? Yeah.
Okay. Yeah. That's way way down that
way. Yeah. Okay. You been drinking at
all tonight? Yeah. You have been? Some.
Some? Yeah. Okay. About how much?
Um half a bottle of wine. How much? Half
a bottle of wine. Half a bottle of wine.
Yeah. What What kind of wine? Um red.
Red wine. Yeah. Okay. About how long
ago?
2 hours ago. About 2 hours ago. Yeah.
Okay. You know what time it is right
now? Yeah. What time is it? 11:30. It's
11:30 right now. Okay. Um it's actually
1:45 in the morning.
right now. So, just so you're aware.
Yeah. Okay. All right. Um I noticed that
uh there was a bottle of alcohol. Yeah.
Um is that is that yours? It's hers, but
I d I dropped it off. You dropped it
off? Yeah.
Okay. All right. Okay, Nina. Well, um
I'm sorry, Stephanie. But what with what
you've been telling me and the way your
vehicle is parked right now and with the
alcohol I see um in the car. Um all
right. I'm going to I'm going to ask you
if you would be willing to um take some
field sobriety test, some voluntary
field sobriety tests.
They're not. They're voluntary. You
don't you don't have to take, you know.
Okay. Would you be willing to take a a
voluntary uh PBT
breath test? No.
No. Okay. All right then. All right. See
her different.
Okay. How can you tell she's drunk? We
don't have Friday test. Okay. We don't
have How can we tell she dropped it? Um,
look at her eyes. Her eyes are drippy.
She's starting her speech. She didn't
know what time it was. Says it was
11:30. It's not obvious except this
place so no one gets it. There's uh she
admitted to drinking or drinking. She
say half bottle wine. Half a bottle of
wine. Okay. Um she
has open container bottle in her car
with her.
Okay. So I mean without doing this I
mean I don't I don't know if she's drunk
but there's evidence showing. Okay. So
you just said you don't know she's
drunk. So it's either you do know she
drunk or you don't know she drunk. It's
one or the other. Okay. You don't need
field so far has to determine if
something stupid can't do because you
already named everything else. She
selfated drinking half bottle of wine.
Her vehicle's in the center of the road.
This isn't normal. Okay. She got googly
eyes. Uh certain speech.
Do you think you have enough director
for DUI right now? Yes. Okay. Let's get
that done then. Okay. So, what have you
been up to tonight?
hang out with my friend. Okay. What have
you guys doing there? We've been
drinking. Okay. Huh? Hanging out. How
much have you had to drink? Two
beers. I think there's a couple more on
the floorboards there. Open bottle of
wine, maybe. I So, so probably a little
bit more. Yeah, I had her with me, but
like
Okay. So, how how'd you end up stopped
in the middle of the road?
You know what intersection we're at
right now? Yeah. What do we got? No,
don't look. Lakewood. Lakewood? Yeah.
No, that's that's not a street name in
the city of Lacy.
How'd you end up stopping in the middle
of the road?
[Music]
I mean, like, do you know or Yeah. Yeah.
Go ahead. I do. I just So So what
happened?
I mean, it's dangerous, right? Something
could happen.
All right, Stephanie, you turn around
for me.
This time being placed under arrest for
DUI. Okay.
Yeah, it's Stephanie. Is it? Do you give
my part one of my partners permission to
pull your car off the side of the
roadway somewhere in a safe space so we
don't have to tow it? Otherwise, we're
going to have to tow this thing.
No, I don't want to.
Can you work on tow?
Yep.
Is there anything else you want out of
the car? Cell phone, purse, keys. Yeah,
cell phone, everything. Well, I can't
grab everything, but I can at least grab
like a cell phone. Cell phone and purse.
Cell phone and purse. Can you give me
permission to go on there just to grab
that stuff real quick? Okay. Once we get
you in the back of the car, I'll go grab
that stuff for you. Okay. Thank you.
You guys the car for me right there.
