on June 9th 2022 a Hinsdale police officer was serving an arrest warrant for a domestic violence allegation the suspect 45 year-old Shawn Malarkey allegedly hit her ex-husband with a car this awesome video came from Blue watch so if you're not watching them check them out you might find something you like on there right now get out of the car ma' we'll talk about everything but get out of the car yep 20x we're in the garage she closing oh that's not safe that lady knew that there's a police officer standing at her door in her garage and then shut the garage on him so there's some officer safety stuff that goes on there because now his backup can't get to him um you have no idea who's going to come from inside the house into the garage that's that's a that's a pretty tense situation y step out excuse me excuse excuse me sure hands off of me step out of the car right now yes no step out of the car get your hands off of get out of the car you're under arrest no I am not yes you are no I am not yes you are get your hands open this garage door no I am not let go I don't think she understands how the law Works no get out of the car now no I will tase you if you don't get out of the car you better take your hands off of me right now get your hand officer stop I told you you're under arrest the car why cuz you have a warrant punch her right in the face yes you are so there's all sorts of different defensive tactics um ways or techniques to removing someone from a vehicle you can take whole classes on removing people from the vehicle but like that active aggression when she's pulling her hands back in and you have no idea what's in that car you don't know if she's got a gun in there or a knife if she's going to come up with something a need a who knows a knitting stabby thing um she needs to get out of that vehicle and once she's very overtly refusing those direct orders and you put your hands on someone you could up that level of force to a reasonable level and sometimes it's a it's a direct strike it's a hard empty hand strike whether it's to her arm um whether you want to you know reset her UDA Loop and maybe give her some sort of head strike I think that would have been totally applicable in that situation when they're oneon-one um his partner gets there obviously then they grab her and yank her out and then she's mad that they yanked her out but she's drunk she's actively resisting she was told she was underr and to get out like what do you think's going to happen like we're we're going to arrest you when we have problem cause the officer said you're under arrest she said no I'm not that's not the way that things work excuse me I just sent a message and I am excuse excuse me excuse me get out of the car right now no I told you I can handle this peacefully but you have to get out of the car no you never said that I sent you a message my attorney affirmative I have one cough on you you're going to jail excuse me did somebody say that you could come into our house y it's cold in the rest War this lady's already on this Police Department's radar um they're there to serve a warrant she had an outstanding warrant for um sound like attempting to run her husband over with a car which is aggravated assault um if she didn't kill him uh it's probably why he wasn't in the house he's probably worried about her being crazy and killing him so uh but there you know this isn't just like a random stop on the sidewalk where they just see someone like oh hey get out of your car they had probable cause from the minute that they confirmed her identity um and knew that she had an outstanding warrant they' probably caused the place her under arrest so she's like oh who invited you in in my garage well really don't need to be invited when you have an active warrant so um she was she was off base from the word go but I mean these officers are obviously heads up they obviously knew what they had um and who they were looking for and they found her don't stop tugging I'm going to tase you if she needs to be punched in the face yes no you're obstructing right now do you understand you're obstructing I'm not going to tell you again no I'm not going to tell you again get out of the car right there we go out you come there we go he immediately got out on the radio and said hey she's closing the garage on me um he's got a heads up partner obviously that made it through a side door but that door wasn't there um that really creates a an officer safety issue so I I wouldn't have been very comfortable if she would have did that on me and I'm sure he felt the same way H outch that look at her trying to kick her leg and shrimp up nope unbelievable fale you did this no I didn't no I didn't Andy asked you to come out Excuse Me Andy asked you get out the car no Andy yanked me I yanked you because I told you you're under arrest and you refuse to your vehicle yes step up that's what's nice about body working CER is your attorney is going to cringe when he sees this and how you act that my attorney has filed a motion to quash this all right you just stand your knee my attorney has filed a motion to quash this no one cares what your attorney did we're going here this way to you hit us you do anything stupid towards us we're any charges on if you hit us or anything let's go you've already hit me you need it you need needed to be hit more told you under arrest now you got a whole show for your neighbors here you are a dick what a cordial woman my children don't have anybody at home right now you're going to put my kids alone in danger I need to call my attorney I'm not getting in that car until I call my attorney I'm calling my no I'm calling my attorney it's not going to happen no I'm calling my attorney that's not how this works now as she right here she's like I'm not getting in the car until talk to my attorney like that's not how life works we don't just stop everything we're doing while you're in handcuffs and we all stand there politely and let you talk to your lawyer it's not how it happens you go and you get booked into jail and then you call your attorney from jail you just obey with everything if there was a false arrest you get to sue the police department that's that's how things work if we're in the wrong you get to sue us that's fine it's it is it it's part of the job sometimes officers do things that are bad and then those officers get fired the department gets sued the department pays out and that's just the way and and then we go on about our business I don't think that's happening in this case and uh as she was like I'm GNA sue you you're G that's not going to happen you can't sue someone for legally arresting you and then fighting you when you fight with them that's that's not how lawsuits go and there isn't a court in the country of anywhere where that's going to fly and I'm sure it's not going to happen in this jurisdiction either call your attorney right now you're under arrest call no I'm calling my attorney sit in the car my children are home alone giv you an order the car home alone my children are home alone we will take care of your children no you're not taking care of [ __ ] the way that you take care of somebody throwing them down on the ground uh do the pull through a shitty fing human being that's messed up you you throw restraint some's called a hobble um but pretty much what it does is it's a loop that closes tight that Loop goes around your ankles it locks your feet together and then you take the other side of that rope and you pull it out the door and shut the car door in the Rope what it does it prevents you from raising up your feet and like kicking the back window or kicking a side window window or anything like that it eliminates or at least deteriorates someone's movement or ability to move within the back seat of a caged car um it's it's a we use them um there a lot of departments issue them it's a great tool for someone like this that's that's overtly aggressive and that they're they're actively fighting with us um and these guys were when they pulled it out I thought it was great cuz it's it's exactly what she needed more times inapo do you understand everyone this is awesome do you understand how many times T wouldn't had to touch you at all if you would have just gotten out of the car we have a couple charges of our own too so this is awesome we could just do what he says listen to what he says I'm coming for him okay my attorney is fing charges let's fig attor don't it's not the way you have to disarm yourself so any guns any Knives have to come out so you see this officer takes his gun out puts it in a lock box and locks it um that's because he's going into their jail facility doesn't want to bring a firearm into a secured facility so it is it's what we do um it's industry standard it's common practice everywhere uh people in the jails don't have guns unless they're you know transporting a suspect or something outside of that jail facility um so that's that's what that was and that's why he did that is it's probably their policy like it's policy everywhere step out where's my watch I have your watch oh is it accounted for what's up that's what I have your watch means accounting for it we drove four blocks he has cussy of your watch in the guess what just so you know body camera your watch is right here okay guess guess what I don't take anything for granted that's great can you hop out the car now I don't know you want to drag me out like you like you dragg did nothing Shawn Malarkey was charged with felony aggravated DUI her third DUI with a child passenger and felony aggravated assault to an officer misdemeanor count of resisting she also received a citation for transportation or possession of open alcohol buy a fine of up to $1,000 a week later additional charges were filed against her for endangering the health or life of a child violation of a bail bond and resisting or obstructing an officer her court cases in DuPage County are still open the court case of the domestic battery was dropped that's awesome
