Little bit of suspicion. You going about 30 in a 45 coming out of a 55. >> I've got a bad transmission. >> It does. Okay. So, I just been making sure you ain't had nothing to drink. >> You ain't had nothing to drink. >> I've been sober for 14 years. Almost 15 years. >> Awesome. Glad to hear that. >> Glad to hear that. So, he's been sober for 14 years. This is Officer J. Thatcher of Adville, Georgia. He's a tyrant. He's about to arrest a sober elderly man for no other reason but that he can. It just pisses me off. I'm not gonna lie. >> Where'd you get the car from? >> Uh, it's my son-in-law's car and he gave it >> to me. So, >> yeah. >> But it's been a bad transition. >> He just saw a car that was going what he thought was slower than normal and decided to pull him over because he just hadn't ruined anybody's day today. But he's going to get to ruin this one. >> Um, just to make me feel better, would you be willing to do just a couple of little field sobriety exercises to make sure you're okay? OH MY GOD, this pisses me off. Just to make me feel better. I know you've been sober for 14 years and all and I don't smell any alcohol. You really don't look like you're impaired, but just to make me feel [music] better. Would you mind doing some fields of brightness? This is exactly why I wrote my book. I don't answer questions. It's on Amazon. It's a great read. And everybody that drives a car should read that book because what he should do here is say, "You know what, officer? I'm sorry. I don't take tests without a lawyer. You're not required to help this police officer feel better. >> If you just uh we'll just come to that that white line right there. All right. You ain't got no grenades, shotguns, anything like that on you. >> This just makes me laugh every time I hear it. You don't have any hand grenades or bombs or shotguns or anything like that, do you? No. What do you want, officer? To make you feel better, do you want to search me now? Yes. [music] That's what he's about to do. He's about to pat him down for weapons. this old man that looks like he clearly has a hang grenade on him, right? Oh god. >> All right, I'm just going to pat you down just to make sure. And you just got your wallet right there. >> Rose. >> Rose. Okay, sounds good. All right, you go. All right. Have you ever done one of these before? >> No, I've never done a DUI stop before. I've been sober for 14 years. >> Uh, what I want you to do is just put your feet together, hands down by your side. All right. Do you have any injuries to your brain? Any kind of car wreck recently? Any eye injuries, anything like that? He's not going to please this police officer. He's 74 and the police officer is going to make him show indicators of impairment. Let's just watch the follow the pin with the eyes test. >> You see the tip of my pin? >> Yeah. >> What I want you to do is I'm going to move it back and forth a few times. I want you to remain eye contact with the tip of this pin. Don't move your head. You understand? >> Mhm. All right. This test is not to see if you can follow a pin with your eyes without moving your head and then you win. It is what your eyes do when the pen gets way out here is what they're looking for. And it's called horizontal gaze nestagmas. [music] HGN. If you're impaired on alcohol, your eyes will do this little twitch thing where they're trying to stay focused on the pen and they bounce off just [music] a little bit. But you've got to hold it there for 4 seconds. If you don't hold it there for 4 seconds, you're not determining whether [music] it is sustained nestagmas, which is what he needs to look for. He barely holds it for one second. He he does the test too fast. And he's going to say later that he showed all kinds of impairment clues [music] on this test. So, Officer Thatcher, how is it that he could show any clues on the HGN when you don't suspect him of being under the influence of alcohol? That's an interesting question that I bet you a good defense attorney might ask this guy on the stand. >> When I tell you to begin, I want you to take nine heel totoe steps. Okay? It's going to look like this. I'm going to do three for demonstration purposes. You're going to go one, two, three, and so on until you get to nine. Okay? When you get to your n When you get to your ninth step, keep your front foot planted. Take a series of small steps, turning yourself around. Okay? And then continue back. One, two, three, and so on until you get to nine. Okay. When you when you start, don't start yet. Don't start yet. Go back. Yeah. There we go. When you start, don't stop. Count your steps out loud and remain eye contact with your foot. You understand? >> Yeah. >> All right. >> Here's the reason I tell you not to do these tests. The guy starts to take a step and he says, "No, no, no. Don't start yet. Remember I told you not to start yet." Guess what? You just got a point off on this test and you haven't even started walking. He's looking for things that you don't know he's looking for. He's looking if your heel touches your toe or lands within a half inch of your toe on every step. He's watching your hands to make sure you don't do the tightroppe thing for balance. He's watching to see if you step off the line, of course, or if you stumble or if you fall. None of that's going to happen. This old man's going to walk this line pretty good and he's going to think he passed. >> You can miss. >> Miss, miss, miss. Miss. Miss. >> That one's good. Miss. >> That one's good. Miss. >> Improper turn. Oh, he stumbled. Oh, >> miss. Miss, miss, miss, miss. Stumble, miss. He walked the line pretty good, but there's about this much gap between each of his steps. He thinks he's doing fine, but he doesn't know the officer's looking for heel to toe. And the officer does say, "Can you walk heel to toe down this line?" But he doesn't emphasize, "You're going to go to jail if your heel doesn't touch your toe." If he would tell him that, I bet his heel would touch his toe. The officers don't really instruct what they're looking for. Now, do you think that's fair? Cuz I don't think that's fair. And that's why I tell people, you're driving just fine. You haven't wrecked. You're not swerving. You're going under the speed limit by his own admission. There's no reason you need to make this officer feel better. Remember, that's why we're doing these tests because just to make me feel better. Cuz they put me on this stupid dayshift and I don't get DUIs on dayshift. I don't get to go see the pretty nurses on dayshift. Good freaking grief. All right, this next test, um, we're going to put our feet together, hands down by our side again. Okay, this is just the balancing test. There's no more walking. Okay. When I tell you to begin, pick a uh pick a foot of your choosing off the ground approximately 6 in like this with your toe pointed out and your foot parallel with the ground. Remain eye contact with the toe and I want you to count out loud 1,00 1,002 1003 and so on until I tell you to stop. >> 1002 >> Oh, see >> I don't think I can do it. >> You okay? >> You must be drunk. 