On January 1st, 2023, a Portage County Sheriff's deputy was on patrol when he ran the plates of a vehicle in Stevens Point, Wisconsin. It came registered owner had a suspended license, so the deputy decided to conduct a traffic stop. Upon approach, the female driver, 33-year-old Nicole Golamsky, immediately began yelling and cursing. >> All right, found this video on Code Blue Cam. I like it cuz it's from Wisconsin. It's one of my favorite states and their stuff's awesome. So, check them out. >> You guys are following waiting for me to leave my gas pump. Look around, douche. >> Well, the reason why >> you don't have anything better to do on New Year's Eve, New Year's night, New Year's Day when there's all these mother. Get that out my eyes. >> It's not even >> I didn't do anything illegal. I do know I know your was going to pull me over. I saw you sitting at Hardies. Hardies? >> Yes. Cuz you're lazy and you don't want to pull over somebody with actually where you have to do paper. >> Who has a suspended driver's license? >> I got a suspended driver's license. But you can pull somebody over drinking and driving, right? >> Okay. Can I have your ID? >> No, >> I don't have it with me. My name is Nico Lonsky. You know who the I am cuz you just said I have suspended license. >> Do what you got to do with >> I have to verify who you are. >> Don't find anything. I don't give a And your buddy back there can bring his dog. You guys do this to me anytime. >> I've never met you before. I don't know what you're talking about. >> Why did you creep at Quick Trip? >> What a terrible human. >> Answer that. >> Cuz I saw you at a suspended driver's license. >> How did you see that? If you're on the other side of the parking lot and then drove around my vehicle, then drove around again. >> Running license plates is a common law enforcement technique. It happens everywhere. Um there's just because you're in a parking lot doesn't mean that your plate can't be run. In addition, it's easier to run a plate in a parking lot cuz the car is not moving. You can pull up, look at it, make sure you got it right, type it in. Uh, so you're not typing and driving. It's great. I love it. I do it. Um, all good law enforcement officers that are looking for um a vehicle to stop for really good reasonable suspicion for a stop. That's it. It's great. It's legal. He had every right to do exactly what he did. So, just because she doesn't like it doesn't mean that it's bad. >> Okay. You know what? I don't You don't have to answer. I don't have to answer. >> What's your name, sir? >> He doesn't have to answer you, does he? >> Get it out of his eye. Wow. >> Who? And neither the am I. >> Neither am I. >> I don't know that. >> Oh well. >> He's amazing. >> What's your name? >> Boss. >> He does not need to tell you his name legally. >> You're not going to try to make somebody. He's a passenger. >> Did I do anything? >> You are being This is enttrapment. Do you know that? You're going to get in trouble. Entrament. >> Yes, it is. >> You think I'm going to get in trouble? My sergeant >> I don't think that word means what you think it means. >> You been drinking tonight? >> No. Breathalyze. >> Breathalyze. >> Get it. Get it. How do I know? Your eyes are glossy. Glossy? >> Yeah, I smoke a lot of weed. >> You've been smoking tonight? >> Nope. >> When's the last time you smoked? >> None of your business. You smell weed? Nope. Are you going to find weed? Nope. Sorry. You You wasted your time. >> I know. Actually, I think I do smell weed. >> You do. Search it. I told you. Get your dog. >> I don't need a dog. >> Do you got weed on you that you would put in my >> Why would I have weed on? >> Marijuana is legal here. I don't I I don't necessarily like that, but it is what it is. And I don't I don't have any say in it. So, we have medical, we have recreational marijuana. It's all legal as long as you're 21 and or over. Um, and you're not impaired while you're driving. But simply having marijuana in your car in Arizona, as long as you're 21 years old. We don't even search cars for that anymore. We used to back before it was legalized. Um, so obviously Wisconsin's got different laws in Arizona. I say it every every time that we have one of these chats that laws vary very specifically state by state. Um, but in Arizona, if I smell green marijuana in a car and the drivers over the age of 21, I really don't care unless, you know, there's impairment is a possibility. And that's that goes down a different route. But if we're not talking about impairment here in Arizona, no one really cares. Now, in Wisconsin, obviously a totally different story. So, which is the way that Arizona used to be. So, but times change and you got to be up on the laws and change with them. >> You seem like a dirty lazy cop. >> Oh, that's >> Wow. What a terrible human. >> That won't find