Never never going here a little bit ago. Starting to hear a little bit. Guess that's the mom. The girls I had hurt him back in like she's 18. apparently rear ended him at Merwin 125, which is not even in Pierce Township. I guess she took off from there. She ran down 125. Uh went into Kemba Credit Union, swung around, came out the the entrance. Mhm. Uh which you know how that's set up there. It was and flew all the way across 125, came down the 10 mile, blew through the light, uh came down, turned right, uh blowing every stop sign she could she could come to. And I I told her I should put the car in. You could tell she had been directed. Okay. Put the car in park. I would have been fine if she would have called her mom, parked over in the Chile place parking lot, and had her mom come and get her, and I would have got insurance information. But to take off, she could have killed somebody. She could have killed somebody. And then she threw something. She ran up into this guy's yard. She came down around here. I guess she swung it too wide or something. Went up into his yard. Uh throwing out beer cans. Uh throwing out that. Two other girls were in the car. They took off running. She multiple times ran down this way. So, I don't know if she's pitched stuff down here. It kind of looked like they threw something over there, but then it they kind of went over my edge of my woods, too. Like they pitch stuff over there, too. So, I gotcha. Are you okay, though? Were you hurt? Yeah. And the damage is minor. The damage is minor. This your vehicle here. Yeah. See the the paint stuff here? She got me here and here and here. I got you. Uh damage is minor. It's, you know, probably uh 4 or 500 bucks to fix it. She's claiming she wasn't driving, I guess, but they actually saw her. Oh, yeah. I saw her. She was She was behind me. Yeah. And like I said, she was the one that I tried to get to put in a park. Okay. Do you live around? Do you live at this? All right. I may get a statement from you. I'm going to talk to her first before I proceed, but I might give you a statement just to verify that she was the one driving. Also, do me a favor. Let the mother know that it's not okay. even if it's legal to have pot in Ohio now, it's not legal to operate a motor vehicle under the influence of pot. Okay. And she said, "Oh, it's completely legal." I said, "No, no, it's not. It's not." And it smells like a What? Did you smell the inside of the car? No, I didn't. It's It's pretty right. Actually, Actually, the mom came here to get her and get her to leave and was going to leave. She tried to get I had her keys. Okay. She just tried to take her daughter and and let her leave the scene. I got you. All right. Well, I'll talk to daughter. Obvious stay here for a bit. Sure. Other side. Okay. What's her name? I don't even got I think I have her keys up here. Okay. Is this her here? Yep. Hi, I'm Trooper Perry. What's your name? Sienna. Sienna. Can you tell me what has happened tonight? No. No, I can't. Well, at least what I'm hearing is you rear ended someone and then you're driving like a crazy person all around here. Is there a reason you were doing that? What were you up to tonight? No. Troopers out here. Okay. All right. Have you been drinking tonight? Alcoholic beverages? No. No, sir. No. Is he smoking any marijuana at all? No, sir. Okay. You being honest with me? Yes, sir. All right. Well, what I'm going to have you do is I'm going to get you out of the vehicle. I just want to check you out, make sure what happens there. Um, you weren't hurt at all from the rear end of them, were you? Nothing like that? No, sir. Not feeling any pain in the head, nothing like that. Oh, no, sir. Okay. All right. Just sit tight there for me. Sorry. Have you step out this way for me? Do you got shoes in your vehicle? Okay. I'll have you walk towards the front of my patrol car there. You stand on this side for me by the wheel. Was there other people in the car with you as well? You know where they went to? No, I wasn't driving. Okay. Well, I got it on good authority you were the one driving. I wasn't though. That's what he was driving. My friend, I don't know where they were. Have you ask you a few questions first? Uh, you currently wearing any type of contacts? Okay. I know I already asked you experiencing any head, neck, back, leg injuries at all affect any testing. You currently seeing a doctor for anything? Yeah. What are you seeing a doctor for? Life. was like any specific illnesses or just a yearly checkup or Yeah, specific illnesses. And do you have any major illnesses that I need to know about? Yeah. What type of illnesses do you have? Like anxiety, depression. Okay. And do you take medication for that? Yeah. How often do you take it? Every day. And have did you take it