1003 1004 1005 How am I supposed to do? How many times? >> Uh just until I tell you to stop. Yeah. Or in if you unless you feel like you're about to fall, you know, we can stop for your safety. >> 1,001 1,002 1,003 1,004 1,005 1006 1007 1008 >> Okay. All right. You stop. >> Well, you must be drunk, old man, cuz you can't keep your foot off the ground for 30 seconds. [music] As a police officer with a frontal lobe, you can't deduce that a 74 year old man might not be able to keep his foot off the ground for 30 seconds. Go get your manual officer and look in there and tell me where it says this test is not rated for people over 65. If you've got an individual that's more than 50 lbs overweight and over 65 years old, these tests are not rated for those people because they're going to do what looks like an indicator of impairment for reasons other than impairment. He's not drunk. Okay. But he's about to go to the pokey because he can't keep his foot off the ground. Is that fair? >> I know you said you've been sober for 14 years. >> 15 years. >> 15 years. >> Have you had anything at all? Any kind of medication? Any kind of drugs? Any kind? >> I take I take medications for my heart, but that's >> okay. Well, that's not Yeah. >> Why would you answer that question? Why do you think he's going to believe you when you say, "Well, I'm not really taking medication either." He's going to find a reason to put you in handcuff. I promise you. Would you be willing to uh give a just a a roadside breath sample? >> Sure. Okay. All right. >> Yes. 100%. Give the breath sample when you're sober. Those are tests that I want you to take. The field test I would have said no to. Give me a breath test. Give me a blood test. I'm not taking road test. >> Blow. Blow. Blow blow blow blow blow blow blow. Keep going. Keep going. Keep going. There we go. You're all zeros. Um my biggest concern is just the driving the performance of the field sobriety. I mean have you you haven't taken any any medication at all? Are you prescribed any medicine just for your heart? Okay. Do you know what would make you act like this? >> Yes. I'm 74. I know you're only 25 and you don't know what it feels like to be 74, but I'm 74. We did a video with an an old Vietnam vet who really knew how to shut the officer down. I wish this guy knew what he knew. >> I take uh two blood pressure medications and it makes me kind of fatigued, but other than that, >> that's just too much information here, Mr. Lynch. So, he gets arrested. The officer goes down and and draws the blood. The blood comes back surprisingly with nothing in it. No alcohol, no drugs. And what do you think happens at court? This man probably spends $10,000 on a lawyer and gets his case dismissed. The daughter here is the one who's posting these videos. And we got this main video from her channel. It's called Flannery. And so go give her the credit she deserves and watch her other videos. We're going to watch her updated video. Let's see what she has to say about the blood results. My 74year-old dad was arrested for an alleged DUI on Memorial Day 2025. He did the field sobriety test and then he blew zeros on the breathalyzer. 2 months later, the case was completely dismissed because the blood results came back negative. Now I have the actual police paperwork and the blood test results proving everything. So let's go through the receipts. Exhibit A. This is the official Adarville Municipal Court record. >> Notice this is all in handwriting. This little city's not even digital yet. Says a little something about the city that we're dealing with. Okay. And the mentality of the police [music] department. >> The negative test results. This is the actual GBI crime lab report. [music] Not the roadside breathalyzer, but the blood test. Screened for prescription drugs, amphetamines, benzo, marijuana, cocaine, opioids. Every single one. Nothing. [music] Detective. Failed the walk and turn, which you can see in the footage. He did do a little wobble. Mind you, he's 74. He was post heart attack and triple bypass surgery. They even removed a vein from his leg to put in his heart. Okay, that's how serious this procedure was that he had recently gone through at this point. And yeah, he's going to be a little wobbly. I requested the training records from this [music] officer from two different agencies that he worked for. Firearms training on file, rifle qualification on file, sexual harassment training, all on file. Now, the DUI detection training or the field sobriety test certification, they did not send that to me. I requested it. They did not have it. Not a single record from either agency showing that he was ever certified to give those tests that he did to my dad. >> She's right on the training. If he doesn't have his updated training on either A-Ride or one of the other field test certifications, then he's not certified. That would not surprise me for a small town police department. Now, go give Flannry the like and the share and the subscribe that she deserves. She's doing a good job. Maybe we'll have her on the channel on a podcast one day to see what ultimately happens. It sounds like they're pursuing this when she says for accountability. I believe what she's talking about is a civil rights violation lawsuit. So, I think that's where she's headed. I don't know that she's filed a 1983 action yet, but we'll follow up on it and we'll report back to you. As always, if you liked this video, you're going to love this video.
