What happens when you refuse a field sobriety test, but you agree to take the breath test? There is one occasion when I can argue this is a good decision. If I am completely sober and I know that I'm going to pass a breath test or a blood test, then I might agree to the breath test or the blood test. Even if I'm completely sober with nothing to drink, I would never ever take the field sobriety test because they're too subjective. The cop can misunderstand certain things that I do. He's going to mark indicators of impairment if I take those tests because there are over 600 people in a recent study here in Middle Tennessee that were arrested for just that reason. Thank goodness they took that breath test. It doesn't happen often, but it absolutely can happen.
