man you realize your sunglasses are on upside down so on a scale of 0 to 10 with zero being you're completely so and 10 being your pass out cuking drunk where do you think you're at Hillary did you call 911 yes lawn crime is where we found this they have a specific Channel just for body cam so lawn crime body cam is where we found this they've got some pretty cool stuff first time we've used it but it won't be the last so check them out this incident takes place in Maryville Ohio on August 5th 2023 at around 5:30 p.m. officer Connor Jones of the Marysville Police Department enters a drive-through convenience store and notices the driver in front of him arguing with the store employee before driving off officer Jones puts his overhead lights on and pulls the vehicle over a few minutes down the road hey ma'am hi officer Jones here so the the attendant the uh drive-thru uh was concerned about your wellbeing he thought you might be impaired or under the influence of something no I don't understand so you don't understand what why told that yes man you realize your sng glasses on upside down yeah they're upside down look at me real fast whoa okay have you consumed any sort of alcohol no I've been home my son you okay so no alcohol tonight no okay any sort of narcotic no no we do any sort of Narcotics no no do you have your ID on you ma'am the driver 40-year-old Hillary Hutchinson rummages through an empty plastic bag likely from the convenience store for her ID after that search turns up fruitless officer Jones has Hillary Ed her vehicle for a series of field sobriety tests I believe that you consumed alcohol smell that there's the order of an alcoholic beverage coming from your person all right so there have you go to these test all right it's my pen only with your eyes and your eyes only all right there we go look at the pen the need you to look at my pen and my pen only fall with your eyes all right don't move your head in the police world this is called a horizontal gaze and stagis test sure officers will move around a pen finger or flashlight in order to detect twitching or jerking of the eyeball commonly seen in people under the influence of drugs or alcohol so the first test that they administer to this drunk lady is hgn horizontal gaze nagas um I've been an hgn instructor since like 2005 um so it's it's a topic I could talk about a normal pupil as it moves from left to right moves smooth uh we used to use the example of a a pool queue going down a pool table or a windshield wiper on a wet windshield when someone's impaired either by alcohol by a different central nervous system depressant um something like a dissociative anesthetic like ketamine or PCP or inhalant like if they're huffing gasoline or laughing gas or anything like that what it does is it makes the pupil instead of moving smooth it moves very jerky and it's a it's a jerk like a windshield on a dry wind a windshield wiper on a dry windshield so that's the example that we used to use um so that's what that's what they're looking for so as they moving that pen from left to right horizontally they're looking for nagus or the involuntary jerking of the eye so that's what what they're looking for it's a great test it's incredibly accurate for people that are are impaired after finishing that test up officer Jones attempts to conduct two more physical tests on Hillary but a misunderstanding and an injury might get in the way I I I can't explain to you there there was OD of alcohol from your person okay there with the drive-thru I pulled up he said I believe she's intoxic you need go check on her okay I'll talk to you I asked for your ID twice and spend time digging around in a paper bag or TR some plastic bag we able to follow simple commands Okay I did that all right so that's why we're going through these tests to ensure that you're safe and okay that you can drive okay yeah I literally look like two seconds away don't care super common this hey I live right down the block um I can have someone come and pick me up I just live right there things we hear all the time um I'm sure that wherever you live if you are a consumer of alcohol you know the closest place that you can reup when you run out and once you're impaired and your judgment goes out the window of hey I probably shouldn't drive because I've been drinking you already know where you're going and typically it's somewhere pretty close to your house so very common that we arrest people just within a couple miles of their house and very often hear the same hey I live right there hey I could walk from here um you know all of these these drunked P that make that person think they're going to get out of it 2 seconds away or two miles away my job is to keep everybody else and you safe so last night do you think you'll be able to do this test or do your hip replacement prevents you from walking in a straight line no they're absolutely I can can prove that but you're what's going underr rest I have hip replacements yeah I I get that but will they prevent you from walking in a straight line probably yeah okay with your hip rep placements prevents you from standing on one foot for 30 seconds okay I don't know can you come say with