today? Do you take it towards the morning or what time? Morning. when when you die back or epileptic at all. All right. So, I'll have you take one step forward towards me. What What is this for? I'm going to check your eyes out. All right. So, what I'm going to have you do, so I want you What is this for? I'm checking to see if there's any signs of impairment. I didn't submit to this. You didn't submit to this? Yeah. You didn't ask me if I wanted to do this. I don't want to do this. Well, I said I was going to have you step out, but check out see if you're okay. All right. You didn't clearly see I can clearly smell alcohol in here. Okay. Okay. You didn't ask me. Did I want to submit to a surprise? I mean, it's all optional. You don't have to. You didn't ask me though. And I don't I don't have to ask you. You do, though. And I don't want to. Well, clearly, you know, you don't have to. So, there's how you manage, right? So, I'm refusing right now. Okay. Well, hang right there for me. So, I'm going to face towards my vehicle here for OVI. Spread your feet apart for me. Put your hands together. Okay. So, how because I didn't submit to a field sobriety test. No, cuz I can smell alcohol on you. I got multiple witnesses says you're driving and you also struck somebody. Because I didn't submit to a field sobriety test. It doesn't. I don't need you to do fuel soiety test to place you under arrest for OVI. Okay. That's why. Have you ever been arrested for OVI before? Have you put in a praying position for me? Are those too tight for you? That's not a question of admission of guilt. Cuz the cuffs too tight for you. Okay, [Music] mommy. They're arresting me because I wouldn't submit to a field soiety test. You're in a right. That's why I'm going to jail right now, so it's okay. You're not going to jail tonight. Thank you, sir. You have the right to remain silent. Anything you say can will be used against you in court. You have the right to talk to a lawyer for advice before he ask you any questions. Have a lawyer present with you during questioning. Unable to pay for a lawyer, one will be appointed for you prior to any questioning if you so desire. If you wish to answer questions now without a lawyer present, you have the right to stop answering questions at any time. You also have the right to stop answering questions any time you talk to. Um, did y'all give her my keys? I have your keys with you. Thank you. Can you please give them to my heart? Uh, I'm going to deal with you first and then we'll go from there. Don't worry. I'll get the keys. Appreciate you. So, like I said, I'm not planning on taking you to the jail tonight. Thank you. I just I'm just worried about my car being arrested. I'm assuming this is your first time being arrested. I did, sir. I just don't want my car getting broken into. Y'all have my fees, right? Okay. Thank you. That's all. So, the plan is is we're going to take you down to the Tavia Highway Patrol, offer your test. You refuse or agree to and after that do some paperwork, get you home. All right. Yes, sir. I just I just don't want my rights violated. I'm not drunk. I'm fine. So, that I don't want my right I can smell alcohol and I can smell marijuana. I I definitely smoke marijuana, but I'm not drunk. And I won't allow. When did you smoke marijuana? Right. Okay. All right. Do you have anything on you that can poke me, stick me, hurt me at all? No, sir. And I smoke marijuana two days ago. Two days ago. Didn't smoke any today at all? No, sir. Okay. Last time I smoked marijuana was 2 days ago. All right. All right. So, I'm just going to search you now. I can place you in front of the car. There's I got a camera and I got a camera on here. Yeah, that's okay, sir. Do what you need to do. Just face towards there. Mhm. Sweet out that gas. Your wallet in the car. It should [Music] be your Oh, that's a Yeah, that's a difference. That's from the um smoke shop, though. Is there marijuana in that or is it just regular built eight? Built eight, but it's from the smoke shop. Like, it's legal. Okay. I bought it from the smoke shop. Well, it is legal to smoke in marijuana or smoke marijuana, but it's not legal to drive in paired. That's an issue. Yeah, but I didn't smoke that in paired. That's You said you didn't have any shoes in your car. Uh, I should have some black flip flops. All right, I'll get you some shoes. Grab your shoes. Okay, I'm not worried about my shoes. Well, I'm just going to grab it for you. I don't know. All right, just sit back for me. What's What am I being driven for? OBI. You're being arrested for OBI driving impaired. All right. Just sit tight for me. Mhm. Okay. What was that? What was that for? Well, I was just warning her. I didn't know if you got out your cuffs or not. Yeah, I got my cuffs on. Okay. Dumb