pad in my vest so I don't have to ride in my hands some guys choose to um some guys will get a registration and write on that so everyone's kind of got their own little style of how they do things um I keep a pad cuz I feel like it's just easier and then I'm not writing on my hands um but it's a it's just it's kind of like a style preference so but uh I mean just from the very beginning this police officer is is awesome and obviously understands what he's dealing with and has a great level of patience I do not want my weapon outside of the vehicle I willing to put weapon on the dash so that you can clearly see not touch that fine then it'll put the paperwork on the dash for me put the paperwork on the dash so difficult all the time and it's a lawful order put the paperwork on the dash now and put your hands on the steering wheel and don't move them okay you're being confrontational you have a firearm we're not going to play that game I'm going to get your name date of birth and I'm going to continue my traffic stop do you understand that think I'll just plead the fth so fine I recommend that well if you're not going to plead the faith you're going to need to present me with an ID can you point to where your ID is no sir you told me to put my hands on this you told me you were going to plead the fist which means you're not going to talk anymore okay if you're not going to talk you can't tell me your name and your date of birth does that make sense so will you tell me your name and date of birth not until I present this paperwork okay 32 and6 start me another one can I get another unit I want my friends to enjoy this also keep your hands right where they're at I will keep them there as long as I can okay perfect they need to remain there and your hand is a firearm and so that's what I go off of okay and I was willing to compromise with you but you're not willing to compromise you want it what is the Compromise I'm willing to put it on the dash or even to allow you to put it on the dash I am not willing to allow you to remove it from my vehicle okay Supreme Court says otherwi Dash I'm going to unload it first that's fine okay will you put your hands Pro and she had the firearm head not a big deal um I asked her if it was a firearm that she point at it or tell me instead of reaching it she reached for it um anyway I asked her to put her hands on her head so I could remove it from her and take it back to my vehicle to secure it during the rest of the Stop and she's mildly argumentative she refused to do that we ended to come into a compromise she let me take it off her and unload it um so it's been a bit of a confrontation I've asked her for a license mulle times she said she wouldn't give it until you got here so that's where rest so can I have your license want to repeat myself okay can I have your license please okay just real quick ma'am just so you know my name is Chief broster like you know I got my camera going too so it is recording okay I thought it was great that the chief of police shows up um I've had the sheriff back me up I've had captains and Chiefs back me up um it's it's always nice when when they show up um it doesn't change anything it doesn't change how we do business um and if you work for a great leader um like I've had the privilege to do it it doesn't it doesn't change how you do business and obviously this cops demeanor was the exact same before the chief arrived and after the chief arrived um so which means he's doing everything right um you know he doesn't have to act one way when the chief's not there in a different way uh when the chief is but and when the sheriff Sheriff shows up on my stops he knows what's going to happen he knows that he's going to see something that he normally doesn't see which is a citation being written and then we're going to uh we're going to issue it we're going to get back to business and uh he he definitely has our back and uh obviously this Chief has this police officer's back also okay I've got my camera recording as well now as I told you before before I relinquish my information I'm going to go over this pap okay stack of papers is Right NOP no that's a that's a receipt from Costco it's got the line through it I promise this order when I put think that should be binder that she read the papers to the officers it takes green KS a while to get things organized but she finally finds what she's looking for so as you're asking me for my driver's license do want you to know is it's right of the citizen to travel upon the public highways and to transport his property thereon by horse drawn carriage wagon or automobile is not a mere privilege which may be permitted or prohibited will but a common right which he has under his right to life liberty and the Pursuit of Happiness under this constitutional guarantee one may therefore under normal conditions travel at his inclination along the public highways or in public places sovereigns have this thing about traveling I'm not driving I'm traveling you can travel on your own two feet there's that song about these boots that are made for walking that's you're supp that's how you travel that's how you can travel without any sort of interference you're just walking down the sidewalk and you haven't been involved in any and criminal activity you can't be you can't be messed with but when you're driving there are certain laws and those laws are in every state including Oregon that you have to have registration you have to have a driver's license you have to have insurance the things that you need in all 50 states um and probably all the US territories they probably require registration insurance and driver's licenses too um so like if you're you're in Guam or you're in you know down in Puerto Rico probably need to have have some insurance so um the fact that this lady is thinks that she's exempt because she has a stack of papers that she read some case law that was probably from you know 1905 um yeah that that doesn't work and while conducting himself in an orderly and decent manner neither interfering with nor disturbing another's rights he will be protected not only in his person but in his safe conduct all right next page and I can give you where to find that if you would like and