foreign [Music] hey everybody I'm David ridings Nashville criminal attorney this comes up all the time should I take the breath test or blood test if I am pulled over and suspected of DUI my general answer to that is no you should always refuse to answer any questions and refuse all testing without a lawyer since they're not going to give you a lawyer on the scene of a traffic stop that means you should refuse everything there is a legal consequence to you refusing a breath test or a blood test so if you were stone cold sober and had no alcohol and no drugs in your system and you felt like the blood test or breath test was going to help you and I know you say well nobody could be pulled over and suspected of DUI with no alcohol or drugs in your system oh yes they can I've had several cases over the years where there was no drugs no alcohol and the person still got arrested for DUI but generally speaking I would refuse to give blood or breath unless I knew knew it was going to help me you're giving evidence against yourself which the fifth amendment gives you the right to refuse to do and it protects you from giving evidence against yourself I would always refuse unless I knew it was going to help me hope this helps somebody remember go to Nashville criminal attorney if you need more information I'm David ridington I'll see you next time