nothing. Don't be upset and then have to give me a ticket for suspended license. >> A ticket anyway. >> Why don't you going to happen? >> Don't want to ID himself either, >> dude. This guy waited at Quick Trip for me >> for no reason. And I'm pumping gas and doing my makeup. >> Ready to actually go to a friend's house. >> Have a couple drinks. >> How much have you had a drink already? >> None. Breathalyze me. I'm not talking to you no more. >> I'll be right back. >> So, if you've got a violation of passenger and he's refusing to identify himself, >> I walked up. He wasn't wearing a seat belt. He's claiming he took it off, but I don't believe him. >> Okay. >> Uh neither one of them had him on. She's telling me she's the RORO. She gave me her name, but she didn't have a driver's license on her. >> Okay. >> So, I can write her for that. >> Yeah. Check and see if you can find a driver's license picture. >> Well, yeah. I stopped her for uh she's suspended. >> Oh, okay. >> Let me ask you something, sir. Do you have a valid driver's license? >> No. >> No. So, neither of you are leaving here then until >> you have a valid driver also? >> What? I can walk away, can I? >> You can't leave right now >> if I'm not being detained. Yes, I can. No, you are detained. >> You are detained. >> You're getting a citation. >> You're not going anywhere. >> That's not being detained. >> Fourth Amendment says it is. >> When your is done giving me a ticket, [Music] >> alert suspended driver's license, female, white. >> There's a ticket. That's what I like to hear. >> He's not driving out here without a license. So, >> he says he won't have one either, but he won't identify himself. >> Perfect. They can sit here until they get someone out here. >> Operator failed to have passenger seat belt. >> Yep. That's a >> She's getting a seat belt and a suspension. >> How far do you want to push? Because I didn't too failure to carry her driver's license on her person. >> I kind of feel like that's a double-edged sword because of this already being suspended. She doesn't really have a driver's license. Otherwise, I was going to write it. I was going to say that is >> I mean >> if he says he had it on, he took it unless you saw that he had >> I pulled up behind him. They never took them off. Uh they were in my books, they were never wearing them. Um there's video from my squad. >> You never see him remove seat belts or anything like that. They were in my book, they were not wearing them. >> Okay. It's up to you. This is it's your stop. So if if you feel that he truly wasn't wearing his seat belt and you have a violation that he's required to identify himself for his citation if he refuses to identify himself. >> Well, I didn't write him a citation. I was going to write it to her instead of >> what I'm saying is he's obstructing an investigation. If he has got a citable offense that you intend on citing him for, then >> then but it it's up to you if you want to push it that far. If he says he doesn't have a license, he can sit on him until we get someone out here to pick him them and the car up. >> So then we're just going to have uh I don't know, it goes far take him to jail to identify him and he can get it booked in for obstructing. >> If if you Yep. If you wanted to go that route, >> do it >> at your discretion. >> This conversation that happens between two officers, two deputies, whatever. That happens all the time. Uh we roundt uh situations, scenarios, traffic stops. Hey, this is what I'm thinking. Hey, I'm thinking this. Hey, what do you see? That is totally normal. Um, it happens all the time. Sometimes you have someone that has a better code or a more applicable uh charge or violation that they've observed. So, we get together and, you know, and and get different points of view on traffic stops, on the scene of of anything, of an assault, of a shoplifting, whatever. We do it all the time. Um, so but ultimately it is that the initiating officer, it's his call and that's exactly what what this other guy says is, "Hey man, look, it's this is this is what I see, but it's up to you. Totally normal and we have all the discretion in the world. >> If you've got a citable offense, he's refusing to identify himself. He's by law required to identify himself." >> Yeah. This would be a simple >> simple $10 ticket or a criminal. >> Well, that and just >> that's it. $10. >> I love that passenger not wearing a seat belt. It's a $10 fine. I love it. Um it still conveys like, hey, it's the law. Um you know, you're you got to wear it as a passenger. Occupant safety is a big deal. But when he goes to court to pay his $10 ticket, then there's, you know, administrative fees and court costs and, you know, every so it's not $10. It'll end up being a little bit more than that, but it certainly gets the passengers attention. lets them know