you ain't searching my truck [Music] [Applause] [Music] well hey everybody you ain't seen nothing yet goodness gracious it's been a long time i have taken some time off i've been out of this state went on vacation up to montana and then came back to just an incredibly busy season and so i haven't done a video in at least two weeks so i've got some uh fun stuff for you tonight uh i'm david ryden you're live on stand against dark blue and police and the police we break down body cams and and we shine a light on policing if it's good we shine a light on it if it's bad we shine a light on it and there's a little bit of of each tonight i promised you something in my last video a couple weeks ago that i'm gonna deliver on at the end of this at the end of this show so you're not gonna wanna miss that part to the certain dismay to the certain dismay of two of my children they're gonna hate this video but it's not my fault you let me video it alright so first let's jump in and talk about um this case out of kentucky i want to give a little shout out to uh police activity youtube channel they um the link will be in the description but be sure to give them the credit that they deserve by watching their by taking a look at their channel let's let's watch this video this man was pulled over by police i'm going to show you the some of the beginning of the interaction and show you again we i'm a former police officer and a criminal defense attorney been doing this for a long time i teach people how to interact with police i think everybody ought to be taught how to interact with police i think it ought to be a required class in high school how to be pulled over by the police people need to understand what their legal rights are in this country and a lot of people know their legal rights or they they know how to say them a lot of people can tell you what their miranda rights are you have the right to remain silent anything you say can and will begin cannon will be used against you in a court of law you have the right to speak to an attorney and have one present during questioning if you so desire and cannot afford an attorney one will be appointed for you and if you've watched any tv at all you know those rights but most people don't know what that means they don't know how to invoke them they don't know how to invoke them in a way that doesn't give evidence against yourself and and is respectful you can be respectful to the police and cooperate with the police without giving up your right to remain silent it's not easy to do i'm not going to say it's easy because it's not easy it's much easier just to cave and answer any question that they ask you but that's not smart you ask any police officer he'll tell you off duty that's not smart and police officers if they're anything like me will teach their children how not to do that um but when they're working obviously you know their job is to enforce the law and their job is to um make arrests and to and to prosecute cases and so it's easier for them if you just answer questions because that helps them in their job but it's not good it's not a good practice for you so just remember be respectful say yes or no sir yes ma'am no ma'am they tell you to get out of the car get out of the car um if they're wrong and they tell you to get out of the car that's something your lawyer can handle like if they say they're going to search your car don't consent to any searches but if they are determined to search your car back up be respectful let them do their job your lawyer will be able to handle that in court if it's an illegal search if they tell you you're under arrest put your hands behind your back you're under arrest nothing good comes from you fighting with the police and feeling like you're emboldened in this climate to resist arrest it's illegal to resist arrest it's even illegal to resist an illegal arrest you don't have the right to determine on the scene that this is an illegal arrest that you're allowed to resist so that's why it's illegal to resist arrest whether it's a legal arrest or an illegal arrest i say that because i've got a lot of people that are charged with resisting arrest and ultimately we win the case against them that originally brought the cops to arrest them but the resisting arrest charges still are able to be prosecuted if they if they do resist arrest so don't resist arrest if the police are wrong your lawyer will be able to help help you and your lawyer will be able to win that case but you have to be respectful and you have to respect the authority of the police however that doesn't mean let them walk all over you i'll be the first one to tell you nothing good comes from you talking to the police without a lawyer ever ever i don't advocate ever answering questions of a police officer without an attorney even if you're completely innocent everybody i've ever represented is i say that jokingly but if you're innocent all the more reason for you not to give evidence against yourself or talk to the police without an attorney so let's get into this first video um this man gets pulled over by the police and clearly um it's it's an encounter that that you're going well this man's just he's a little quirky um i'm gonna let you watch the interaction i'm let you watch this not all of it because it's a very long video but i'm gonna let you watch enough of it so that you get the idea of what the police are doing when they pull people over and this guy's in a unit that's trained to pull over people on the interstate and and and determine whether or not there's reasonable suspicion or probable cause to take a drug dog around their car um they're they're looking for narcotics and and illegal narcotic activity they're actually looking for money and they work here in