Yeah, I got
her. And we're good. Appreciate it.
All right, Stephanie, before you go in
the car, okay? I'm about to search you.
All right. Yeah. So, widen your stance a
little bit. Okay. Any sensitive areas,
I'm going to use the back of my hand.
Okay. Yeah. All right. Do you have any
weapons on you? No. Anything on going to
poke me or hurt me? No. No. She's
grabbing her purse and her cell phone.
Look that way for me. Where is it? Just
in the passenger seat. Is it just in the
passenger seat?
your personal cell phone.
Yeah. Good. Look that way for me.
Are you able to clear that call and join
ours will be clear here and
all right
Stephanie your warnings. Okay. 71 Sam.
All right. You have the right to remain
silent. Anything you say can be used
against you in the court of law. You
have the right at this time to talk to a
lawyer and have him present with you
while you're being questioned. If you
cannot afford to hire a lawyer, one will
be appointed to represent you before
question if you wish. You can decide at
any time to exercise these rights and
not answer any questions or make any
statements. Do you understand each of
these rights I have explained to you?
Yes. Having these rights in mind, do you
wish to talk to me now? Yes.
Okay. All right, Stephanie.
So, all right. So, how many how much
have you had to drink tonight?
A couple beers.
A couple beers. Mhm. Okay. Is that it?
Yeah.
Okay. Because when we were at your car,
you told me you had half a glass of
wine. You think that's another one?
Yeah. I had a half a glass of wine and
then I had a couple.
Okay. So, you've had half a glass of
wine and a couple beers. Yes. Okay.
Where were you drinking at? My friend's
house. All right. Where's your friend
live?
Where' she live at? Um I don't know. I
have I have her address in my phone.
It's in your phone? Yeah. Okay. All
right. So, you're drinking any about How
long ago this About How long ago did you
drink? What time is it? You don't know
what time it is right now? No. Okay.
Right now it's 1:50 in the morning.
An hour and a half ago. An hour and a
half ago. Yeah. Okay. That was your last
drink. Mhm. Yeah.
Okay. How'd you end up in the road in
the middle of the road right there? Um,
she let me go home. What's that? She let
me go home. She let you go home? Yeah.
Did you Did you hit anything or you just
wanted to park there? I
just I wanted to go home. Okay. Yeah.
I'm trying to figure out how you ended
up in the middle of the middle of the
road right
there. You don't either you don't
remember you remember stopping in the
middle of the road or No, I remember
driving and she didn't she didn't see
anything. Who's she? Nina. Was she with
you? No. No. You were by yourself? Yeah.
Okay. Whose whose bottle of alcohol is
that in the car? Mine probably mine.
Probably yours. Yeah.
Okay. All right. Sit tight for me.
I'll write a supplement tomorrow. But do
you need an initial statement for me
about what I saw for your report? Yeah.
Sure. Witness statement. Well, I'm not
filling out a witness statement for, but
I'll give you a verbal statement if you
want to. And then I can you can just you
obviously say in your thing if you need
additional information. I also took this
was the only phone in my pocket at the
time but this was her when she was
initially stopped there. Um I took some
photos of her passed out and then she
was with the alcohol bottle. Um so you
can send me a link. I can just text
those to you. It doesn't matter. But uh
so I'm
driving eastbound on in the right lane
of Lacy Boulevard. As I'm pulling up, I
see a car stopped in the straight lane
with its left turn signal on. Obviously,
it's one way, so I thought it was kind
of weird. As I pull up, I see that the
other female vehicle is uh stopped over
in the right hand turn lane across from
her. Um, as I come up, the female's out
of her car. She kind of waves me down a
little bit. I get out. I say, "Hey,
what's going on?" She's on the phone um
with dispatch and she's like, "Oh, the
lady's passed out." I go up to the
vehicle. So, I take the phone for her
and I'm letting dispatch know the
information. Uh but then I go up to the
vehicle and I see the female unc pass
passed out uh in the driver's seat of
the vehicle. The car is in park. Her
foot is off of the brake. Um so it's
parked there and she's uh like the
music's playing, everything, all the
stuff's on. Uh I finished giving you
guys the information. Um we were maybe
here for like 3 minutes or so. I was
kind of watching. Then I got concerned
maybe it was a medical emergency. And so
I start hitting the window. I mean, I
was pounding on that window like 45
seconds a minute. The front of it, the
side of it, just really hitting it hard.
