But this mother been following me, him and his homeboy about the last 25 minutes. I just got on the road. We f to see. Hey, look at him. He coming out. [ __ ] been following me like the last 30, 40 minutes. I'm doing 40 m an hour. I ain't doing [ __ ] I'm going to ask you why you pulled me. >> Yes, sir. I'll explain to that to you in just a second. I see. So, the reason I pulled you over, man, is because we got behind you. Hey, roll that window down. >> Yeah, my window is down. >> Roll your window down. >> I will not. I'm talking to you right now, >> sir. I'm going to I'm going to ask you one more time because now you're going to go to jail. >> For what? What did I do? Y'all follow me. Y'all follow me. I'm trying to explain. Can I talk first, please? >> No, sir. This is not your traffic. >> Talk to me. >> Roll your window down if you don't mind. >> Can you tell me why you stopped me? >> I'll explain that to you in just a second. >> I'm not rolling my window down. >> What is the What is the reason y'all stop me? Y'ALL FOLLOW ME 30 MINUTES. Talk to me cuz you ain't GOT NO LAWFUL REASON FOR STOPPING ME. You ain't got no lawful reason for stopping me. Can you explain to me why you got that dog running around my car? Y'all pulling me for no reason. and tell me why I'm going in handcuffs. That's what I need you to do. I AIN'T BREAKING NOT ONE LAW, BUT I GOT TO GO THROUGH THIS. >> THAT'S WHAT YOU DO. >> YOU SHUT YOUR MOUTH, >> BOY. These cops followed this man for over 40 minutes, tailing him at every step, like predators waiting for a mistake. Every time he changed lanes, they changed lanes. Every time he pulled into a parking lot, they pulled in right behind him. This wasn't policing. This was outright stalking. But this silent intimidation was only the beginning. and what came next is one of the most shameless fishing for a crime expeditions you'll ever see. And the story of a guy who didn't quietly bow down to the cops demands, but instead pushed back in a way they clearly did not expect. Now y'all can't see him, but this mother been following me, him and his homeboy about the last 25 minutes. We going to see if he going to follow us. Let's see what going on. Crap. [ __ ] ain't breaking no laws or nothing. Nothing. And I'mma go the opposite way. Yeah, now he right here ready to pull out when I pull out. Come on, go. I'm going to pull out right now on [ __ ] Now I'm already recording now though. I'm recording now. You look now he coming. Now he jumping behind me by himself. Yeah, this him right here jumping dead behind me, fool. Now he behind me. I'm doing 40 miles an hour. I ain't doing >> Yeah, he pulling me right now. >> My man. >> Well, sir, can I ask you why you pulled me? >> Yes, sir. I'll explain to that to you in just a second. I see the fire. >> Yep, that's right. It's up for y'all to see. I ain't do nothing or anything like that. So the reason I pulled you over, man, is because we got behind you. Hey, roll that window down, sir. Carolina you to roll your windows down when officer. >> Yeah, my window is down. >> Roll your window down. >> I will not. I'm talking to you right now, >> sir. I'm I'm going to ask you one more time. Okay. Roll your window down. All right. Because now you're going to go to jail >> for what? WHAT DID I DO? Y'ALL FOLLOW ME. Y'all follow me. I'm trying to explain. Can I talk first, please? >> No, sir. This is not your traffic stop. >> Talk to me. >> Roll your window down if you don't mind. >> Can you tell me why you stopped me? >> I'll explain that to you in just a second. >> I'm not rolling my window down. Watch this carefully. The cop doesn't explain the stop. He doesn't cite a violation. He doesn't even pretend. He just demands compliance to an unlawful order. There's no law that says that you must roll the windows down when stopped. And when the guy refuses to blindly obey his authority, the cop threatens jail, which according to Terry versus Ohio is an established violation of the Fourth Amendment. A police officer must have a reasonable, articulable suspicion of a specific crime to lawfully detain someone in a traffic stop. Here, the cops have nothing besides their ego and