tennessee we have an interstate that's highly trafficked by drug traffickers going from the west coast to the east coast so going from the west coast to the east coast is usually the direction that you will get the dope and so they work the westbound side of the interstate most often because that's the side that you're most often going to get the money now do they like to get dope yes certainly but they'd much rather get your money for some reason and that happens and you know criticize me if you want to i used to be a police officer so you if you haven't been uh then you keep your opinion to yourself because it's it's not valuable but if you want to criticize me that's fine it's true that's if if the police were being honest in these task force that worked the money side of the interstate when i worked the police department we we knew that we knew which way the drugs were coming versus which way the money was coming you're more often likely to get drugs in one direction because that's the direction that the drugs go and you're more likely to get money in the other direction because that's the direction that the money goes so um this guy's in a unit like that he's trained to pick up on little clues that you give off that you don't realize that you're giving off when you're talking to the police and that's why we say don't talk to the police on this channel hello angel i am not getting your notice yeah you know what facebook is bad about that facebook's bad about not notifying uh when we go live and i guess shadow man and me i don't know i never have gotten the notice yet tonight either for some reason and it could be because i haven't made a video in two weeks i apologize for being gone so long but it's been busy around here hey rick thanks for joining us and uh one core because yep um thanks for joining us thanks for commenting on this video by the way be sure to like this video comment on this video and share this video it helps us and the more people we get on here that will share the video and comment on the video the more likely facebook is to notify people when we go live and youtube as well so let's watch a little bit of this video and then i'm going to skip through to the um action part here in a minute but let's watch this this police officer is well let's just watch him in action i'm wondering if you guys are getting the sound properly if you're not getting sound could you please let me know that especially on this video because it sounds like for some reason and i'm not able to watch it on my other screen here because i never did get a notification from facebook so i'm going to hit play just tell me if you're getting sound properly just for the day oh okay i got you we're at hamilton live okay so watch it how he's just nonchalantly questioning this guy and this guy's just going along and answering these questions if this were me in this traffic stop i wouldn't answer questions like this even friendly questions um when you when you when you're stopped by a police officer let's get to business why'd you stop me and don't answer questions about where you're going where you you know what where you're coming from and this kind of stuff he's he's working right now folks he's not your friend he's not just catching up with you because he hasn't seen you in a long time he's working so keep that in mind [Applause] where what's that you know so this guy's eating something he offers them he offers the officer something to eat i don't know if it's a cracker or something he's and the guy's like no i'm good thank you and that's believe it or not um that's an indicator that you're it's suspicious because it's like he's trying too hard to be friends with this officer and it's just unusual behavior and so this guy's is throwing off some indicators to the police officer that he's en engaged in something that he doesn't want the police officer to know and the officer will get around to that here in just a minute stolen guns or something so he just keeps telling this story and and trying to draw the cop off guard and just basically he's doing the same thing cops trying to do the cops trying to pretend that he's your buddy by talking to you and what he's really doing is he's working and the guy in the truck is trying to throw the cop off by thinking you know i'm just this nice country boy that's offering you some crackers or something to eat here and you know telling you about this other time i boo booed got in trouble something but it turns unfriendly pretty quick here in a minute and we're going to watch how that happens i'm going to skip ahead this goes on for a few more minutes and the officer is just asking general questions and the guy's given um odd responses so it comes down to it and he asks him to step out of the car let me bump to that okay okay i've been trying to read people that happens is you know i i'm not saying you didn't i'm not not saying you didn't do anything wrong okay but a lot of your mannerisms and gestures while you've been sitting here talking to me okay i'm trying to read people okay okay i'm just asking okay listen i'm gonna give real quick okay okay do me a favor and step out for me real quick okay step right back here okay real quick so watch closely when this guy gets it takes him a few seconds to get moving to get out of the car and he's probably squirming in there because he's clearly in a minute you're going to see he's got something to hide but watch when he gets out of the car it turns bad quick so step right back here man we'll be just a second all right all right step right back here for me my man what's up [Music] squad immediately what do you see it happened really fast um and i'll put it back here in a minute because i want you to see the end but watch how quick this guy