Recently, I did a video on what to do when asked to take field sobriety tests. I had a commenter, John Gonzalez, 73, said, "But if you refuse the field sobriety test, you automatically lose your license." What then? In Tennessee, there is no legal consequence to you refusing a field sobriety test. And they can't charge you with a crime for refusing the field sobriety test. The field sobriety tests are voluntary in every state in the union. In order to lose your license in Tennessee, you have to refuse a chemical test, a breath test, or a blood test. But as you've often heard me say, I would rather run the risk of losing my license for a year than giving them chemical proof that results in a DUI conviction. The penalty for a DUI conviction in Tennessee is significantly more than the penalty for refusing the breath test or the blood test. So, thank you for your comment, John Gonzalez, number 73.