power trip. And things are about to start spiraling fast. >> You ain't got to grab me, brother. I'm coming. I ain't got nothing in my hand. I ain't got nothing. I'm recording on my phone. >> And can I say this before y'all do that? I don't consent to no search or seizures. I don't consent to none of that being seized right now. >> For what though? >> Because of traffic. Well, as soon as those traffic lights come on, that's a seizure. >> How is that a seizure? What is the What is the REASON Y'ALL STOPPED? Y'ALL follow me 30 minutes. Like, tell me why y'all say passenger side. All right. >> Yeah. Tell Tell me why I've been recording Y'ALL THE LAST 40 MINUTES. Tell me why y'all following me. Tell me now. >> Would you let me listen to you? >> Tell me now. >> Talk to you. >> Talk to me. Please tell me. >> So, listen to me. All right. The the typical normal human being is not going to pull into random driveways. >> I can do what I want. It's not illegal for me to do. >> Listen to me. >> Talk to me. >> Listen to me. YOU'RE NOT LETTING ME TALK. >> TALK TO ME. YOU'RE NOT LETTING ME GO >> CUZ YOU AIN'T GOT NO LAWFUL REASON FOR STOPPING THAT SIMPLE. YOU AIN'T GOT NO lawful reason for stopping me. Cuz I'm turning cuz I'm turning in uh driveways. >> We got reason suspicion to pull you over. All right. >> And what is that? Cuz I'm turning in driveways. >> Yes. Normal human beings do not stop into random driveways when cars when police behind us. >> Cuz I can turn in a thousand driveways. >> You pulled into a random driveway. You turn around. All right. >> I can do that. >> Then you pull into a gas station. >> I can do that. >> As soon as we left, >> you know, I can y'all FOLLOWING ME. THAT'S WHY I'm turning into all them random places. Y'all following me. YOU RACIALLY PROFILING ME. I AIN'T BROKE not one traffic stop. Not one. Now they got a dog. COME ON. CUZ Y'ALL WAS PROFILING ME. >> AS WHY THE DID YOU PULL ME? Cuz I turned in driveways. >> YOU'RE NOT LETTING me explain. >> Explain to me one more time. >> No, sir. I'm not already. >> Hey, can you explain to me why you got that dog out running around my car? >> Cuz you asked me to. >> And why would you ask him to do that? Can you Can you talk to me? You ain't gonna answer my question. Can I get your name and badge number right there? >> And this is where the stop crosses into a clear-cut escalation because under the Fourth Amendment, police are not allowed to use a canine as a fishing tool. A dog sniff may look harmless, but legally it's treated as a search. And a search isn't supposed to happen just because an officer feels suspicious, uncomfortable, or curious. They need either probable cause or a lawful detention of which they have neither. They can't create cause by intimidation, profiling, or attitude. But in this stop, there's no violation, no crime, no articulable offense. Only a man who wouldn't comply on command. So instead of proving a crime, they bring out the dog to try to manufacture one. And that is exactly why so many innocent people end up searched, humiliated, and violated. Not because of evidence, but because of abuse of authority, just like you see here. >> Can I get your name and badge number? >> Can I get your name? >> D Rogers. >> You got bad number. We don't got fast. >> All right. All right. All right. All right. >> I don't worry about nothing. >> Go be around the dog. >> Oh yeah. I ain't worried about that dog. I need to see this dog. Yeah. You ain't going to hit on nothing. >> They talking to you. >> I rather watch this for a second. >> Huh? I rather watch this for a second. Make sure it ain't nothing going on for me there. >> What's your name? >> But can you give me the lawful reason why you stopped? You ain't told me nothing. >> YOU GO TO JAIL. GIVE ME YOUR NAME. >> My name Douglas Win. Cuz it's Douglas Win. Douglas Win. I'm not playing with you. >> All right, cuz you you stay over there. You're not part of this. >> Yeah, we ain't doing that. >> Address. >> I got license. I'm going to give you my license. Can I do that? There you go. >> Cuz how the I'm not cooperating. Y'all pulling me for no reason. >> Let me tell you something. Let me tell