enough the guy's not a very fast man he's an older gentleman and he's not quick um since 7 19 is where i need to go back but if he had been a little younger and a little faster this officer would be dead watch out watch how this happens how quick it happens but at the same time how slow this fella is on his draw thing thank goodness for the jump right back here for me my man what's that and so like immediately look at this so i don't know if you noticed on the draw this guy doesn't have his finger quite on the trigger um and if he had he's just not he wasn't quick thank goodness and the cop was able to he's got a partner back here to his right um but he was not able to get a shot off this this jump this uh suspect here was not able to get a shot off before the cops were so guy look at all these cars just going in the background too so easy i mean when you're you don't think about it when you pass a police officer on a traffic stop uh you don't think about whether or not that traffic stop could go bad when you're passing and somebody could end up shooting you but it's so easy for something like that to happen and it's in this day and age you just you just never know so it it ends up let's see so it ends up they they did kill this guy i mean he's he's deceased laying there on the side of his truck and they do approach here in a second and uh you can see he's he's kind of leaning in there um and he doesn't find anymore and he doesn't attempt to shoot anymore but i believe they faintly wounded him hey your [ __ ] abs i can't see his hands he's reaching he's reaching he's reaching he's down he's down yeah he's down and he wasn't i mean he wasn't reaching but he was just kind of leaning in the truck there and they do ultimately get him out so um it's easy to criticize the police but this is why they can they can be aggressive because they deal with situations like this and you never know from one traffic stop to the next which one's going to be the one that that you have to shoot somebody back in the day when i was a police officer when i first came on the police department i knew guys on the police department that been on there 30 years 35 years some 40 years never once pulled their firearm in the line of duty um it wasn't like that for me i was a police officer in murfreesboro when i first started and happened to drive up on a shooting just by happenstance and there were many times that that i had to pull my firearm in a defensive posture and was involved in a shooting where we exchanged fire and i shot somebody in 1996 so it's not it's not like it used to be when when i was a young police officer i think times have changed and the police now are it's quite common for them to pull their firearm and and to end up in a situation um for for them to end up in a situation like this yeah he did look maybe he might have been a little bit impaired there rick he might be right about that but um certainly it's it's thankful that the officer was on his toes and that this guy was actually slow um otherwise we'd be looking at a different situation let's move to the next video this is a navy veteran and he gets arrested for doing everything right he does everything right let's let's watch it i will pull that video in here share my screen sorry i don't have a producer tonight ever so we're working on that though got some things coming up in the future hopefully that you guys will like so this is outside of a bar late at night the officer is inquisitive because this man's sitting in front of a closed bar okay you can be inquisitive i wasn't i was of an inquisitive nature when i was a police officer and so i would if i drove by this closed bar at three o'clock in the morning and it closed at two and there's somebody sitting outside yes i would pull up to see is this person a lookout for somebody that's actually broken into the bar or or what's going on why is this person sitting in front of this closed business yes i might do that deductive reasoning is easy folks within 15 seconds i could tell you i would have walked away from this situation and said have a good night sir and be careful because you can quickly tell he had been in the bar for quite some time he's clearly intoxicated but he ain't driving he ain't hurting anybody he didn't get in no bar fights he's just sitting out there waiting on his uber and he doesn't have to identify himself we're not a stop and identify state here in tennessee and in in most states you don't have to identify yourself where did this happen the wheat ridge police department and i don't even know what state that's in but in most states you don't have to identify yourself unless there's reasonable suspicion of a crime which means that the officer has to have reasonable articulable facts that he can say articulable means able to be spoken you have to be able to speak the facts that led you to believe that i am committing or about to commit or have committed a crime okay um in this case the the only suspicious fact is that he's sitting in front of a closed business but using your noggin and deductive reasoning you can you can say he's sitting in front of the closed bar because they closed otherwise he'd be inside of it probably still drinking but clearly this guy's not committed a crime and and the officer just ought to leave him alone in my humble opinion how enjoy it happens what's [Music] no you don't i don't i'm not doing anything wrong well you're sitting in front of a closed bar and [Applause] let me see ready yeah okay we can do this one in two ways sir okay we can do this many ways oh i'm sir just give me a comfy copy and we'll be fine and the guy's like no i'm not giving you my id i haven't done anything wrong and he's right but what did he do everybody raise your hand if you know he