They have to have reasonable articulable suspicion to even ask you or or probable cause to believe that you're DUI to even ask you for a blood test or breath test. Smell of alcohol alone is enough to ask you for a test. >> Okay. >> If I've had nothing to drink, I don't take any medication, I'm in the best shape of my life, I never ever would take the field sobriety test. Stand on one foot, walk this line, follow the pen with my eyes. No way. If you've had nothing to drink and you don't take drugs and and prescription medications, absolutely take the blood test. Absolutely take the breath test.