you something right here. >> Y'all pulling me for no reason. Come on, Cuz. All right. But quit touching me. You don't touch me no more. >> Or you can go in handcuffs. Do whatever you want to do and tell me why I'm going in handcuffs. That's what I need you to do. >> Cuz you need to calm the [ __ ] down. >> Cuz you're telling me I need to calm down. I'm going to [ __ ] Come on, cuz y'all pull on. Can you tell me why you pull me? >> I already explained it to you. >> You didn't cuz I PULLED IN DRIVEWAYS. >> SHUT UP AND LISTEN. That's >> so You see what I'm saying? I got to shut up and listen to you. >> Now I got to shut up BECAUSE YOU AIN'T GOT NO VALUABLE REASON TO PULL ME. >> EXPLAIN IT TO YOU. >> CUZ I PULLED IN DRIVEWAYS. CUZ YOU SAID I PULLED in driveways. >> Explain it to you. >> Cuz I pulled in driveways. >> Yeah, I'm good. It ain't nothing. Yeah, I'm good. >> I'm saying you were good. >> You're goddamn right I'm good. I JUST WANT TO KNOW WHY I'M GETTING PULLED. THAT'S IT. WHY THE HECK? WHY THE SHOT? >> IS there anything illegal in the car? >> Cuz ain't nobody getting in that car. >> All right. Well, the dog hid on the car, so we're about to search. >> So now the dog hit on the car. >> Cuz I don't even want to talk. >> All right, that's perfect. >> Yeah, I don't want to talk. >> Do what y'all got to do. Can I get your name and badge number? >> Yep. >> Can I get your name and B? I don't know. >> 8217. >> Excuse me. Can I Can I get you? >> [ __ ] walk up there. >> You're talking about Why the You got to talk TO ME LIKE THAT. >> I AM. I'M HOSTILE. I'm sitting HERE ON THE SIDE OF THE ROAD. Y'ALL AIN'T GOT NO REASON TO PULL WITH ME. BUT THAT'S WHAT THEY DID. YEAH. Turn that [ __ ] on. I hope it is on. >> Come on. Cut down. Look at these the pigs going all through my is crazy. >> Well, boy, >> boy. I don't acting like I supposed to act cuz y'all RACIALLY PROFILING ANOTHER BLACK MAN. It ain't to you. It ain't TO YOU. I AIN'T BREAKING NOT ONE LAW. BUT I GOT TO GO THROUGH THIS. >> I'M HERE to run the dog, >> man. Come on. Cuz you here to ride and suck like them. >> Stay right there. >> WHERE AM I GOING AT? CUZ CAN I RECORD? >> ALL RIGHT, THEN. Shut your mouth. That's what you do. >> I wish you'd shut your mouth. >> No, I will not. >> That's what YOU DO. >> YOU SHUT YOUR MOUTH. >> YEAH, >> BOY. >> I will not. >> Boy, you mother ain't scared to jail mother violate my rights. I can TURN IN MANY DRIVEWAYS IF I WANT TO. NOW, THERE AIN'T NO REASON FOR Y'ALL TO PULL ME. NONE. And don't BE TRYING TO PLANT [ __ ] IN MY CAR CUZ I AIN'T GOT NOTHING IN THERE. NOTHING. AND EVERYBODY BODY CAM NEED TO BE ON. >> YES, SIR. >> That [ __ ] ain't nowhere near right. And you going to run on my firearm on too. And you going to run on my fire on too. >> And here's the constitutional problem. They can't escape. Since the stop itself had no lawful foundation, then everything that follows is already tainted. The search unlawful, the dog unlawful, and now running his firearm, too. You can't justify a seizure by what you discover after the seizure. That's not how the Fourth Amendment works. The law doesn't allow officers to detain first and invent reasons later. It doesn't allow them to escalate until something finally sticks. So when they start running his firearm here, it just proves how far they've already stepped outside the Constitution because at this point they aren't enforcing the law. They're just trying to save a stop that never should have happened in the first place. And you going to run my fire on too. That is crazy. I need your badge number. We going to go right down here where we need to go. I need y'all to point me in the right direction. This is what I need you to do. Yeah. I need you to point me in the right direction. You say your badge number will up. >> You guys don't care. It's 8217. >> Thank you. That's professionalism, ain't it? No matter what I'm acting like, you be professional. >> Yeah, >> that's a two-way street. >> No, it ain't. You get paid to be professional. You a peace officer, >> mother. You You supposed to keep the the oath. You supposed to be protecting me. >> Also an adult, >> man. Yeah, I'm adult. THERE'S