boat or it can be all of you guys I do not care so I like the social experiment that this Warden is playing with this group of violators and it's i' like hey everyone can get a ticket or just one person can get a ticket you guys Go and Talk Amongst yourselves and figure out who's going to who's going to get this I kind of like that so I don't know what the conversation was on the back of the the the suspect boat but it's man there had to be a lot of finger pointing and like hey this is your idea hey I'm only here hey this is for you so I kind of I like the fact that he made them make the decision so that was a that was a pretty good pretty good angle on him I'm doing good how are you doing ma'am I'm pretty upset I'm sorry you feel that way I'm sorry you feel that way is very similar to I don't care what you have to say and I appreciate that because it's a it's a much more tasteful way of saying it but it gets the same point across which is I don't care what you're saying and I'm going to do what I have to do so I I like this guy's use of that particular verbiage because I appreciate it there's not going to be a wiggle room on alcohol ma'am you should know that there's no uh it's a portable breath test okay you're going to blow into it if you're above a 02 you're going to get a citation today okay the citation you still to go home okay but you'll have a court date do we understand that okay if it's below a 02 cool you guys are still going to get charged with h possession of alcohol by underage okay do we understand that now how you guys break that up it doesn't matter to me it's either one or all I have a lot of paper I give it to you as your choice so you guys can comp powwow how you guys want to do that it can either be the captain the owner of the boat or it can be all of you guys I do not care okay the thing I care about is you guys have a handle of Crown you guys have load of Bud Light red stripes and some seler stuff that is ridiculous but you guys have a lot of it and none of you are even 20 so I like the fact that they had a handle a crown Crown's one of my favorites I'm over the age of 21 and I can drink it I also like the fact that this Warden said that those selsers are ridiculous um I mean I'll drink a Selzer if it's there um I'd rather drink a beer if I'm drinking something out of a can but like I'm not a Selsa guy um apparently these kids are maybe it's a maybe it's a new it's a millennial thing like maybe they just maybe they need to drink selers maybe they're counting carbs I don't know but uh I like the fact this Warden threw some shade on them anybody 20 oh you're so close but you're one year away one month away way July would have been the better month to do this okay so that's what's going to happen right now um and yeah any questions any comments any concerns so um if you guys want to come to the bow or you guys want to go to the back and figure out how I'm going to write either all of you or one of you for the possession of alcohol because you're on the boat with alcohol you are in possession of it doesn't matter if you're sitting in the back or sitting in the front do we understand so it's one person gets it or everybody gets it yes sir do not care okay so let me know what it is go ahead and talk about it um but for you yes so like I said if you're below a 02 okay that's the threshold for 21 year olds okay if you're below a 0.02 then you're fine if you're above it you're in you're what's called operating a vessel above a 02 while under the age of 21 okay it is a it's not a misdemeanor it's a court it's an infraction okay it's a little more serious than a parking ticket okay however you'll go to court it's a mandatory court date okay you'll go to court and then after you go to court you'll go to uh what do you call it uh they'll probably assign you either some kind of uh drug and alcohol class you have to go to there depending on your history if you have any there'll be probation it depends on your history I don't know what it is it all varies upon your previous history do you understand um if you have if you have none then that works in your favor mistakes happen people drink it's okay shouldn't be doing it one because you're under 21 but two you're in public okay so guys brought this on yourself on okay they know that this isn't the the the bust of the century you know it's not going to put them on the front page of the paper they're just addressing with what they see so they see some underage consumption they see an operator that is under the age of 21 has alcohol on board you know on board as far as being in in her body um and that they're just pursuing that Avenue instead of trying to blow this up into a fullblown um you know boating Under the Influence or boating while impaired whatever they have there in Florida um so I I think they're doing the right thing I think they're using some of the discretion that they have they're addressing the issue they seize the alcohol um someone's going to get a underage possession of alcohol citation along with the driver getting the operating with alcohol in their body so doing the right thing and I think that they're putting the right amount of importance on it which is somewhat important but not a homicide level of importance so this is your boat it's my dad your dad's boat so did y'all tell me about how uh this so either one person get MIP and takes it for everybody