on November 9th 2023 officers observed a
vehicle with an expired registration in
Verona Wisconsin and conducted a traffic
stop the driver was identified as
Nicholas seagull who promptly admitted
that he did not have a valid
license hello my name is off Sur FR day
with ro three of the stops of the
registration tags on the truck are
expired looks like pretty recently
though like September is were you is it
your truck or your truck no it's my BX
okay do you have your driver's
license I don't have a valid license at
all okay is it suspended revoked that's
suspended okay what's it for just for uh
tickets I just paid them off I have to
get so just failure to pay tickets you
know how like many like tickets you got
or like the amount left uh no they're
paid off and everything have to get sr2
insurance okay so do you have insurance
do you know it's it's your boss's truck
yeah okay you don't know if they have
insurance now or okay do you know if it
would be in like a the glove box at all
yeah I know for a fact
you sounds good where are you guys
coming from today uh delille okay sounds
good uh I know seems for done it cuz you
gave me your license but can I get your
first name uh Nicholas Nicholas how do
you spell it n i c h o l a and then
middle initial D D isn't David and then
our last name
s um and did you have your license on
you sounds good I'll take that from you
just hang tight in the truck I'll be

it while conducting the traffic stop the
officer detected the smell of marijuana
upon questioning Nicholas admitted to a
pipe being in the truck and gave the
officers consent to
search hey would you mind just shut the
vehicle off and then you want to step
out and talk to me we're just going to
go back to the back of the
truck appreciate it I'm just going to
come over here
um so you don't to be straight up with
me why is the older of marijuana the car
how much you got in there it's pretty
obvious there's actually none in there I
have a pipe in there a pipe just a
pipe what's the last time that you
smoked in the car when's the last time
you smok in the car uh how long have you
had the car I know you said it's your
bosses but well I've had it for the day
the day okay and then who is she to you
uh my girlfriend your girlfriend okay so
what was the kind of arrangement for the
truck is that you just have for the day
no I've been driving this for as a loner
cuz my truck's in a shop okay so what do
you do for work uh construction okay was
there any reason why there'd be any
marijuana in the car I know you said you
just have your pipe is it just like a
you know smoking pipe for marijuana okay
where is that at in my uh little pull
thing front the what in the there's a
little pull out thing under the dash
okay sounds good and then any reason why
she would have any stuff on her that you
know about no okay
um would you give us might have one she
might have one too but a pipe I think
yeah so you got smoke this
morning do you smoke in the truck do you
smoke somewhere else well at home but
it's just a stron holder so I can't
smell it on you that's the thing it's
all but um so yeah would you give us
consent to search the car yeah okay I
appreciate that um he's just going to
pull her out really quick and then just
so you're not getting hit by traffic you
just want to come step over here and
would you mind Tak your hand out of your
pocket um would you mind let me search
you just so I you know cool okay
yeah you want to put down the truck so
I'm not going to put your handcuffs or
anything like that but would you just
put your hands behind your back and I'll
hold on to them I got to get my gloves
on first so you got a couple minutes

good and then where are you going today
uh Festival I was going to get some
dinner I got you all right I'm just
going to come behind you and then hold
on to your thumbs

know you guys are being cooperative so

yes while conducting the search the
officer discovered a marijuana pipe and
crack
pipe
are you can hop in the truck we'll be

minutes yeah he had like a they both had
smoking pipes hers was in her purse his
was like in the thing where he he told
me where it was got and then uh there
was like a little puff bar
on oh yeah he said there was like some
vapy thing that said it was CBD that cuz
his brother Works a lab in Madison or
something yeah so it's not like we can
verify it or not yeah so that's what
probably are talking about then a crack
crack bip yeah so is that that that's
just paraphernalia so just immunity
paraphernal okay she do like open cases
yeah I'll to look
um all right Nick um I got some
paperwork for both you I kind of go
through them um so you know search the
car there's you know both you guys had
some pipes like he kind of said you do
have some records of it I do have the
discretion either to do municipal or you
know a misdemeanor I just chose to do it
municipally today um so both of you got
a possession of drug pereria ticket it's
just Municipal so if you do want to go
the court date for both of you would be
on January 3rd at 7:00 p.m. at our
Courthouse okay um so this one is for
you um and then just do your license
being suspended there's a citation for
operating while suspended again same
corate what's that okay so that same
thing same court date yeah so if I get
my license back before this date can I
go to your court date yeah
okaying that our judge yeah our judge
has been known to help people out pretty
good so like if you work with him he'll
probably work with you um so you're
being pretty Cooperative during it so I
gave you a warning for the registration
and then the no insurance I know it's
not your truck but um technically since
you're driving it you still have to be
responsible for it even though it's
Technic not your car so um so I give you
a warning for those two and then this is
hers so again same thing as yours it's
just uh for the drug paraphernalia same
court date uh the full amounts on the
top right for all the the forms uh
instructions how to pay on the bottom do
you have any questions at all no okay
none of them are mandatory court dates
but yeah if you want to go to the
citation or whatnot over the drug it's
your option to do so um so you guys both
have suspended driver's license but
we're in a private parking lot and we
cannot enforce Wisconsin state laws so
technically you can drive in the private
parking lot but if you get back on the
road it's the same thing you're driving
at your own risk so I'm not saying we're
going to you know sit down there but me
just driving back home to Belleville you
can get stopped by it and get cited
again so I would recommend having
somebody with a valid license once you
get your food come pick up the car if
you do Drive take your own risks does

cour just know that the only typical
encounters with people and situations
like this especially D license isssues
drugs and things like
that you can't you can't get more of a
fine or more in trouble by going right
you can only get lower fines or lower by
yep so and our judge has been pretty
cool so um we obviously can't tell he's
going to make any guarantees about what
he's going to do but he's been to help
people out so but uh I'll let you get