challenged the authority of the police officer which um in this country in most cases not every case not every police officer's like this i promise there are officers that would have said but just have a good night be safe don't there's not a car there i mean his car is clearly not in this parking lot there's nobody in the parking lot you can not you can disbelieve that he's called an uber but that's easy to check and even if i i wouldn't need to see proof that he called an uber his you know his telling me i've called an uber would have been would be enough for me but you know back up and just sit across the parking lot and wait and see if an uber pulls up and picks him up if if he gets up and kind of hobbles or stumbles to a car then you can pull in because you know he's intoxicated you certainly don't want him to get behind the wheel um can he be arrested for public intoxication great question rick the answer is yes he could be because public intoxication is that catch-all that police will just say yeah i'm arresting you for public intoxication if he's not a danger to himself or to somebody else that in my opinion is still a gray area if i'm a judge which one day possibly i'm not announcing that yet but there is an election coming up for judge next year and somehow he might be in that race and if i were a judge and i were faced with this video and he were arrested for public intoxication i would dismiss that case because number one um he's not in public there's no there's not public around there he's not disturbing anybody he's not a danger to himself and not a danger to anybody else he's he's gotten drunk at this bar so clearly he's intoxicated and yes he might be in a public place but he hasn't done anything to create a danger to anybody and i wouldn't arrest him for public intoxication now the standard is are you in a public place and are you intoxicated and yes you can arrest somebody for that but why would you in this particular case the guy seems to be doing everything right which he tells this cop really quick i'm doing everything right good lord leave me alone why are you messing with me and i have to agree respectful to you i'm sitting here winning on my i am not doing anything wrong well i'm doing everything right now and i would have to say you know what bud you're right i'm sorry i'm gonna go back to my car and do real police work i get it that he's not giving you what he what you asked him for but that's the problem in policing it's one of the problems and you know i it's it's different for those who've never been a police officer to criticize the police because it's not fair you've never been there you don't understand it you don't get it i have been there and so i i feel like i am entitled to criticize the police and i do often criticize the police but also praise publicly the police when they do good things and they do the right thing in this particular case this man's done nothing wrong and he's just not wanting to identify himself and you don't suspect him of a crime except you know he could argue public intoxication but it's not worth that and that's why i'm saying it's he ought to just move on but he doesn't because he feels like his authority has been challenged and that doesn't go well with some police officers drinking and driving and why are you why are you messing with me i'm not messing with you so you're saying yeah you are you're sitting in front of a close bar you are messing with a navy veteran that is waiting on an uber so i'm going to ask you what is doing nothing wrong can i see your id no you can't you're drunk in public no i'm not dragon republic give me your id no i'm not drunk in public i'm not because it's not public there's nobody around here he can't argue that he's drunk because he's pretty drunk this is what this is what pushes the officer over the edge watch this i'm giving you a lawful order you're not getting anything dude did you hear me he says you're not getting anything dude and that that's just too much for this officer's pride he just can't handle it it's a shame but he can't handle it stand up nothing wrong stand up stand up stand up stand up what are you doing i'm sitting there what are you doing i just got my video camera out i was just getting focused on you and you what are your users were arresting me for nothing so um okay so it's your phone down sir and put your hand on your back i'm saying you're doing nothing waiting on newberry well that's not all you asked for you have to see his id and he didn't he didn't want to give you his id you asked to see the uber and he said you're not getting anything and that just made you mad because you just feel like you ought to be in charge you don't not have a drunk person telling you that you can't be in charge cops don't like anybody telling them they can't be in charge that's why derek shove is in prison today because he was not going to be told by anybody to take his knee off that guy's neck it's it's a problem that's widespread enough that there needs to be direct training on it and i think some of it's the jesus factor i mean cops just need to have jesus and they need to treat people like jesus would sure you got to protect yourself you got to be on guard and you've got to you've got to deal with the dredge of society sometimes i get that but you can do that in a way um that doesn't offend people and that doesn't you don't have to challenge somebody for authority every time you encounter somebody i mean it's yeah you've got the badge and the gun and you you are in charge but that's a very nice thing to say rick you um you will have if you're in davidson county voter maybe you'll have a chance to vote for me next year i'm not officially announcing that yet i'll make a bigger deal out of it when i do so but