ass. So, ma'am, she is being placed under arrest for OVI. Have multiple witnesses saying she was the one driving the vehicle. I'm not planning on taking her to jail tonight. She's only 18. Correct. She has a song. She's in college. I really don't want this to ruin her life. Well, it's not going to ruin her life. Uh I'm going to take her back to the Battavia Highway Patrol, offer her a breath and urine test. And I look, I I understand you're an officer and I I'm not This is no disrespect intended, but she's driving drunk. And did I hear she has no insurance? No. You know, she doesn't have insurance or I didn't hear. They stated that she didn't have any insurance for the vehicle. And you're not going to impound the car? No. Does that honestly seem right? We we don't have to tow the vehicles. Okay. Well, it just seems to me that it's kind of like no big deal. I knew for her to slam some vehicles. She is being arrested for OVI at 18. So, I understand. I mean, I would say that's a little bit worse than a car being in the morning, make sure ain't no damage to my uh place. Did she drive in New York? I drive in New York. If you go up and look down, you can see it like plain as day. That's what I threw this out my yard. She threw that loco beer out the window. Her hub cap. If you go up and look down 100%. Did she stop in the yard at first or sideway all the way up into there? Okay. That's when two people down. You'll see what I'm talking about. I tried to pull in behind a blocker, but I she was going to re or back into me. Yeah. So, I'm back. I'm not saying that's right. I will say, sir, I understand you're trying to get justice for what happened, but it was also very dangerous what you do. Like, I get she was driving impaired and stuff, but chasing after them as well. I was like, that's Well, I I I think the problem I'm not saying like I understand it, but I'm just like something for future reference. Like, it's not worth risking your life, especially the amount of damage. I know it's not right, but I'm just saying for future reference, it's very dangerous. I didn't risk my and I I I I understand what you're saying and I don't I don't you know it could have been a bad situation but I knew the situation I was in because I knew she was a young girl and she wasn't armed or there would have been a confrontation right there at 10 Mile. Mhm. Okay. So I didn't I'm I'm 55. I'm not I'm not a young guy. I' I've lived a bit and anyway I I knew that I was not in a dangerous situation following her. I wanted to make sure she didn't kill somebody. That's what I wanted to make sure. like how bad she was out here cussing and screaming the whole neighborhood. I mean, I mean, if I wanted if I wanted to be I understand. So, one of the major issues though is I'm also not here. So, I didn't get to see a [Music] multip she basically and I don't want to I don't want to push anything on this, but she basically assaulted me multiple times coming up trying to get the keys from me. Oh gosh. Uh for her cars. I don't want to push that. I don't want to push that at all. I don't I mean, I can I can add that to R4, but if you don't want I don't want I don't want to push anything like that because like I said, she's a dumb kid uh with a massive sense of entitlement. Yeah, I can definitely see that. But pretty much what I'm going to do from here, I was going to do a crash report for you, just get your information so I can get you out of here. Did you want any type of report? I mean, it's not necessarily a crash, but they did drive into your drive. I don't I don't know. I just want to look at it tomorrow. There ain't no I ain't going to say no. Uh at least the tire marks I'm seeing from here. I'm not seeing it's right here. If you you need to walk up and look down. So I can see it. I don't know if anything crazy damaged necessarily. It might not be nothing. If it ain't I'm not worried about it. Okay. I'll I'll assess it. No, you're I mean I can give you our post phone number too. I mean I won't be in tomorrow, but you can call the post and they can get some type of report for you. It looks a little bit right there. If it ain't nothing I can take down, I'm not even worried about it. Yeah. What I'll do is I'll give you our post phone number. Like I said, I I'm going to be off for the next three days, but if you want to get another trooper out here to place a report. Mommy. Mommy. [Music] Mommy. [Applause] Mommy. Mommy. Mommy. Mommy. [Applause] Mommy, [Applause] mommy, come here. Mommy. Mommy, can my mom come over here and talk to me? Uh, give me a second. I'll have her walk over here. Thank you. I got your phone, by the way, up here. Your daughter wanted to talk to you real quick. But you're good. You're good to She has really good anxiety. I just Yeah, I heard. But at