like, hey, you got to click it or you get a ticket. >> Like it's this is unnecessary. >> Yep. The >> whole thing is unnecessary. [Applause] >> Okay. So, are you willing to tell me who you are? What your name is, sir? >> No, he doesn't have to. I'm telling him not to talk to you. Do not >> I'm not talking to you right now. >> It sounds like she's obstructing. >> You need to stop talking. Step out of the vehicle. No reason. Step out. >> There we go. >> Come here. I'm going to talk to you back here. >> Here we go. >> She's going to get him arrested. >> Yes, you do. >> There we go. >> That car, please. >> There we go. >> I just want to know you're speaking person to person. Like, why are >> Yeah, I was not There's one, two, three, four, five here. >> Look at how you reacting. >> Because >> I'm not trying to mistreat you. I'm not like trying to make you feel bad. >> Listen to me. Please let me finish. Sure. >> There's so many drunk crackheads, methheads, alcoholics, people with so much stuff that if you pulled them over, you would actually I don't know. It would feel like you were doing good because they were drinking and driving or they had drugs or they were doing something bad. But why pull? >> Well, you physically told me you're smoking pot weed all the time >> because you're being saying my eyes are glassy. You smell weed. Actually, I do smell weed now. You know you don't. You don't smell weed. You don't smell alcohol. I haven't been drinking. >> Okay. It's lying to me. >> It would be lying if I was lying. I'm not lying to you. >> Don't raise your voice at me, dude. I have daddy issues and I don't >> I believe that. >> DSD, do not talk to me like that. >> Do not. >> I'm not lying. Everything I say that we're talking about is recorded. >> How scary this is when you see like this happen on the news. >> None of this would even have gone be to where it is right now. >> Held down by you guys. You could at least have the slightest bit >> of respect. >> Brad, I do not I want to walk the from you cuz I don't owe you. >> But you know what? Walk to the front of my car. You know what you would do? >> Just walk to the front of that car. >> You would physically hurt me. You would hold. >> I'm not going to. But if I >> I'm not even going to touch you. >> You would. You'd shoot my >> Just have a seat right there. Relax. >> How easy that is. >> Okay, so here's the thing. You're not identifying yourself. I pulled up behind you. I have a camera that's also in my car that I've never observed either one of you removing a seat belt. Therefore, you weren't wearing one. It's a violation. If you're not going to tell me who you are, give me your identification. That's obstructing. And then we're going to handle it differently. >> What are you trying to do? >> I just just tell me who you are. >> What have I done wrong? Cuz I saw you. >> He just said, >> "Yeah, I saw you at Quit Trip. I ran her plate. I saw that she was suspended as a registered owner of the vehicle. I can legally do that. I could sit at a gas pump and run every license plate. >> Absolutely 100% true. >> Aaron s >> I R V I N G Singer right now so I can tell you how it is. >> 62. Could you look up a Irvin Sarra Goza in the house? >> Love how he's videoing like this officer doesn't have a body cam on. >> If she wouldn't have like started yelling at me and like all this would have this would have never got >> so silly. It's just that we're all the time they just happen like we're not doing anything. We're literally at the picture standing there and like so I drive around and I like that's my job is to observe traffic and I run license plates. >> It's literally in every police officer's job description >> with suspended driver's licenses. I look for people that are revoked. >> So now you're out in forest quiet. >> This is my normal shift. >> There's quite a few guys up to you guys >> right now. Yeah. You got us on shift change. So, there's a lot of us cuz there's guys coming off and on. Half hour ago, there was like three of us. That's it. >> Trying to mess with us when you could be actually doing something, guys. >> Okay. How much weed is in the car? >> There's no weed here. >> I can smell it. >> If you can smell it, then you need to get your nose check. >> No, no, we're talking to him. He already got your name. >> She is. >> Stop asking questions about Jared. You want to walk up here? >> Get it done and over with. You want to get in here and check it out. So, I looked at past contacts too with the car and like it even says that there's been marijuana in this car. So, you're going to tell me that I don't smell it when it's been in here. >> I don't care to search the whole vehicle. Honestly, I don't want to look in the damn vehicle. >> I don't care. Like, what are you trying to get? I'm tell >> I'm just being honest. I'm talking to you man to man. Like, there's