i feel like that announcement is forthcoming i will tell you in this case um they they do ultimately arrest the guy but they do release him uh and his uber does pull up he does i think they called a sergeant to the saying and the guy basically just kept saying man i'm trying to do everything right i'm not trying to disrespect you and at the end of the day the uber pulls up and this guy fist bumps them as he goes off and shakes their hands and whatnot so it they ended up being friends as they parted ways so it had a happy ending to that story i guess okay um can you next on the agenda on the agenda tonight if i can talk um thank you angel that's very kind um on the agenda tonight we are going to answer the question can you legally tape record a teacher let's see the answer to that question or let's see a story on i'll i'll answer the question because it's it's not as cut and dry as they make it out to be in this story but watch this fifth one i grade what your mom would say only on five a saint lucie county student says she was suspended this week for trying to defend a classmate the eleven-year-old says she took a recording of her teacher allegedly bullying another student needs channel 5's megan mcroberts has more on why that student at samuel gaines academy is now being punished megan well kelly it seems anymore most students do bring us up so this child had a cell phone and she did what she thought her parents would want her to do because she's been taught not you know not to just stand by and watch people be bullied now i don't think her parents knew that the bullying was going to come from the teacher but this kid did what she i mean they're not going to believe a kid over a student i mean a kid over a teacher if i go in there and tell them that this teacher's bullying this other kid nobody's going to believe me i'm just a stupid fifth grader they're not going to believe me over the teacher that's what this kid says so ultimately she breaks out her phone and videos the teacher but um there is a policy in this school that that does not allow you to take record of a teacher without their permission i will say that's not the law but it is a policy in this school so there's a difference illegal eleven-year-old brianna cooper has good grades and works hard at samuel gaines academy in fort pierce but a video on her phone got her suspended for five days i thought i did the right thing brianna says one of her science teachers was being mean to a student so she took out her cell phone and started recording what she says were threats by her teacher to a classmate don't let this aside for you i would drop you here yeah right you don't know me so don't give me no look brianna says wow so don't let the size fool you i will drop you this teacher says to a fifth grader and it sounds like she's dealing with a little smart alec and and so she's probably gotten um frustrated at this kid and maybe his sarcasm and you can tell she's she's frustrated but unfortunately you don't get to talk to fifth graders like that if you're a teacher or you shouldn't and the focus here should not be on the fifth grader that tape recorded this it should be on the teacher that's talking like that to a fifth grader and and my image oh in my humble opinion teacher had been mean to students before this time she wanted to prove it you think that they would actually believe a student over a teacher biggest kid in fifth grade you economized the smallest one i wonder what your mom looks like you don't speak to children let alone your students like that brianna says she turned the recording into a teacher wanting to defend her classmate only to give call to the principal's office since suspended the school telling her it was illegal to record a teacher without them knowing i never had anybody tell me you cannot record she thought she was doing a good thing she's 11 years old she doesn't know the law law enforcement says recording someone can be legal if there is not an expectation of privacy in this case briana's mother cassidy faulkner says the school told her there is an expectation of privacy even in a large classroom faulkner well that's not true you can have a school policy all you want to and you can say you will get in trouble at this school if you record a teacher without the teacher knowing but let's be honest why is why do they have that policy it's so they can protect their teachers from prosecution for doing something wrong it's not illegal to tape record a teacher even if the school has a policy against tape recording teachers without their knowledge or consent it's still legal if there's not an expectation of privacy the expectation of privacy is for example you can't set your little your little phone recorder up in the bathroom and walk out and record somebody in a place where they have an expectation of privacy you can't even turn your recorder on and set it on your desk and walk out of the room and tape record people that don't know they're being tape recorded but if you're capable of hearing and seeing what you're hearing and seeing then you're capable of legally recording what you hear and see because the courts have held long-standing law the courts have held if you're able to hear it and see it and commit it to memory this is just an extension of your memory it's okay for you to record something that you're able to hear and see and i don't know if you remember the project veritas thing that came out where they were recording people at planned parenthood talking about selling baby parts and whatnot that guy got a lot of trouble for that but he was recording from another table um well not some of them he was there were some things that he did that he was recording from another table he wasn't part of the conversation but he