this point, you're good to take her cuz once I get done with him, I'm going to head to the post. No, no, no. So, you I was going to let you talk. Well, there might be where her flipflop went. Oh, yep. I'll go get that second one, but I'll let you talk to her real quick. Okay. Hey baby. Are you all right? Yes. This here is going to take you to the station and I'm not going to get you. You're not going to get a job. Okay. I need a charge, but you're not going to get a job. Charge for what? Charge for what? Okay. You have my All right. I love you. I love you, too. You trust me, right? Yes, baby. Just wait. All right. I love you. I don't have the other one, so it's pointless. I don't even know that. It's in the car. It's in the car. Can you give me a hug, please? like I'm not doing I wouldn't drive. I know, baby. Just Just take some breath. There's your shoe. I love you, too. I'll be there to get you. There's flop. I'm not drunk. I'm just freaked the out. I understand. That's at least my experience. Why? I say you do believe that you're imperial. I'm young. Like, I understand. Well, that's even worse. You're not supposed to drink till you're I'm not drinking. I'm just freaked the out. I get you. I'm not just take a breather for me. I am, sir. You're not I know. I appreciate y'all for for, you know, working with me. I appreciate y'all. I'm in college. I work a job. I have a son. That's what she said. I'm not drunk. I'm freaked the out and I'm just anxious right now. Keep breathing for me. We're almost out here. I just got to get these couple statements. I Does she have like my phone and my keys? And I have your phone. She has your keys. Like I got your phone so you can call her. But she's going to be Will you be able to give her my phone? No, I'm going to bring the phone with you so you can call her or come pick you up from the post. Like I said, I'm not planning on taking you to jail tonight. Thank you. So, just sit tight for me. I understand it cuz you know I'm just freaked. I got you. I don't know how to Well, we'll be here probably another 15 20 minutes. So, just sit tight for me. Is she allowed to come up here and talk to me? Can I talk to my mom? Uh, not with me, but she's going to drop your car off somewhere. My mom? Yep. She's How is she going to drive her car anyway? She's going to walk back, I guess. I don't know. My car? Yeah. She's going to drive my car away. She's going to park it somewhere so it's not over here. Like I said, I wasn't planning on towing it. So, thank you. Just sit tight for me. Let me I appreciate you for not towing it, sir. I got you. Thank you. Watch your knees. I'll pray for my own mother dummies. I'ming drunk. Dumb asses. Public defender. Y'all thinking I'm drunk. [ __ ] I ain't drunk, [ __ ] I get my own lawyer. [ __ ] Can I step out? Yep. Oh, you're going to go see a little face front that door for me. My neck itches. I'm going to take your cuffs off when we get in there. Take a left here and stop in front of that doorway right there. Yep. Yep. We'll take a cup off. You feel the sublime bliss here in a second. Thank you. Go ahead and have a seat on that bench for me. No, no, not yet. officers here. So, when she gets in here, I'm going to be reading you this form here. I'm going to have you have a copy if you want to follow along. Read the top section. What's it for? It's for the OBI test. So, because I smell an odor of alcohol, marijuana on you, I'm going to offer you both a breath test and a urine test. Now, they're not extra charges. They you decide to take the test and they're both above the legal limits. So it's just purposes I'm going to choose not to take that's okay but I'm just I was just explaining to you so you sense of your decisions but I'll basically read through this you're saying now since it's your first offense be suspended for a year now technically since you have a Kentucky license it'll be a little bit technically not suspended but you're suspended at least here. Would there be like a So, I'll be sending within 5 days. So, probably next Tuesday. But so, well, here, let me go ahead and read this for you, and we'll go through all that. You're now on arrest for operating a vehicle under the influence of alcohol, a drug, or a combination of them. If you take chemical tests required by law, your hydro privileges will be suspended immediately. I have to pay fee to have the privileges reinstated. So, like I said, for I heard you're planning on refusing, but so your license would be suspended for a year. You decided to take the BR test for your own test and it's over the legal and that be for 90 days. So, still going to refuse. I'm not understanding, but sure. Yes, I refuse. Basically, this is all confusing, but yes, I refuse. Well, do you have questions about it? I just I just rather