Can we challenge the claim of the smell of mar? Certainly, you can do so. But I will tell you this, the courts are going to believe the police officer when he says smelled. The big issue now is whether or not the police officer really legitimately smells illegal or whether he's smelling legal hemp because in Tennessee now it's legal to possess and use and own a called hemp. And hemp is the basic plant of so there is no way for even a drug dog to tell the difference between legal hemp and illegal wheat. So if a drug dog can't tell the difference, how in the world can this police officer tell the difference? And so we would make the argument uh if this were a case that I were handling, I would make the argument to the court that evidence should be suppressed because there's no way for the police officer to tell me whether he smelled legal hemp or illegal