could overhear it so his argument was that i can oh if you're saying it loud enough in a restaurant that other people can hear you don't have an expectation of privacy i happen to agree with that but that's not what we're talking about here what we're talking about here is can you tape record a teacher the answer that is yes although in this particular school you might get in trouble or suspended or whatever they ended up doing to this little girl the little girl got in trouble for videoing this teacher and probably just reprimanded she probably really didn't get in any serious trouble and certainly she didn't get any legal trouble because it was not illegal for for her to video this uh this teacher thank you rick um so i guess enough about that i will say last week not last week week before the last video i did we did a video on let me see if i can pull it back up give me just a second to bring that in here so it's gonna set up my last little video here that's gonna piss off two of my boys they might be watching i'm not sure if they're watching or not but if they're not watching live they will certainly catch it later so this is the the teacher um this is the teacher that that kind of lost her mind over over the mask this kid wasn't wearing a mask but let's let's watch it i don't care if you're vaccinated you little dick okay i don't want to get sick and die okay there's other people you can infect just because you're vaccinated you know what you're not a special person around here you should hear about how everybody talks about you i don't know i'm sure talk to me i don't care here i'm a jerk okay you're a jerk you're a jerk you're a jerk a jerk so that reminded me of a video i played that video in its entirety you can watch the show the last show that we did that teacher goes on to berate this kid for several minutes because he wasn't wearing a mask and she was saying things stupid things like there's people you can infect just because you're vaccinated i mean she's just a she's a [ __ ] she doesn't she bless her heart she's not making any intelligent sense at all she she's just an angry woman um who lashed out at this kid and uh yeah anyway so it reminded me of this video of my children that's all right that's why i have kids oh crap where is it give me a second i'll get it in here share my screen there it is watch this i'm stupid you're supposed [Music] shut up [Music] [Music] i can't believe that they let me video that i mean they it's not like they didn't know i was i wasn't secretly clandestinely recording i'm standing there like this just shaking my head going i can't believe you are letting me video absolutely blew my mind oh gosh angel says you can't get coveted after having the vaccine and spread it to others don't get me started on that angel so you're going to get me in trouble that's why they're probably not because i talk enough about stupid things in the media now that's probably why facebook is not uh sending notifications out when i go live it's called shadow manning and i might be the victim of that but that's okay um we're gonna press through that and we still have our videos and we have fun we're working on a couple of things in the future that hopefully will make this show better i'm getting a producer is one rebranding a little bit is another but um certainly i just enjoy you guys coming on here and commenting and we break down these body cams sometimes we have bully cams we have the bully cam of the week award frequently and uh i'm trying not to turn it into a political show but sometimes you just can't help but talk about the hypocrisy in this world it's gotten palpable it's so stupid that i can't i just i can't get my arms around it that to on on my next show i'm going to show a video of the i don't know what you call him the archangel tony falci and we're going to put a montage up of his first he says we don't flip-flop here at the cdc the cdc's never flip-flopped he said that yesterday or day before yesterday and i just laughed out loud you you haven't flip-flopped mr well you just really don't need a mask it's you might make you feel better but it's really not helping you to wear a mask and then it was like oh my god you don't just need one mask you need two masks and maybe three masks would be better than two and then if you're unvaccinated you really don't need a mask and then the unvaccinated really need a mask and if you're a kid you certainly don't need a mask it's not helping children walk around with their parents out there with a mask on and then oh my gosh it's just it's it's nauseating at this point it's so exhausting to watch them flip-flop back and forth on them it makes me so angry that we have given them such power over people and over our freedoms in this country and i don't know what to do to get it back and it's not something that i can physically do to get it back but we can we can sure shine a light on it that's what we do here is shine light on things so than that i don't know what to tell you i hate that it's gotten where's my trying to find my glasses i ain't right there on my shirt it's gotten so ridiculous that sometimes i do talk about it and um and that might be why facebook and youtube are shadowvending me so i'm determined to get on one of these other platforms and there are several that we're looking at rumble is one wemkin is another and being able just to freely talk about whatever you want to it's a shame that you can't do that anymore in america if if your opinion doesn't match the narrative of the people in power you're not allowed to have your opinion what a freaking shame anyway you guys for watching i appreciate you being here be sure to like this video share this video and comment on this video we'll be back tomorrow thanks guys love you
