okay you could do she I pulled up here she's behind the wheel still she's talking to her boyfriend on the phone do you this portion of the investigation is during a DUI investigation is the most important part and it's establishing actual physical control so establishing actual physical control means that you can prove without any doubt that that person was driving driving that car that they were in actual physical control in the driver's seat not that they were driving um at the time when you saw them but that they had the ability to drive um it different lawyers have different ways of explaining it um but it's pretty much if you could put the car and drive and drive it's actual physical control so the car was on she was seated in the driver's seat when the initial officer pulled up and that's all you need you just have to put them behind the seat that's why they had this conversation is establishing that as one of the the first fact in making a DI arrest somewhere in the city she hit something we don't know why don't know where but she's definitely behind the wheel when I get here which puts her the signal one you can smell the alcohol coming off her breath she gets out years prior she had a DUI she said it was a big deal but now she's DUI again and hit and run and then fails to identify herself and then resists arrest so maybe she needs to stay away from alcohol cuz