or MIP minor in possession so you see you got an operator there that's driving both boats cuz they're tied together one person can take the Citation for possession of alcohol and if you guys can't figure it out he's going to write everybody it's either all of them get minor in possession or not minor but underage because they're not minors but underage or uh what you call it or one gets it it's up to you guys figur it would be a nice option I don't have to give it because technically you guys are all in possession but it's MIP charge I don't know what you mean by MIP Min you're not a minor so it's just underage how does that work you I fight it off no you can fight I get paid overtime I get over you get over I get overtime so I'll go to court oh no no I know no I'm just saying like just so because a lot of people think that oh I go to court and they won't show up no we show up hello I hear you I didn't know it was FWC yeah it's FWC it's not lakew worth how are you I'm doing good how you doing ma'am I'm pretty upset I'm sorry you feel that way what you upset about ma'am so actually I work with FWC I read all the I do a lot of volunteering and work with okay I'm retired director of Lor okay so there's not going to be a wiggle room on alcohol ma'am you should know that there's no uh there's no wiggle room on alcohol ma'am you know that I didn't know you know that Ma she do you know that or not ma'am CU I know you're not asking me to wiggle room on alcohol no I'm just saying that she does not drink at all okay if she doesn't drink when she blows into that it should be a 0 and then we don't have to worry about it again but if she said she has drank or she has drank which you said she doesn't drink that's why she was operating so if she hasn't drank it should blow triple zeros and we're do it if she refuses don't want to do it then I already explain to her her the consequences for that okay so if you say she doesn't drink then you should advise your daughter to go ahead and blow and we have we worry we don't have to worry about this you let me know good logic so I'm not a fan of this Mom um she's trying to negotiate absolutely unsuccessfully which I I like that that happened but I don't like that she's trying to negotiate for her underage daughter who did everything wrong um consumed alcohol was on a boat with alcohol all underage kids driving Daddy's boat um she's doing everything wrong and the mom is trying to get her out of being held responsible for the Myriad the plethora the cornicopia of poor decisions that this girl made instead of holding her accountable and letting her learn from this mistake so not a big fan of the mom definitely a big fan of that Warden saying hey the time is up she needs to blow or this is going to go a different way and I like that okay so I mean I can tell that you're not really willing to I'm not willing to look over a child drinking no I'm I'm not willing to overlook someone on a vessel operating a vessel that has been drinking no I do not play with that can you okay can you tell me what the options are the options are she blows right now okay she because she is underage or she's under the age of 21 I'm not running a Bui route I'm running a 02 violation which is a 21y old or under operating a vessel while having a impairment on AKA drinking okay she blows into this right here she blows into this it's a point of 2 or lower she's not operating The Vessel while while INX I thought it was 8 no that's for the Bui route which I explained to her I don't want to run that because she's under 21 I'm not trying to ruin a kid's life okay this right here is an infraction either way it's an infraction with a mandatory Court we either way one she has a leg to stand on the other she doesn't one she has a way to battle it the other one she doesn't refusal is the doesn't no matter what she will get those she'll get those so in Arizona if we were investigating an oui or operating Under the Influence a DUI on a boat and she would have refused to blow we would have gotten an ew warrant gotten a warrant for her blood Drew her blood subsequently had it analyzed um there are states in the United States where simply the refusal to blow just that is a separate charge and you're charged accordingly for your refusal to blow um other states just I don't know I don't know what they do if they just document it in their report so it's kind of different state to state um I thought that this warden's angle um that he said that he's not pursuing the full fledged um criminal offense but that he's just doing the um the underage person with alcohol in their body operating a watercraft thought that was pretty good um Arizona has zero tolerance apparently in Florida you could be at .02 um if you're a 0.01 in Arizona it meets the threshold because you can't have any alcohol in your body so Florida is a little bit more lenient than we are here okay so if she refuses she loses her license for a year she loses her ability to operate a vessel and depending on the court the court can take away her license all right because she is a minor I mean she's not a minor she is under a 21 okay there was a boatload of liquor on there okay okay so that will go in the report obviously so she didn't even want to go in the boat today that's it's it's it's okay like her and begging her to go she and I are sitting on the couch working on her College I know she told