my mom be in here so I could You are 18 now. You are at all. Right. I just turned 18 a month ago. Yes. I refuse. That's what I'm thinking. Yeah. You do have Thank you. I refuse. That's why I just said I refuse. [Music] I'm just not racing them with the bill. Not [ __ ] you at all. All right. So, I'll read this bottom section here if you want to follow along. Independent of any p penalties or sanctions imposed upon you pursued to any other section of the revised code ordinance, driver's license or commercial driver's license, permit or non-resident operating privileges now suspended. Suspension takes effect immediately. Suspension will last at least until your initial appearance on the charge be held within 5 days after the date of the arrest or issuance of the citation to you. May appeal the suspension at the initial appearance before the court appears the charges against you that resulted from the arrest during a period of time ending 30 days after initial appearance. Oh my god. I'm sorry. This is not your fault. I'm not trying to say that you swear to God. I'm so sorry. You are not personally offend me in any I hope I'm not. I'm not trying to at all. I I would say just for I'm not trying to be rude, but I try to work on the attitude a little bit. It was a little bit bad when I started. I mean, I've had way worse, but just now I'm a lot more relaxed compared to other churches. So, they don't like that. Yeah. When I was younger, I had Listen, listen, listen. I'm I have mental like real mental [ __ ] that I've been diagnosed with. So, this me the way I'm acting towards you is growth for me. The way I'm speaking to you is really gross for me. But I respect you and I see that you respect me and we respect each other as people. So that's why I'm talking to you respectfully. But this is really hard for me because of the the [ __ ] like just the mental issues I've been diagnosed with. But I'm proud of myself for how I'm reacting with you and I appreciate you. So what I'm charging you with tonight is OVI then also called it's called ACA which basically rear ending a vehicle from crash. So, but I understand charged with OBI question. Yeah. So, none of this really happened. So, without the proof, what can y'all do? Well, I got proof on your vehicle striking vehicle. At least now at least with everything they said, I'm not charging you for all that. I can't prove that. There probably was a little bit of poor decision making with driving away and all that. It also would be the other person chasing after you is also dangerous as well for him to do that. But like I said, I can't verify that. I'm sure something happened along the lines. Maybe not to the full extent. I don't know. But at least what I see, I do believe that you are prepared with everything I've seen. But I will say regardless of said, I know you're young. It's not a great thing, but it can only go up from here. I would just say just make better decisions in the future. Like you said, you're in college right now working at uh Twin Peaks. So just something to keep in mind is like it's dangerous to drive. So you get seriously hurt. You have people in your car as well. I'm sure they went I don't I have nobody in my car. I drive. I know that because I've had family members die from people drunk driving. I'm not drunk driving. I'm not impaired driving. I'm hydrating. It's not okay. And I don't agree with that. And I'm not doing it at all. That's perfectly okay. It's just everything else. I know. I know. I know. Y'all can feel like how y'all want to feel, but um that's not what's happening at all. I've had family members lose their lives to that [ __ ] I would never hop on the roads and talk. Were your You said there was no gun in the vehicle apparently. Correct. All right, I'm displaying your paperwork. So, this is a copy for the real test machine. All the information on there. Get a copy as a result. They still print something out, but and then this is your citation. Your court date 24th at the Claremont School right here in the address is right there underneath it. It's at 8:30 is mandatory. signing for. Can you just take some explain this for you and then we'll head out. But like I said, sign up for ACA and then the OBI. What's ACA? Sure. Uh speed of short distance. So basically we're ending somebody. All right. Uh phone number for if you have questions and like I said this fine there. Don't you have any other questions for me? No. I got your phone number. There's your paperwork there. And we'll go out that door there. [Applause] push oil in my car. I dummy my [ __ ] up. Just put your name there for me. Just shows that I'm releasing to you and I'll give you a copy and you guys are good to go. Where's my car at? Marathon. Thank you. All right, you guys take care tonight. [Music]