When I was on the phone dispatch, they
could hear it in the
background. No response. Uh after
probably like a minute, her eyes like
kind of flutter open. She puts the car
in drive. Doesn't put the gas on, but
puts the car in drive. And the car
starts pulling forward into the
intersection. And so obviously he's a
busy road I'm like hey kind of like
going off like stop the car like stop
stop and then finally when she pulls up
to here. So she was parked like
basically like directly in front of my
vehicle. I just pulled it right behind
her.
Um ends up stopping right there. I tell
her to turn the turn the car off, put
the car in park. Uh and then I I reached
in after I got her to unlock the door.
She rolled the window down. I unlock it.
I reach in. I turn the car off for her
and then she gives me the keys cuz I'm a
citizen and I can do that. Um, and then
I mean from there I didn't ask her any
questions, but I obviously saw the half
empty alcohol bottle and stuff in the
passenger seat and um, she was having a
really hard time like opening her eyes
and like focusing on me even when she on
that initial contact. Um, didn't seem
like she was like oriented at all. So,
did she deny medical or did medical just
clear? No, we for them to go. So, they
didn't check her out at all?
No.
Where where the keys at? I gave them to
you. Gave you what? The keys. They're on
the back hood of the car. Okay.
But that's all I got. And I'll write you
a supplement if there's anything else
you can me. Nope. Okay. I'm going home.
Thank you.
Still awake? Yeah.
Okay. Going to step
up. Watch your step. Stay right here.
Face the
car. You always bring him in through
this door, not the main
door. Go to your
right. See the seat to your right. Okay.
That's where we're going to sit. I'm
going to take you out of the cuffs.
Okay.
Just have to technically be handcuffed.
And there's a little foot right here.
You need handcuffs, too. But I give you
free hand to be able to write anything
down. Okay.
That loose.
Thanks. Turn around for me.
[Applause]
comes that cup.
[Music]
[Applause]
Okay. Hit the green button just so that
it's all warmed up and everything and
then you do your mouth check so you can
start your obseration time before you
even do any of this because it helps
process.
All right, Stephanie. Uh let's see.
check.
You don't have to worry about writing
stuff down. You want to go down.
So, I just need to I need to do mouth
check. So, I need you to open your
mouth. I just need to visually just look
in there and make sure there's nothing
in there. Open for me.
Lift your tongue up.
Okay. Thanks.
your phone if you want to grab that
[Applause]
number. So, I want to at least shed some
light on you and uh probably was uh kind
of a bad time for you. Normally, we book
all DUIs, whether it's the first DUI or
not because we're having court system
issues tonight. You're going to be
provided a criminal citation, given a
court date, and you'll be allowed to go
home tonight. So, the sooner you can get
that phone from a partner, he'll make a
phone call to your friend. So we can get
her out here, assuming she's not
drinking at all, and she'll be able to
come pick you up once we're all done
here instead of you getting booked into
jail tonight. Sound good? Yeah.
So, take that. I'll talk to her.
Sorry. Hey, you stepped in.
tonight. I had some white today. Is that
your mother?
Hey, stop. Let me talk to the time for
phone conversation. Okay. I'm at the
Lacy Police Department. Here, let me
talk to her.
I'll explain. Let me talk to her. Okay,
Stephanie. Mommy, please. I'm going to
take this from you now. Okay.
Hello, ma'am.
Hi. This is Officer Door of the L Police
Department. I want to just let you know
that um is Stephanie your daughter?