her can I talk to you yeah as officer Jones and responding officer Casey Kidwell walk away from the suspect officer David Griswald also on scene tries to get a better understanding of the driver's State of Mind ma'am have you been drinking today not at all why do you have an alcoholic beverage on their seat though let's backtrack for a moment before officer Griswald approached Hillary he inspected her car upon arrival in the passenger seat he spotted a container a spiked punch with over 11% alcohol content um I Dr so did you have like two of those today or three of them or how many of those today have you had I those two got two of those today what time I'm not goingon to lie so no you're fine uh what time did you start drinking um probably like 11 this morning 11: this morning okay do you know what time it is now no no yeah had to guess what time you think it is 11 11:00 a.m. p.m. which one a. you think it's 11:00 a.m. what if I told you it it's 5:30 p.m. I've been my mom okay okay all right um so you you said you started drinking those at what time 11 started drinking around for six hours so on a scale of 0 to 10 with zero being you're completely sober and 10 being you're pass out puking drunk where do you think you're at like an 11 so like zero is you're sober and 10 is you're puking pass out drunk no I've been home so oh I'm just saying where do you right now where do you think you're at on that scale from 0 to 10 like an 11 after Hillary rates herself a whopping 11 on the drunk scale officer Griswald attempts to test her knowledge of the alphabet so where you live doesn't really affect whether or not you're able to drive yeah I super common drunk logic are you comfortable with the alphabet so you know the alphab pretty well okay so if I asked you to start with the letter F and end at the letter T would you be able to do that okay so without singing or anything if you start F to T I like it all the way through the alphabet to the letter t for me can you do that for me so start with the letter F so skip the letters before that and just start with the letter F and go to the letter t g I do our concern is that you may be intoxicated no I get that I get okay like my dad was police officer so this is just another way that we can evaluate whether you're good to drive or not okay right no I live literally around gotta okay so are are you willing to do the the alphabet thing for me yep so start with the letter F and end at the letter t Okay [Music] so L whoa that's not even close to the alphabet yeah so if you can start with the letter F and go to the letter T in the alphabet yeah t q u r s okay nailed it now on to numbers yes all right so are you pretty good with numbers and counting yeah okay so if I ask you to start with the number 72 and count backwards to the number 51 would you be able to do that so count backwards from 72 to 51 could you try that for me Ur s t i so you're you're doing letters I'm asking for numbers so start at 72 wow the number 72 so there are tests that are standardized so the standardized field sobriety test battery is hgn the walkin turn and one length stand so those are the three that are standardized there's a whole bunch of tests that aren't standardized Romberg modified is one of them finger to nose is another um and the the counting or alphabet um is another one uh so these were both administered correctly um hey pick a letter go forward in the alphabet to another letter and then say hey recite that without singing um the number test pick two numbers and then that that one's a countdown so we never ask someone to say the alphabet backwards that's just a that's that's a farce that's never happened um anywhere in modern law enforcement uh but the counting yeah man count backwards from 71 to 52 like that's pretty easy like 71 70 69 68 67 go down super easy for someone that's impaired that cognitive ability is impaired and they can't do that so it's a good test but it's just not one of the ones that's standardized for everyone to use across the United States and count backwards to the number 51 can you try that for me could you try it so say 72 and then 71 and then 702 and it goes down good so can we count backwards from that to 51 probably not probably not okay you willing to give it a try no no let's switch over to the body camera of Officer Casey Kidwell at this point she just finished performing a second ey test on Hillary and gives her one more chance to redeem herself all right next one what I want you to do same stay in the same position okay and what I want you to do is you're going to lean your head back when I tell you to begin rber modifi close your eyes and what I want you to do is Count to 30 all right what you think is 30 seconds okay so however you get the 30 seconds doesn't matter how when you think 30 seconds has passed I want you to look at me and say stop do you understand do you understand okay so when you're ready go ahead and begin so just like I instructed all right so when I tell you to begin you're going to t tilt your head back close your eyes all right and when you think 30 seconds has passed you're going to look at me and say stop do you understand yeah okay you may begin when you're