we don't need to Supreme Court has already squashed that so no you Supreme Court has not yes don't worry about that case law driver license you do not okay we can argue this later so you need to provide the the offer with your driver's license or you will be arrested for p to and present for what time tell the gear and present a driver's license that's a a class misdemeanor in the state of or without a crime it is not a failure look how easy then you have to let go of it you have to do you have why do I have to let go unbel do do you have a concealed handgun license with you no okay do you have an insurance for the vehicle not required whether whether you feel it's required or not do you have ins information yes or no no okay do you have registration information whether it's required in your opinion or not Ain nobody got time for that okay so you just okay and if if you if you read closely they did not rule that you have the right to travel without a driver's license in a motor vehicle they did and I can show you well that that's fine again if you if you believe that that's the case that's what it Courts for it's not to set out here and argue on the side of the highway with the officer we don't hold court on the side of the road things and yeah I'm just going to put it in this bag all who is you uh just violation I've never got um so she prevented you a driver's license and she's suspended yes okay I'm going to ask her if she knows that that's a time also it's also a crime in Arizona and convicted convicted on December 29 to 21 on public I like this Chief m' did you know your driving privileges are suspended in Oregon pleas the F okay after checking her information in the system the officers decide it's time to arrest her yes hey Gina yes this the deal okay I need to step out of the vehicle because you're being placed under arrest for car to control firearm there we go they arrested this lady for carrying a concealed weapon well in Arizona we don't have that if you are in public and you're not a felon you're not prohibited a prohibited possessor or prohibited from carrying a firearm you could take that gun stick it in your pants throw your shirt over it and go about your business and as long as you're somewhere where it's not prohibited by signage you can have your gun so Oregon they're like oh you have a concealed weapon that doesn't doesn't exist here cuz Arizona stands that there's a second amendment and you should be able to carry a gun where you want um now the knowingly possessing a suspended canceled the revoke driver's license that law is the same exact way in Oregon as it is here so if you know your driver's license is suspended you present it to a law enforcement officer as a form of identification in the state of Arizona that's a misdemeanor and could also land you in jail um so these Oregon officers obviously knew what the laws were that she was breaking took her into custody exactly like like what should happen and she she needed that you're placing me under arrest for a concealed fire ma'am can I ask what led you to that decision okay well you're you're carrying a concealed firearm and that's a crime in Oregon ma'am do you recall I asked you if that was a gun underneath your deck and I said yes okay so by me not being able to tell whether it was a gun or not it was not in open plan view right so would have been concealed if I can't tell that it's a gun you can obviously see the butt of it if you got your sweatshirt covering that gun it's concealed an open carry is open carry nothing obstructing the firearm or the holster that it's in so had it been on the dash or like flat on the passenger seat or had it been on your side without a sweatshirt covering it that's not concealed but you have it under clo that's concealed one in and additionally it's also a crime to present me with a driver's license knowing that it's suspended I see you were convicted of driving while suspended in December late December of 2021 which is only a few months ago Additionally you haven't been reinstated at all since then so there's a pretty good inclination that you knew you were suspended and knew that license was not Val that's also aate there we go you're making assumptions you're making assumptions oh as far as your knowledge you're assuming whether I knew or did not know I never said I knew for a fact okay I I I'm not in your mind I can't know that but there's pretty pretty good evidence to show that you likely knew but additionally from that for the concealed firearm yes you are under arrest so we just need you to step out we don't want it to be in or anything um just ask you step out and face the panel their to me like I explain to you this this isn't the place to argue that just makes things worse that's why there's Court yeah you guys looked for the most Petty thing that you could to arrest me for okay well we didn't we didn't willing to bet that in the process you guys have got a whole lot of other things going on so before we jump to that I'd like to know what I was pulled over for I I told you you up for expired tires okay Additionally the registered owner of the vehicle is suspended it appeared to look similar to you based off the picture I pulled up before I stopped you but in and of itself I can stop you if the registered owner of the vehicle is expensive absolutely true suspended and the description would match these cops are great have a lighing on the back here that's broken I didn't notify you that that's why I saw you cuz I was primarily just stoping for the attack but I mean we can point at things but I don't want to nitpick with you I don't want to argue with you okay this is kind of what we're going to do um you're obviously very familiar with the courts you reference the Supreme Court earlier in the stop okay so you know that that's the place to argue this stuff so at this point that's why you're under arrest okay so we're going to ask that you step out we don't want an argument with you we don't want any you going to do with my car so your car so you were convicted of driver want suspended recently so you have no insurance on the vehicle you guys have no legal right to tow it okay again you can argue that in court but I'm talking to you now okay this isn't the