oh dr judge says foul ball [Music] everybody i'm dr judge thanks for joining us i appreciate you being here tonight hey i've got a short video for you today um and on this channel we well you know what we do here i'm a former police officer attorney running for judge in nashville tennessee um we're gonna be kicking off a a new campaign for judge in a few weeks and as part of that i wanted to we're we're going to introduce you to a new uh non-profit organization that i'm just really super excited about i'm so excited about it i'm about to tell you too much because i have to save it until we're until we're ready so stay tuned for that tonight i'm going to show you a quick video these these bully cops just i i can't say it enough you just have to have a thick skin if you're going to be a cop you can't you can't get into this business if if you've got a fragile eco and this guy you will see just doesn't um handle adversity very well i mean i know people in positions of leadership that don't handle adversity well you know what i can say about a leader that doesn't handle adversity he's not a leader if if you've got a leader get a little i get a little off topic here and i'm trying i'm not going to try to get too far off topic but if you have a leader who is unable to fire somebody and unable to handle with handle adversity personally so much so that you have to hire somebody else to come in to do just the firing do all the negative stuff if you've got a leader that you have to hire somebody else to do your dirty work you got the wrong leader he's not a leader he's a celebrity and anyway got off topic there watch this video this just to give you a little bit of background this police officer rides by two young college age looking young men um one of which gives him the single finger salute and the cop just loses his ever-loving mind the officer followed him and that's where the body can't get also be sure to check the original video out in the in the description the link is in the description section below uh and give them the credit that they deserve over here [Music] yeah okay so just to give you a little bit of education you know i'm a former police officer i'm a defense attorney i teach people all the time about how to encounter the police what to do what not to do what to say what not to say every i mean every person i've ever represented not every almost every person that i've ever represented is generally aware that they have rights some of them can even say their rights all the way through they can say you have the right to remain silent anything you say can and will be used against you in a court of law you have the right to an attorney to have one present during questioning if you so desire and cannot afford an attorney one will be appointed for you at no charge some people can say that all the way through but they have no idea what it means what it means is when a police officer jumps out of his car and says hey hey hey where do you guys live do you live around here let me see some id no bueno i'm sorry um i don't give you id i'm not going to tell you who i am if you're a police officer you jump out of your car and you're mad because i flipped you off i'm not going to tell you my name i'm not going to give you my id and you know what i'm not required to you're not authorized to get my identification and know where i live and know who i am i'm i'm a little afraid for my safety if you're jumping out of your car demanding that i give you id some cops think that because they're police officers if they ask you for id you are required to give it to them always some some cops think that i'm gonna teach you something today folks if you didn't already know that's not true it's not it's not true you don't have to identify yourself to a police officer unless he can articulate reasonable articulable suspicion of a crime and that's a a trigger word it's it's an it's a word that the courts have come up with it's actually a phrase the police have to have a reasonable articulable suspicion of a crime you know what reasonable articulable means it means that it's reasonable to the average person and you can say it reasonable articulable facts sir the reason i stopped you was you were walking around you had this bag of tools on your back and it was two in the morning and you're walking down this back alley where we've had a lot of burglaries that's reasonable articulable suspicion that you're back there may be fixing to break into something maybe it's enough maybe it's not enough i don't know but in this particular case listen to what this cops reasonable articulable suspicion is okay let me see your id i need to see you guys you guys are aimlessly walking out around here you guys are aimlessly walking out around here that means two things one this cop doesn't know what aimlessly means and two he doesn't have reasonable articulate suspicion of a crime so um this cop's already batting the negative i mean do you live over here okay stop police officer asked do you live over here i'm sorry officer i don't answer questions um of the police there are some auditing uh what they what they call auditors first amendment auditors and second amendment auditors and we talk about those sometimes on this channel and there's people that go around with video cameras and they'll just video they'll walk into the register of dean's office and they'll have a video camera and they'll be wearing a gopro in their head and they'll have one right here and they'll maybe have a camera on their shoulder and they just walk around they just video people and then people get really bent out of shape when you come in with the video camera and they go you can't video in here well sure i can and then they call the police and the police try to tell them that they can't video and then the cops get in trouble because they can video they can do first amendment protected activities and so the auditors do things to instigate trouble and i don't agree with all those we talk about some of them here on this channel but what i like to do on this channel is teach people how to interact with the police what they should say what they shouldn't say what they should do what they shouldn't do how they should act how they shouldn't act and in this particular case these boys do pretty good and at some point you're gonna have to make a stand at some point you're gonna say i'm sorry officer i'm not giving you that and you can just and you can attempt to walk off now if the cop says don't walk off you're being detained then whether you think it's right or not then you're being detained so if the police officer says you're being detained then you say okay i'm sorry officer i won't go anywhere but what are you detaining me for try to get him to say it try to get him to articulate it if you've got a video camera you immediately get your video camera out and you turn it on and you video the encounter if you've got a buddy standing by you tell him hey get your video camera out and video this that now the buddy might be scared to do it because he might think the cop cops gonna get mad at him it is i don't believe it's illegal anywhere in the united states anymore to video a police encounter it used to be illegal in some states to video the police believe that or not that's changed in in nearly every if not every jurisdiction certainly it's not illegal in tennessee to video an interaction with the police and you should video them okay so this cop um proceeds let's just watch the rest of the video i need to get your id from you that's goodness see he's doing he's doing pretty good no thank you officer i don't agree with that have a nice day i'm going to keep walking and he attempts to walk away and then the cop says no you're being detained for suspicious activity you're aimlessly walking around okay the cops got nothing and and he's just mad because they flipped him off so right now this is what you do you say i'm sorry officer i disagree with you i haven't committed a crime i want you to call your supervisor to the scene okay here's the problem