NO ON GETTING RACIALLY PROFILED FOR NO REASON. MOTHER DIDN'T TELL ME ONE CRIME. IRIS, I BET YOU I WILL NOT GET ONE TICKET. I WON'T GET ONE TICKET WHEN I LEAVE THIS [ __ ] >> YEAH. OKAY. GIVE IT TO ME. THAT'S WHAT I WANT YOU TO DO. GIVE IT TO ME. HEY, CAN I GET YOUR NAME AND B NUMBER? I'LL WAIT TO YOU. I'll wait you done. You ain't got to talk. I can understand that. And please don't find nothing in my car cuz this [ __ ] is crazy. And I don't supposed to feel no way cuz I'm getting racially profiled. >> Who said you were racially profiled? >> Why? What? He a You know why he stopped me? >> I pulled up here late. >> All right. All right. But you know why he stopped me? He said cuz I was pulling in direct I was pulling in driveways stores and and pulling right back out. Did I Is that a law? I can't pull in I can't pull in no stores. >> Not reasonable. >> How is that reasonable but still suspicious? >> Slow down. >> How is it reasonable? I'm trying to I'm trying to talk I'm trying to calm down, fool. Forgive me. Forgive me. All right. I'm going to calm down right now. Forgive me. >> All right. So you telling me I breaking the law? >> I didn't say that. >> All right. Well, you said you said All right. But I'm telling you what he just said. See, I know you ain't. You sucking, man. You sucking. You sucking. That's it. You don't want to be You don't want to speak the truth. You want to ride that blue line. >> Yeah. Yeah. Cuz you NOT TALKING TO ME. I SEE WHAT YOU TRYING TO DO. YOU WANT TO RIDE with them. Come on, MAN. RIGHT IS RIGHT. WRONG GETS WRONG, FOOL. SPEAK ON CAMERA. WHY? WHY is cuz you just heard him say he pulled me cuz I turned in the driveway, turned in the store. Hey, THAT WAS SUSPICIOUS. WHAT CRIME IS SUSPICIOUS? IS IT A FELONY OR A MISDEMEANOR? COME ON, FOOL. >> And this is the question that exposes the entire stop because suspicious is not a crime. It's not a felony. It's not a misdemeanor. It's not even a citation. Suspicion is a feeling and feelings are not laws. Police are supposed to stop crimes, not vibes. They are supposed to enforce statutes, not instincts. So, when this man asks, "What crime is suspicious?" He isn't being difficult. He's pointing directly at the legal vacuum this stop is built on. Because in America, you don't get detained for being different. You don't get searched for being nervous, and you don't lose your rights because an officer feels uncomfortable. And the fact that no one can answer that question is the answer. Come on, fool. [ __ ] ain't dumb to this [ __ ] [ __ ] ain't dumb to this [ __ ] We going right downtown. I recorded YOU WAY BEFORE Y'ALL PULLED ME. RECORDING YOU. WELL, I KNEW YOU WERE GOING TO PULL ME. NO, LOOK. [ __ ] bagging over THERE TO FIND SOMETHING. THEY PROBABLY GOING TO PLANT SOMETHING. THEY want me so bad. >> They're wearing a camera. >> Mother want me so bad. THEY GOING TO PLANT SOMETHING ON ME. [ __ ] don't want me recording or nothing. No, they going to find a reason to take me to jail. Especially him. No, it's really him. I know I told you that. I'm apologize cuz I ain't mean to buy my uh I don't know cuz I I get emotion. I wear my emotions on my sleeve. And if you think this stop right here, right, I know you probably wishing I go to jail, too. But it's all right. It's all right. I ain't breaking out one law. Mother told me he pulled me cuz I was turning in houses and stores. YEAH, CUZ Y'ALL FOLLOWING ME 40 MINUTES. THAT [ __ ] AIN'T RIGHT, FOOL. [ __ ] SEE EVERYTHING ON MY CAR, RIGHT? THAT AIN'T GOOD ENOUGH. THAT AIN'T GOOD ENOUGH. They want to bring THE DOG MAN AND SAY THE DOG HITTING THE DOG AIN'T DO A MOTHER BUT PLAY WITH HIM. Come on man. >> That dog ain't do but PLAY WITH YOU. I'M WATCHING YOU GUYS. Come on man. That [ __ ] is not right. Cuz >> weed in your car. >> Now he smell weed in my car. >> If I smell weed in your car, I could have certain now. So now you saying you sell weed. >> But if your dog didn't hit Yeah, you shouldn't. Cuz you sound crazy, man. >> I don't sound crazy. >> You sound crazy, man. >> I do this for a living. >> Yeah, I know you do. And just arrest any black man. Look, he he looking. He How long they going to