place for these arguments okay ma'am so I'm going to ask you to go ahead and step out of the vehicle and and if you refuse to I will step out of the vehicle however the US Supreme Court has already ruled that a vehicle is a household effect okay therefore you have no right to tow it okay again you can argue that in court you can argue that you can file lawsuits you can do what you like so in other words what you're saying Chief is that you don't care get him on the camera that you are stomping all over my constitutional right what I what I care about is um this this is my job okay I am educated and I'm informed and I get the training on laws and court rulings but that does not mean that you know all the laws and that does not mean that you are kept up to date on the US Supreme Court right so I'm I'm pretty kept up to date and again if I if I if I'm if I'm wrong I'll eat crow later absolutely yeah we can be wrong later is not going to help but it's not today so go ma'am go ahead and step out of the vehicle you under arrest you guys are taking something that you have no legal right to again not the place for the argument I I have not even said that I'm going to tow it yet but we need you to step she just she needs like a Coke and a smile oh she get out oh look how easy that that is there we go would you please be gentle I have a right shoulder inury so hold we'll put on please do not pull my arms out we're going to do our very best I'm only I'm only limited by these two be a little better if you were able to hold a little more double cuff this police officer takes one set of cuffs on puts it on one wrist and then interlocks another set of cuffs to go on the other wrist typically we use this on uh people with broad shoulders shoulder issues or people with a certain amount of of girth um people that would be more sturdy in appearance um as was the case with this uh this lady she um doesn't shop on the petite section so that uh those the double cuffing is a technique that we use uh very commonly on people that are um bigger boned that's use for big people I'm sorry that I'm not standing still enough for you I'm a little bit scared real quick ma' you do have the right to remain silent anything you say can OB be used against you a court of law you have the right to have attorney president where you be in question if you can not afford to hire a lawyer want to be appointed to represent you at no expense do you understand those rights ma'am I'm keeping this 3 216 one female C after she's in handcuffs the police Pat her down and help her call a neighbor to come pick up the car so this is a great Exemplar of empathy um they didn't this lady's car which probably needed to be towed um but they allowed a neighbor to come and pick it up um I I do that if the neighbor's close you know like if it's hey they're 5 minutes away and it's going to take the tow truck 30 minutes to get there it's easier um and faster and more logistically sound for me to call the neighbor have the neighbor come 5 minutes down the road they jump in the car and take it away um we don't get bonus points for towing cars so it doesn't matter how many cars you take or if you don't um and really it's it's kind of a waste of time to just sit there and wait for a tow truck if there's a a easier and faster remedy from there she's headed to jail is it okay if I take your glass off before I put you in the car preferably not just so difficult need to be happier okay I'll have you step this way for me and just ride around me to the door here so the best way is going to be me to get up as close about Corner as you can face me and then sit back and then swing your legs in just do your best you can take as much time as you need okay how would you like me to help you you like me to hold pressure on your back so you can slowly go in you want to hold on to your sweatshirt like this that'll work slowly lean down who knew sitting with so difficult keep going there we go yep the backup Chargers don't have a lot of room I'll give you some time to get your leg so not as easy I know it's it's difficult there we go okay this is you want me to go on the other side and pull on you yes there we go it just help those little tootsies in there so if this was just a suspended license traffic stop and she would have been totally compliant provided her information as required by law I am very very sure that this police officer would have issued her a criminal ticket for driving while suspended called her neighbor um and said hey can you come drive the car do you have a good license yes can you come here and take this car she can't drive same way that that I do it um and that's it but because of her actions and all of this I have to read the paper and no you can't do this and no I'm not going to give you my drive all of these things that exacerbated this situation now she goes to jail and that should be a lesson to everyone that there's an easy way and then there's the way that this driver did it and in this situation those are not the same way so if she would have been way more compliant and just acques the request that was absolutely awful this probably would have gone a different way set you up perfect there we go okay would you like a window down uh no thank at one point the officer taking green cards to booking has to pull over as the woman has a very dramatic reaction to being in the cramped back [Applause] seat I got to Ste did you like an ambulance I just got to get this standing up is hard fighting all that [Applause] gravity you're positive you don't want any medical attention correct it won't it won't help might need like like the bed of a pickup truck like a like a Suburban Hy so she was having a back spasm and couldn't wait so I'm sorry my back couple weeks ago and has been kind of sliding in and out since it happens also known as incarceritis or jitis that's kind of what that looks like how are you sir how are you at all those pine trees in Oregon holding my shoulders how would you like me to hold them just yeah and I'm going to lean to the right to stretch and then I'm only lean to the left okay there you go little stretch little stretch there we go now if you can get that stretched out to the jail it'll be they'll take those off and