me about youf in the rord problem I understand ma'am I'm not trying to ruin her life I just apprciate my thing is that is the thing that kills literally I was talking to all my friend I mean I so I mean I've worked in law enforcement my whole life have a volunteer I all yourth trying to get that preferential treatment my buddies that were all Marine units for a long time but that's all pbsf so I didn't know was F WC and I'm totally with you I mean I'm a [ __ ] law enforcement person just like you this is my kid oh and listen I understand you I understand you want to help your kid and that's why I was telling her she's a big girl she's over I can't I I can't I don't know what's I can't I can't give advice I can't give advice I'm not I know why that Mom is there I gave her the courtesy because she is over the age of 18 I didn't have to wait I don't have to wait but at the same time I have no problem waiting because it is a decision I understand that and she's she won't even more out she doesn't want to drink CU she's like I'm only three three she hasn't been drinking there's no problem going to screw it up well she told me one month but it's it's okay yeah she told me one month but we found out it was in September she's like a straight A kid she's like the like this kid works so hard and now she's out she didn't even that's boat the wheel for a secondes me off I want to go over there and all okay he didn't even want to go so yeah so like I said there's so she if it shows up so she a drink of whatever and I don't know I mean she's only been up there for dress over here we're good so there are things how would I say there are things like called breath Mal bre breath alcohol well she hasn't had any alcohol since I don't know about 20 minutes now 30 minutes now so that that won't be the indicator on here now it's just going to be if it's inist or not okay again above a .02 it is what it is let's be honest you I mean I'm sure you took some kind of drink you're obviously not drunk I mean she's clearly no I only dropped her off on the boat a half hour ago so you haven't even been out that long so if she does have some well if she's below a 02 then that Situation's over with do think the situation of for her for that to show up on that how like if she took a sip or a couple sips of a drink it all depends on how fast she metabolizes metabolizes alcohol you know what I mean look at this mom not allowing her kid to take responsibility if she's if what she's told me was I can't like I said I can't tell you to blow or not to blow I can only give you your options and then you guys have to make the decision actually she has to make the decision I'm giving her the courtesy to have her mom there to help her out with it okay so I don't know if if Florida has a ew warrant system like we have here in Arizona and that Warden couldn't threaten that like he couldn't say hey if you don't blow I'm going to get a warrant and then you're going to have to um because that would be considered coersion so there's we can't threaten um hey I'm going to get a warrant or hey I'm going to do this if you do if you don't do this I'm going to do that um so he just gave the information let her make a a well-informed decision but it it it's sometimes it's easier if you say look man I'm just going to get a warrant we're going to get it anyway um legally we can't do that so there's some things that we just can't say and that's one of them so I think he this Warden did this particular contact the right way so if so if it does go higher than a point2 seems like you could barely just take one little SI well they're not leing all to have anything on their system that's what that's why it's a 02 okay I just don't know the building r no it's not it's not an arrestable offense this she's there drinking water my best friend Jeff okay he just got off work he's a lawyer that's why he he knows how upset I am I I was like oh my God out of all people on the planet has to be Katie like she wasn't even operating in the boat she didn't even want to go in the boat beging her to go so I just asked him like I don't know what because I I was calling all my buddies a PBSO but then I pulled up I'm like oh it's FWC I don't know the rules trying to call a faor that he's not trying to charge her with a Bui but it's just like underage what's it called under underage under .02 operating a vessel above a 0.02 while operating The Vessel if she can blow a 0.15 for all I here right now it doesn't matter so if if she does you explain that again for 02 okay she shouldn't have anything in her system if she has above a 02 there is a mandatory court date that she has to go to it is undering no is underage drinking yes it is not underage drinking in the sense of driving a vehicle okay because it's not autom drink Al dilute the but it could be drink water to dilute the alcohol in her body telling her there is a mandatory uh hours of service there's a mandatory fine there's no operation of a vessel and now the license gets put onto the table if she blows and she happens to blow over again doesn't matter if it's a 02 does it or 03 or a 0.15 I don't care okay because that's what I'm running and I can't run a be y section after that okay I've allowed the powwow it is about to get to cutting time where I need to have her make a decision it it doesn't make a difference all right so you're going to blow you're going to