Okay. All right. Um she was drinking
tonight. Um and so we we saw her and
Lacy. Um her car was parked at an
intersection. Um she's fine. She's safe.
Um but um we have her at the PD right
now. She's going to she's going to give
us a breath test. Okay. And then what
we're going to do is we're going to um
we're going to sight and release her,
which means we're going to give her a
criminal citation. Um and then we're
going to try to find her a ride
home. Do you want your mom to pick you
up? Okay.
So, do you know where the Lacy Police
Department is?
It's uh if you want the address, it's
420 College Street Southeast.
420 College Street.
What's your name,
ma'am? What's your name?
Kathy. Yes. Okay. College Street Street.
Southeast. Southeast.
Yep.
Okay. So, if you just want to come and
when you get here, just park in the
front lobby and then we can give you I I
will give you a call when she's all done
and ready.
You're welcome. Right.
And you already said that you're going
to you're going to give a breath sample.
Okay. So, that's all that. Will you now
submit to a breath test? Is that a yes?
Okay.
Okay. So, when we're
ready, have you ever known this before?
You have? Okay. All right. Well, okay.
It's uh probably similar to what you did
before, but I'll explain it again. Uh
make sure you have a nice tight seal
your lips around the the tube here. Um
one, take a big deep breath in and then
one long continuous um breath out. Don't
blow too hard at the beginning, but also
don't blow too soft either, or else
we'll have to do it again. Make sense?
Okay. Make it like you're blowing up a
balloon. Yeah.
And then my partner, he's going to be
the one holding the tubo for you. So
just don't touch that. We'll hold it all
for you.
And then once everything prints out as
well, too, we'll have a copy for our
records. You even have a copy for your
records as well,
too. Heat. Heat.
[Applause]
Okay. You ready? All
right. I'll hold it. You blow. I'll hold
it.
Blow. Blow. Let go. Let go. Blow. Blow.
Blow. Blow. Blow. Keep going. Keep
going. Keep going. Keep going. Keep
going. Keep going. Keep going. Keep
going. Keep going. Keep going. Keep
going. Keep going. Stop.
Okay. If it's good, it's going to be the
last one. Okay. Big deep breath in.
Ready. Deep breath in.
Blow. Blow. Blow. Blow. Blow. Blow.
Blow, blow, blow, blow, blow, blow,
blow. Keep going. Keep going. Keep
going. Keep going. Keep going. Keep
going. Keep going. Keep going. Keep
going. Keep going. Keep going. Keep
going.
Stop. Just enough.
Perfect.
[Music]
Make sure you sign and print and then
date and location.
[Applause]
Okay. So, this is your this is your
citation. Okay.
It's for physical control and not DUI.
Okay? If you were driving, right, then
it would be a DUI driving under since
you was wasn't driving, then it's just
going to be physical control. That's
what that's called. Okay? Since you were
behind the wheel of a running vehicle
while intoxicated. Okay? So, you have a
court
date of it's right here. It's going to
be November 14th at 9:00 a.m. Okay. Make
sure you show up for that court date. If
not, you might have a warrant out for
your arrest. Okay. Okay.
All
right. Um, so this is going to be yours.
This is the copy
of your breath test. Okay. That's your
That's your level. The the the bold
letters, bold numbers. That's your
level. Um, and then this is yours as
well for you. This is what I already
read to you. Okay. It's just going to be
up to you to fill it out.
Okay. Well,
since since your friend has been
drinking as well, um, and your mom is
still about 20 minutes out. Okay. I'm
going to take you out of the cuffs. I'm
going to put you into that little
holding cell in there. That way you
don't have to sit here. Okay. Get you
some water or something. Is it good?
Stand up.
Not yet. All right.
their money
back just until we get
[Applause]
you think it's a white wall for
She was No, she was drinking as well.
[Music]
All right. You good? Would you like some
water or something? Yeah. Okay.