this guy's the supervisor he's the sergeant great well even though he is a supervisor he still has another supervisor so he has a supervisor that's on duty that you can call to the scene and it's called a lieutenant and you tell him sir i want your supervisor here on if he says i am the supervisor you say no no you have another supervisor that's above you i want him or her on the scene now and i'm not going to comply with anything that you do until you get your supervisor on the scene now you're only going to be able to push that so far if he puts you in cuffs which he's about to do here so let's just watch what happens i need to see your id you're being detained what's your name is is this because i flicked you off um yeah that's what it's that's what it's about it's because you flicked him off he's not going to admit that yet but um that's that's why from my house okay okay okay i'm gonna put you in handcuffs right now this cop's really escalating things here and and he's getting himself in trouble in my humble opinion you're being detained the other guy's like i guess i'll video i don't really want to i've probably got weed in my pocket and i don't really want to interact with this cop so i'm going to stand way over here but i'll get my video camera out i guess have a seat do you have anything that's going to stick okay you're aimlessly walking around and there's been a lot of stuff that's going on around here okay okay have and fellow police officers out there those of you that know me know that i've been a police officer this guy here on the right hand side is helping out his sergeant maybe he doesn't know what happened before but if he does if he knows that this stop is protectual and it's only because he got flipped off and he got the middle finger salute the cop needs to pull the other cop even if it's his supervisor pull him to the side and say look i i don't agree with what you're doing here and i'm not going to participate in it i'm not going to run your once and you're 28s and 29s he's he wants him to help him run run them for checking for warrants in history and i wouldn't participate in that until we get cops that are going to stand up and police themselves we're going to continue to have problems in this country so they give some more you know personal information which i still wouldn't do give them give them your id don't answer any questions here's my id which you're not required to give until they can articulate what they've stopped you for but they're demanding it here they put you in custody and so you are gonna have to identify yourself even though it's wrong you're gonna you're gonna handle that later you can't handle that on the street okay and that's where a lot of people go wrong is they'll try to fight this kind of stuff on the street then they'll get charged with resisting arrest or doing something stupid and what you do is you just invoke your right to remain silent i'm i don't wish to answer any of your questions without an attorney i don't wish to identify myself i don't consent to any searches and i don't consent to this interaction so many times in the 23 years i've been a defense attorney i've seen cops say well this was a this was a consensual contact case we just we were having a consensual conversation with this person and we smelled weed or you know we noticed this or we saw that and the whole time it's it's not a consensual conversation but the people who are approached by the police don't know how how to interact they don't know how to invoke their rights in the in the correct manner the right to remain silent is a right that you always have you don't have to wait until the cop tells you you have the right to remain silent anything you say can and will be used against you in a court law you don't have to wait till he says that you always have that right but you can't invoke it silently you have to verbally announce that you want to remain silent and you're invoking your right to remain silent without an attorney you have to say it and once you do they're supposed to they're supposed to stop asking you questions at that point [Music] 28.99 [Music] it may be disrespectful officer but it's not against the law bless his heart you can do whatever you want to do young man i want to know i want to know listen listen to me i'm letting you talk and let me talk let me explain to you we have every right to stop you to find out who you are and where you live no you don't you don't have every right to stop him and find out who he is and where he lives this is not east germany this is not central russia this is america where we have something called the constitution and the bill of rights and we have freedom from oppression and we have the right to remain silent we have the right not to be interrogated we have the right to be free from unlawful search and seizure and this is an unlawful seizure of the epic proportion oh period okay that's what you feel like as a reminder sergeant bechten is a supervising officer but at this point has made several disturbing statements during the interaction he alleges that the men were walking aimlessly that it was suspicious behavior and detained them because of it he then incorrectly ascertains that quote we have every right to stop you to find out who you are and where you live and that's just bless his heart that's all i can say criminal activity but the most disturbing state so let's skip up through here a little bit let's see live how do you 22. you're 22. have you ever been arrested for anything okay do you have any warrants right now okay so where are you guys on your way to now these are questions that you should not be answering okay in america you have the right to remain silent again we've talked about that a lot on this channel these boys need to shut their mouths they did the right thing in the beginning they said listen i don't want to identify myself and then he forced it and he put him in cuffs okay well here's my id but that's all you're going to get out of me you're going to have my id and i'm not going to say another word i'm going to say i want an attorney i won't say i won't say another word i will say another word and the other word is attorney i want my attorney and i'm not answering any questions until my attorney is here and then if he keeps asking me questions where are you from where do you go to school do you live around here have you had anything to drink today why are you so uh antagonistic you just don't answer those questions you ju you have the right to not answer those questions so you should remain silent i'm not talking to you i'm not talking to you i'm not talking to you right now okay so you normally come over here go to walgreens sit on the bench um not only is this fun sometimes it's okay so i'm sorry that's just not um that's not the law he doesn't get to he he doesn't get to just ask you who you are because you're aimlessly walking around these you know what i say about bully cops now this is not a fireable offense this sergeant needs some remedial training okay i'm not saying that because of this he should be fired i'm saying because of this you need to pull him back into the academy and say hey you're going to go through some in-service training we're going to teach you how to deal with the public we're going to teach you how to have a little bit thicker of a skin and you know as a police officer i've been spit on cussed at flipped off so many times i couldn't even count them i've been peed on you you name it as a police officer it's happened if if you get into that line of work and you have thin skin you're gonna you're gonna get you're gonna stay in trouble the whole time there's no way you're able to do that job unless you develop a strong constitution and some thick skin i'm excited to tell you about the new non-profit but i'm not going to do it yet i will tease it and i'll tell you this this non-profit is going to it's a much needed organization we have so many people in america who can use this service and i'm excited to talk about it we're i'm running for judge in