nothing here. What do you want? >> Nothing. I don't want >> If you try and get in here, get in here. >> Just Can you Can you step out? >> Can you run it? Can you be quick and >> Yeah. No, you're not going anywhere. You guys might as well start calling for a ride. I'm pretty sure it's the sheriff's office. So, these deputies, um, they're like, "Hey, you can't drive. You know, whatever. Call someone to come here and drive your car." I do that all the time. Stop someone in a parking lot or direct them off of the road and say, "Look, you can't drive. Park your car." Um, and then in giving them that lawful order, I don't sit there and babysit them. Like, I think that the taxpayers have a higher expectation of me than to sit there and watch one car cuz what if it takes them 3 hours? What am I going to do? Sit there for three hours? Like, it just doesn't make any sense. So, I tell people, I give them a lawful order. Hey, you can't drive. Um, you know, you're, let's say you did a traffic stop in a parking lot. Hey, you're in a parking lot. Sit here. Keep your air conditioner running. Call someone to come drive your car. And then I go about my business. And if they decide to drive and they get pulled over again, that's on them. And that's, you know, I can't we just can't have that level of of oversight for every single car because we would never get anything done. So, but it sounds like these guys might have the time to sit there. So, she might have to call someone. >> I don't I don't >> Okay, I'm going to have you step forward and hang out with that officer. Does >> he have a does he have a man bun? >> Oh, he does. >> Yes. Go ahead. I have to give you permission. Not him. >> No, you I don't need permission cuz the more I talk to him, have my head in the car, I can definitely smell marijuana. >> How do you know what marijuana smells like? Get that marijuana back then. >> Don't put any drugs in my car for I see it on YouTube videos. >> Do you have your phone with you? >> No. >> Urban, do you want to try to call somebody? Cuz you guys aren't driving out of here. >> Guess what? My uncle lives two houses up. I'm pushing my car to his driveway. >> Pushing my car. I'm going to hand you your phone so you can work on a ride. >> I don't need a ride. I'm going to push my car. >> Okay. Well, then we're going to go knock on that door. I'm going to verify that's your uncle and he says it's okay. You can put your car there. >> Go ahead. Why don't you check the address? >> Why do you have a hatchet in your door? >> I can have whatever the I want in my door. I can have a gun in my door. >> Okay, thanks. That's all I wanted to hear. >> Nope. Thought you didn't have an ID. Oh, there it is. >> That sounds like obstructing. Are you say I I hear all kinds of things. >> I just don't want to talk to you because I don't want you to keep yelling at me. I don't work for the city. >> I don't give a >> You're deputy. Yeah. >> Nicole was released and cited for failure to wear a seat belt, operating while suspended and failure to have a passenger wear a seat belt. >> I like it. >> That's when I was doing that quick trip, but he said he thought that I have a suspended license when I don't have a front plate. >> Keep it up. And I'm going to write you for obstructing for not giving me your ID. >> Please do. >> I don't need to hear it. Not from you and not from nobody. >> Here's a citation for operating while suspended. >> There's a court date and time up here at the top. You do not have to appear. It's going to be a deposit of $200.50. >> Oh boy. >> There's also a citation for you not wearing a seat belt. Same court. >> I told you he was going to write a ticket for everything cuz he's going to feel asked for that. He didn't find nothing. Also, I'm giving you a citation for not having your passenger or your passenger failing to wear his seat belt. >> Okay, >> thank you. >> What are you doing? >> Figure out a way to get your car somewhere cuz you're not driving it. >> I'm going to push you to where it feels good. >> Nope. We'll be here. >> Fighting cuts. I know you will cuz you don't want to do paperwork. You don't want to do your real job and go fight fight time, right? You're a pig that goes down. going to be intimidated. What are you doing? >> He ain't he wants to fight a girl. >> So, make sure she doesn't drive out of here. >> He wants to fight a girl. >> She's going to just drive out of here the second we leaves. >> Yep. Absolutely. >> It's up to you if you want to. >> I've never had cops watch >> sit out here and my vehicle. >> If she wants to push it a couple of blocks, we can follow her and watch her push her vehicle for two blocks. I guess >> call that tow truck. When that tow truck comes, you got to pay for that, right? >> We can't allow her to leave the city to be pissed and I'm going to push my car. You want to be a member.
