Today is just a little debrief. I had a client that came in and got arrested for DUI. Um, this is a a question that I get very often, uh, but it's not one that I've made a video about, but it's it's information that I think everybody needs, especially if you if you've been arrested for a DUI. Nobody plans to get arrested for a DUI, but if that happens, there are things that you need to know, uh, things that you need to do, things that you don't need to do. Um, I wrote a book. I don't have it with me. I would show it to you. It's called I Don't Answer Questions. It's on Amazon. If you just go to Amazon and search I don't Answer Questions book, it'll be the number one listing. It's how and why you should never speak to the police. Um, I don't advocate speaking to police officers. I don't think it's wise. I think everybody should invoke their fifth amendment right to an attorney at uh at the earliest stage. You have to do that verbally. You have to tell the police that you don't wish to speak to them without an attorney. It's uh it's the one right that you have that you have to orally invoke. said you I mean you enjoy rights under the constitution uh by virtue of the constitution but this particular one you have to invoke orally you have to say I want an attorney or I don't answer questions without a lawyer. So this client got arrested um for DUI. He refused a chemical test. They got a search warrant for his blood anyway and um and they took his blood. He was under the impression by doing some Google research, which you know, you can do Google research, but you got to take it with a grain of salt. What you read online is not always true. Uh, in fact, it's seldom true. You really need the advice of an attorney before you make decisions uh about what to do uh post DUI arrest. But they uh took him to jail. They left his car on the side of the road. It was parked legally off the road um on the shoulder and he was afraid to go get it the next day because he read online that his license was immediately suspended because he refused the blood test. That's not true. His license is as valid today as it was the day before he got arrested, which means if it was valid when he got pulled over, it's still valid and usable after a DUI arrest. he just um needs an attorney to fight to continue to keep that license valid. In Tennessee, there are some states that that will immediately suspend your license. Tennessee is not one of those states, but uh but you you can lose your license for a DUI conviction if you get convicted of a DUI. In some cases, you can get charged with violation of the implied consent law, which is refusing a blood test or breath test. But if the police officer gets a search warrant and you submit to the search warrant, case law says that you can't be convicted of an implied consent for refusing. So even if you refuse, if they get a search warrant and you submit to the search warrant, your license is not likely to be suspended for the refusal. It can be suspended for a conviction for DUI, but that doesn't happen until you're convicted. You're innocent until proven guilty. So, your license is valid today as it was the day before you got arrested. You can go get your car and you can drive it home. You can you can go to work the next day. Um Uber may suspend your driving privileges if you're an Uber driver, but that's a different story and a topic for a different video. Hope this helps somebody. We'll talk to you soon.