ready you know what I instructed you yeah what did I instruct you to okay that's not what I said what I said was you stop when I think I'm okay that's not what I said I said not even close tilt your head back close your eyes and when you think 30 seconds has passed you tell me to stop can you tell me those instructions instructions again what did I just tell you tell you when suck you're under arrest that's it what you do before that after Hillary fails every field sobriety test officer Kidwell gives officer Jones The Cue to arrest her all right man turn around put your hand find your back under arrest op drugs alcohol I'm not sure yeah little itty bitty R officer Jones proceeds to handcuff Hillary and load her into the back of his Squad car officer Jones then walks back over to officer Griswald as he conducts an in-depth search of Hillary's vehicle despite looking for her phone and ID here is what the officers found instead is there even a phone in here she grabbed a TV remotes before she left the house her mouth is blue well it's probably these things she told me she had two of those and that she thought it she started drinking at 1100 and she thought it was 11 right now now oh she think she's 23 too by 6 and2 she's certainly not 23 how was at the the drivethru you're getting Canada hey well um you want to get urine in addition to the breath cuz I don't know what the breath is going to show but I think it's more than alcohol I think so too do breath and urine just to get it oh who does urine let me start this out by saying urine is not my favorite I think that's a pretty good coverall um especially other people's urine so uh we don't use urine as a test urine only gets a byproduct so after your body's metabolized whatever drug it is um it excretes everything else and that's kind of what you get with urine um we use blood it's the industry standard here in the state of Arizona so we use breath blood um other bodily fluid we could use oral fluid um there are some instruments uh that could test oral fluid for the presence of some drugs um that is a science that is continuously developing it's getting more accurate um so some agencies have that it's not exactly the standard right now for here standard is blood um for alcohol standard is breath and blood so urine not at all for alcohol um and not at all ever for an option for me back to the station with Hillary and waste no time conducting a breathalyzer test as the test processed Hillary was placed in a holding cell and officer Griswald gave her the shocking results Hillary the the legal limit is 08 y okay you blew a 34 whoa 34 is high uh if you think of like 008 then go to the next one is 0.16 go to the next one is 0.24 and then go to the next one you're at a. 32 and then there's where this lady is at a 34 so you are more than four times the legal presumptive limit it's really high I don't think that I can remember I've ever stopped someone driving in the 3es um I've had them in the threes as a result of a collision where they kind of stop themselves from driving um and then we've drawn blood typically out of the hospital and then get those results but you don't see very many people driving um at anywhere over3 that means you're a professional Drinker like you're not just an occasional Drinker and get up to a point three and then drive around that's that's more than four times more intoxicated than you can be dri okay and honestly I'm I'm surprised here all right Hillary was picked up from the station by family members and driven home but later that night officer Jones and officer Griswald respond to her home after she calls 911 over what happened just a few hours ago I don't want to be like this person well the the first step is admitting that there's an issue right so if we're at that point that's that's a good step that's a good first step if she was arrested let's say at 5 p.m. and it's 900 p.m. her blood's only come down like uh I don't know 05 06 07 somewhere in there depending on how she metabolized alcohol so she's still in the2 level when she calls the police at 9:00 at night to say hey um I maybe I shouldn't drink so much so kind of interesting that she called the same cops that arrested her back to her house just to say hey I'm sorry that I drink a lot um but good for her that if she got on that road and started you know fighting that demon um you know I wish your best of luck have you seen the movie What About Bob yeah yeah so baby steps okay that's why we need to take his baby steps so the first baby step is going to bed and trying to sleep it off second baby step is contacting lighthouse on on Monday okay okay all right does that sound like a plan yeah all right well thank you best of luck call us if you need anything okay do you need help getting your pups in the house no all right we're going to be out we'll get out quick so they don't thank you you imagine living that close to a train every day pleaded guilty to a charge of operating a vehicle while impaired aside from fines a judge ordered her to spend 3 days in jail and 3 days on house arrest in addition to completing a driver's Intervention Program a drug and alcohol evaluation and substance abuse counseling for 3 years
