Most of you know I used to give field sobriety tests when I was a cop. Most people would fail before I even started and they had no idea why. When a police officer pulls you over and smells alcohol, he's going to engage you in certain tests. Even if you're stone cold sober, we never take those tests. I'm going to tell you, "Imagine there's a line right in front of you. I'm going to instruct this test and I don't want you to start until I tell you to." And when he says, "I'm going to demonstrate it." So, you just step out to watch him demonstrate it. Well, you just got a point off because you stepped out of the instruction stance. So, that's how you can fail this test before it even gets started. There are lots of reasons that you can show indicators on this test that don't have anything to do with alcohol. Bad knees, maybe you've got a bad back, maybe you're just old. They don't charge you with an extra offense for refusing the field test. The blood test and the breath test is a little different, but we've talked about that on other videos and you already know that, too. Always refuse the field test, full stop.