search that mother? He f to find something. I I'mma go to jail cuz they going to make it they business. What could they possibly They f to pull something out they hat. They f to pull something out they hat. >> They're wearing a camera. >> They f to pull something out they hat. Look at them. Look at them. All in the wind. Come on. He all in the the river. Come on man. You going to go? You going to skip the hood? Check the hood of the cop. >> Look at him. >> Put your hands out there. I'm searching for >> Hey, can I ask you this though before? >> Put your hands out there. Shut up and put your hands up. >> And now the stop crosses another constitutional line and the most convenient claim that cops use to step on your Fourth Amendment is saying they smell weed. Why? Because smell is invisible and it's almost impossible for a citizen to disprove it in the moment. So, having found nothing on the guy, these cops are grasping at whatever they can and in doing so, violating civil right after civil right. >> See, now shut up and put my hands up there. Come on, man. You quit talking to me like that. >> Put your hands up there. All right. I'm not going to look. He's trying to trying to provoke me to do something. YOU GOT TO PULL ON ME. ALL YOU GOT TO DO TELL ME. TELL ME WHAT YOU WANT ME TO DO. >> SHUT YOUR ASS. >> YOU TELL ME. YOU AIN'T GOT TO PULL ON ME LIKE THAT, MAN. I ain't going to do [ __ ] TO YOU, BOY. WHO THE F TO GO TO JAIL? >> Hold your money, >> man. I ain't put it on the hood. I ain't holding I ain't holding >> if it gets long. >> Come on, man. I AIN'T IT'S GOING TO BE ON YOU. OH, YOU GOT my hands on the hood. You pushing me on the hood. >> I ain't going to do It's >> kind of funny. >> I'mma do whatever y'all need me to do. If you want my hands behind me, just tell me. I'MMA DO IT. YOU AIN'T GOT TO PUT YOUR HANDS on me now. >> You ain't Man, YOU TALKING ABOUT STOP TALKING. HE PULLING ON ME. All you got to do is give me a direction. >> I told you money, >> man. >> THAT'S AFTER YOU PUSH ME. >> THAT'S AFTER YOU pushing on me. Find a reason. They looking for a REASON. YOU WANT TO CHECK MY DICK, TOO? Go in. GO UNDER MY NUTS. GRIP MY DICK. GO AHEAD. >> Put it in there. >> You want to check my dick, too? >> [ __ ] It's crazy. >> Hey, cuz if you going to arrest me, just tell me, big dog. I'm going to put my hands behind my back. Y'all ain't got to rough me up. >> I know y'all won't beat on me, man. I know y'all won't beat on me. >> Come on, cuz. Look how y'all going to let him do that to me. And yeah, if I have did anything, y'all would have threw me to the ground. >> Take my >> Yeah, I don't want that cuz I don't need nothing from y'all. Let me live. Let me live peacefully. >> Come on, man. How the I'm going to be peaceful. Y'all racially profiling me. >> Okay. >> Come on, man. >> And then you going to let the let the little ME GO GRAB ME LIKE THAT. COME ON, C. >> What the did I do besides talk? Give me my [ __ ] >> Is Daddy All right. WHAT THE WHY? THEN YOU JUST THROW ME TO THE GROUND. THEN YOU JUST TRY TO THROW ME TO THE GROUND. You gonna tell me what not the [ __ ] to do? >> Have a good day. >> No, you have a good day, sucker. >> Have a blessed day, >> sucker. Okay, on time out, >> man. >> Man, I ain't got to leave right now. >> You need to leave before. >> LET ME LEAVE BEFORE HE TAKE ME TO JAIL. LET ME LEAVE BEFORE HE TAKE ME TO JAIL. SIR, I NEED NUTS RIGHT HERE. >> And just like that, they let him go without a ticket or any kind of charges. And after all the unfairness of this illegal stop where the guy was treated like a suspect without any crime and had his basic rights completely trampled, the cops still had the audacity to shout orders and try to boss him around. But there is one positive thing in all of this. the fact that the guy had a camera and didn't hesitate to use it because now everything you have seen is uncontestable evidence in a court of law and these cops can and will be held accountable for their reckless and abusive behavior. Now, what do you think about all this? Tell us in the comments and check out our other stories if you too care about civil rights and keeping authorities accountable.
